This typically would place the highest part of the lift below the top of the supe-rstructure of a vessel. But with a jetski, and other PWCs, being substantially lower than boats, it is not feasible to construct install a lift with the equipment that low and close to the dock decking or the seawall cap. Typically with a lift, one walks under the equipment. If the equipment was lower than the mp-otttre jetski, one would have to step over it, and this would create an unnecessary tripping hazard. (b)That the special conditions and circwnstances do not result from the actions of the applicant;The circumstances are not a result of the applicant or their actions, but are a result of the inherent nature, size, and height of a jetski and other PWCs and in the construction of the lift. PWCs are not tall like a b1oat or other multi-persons vessels. And the lift equipment cannot be placed low to the decking, or else it will create a tripping hazard. (c)That granting the variance requested will not confer on the applicant any special privilege that isdenied bv this ordinance to other lands, buildings or $tructures in the same district' The granting of this variance wilfnot confer any speC!al privilege to the applicant. It will allow the applicant to install a lift, such as has been approved and installed at several properties throughout the town, for the purpose of raising and keeping a vessel out of the water. Due to the fact the particular vessel involved in this case rs smaller and shorter than the typical boat, the lift structure will be hight than said vessel,but it is not f,easible to install or contruct the lift so that it is not higher than the vessel in question.
