1977.05.26_TC_Minutes_Special r ~ U TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission PUBLIC HEARING AND SPECIAL MEETING May 26, 1977 10:35 A.M. Mayor Gilday noted that this part of the meeting is the second half - Special Meeting. Present were: Mayor Morton E. Gilday Vice Mayor William S. Hults Commissioner Ruth E. Mumford Commissioner Leslie W. Joy Commissioner Robert D. Clark Also present: Elaine W. Roberts, Town Manager Thomas E. Sliney, Town Attorney • M. Maree Birkbeck, Acting Finance Director Wally E. Schott, Building Official Kenneth Jones, Chief of Police Kathryn M. Borgemenke, Town Clerk Planning Commission - Reappointment 2 - 3 year terms. Alternate - Appointment - 1 year term. All of these vacancies will occur July 1, 1977. The 2 - 3 year terms will be that of Mr. Joseph Boscove and-Mrs. Adele Allen. These two members have been contacted and are agreeable to being reappointed. Mr. Chris Markatos, alternate member, has tendered his resignation from the Commission due to ill health and Mrs. Mumford has offered the name of Mr. Orville L. Edlund, 4505 So. Ocean Boulevard, to fill this vacancy. MOTION by Vice Mayor Hults/Mayor Gilday: "I move that we reappoint Mr. Boscove and Mrs. Allen to continue on the Planning Commission". There were no other names submitted at this time. ROLL CALL on the Motion Carried Unanimously. Minutes Highland Beach Town Commission • Special Meeting May 26, 1977 Page 2 of 6 Mayor Gilday explained that the next Motion should be one to accept the resignation of Mr. Markatos. MOTION by Commissioner Mumford/Mayor Gilday: "I'll make that Motion that we accept Mr. Markatos' resignation". Mayor Gilday stated that the Town Commission accepts this resignation with regret. ROLL CALL on the Motion Carried Unanimously. MOTION by Commissioner Mumford/Mayor Gilday: "I move that Mr. Edlund be appointed to the alternate position to July 1, 1977 and from July 1, 1977 to July 1, 1978". There were no other names offered at this time. ROLL CALL on the Motion Carried Unanimously. • Land Fill Request - St. Lucy's Church Mrs. Roberts read a letter dated May 18, 1977 from Rev. Anthony J. Chepanis, Pastor, St. Lucy's Church, requesting an extension of a land fill permit. She also noted that a survey had been available to the Commission in her office. ROLL CALL on the Motion Carried Unanimously. Consider Landscape Plan - Town Garage • Mrs. Roberts asked the Mayor to hear this item at this time due to the fact that Mr. Schott was in the audience. Minutes Highland Beach Town Commission • Special Meeting May 26, 1977 Page 3 of 6 Mrs. Roberts referred to a memo from the C.A.B. relative to the landscape plans for the Town Garage. Mrs. Roberts had received a landscape plan from Mr. Mangus and it would cost perhaps $1,100. She asked if the Commission wished this item to appear on the C.A.B. agenda this evening. Commissioner Mumford questioned the amount of money that the Town would have to spend if it followed the plan. Mrs. Roberts noted that the Town had planned to landscape the garage, in house, for approximately $200 or $300. Commissioner Clark agreed with Commissioner Mumford. MOTION by Commissioner Mumford/Commissioner Clark: "I'll make the motion that we leave this up to the Town Manager and the expense not to exceed $300.". This amount is for trees and shrubs (not grass). ROLL CALL on the Motion Carried Unanimously. • Memo and Recommendation from Police Committee re: Patrolman Ernest Giordano. Mrs. Roberts read the memo from the Police Committee for the record. The recommendation of the Police Committee was for Officer Giordano to be disciplined. Mrs. Roberts concurred with the Police Chief and she stated Officer Giordano should receive 7 days suspension without pay. Mayor Gilday called for a Motion to accept the recommendation of the Police Chief and the Town Manager. MOTION by Commissioner Clark/Commissioner Joy: "I so move". Mr. Dent called to the attention of the