Ocean Boulevard Highland Beach, FL 33487 Ph: (561) 278-4540 Fx: (561) 265-3582 Page 19 Property Characteristics: Comprehensive Plan Land Use: Multi Family Low Density Zoning District: RML, Residential Multiple Family Low Density Site Location: Yachtsman Cove Townhouse Condominium Parcel PCN#: 24-43-47-04-34-000-0012 Request and Analysis: Section 30-131 of the Town Code states, under the definition of “boat lift,” that in no case shall the lift be higher than the superstructure of the boat when lifted. The Applicant is proposing to install a 10,000 pound capacity boat lift in slip No. 3 of the Yachtsman Cove Townhouse Condominium. According to sheet DTL-1 provided by the Applicant, the top of the lift equipment measures six (6) feet from the existing dock while the superstructure of the boat when lifted measures 3 feet 9 inches from the existing dock. Therefore , the proposed lift is 2 feet 3 inches higher than the superstructure of the boat when lifted. As a result, the Applicant is required to receive variance approval from the Board of Adjustment and Appeals (BOA) for the add itional height of the boat lift. The Applicant has obtained both Army Corps of Engineers (No. SAJ-2019-02616(GP-PWB) and Florida Department of Environmental Protection (No. 50-378383-001-EE) approvals. The Applicant has also obtained approval from the Yachtsman Cove Townhouse Condominium Association to install the proposed boat lift. Pursuant to Section 30-40(a) of the Town Code, the purpose of a variance is to grant a reduction in the dimensional requirements of the zoning code, including, but not limited to, lot width, lot depth, lot size, size or percentage of open space, building coverage, building height, building setbacks, or required number of parking spaces. Section 30-40(b)(1) of the Town Code, states that the BOA shall consider all variance requests for existing multi-family units. As a basis for consideration of an application for variance approval, the BOA must determine an application is consistent with the criteria listed below: (1) Special conditions. Special conditions and circumstances exist which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures, or buildings in the same zoning district. (2) Hardship. The special conditions and circumstances truly represent a hardship and are not created by any actions of the applicant. (3) Literal interpretation. Literal interpretation of the provisions of this chapter would deprive the applicant of rights commonly enjoyed by other properties in the same zoning district under the terms of this chapter and would work unnecessary and undue hardship on the applicant. (4) Special privileges. The grant of a variance will not confer upon the applicant any special privilege denied to any other owner of land, buildings, or structures located in the same zoning district. (5) Minimum variance. The variance granted is the minimum variance that will make possible the use of the land, building, or structure. Page 20 (6) Purpose and intent. The grant of the variance will be in harmony with the general intent and purpose of this chapter. (7) Financial hardship. Financial hardship is not to be considered as sufficient evidence of a hardship in granting a variance. (8) Public welfare. The grant of the variance will not be injurious to the area involved or otherwise detrimental to the public welfare. The Applicant has provided responses to the criteria (see attached Variance Application No. 20- 0001). In summary, the Applicant states that given the proposed boat lift is for a personal watercraft (PWC), in this case a jetski, it is not feasible to install the lift lower than the superstructure of the boat and close to the dock decking. The Applicant indicates that if the boat lift was lower than the top of the jetski, one would have to step over it, and this would create an unnecessary tripping hazard. The Town’s Building Official concurs with the Applicant’s explanation that it is not feasible to have a jetski lift lower than the superstructure of the jetski. Moreover, the Town’s Building Official indicates that the approval of the variance request will not conflict with the provisions of the Florida Building Code. Staff finds that the granting of the variance will be in harmony with the general intent and purpose of the Zoning Code (Chapter 30) and that the granting of the variance will not be injurious to the area involved or otherwise detrimental to the public welfare. On June 11, 2020, the Planning Board is scheduled to review and consider the Applicant’s special exception request (Application No. 20-0003) to install a 10,000 pound capacity boatlift on slip no. 3 in the Yachtsman Cove Townhouse Condominium . Pursuant to Section 30-40 of the Town Code, the BOA may approve, approve with conditions, or deny a request for a variance and the vote of at least four (4) members of the BOA is necessary to grant a variance. Based on staff’s analysis noted above, staff recommends approval of the variance subject to the following conditions: 1. The Applicant receives special exception approval by the Planning Board to install a 10,000 pound capacity boatlift on slip no. 3 for a property located at 1004 Bel Air Drive in the Yachtsman Cove Townhouse Condominium. 2. Following approval by the BOA and Planning Board, and prior to initiation of construction, the Applicant will be required to obtain a building permit from the Town of Highland Beach Building Department. 