Mayor Gilday called the meeting to order at 9:30 A.M. and announced that this is a Public Hearing and Workshop called for consideration of the Master Plan which had been submitted to the Town Commission by the Planning Commission. The Mayor noted that the Plan will be considered in sections and/or parts. Present were: • Also present: Mayor Morton E. Gilday Vice Mayor William S. Hults Commissioner Ruth E. Mumford Commissioner Leslie W. Joy Commissioner Robert D. Clark Elaine W. Roberts, Town Manager Thomas E. Sliney, Town Attorney M. Maree Birkbeck, Acting Finance Director Kathryn M. Borgemenke, Town Clerk Mayor Gilday called on Mrs. Roberts to explain the pages that she had found objectionable. Commissioner Clark stated that he had a question on an earlier page (Page 4 as opposed to Page 7). Commissioner Clark asked for an explanation on Page 4, Item 6; particularly the words "existing infra-structure levels". Mr. Robert Myers was recognized as a member of the Planning Commission to give his interpretation. It was the consensus of the Commission that the Planner, Jim Smoot, be approached in this question and also his explanation on Item 5. Mayor Gilday recognized Mrs. Roberts and she spoke on Page 7, Item 1, Paragraph 3 "Transient Commercial". Mrs. Roberts stated that there is nothing in the Town's zoning that refers to Transient Commercial. The Town does have Transient Residential • which covers a motel building offering rooms for rent, with or without a restaurant or lounge. She noted that "Transient Commercial" is used on Page 7, 10 and 11. MOTION by Vice Mayor Hults/Commissioner Clark: "I would so move". ROLL CALL on the Motion Carried Unanimously. Mayor Gilday noted that if "Transient Commercial" should appear any other place other than Pages 7, 10 and 11, it should also be changed to read "Transient Residential". Mrs. Roberts referred to Page 11 "Transient Commercial", last paragraph she suggested that the words "...." and its obvious commercial characteristics" ...."than commercial" be stricken from the Land Use Plan. Mrs. Roberts stated that, in her opinion, the Holiday Inn is not an obvious commercial activity • nor does it have commercial characteristics; since the Town does not recognize any commercial establishments in the zoning of the Town at this time. Mayor Gilday called for a Motion relative to Mrs. Roberts' above suggestions. MOTION by Commissioner Mumford/Commissioner Joy: "I do move". ROLL CALL on the Motion Carried Unanimously. Commissioner Clark. referred to Page 12. Second paragraph entitled "Government". He questioned the lot number assigned to the Town Hall property. Mrs. Roberts answered his question to his satisfaction. Mrs. Roberts referred to Page 36, Item 6, Commercial Service Center. She stated her distaste for this whole paragraph since the Town does not recognize commercial use. She referred to the history of commercial zoning going back to 1969. She noted that the Holiday Inn was built in a multi-family zone and that the Town Commission by a special act recognized the boutique shop in about 1970. Mayor Gilday noted that this boutique was • recognized as an accessory use. Mrs. Roberts recommended that Item 6 be stricken in its entirety. MOTION by Commissioner Clark/Vice Mayor Hults: "So move". ROLL CALL on the Motion Carried Unanimously. Discussion followed on Items 9 and 10 on Page 36. Mrs. Roberts explained both of these items for the benefit of the Commission. The subjects evolved around natural preserve and environmentally sensitive areas. Commissioner Clark made reference to the Land Use Map, condemnation, etc. Discussion then commenced relative to boardwalk, mangroves, state and federal regulations, etc. Commissioner Clark asked that Mr. Smoot correct the Land Use Map in the areas previously questioned by the Commission. (Environmentally sensitive areas) • Vice Mayor Hults stated that he felt Page 37, Density Transfer should be discussed quite extensively. There was a great deal of discussion relative to many items. The Town Attorney also spoke to this subject and noted this was a very complex item. Discussion continued pertaining to ownership, period of time, restriction of transfer from east to west side, limitations of units on west side, etc. Mrs. Roberts spoke on the subject of the Milani property. Commissioner Clark spoke to the subject of transfer, spot zoning, inequities, etc. Mr. Sliney was instructed to see if there had been any litigation in the area of density transfer in this staize. It was the consensus of the Commission to leave this subject open until further investigation. Mrs. Roberts referred to Page 12 and noted that the part about the Town leasing the F.I.N.D. and T.I.I.F. property had been • omitted. She stated that she would add something in that paragraph. Minutes Highland Beach • Town Commission Public Hearing and Special Meeting May 26, 1977 Morton Mr. Sliney suggested that the plan should be pretty well set as the Town Commission wants it before it is submitted to Tallahassee. He noted that the statute is vague on whether amendments should be submitted. Mrs. Roberts suggested that another Public Hearing be held when the Mayor returns from his vacation and have Jim Smoot present. Mayor Gilday declared that this part of the Public Hearing was ADJOURNED at 10:35 A.M.