Commission that this action would be in violation of the Policeman's BS:11 of Rights. The Town Attorney suggested the Commission postpone this decision until he researched the law on this matter. Commissioner Clark withdrew his Motion and the Seconder, Commissioner Joy agreed. • This matter will be placed on the agenda for the Regular Meeting to be held on June 7, 1977. The Town Attorney stated that if he did not have a definite answer this subject could be tabled again. Minutes Highland Beach Town Commission • Special Meeting May 26, 1977 Page 4 of 6 Memo and Recommendation from Police Chief - Appointment - Raymond Guthlein. Mayor Gilday stated that it is quite definite Officer Simon will not be returning to the Police Department due to a terminal illness. Mrs. Roberts read a memorandum from the Chief of Police requesting the appointment of Raymond Guthlein. MOTION by Vice Mayor Hults/Commissioner Clark: "I move that we take the Chief's recommendation and appoint Mr. Guthlein". This appointment will be effective as soon as Mr. Guthlein is available from his present employment. Chief Jones introduced Mr. Guthlein to the Town Manager and the members of the Commission. ROLL CALL on the Motion Carried Unanimously. • Resolution Commending Election Board The Town Clerk read Resolution No. 327 in its entirety. Resolution No. 327 commended the Clerk and Inspectors of the Election Board for their work on the Municipal Election held on May 3, 1977. Mayor Gilday called for a Motion to adopt this Resolution as read by the Town Clerk. MOTION by Commissioner Mumford/Commissioner Clark: "I so move". Mr. Dent suggested that this Resolution include the Supervisor of the Municipal Election, the Town Clerk. Mayor Gilday asked Commissioners Mumford and Clark if they would accept this amendment. ROLL CALL on the Motion Carried Unanimously. • Mayor Gilday asked that the Clerk mail a copy of this Resolution to each of the persons that served on the Board. Minutes Highland Beach Town Commission • Special Meeting May 26, 1977 Pro osed Extension - Building Moratorium Ordinance Page 5 of 6 Mr. Sliney commented on this Building Moratorium and the intent of the Ordinance. He noted that this Ordinance is proposed to maintain a "status quo" in the Town while the Planning Commission and Town Commission are reviewing the Comprehensive Land Use Plan. He noted that the Land Use Plan, at this time, has no legal status and he felt it inappropriate to gear an Ordinance that has no legal status. This is ~ahy Mr. Sliney has made no further exceptions in this Ordinance. Ordinance No. 313 was read in its entirety by the Town Attorney. Mayor Gilday called for the adoption of this Ordinance. MOTION by Commissioner Joy/Vice Mayor Hults: "I so move". Mr. O'Grady questioned Mr. Sliney as to the reference of water • in the Ordinance. Mr. Sliney answered the question. Mr. Dent questioned the continuing exemptions under the Moratorium Ordinance and the map. Mr. Sliney answered Mr. Dent's question. Commissioner Clark questioned remodeling and there was discussion relative to this subject. ROLL CALL on the Motion Carried Unanimously. This Ordinance is an Emergency and will become effective immediately upon adoption. This will expire July 24, 1977. Commissioner Mumford offered the following Motion: "The Town Commission authorize the Town Attorney to take any legal action as he deems necessary to prevent or abate any unauthorized commercial violation by the Zoning and Master Plan of the Town". This Motion was seconded by Mayor Gilday. ROLL CALL on the Motion Carried Unanimously. Bills for Approval • M. Maree Birkbeck, Acting Finance Director, presented the bills to the Town Commission. MOTION by Commissioner Clark/Vice Mayor Hults: "I so move". Vice Mayor Hults commended Mr. Howard's work and Mrs. Roberts noted that Mr. Howard's contract will be scheduled for the Regular Meeting, June 7, 1977. ROLL CALL on the Motion Carried Unanimously.