3. Pursuant to Section 30-21(g) of the Town Code, commencement of construction shall be initiated within two (2) years following the date of approval by the Plan ning Board. Completion of all conditions of approval shall occur within two (2) years following the date of approval by the Planning Board. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration. 4. Manatee Conditions: The Permittee shall comply with the enclosed (Attachment C) "Standard Manatee Conditions for In -Water Work — 201 V' 5. Turbidity Barriers: Prior to the initiation of any of the work authorized by this permit, the Permittee shall install floating turbidity barriers with weighted skirts that extend to within one foot of the bottom around all work areas that are in, or adjacent to, surface waters. The turbidity barriers shall remain in place and be maintained until the authorized work has been completed and all erodible materials have been stabilized. Turbidity barriers shall be removed upon stabilization of the work area. 6. Project Design Criteria (PDCs) for In -Water Activities: The Permittee shall comply with National Marine Fisheries Service's "PDCs for In -Water Activities" dated November 20, 2017 (Attachment D). Educational Signs: signs must be posted in a visible location(s), alerting users of listed species in the area susceptible to vessel strikes and hook -and line captures. The most current version of the signs that must be downloaded and sign installation guidance are available at: (https://www.fisheries. noaa.gov/southeast/consultations/protected- specieseducational-signs). The signs required to be posted by area are stated below: • All projects in Florida shall use the Save Sea Turtle, Sawfish, and Dolphin sign. These signs shall include contact information to the sea turtle and marine mammal stranding networks and Smalltooth sawfish encounter database. • Projects within the North Atlantic right whale educational sign zone shall post the Help Protect North Atlantic Right Whales sign above. 9. Monofilament Recycling Bins: Monofilament recycling bins must be provided at the docking facility to reduce the risk of turtle or sawfish entanglement in, or ingestion of, marine debris. Monofilament recycling bins must: • Be constructed and labeled according to the instructions provided at http://mrrp.myfwc.com. • Be maintained in working order and emptied frequently (according to http://mrrp.myfwc.com standards) so that they do not overflow. 10. Commencement Notification: Within 10 days from the date of initiating the work authorized by this permit the Permittee shall submit a completed "Commencement Notification" Form (Attachment E). 11. Cultural Resources/Historic Properties: a. No structure or work shall adversely affect impact or disturb properties listed in the National Register of Historic Places (NRHP) or those eligible for inclusion in the NRHP. b. Such activity shall not resume on non-federal lands without written authorization from the SHPO for finds under his or her jurisdiction, and from the Corps. d. In the unlikely event that unmarked human remains are identified on non-federal lands, they will be treated in accordance with Section 872.05 Florida Statutes. All work and ground disturbing activities within a 100-meter diameter of the unmarked human remains shall immediately cease and the Permittee shall immediately notify the medical examiner, Corps, and State Archeologist within the same business day (8-hours). I changed the description for the existing dock to read simply as to remain, without the verbage about the actual construction. I added a simple profile of a standard jetski on to the cross section. The lift platform is shown even with the elevation of the dock and cap; this is standard for a PWC lift. Obviously, the lift extends above the top of the jetski; this is also standard for a PWC lift. It is not normal or feasible to manufacture a lift with the top lifting bars, motors, electrical boxes, etc. that low and just barely above the dock surface. If this cross section satisfies your comments, I will go ahead and have them signed by the engineer (assuming they are working right now) and copy everything to a CD or memory stick, and resubmit back to you. The applicants will be required to submit for a variance for each property. The variance will be for the height difference between the maximum height of the lift and the height of the superstructure of the boat lift when lifted. Based on your latest detail sheet, it would be 2 feet, 3 inches. Please go the Town website, under the Building Department page, to see the variance application (I have provided link below). With regards to the variance application fee, the Town Manager has agreed to include the variance fee within the initial $2,500 fee that each petitioner has paid. On the variance application, you will see various variance criteria, please respond to each criteria accordingly. The Building Department has a drop box (in front of the building department) for application submittals — please also provide the completed variance application electronically and email to me. Variances are reviewed and considered by the zoning board of adjustment and appeals which would mean a separate public hearing in addition to the planning board hearing. Note that the zoning board of adjustment and appeals meets as needed and does not have designated meeting dates. I have been advised by the Town Clerk that because of the active Executive Orders in place due to COVID-19, we will not schedule any advisory board meetings until tentatively late May or as directed by the Town Manager.
