Minutes of Meeting of Town Commission
PUBLIC HEARING
Comprehensive Plan
June 28 1977 9.30 A M
Mayor Gilday called the Public Hearing to order at 9:32 A.M.
Present were:
Mayor Morton E. Gilday
Vice Mayor William S. Hults
Commissioner Leslie W. Joy
Commissioner Ruth E. Mumford
Commissioner Robert D. Clark
Also present:
Elaine W. Roberts, Town Manager
Thomas E. Sliney, Town Attorney
Kenneth Jones, Chief of Police
Kathryn M. Borgemenke, Town Clerk
Mrs. Roberts introduced Mr. Dick Brumback. Mr. Brumback was
an associate of Mr. Jim Smoot's.
Mr. Brumback referred to Page 37 of the Comprehensive Plan,
specifically that part of the Land Use Element that relates
to "Density Transfer". After a great deal of explanation
on the part of Mr. Brumback he noted the transfer would be
from the east side of AIA to the west only; with the
approval of the Town Commission. Mr. Brumback stated that
a density transfer would include unity of title.
There were many various questions asked relative to this
subject. Namely: separation of transfer, physical inability
to accept the transfer, variances, guide lines and
restrictions, conditional use, advantages to the Town,
protection of dunes, deed restrictions, spot zoning, etc.
Mr. Brumback stated that the density transfer concept is
• not used in Palm Beach County and is very new. It is used
essentially in very large municipalities.

Mrs. Roberts then expressed her opinion relative to PUDs
and the value to the Town.
Mayor Gilday recognized Mr. Dent. He spoke on his recommendations
to use density transfer to discourage building on the ocean
side of AIA.
Mr. Sliney stated that he had a great deal of reservation
from a legal standpoint about the density transfer. He
questioned if density transfer was applicable to a town of
this nature. He also stated that he did not feel that there
were many case decisions of this nature. He did note that
he liked the concept.

Mayor Gilday stated that this item be passed on for the time
being and have additional hearings on this proposed
Comprehensive Plan and this item will be discussed in the
future.
