Mayor Gilday called the meeting to order at 1:30 P.M.

PLEDGE OF ALLEGIANCE
Mayor Gilday called for a Motion to dispense with the reading
of the Minutes for the month of May.
MOTION by Commissioner Mumford/Vice Mayor Hults: "I will so move
that we dispense with the reading of the minutes".
ROLL CALL on the Motion Carried Unanimously.
REPORTS - TOWN COMMISSION
(a) Mayor Morton E. Gilday noted that at this time litigation
has been commenced by the Town as against the Holiday
Inn and Mr. O'Grady with a view to obtaining an abatement of
the commercial enterprise being run by Mr. O'Grady upon the
premises of the Holiday Inn.

(e) Commissioner Robert D. Clark stated that he and the
Town Manager attended the public meeting of the South
Central Wastewater "201" Facilities Board and perhaps by
next month this Board will have a sample resolution to be
presented to various municipalities for acceptance of the
"201" Facilities. He did state that the Town of Highland
Beach does not have much choice since it is in the South
Florida Region and presently is contracting with Delray
Beach for sewerage disposal.
REPORTS - VARIOUS AGENCIES OF THE TOWN
(a) Planning Commission - No report
(b) Board of Adjustment - Mr. Horton reported on a public
hearing held Monday, June 6, 1977. A request for a
variance by the Gruenhart Construction Company was denied.
Mayor Gilday noted that a vacancy of an alternate member
still existed on the Board of Adjustment. He offered the
name of Dr. Howard L. Hauge. Mrs. Mumford offered the
• name of Mr. Edward Bennett. Mr. Horton thanked the Commission
and stated he would take both names under advisement.

Mayor Gilday stated that the Town had received a letter of
resignation from Patrolman Ernest Giordano. He called for
a Motion to accept this resignation.

It was noted that the Commission appointed the members of
the Police Department.

Mrs. Roberts stated that she had given the Commission a
packet to study relative to this item. She did note that

since that time she has made a couple of revisions to the
packet this last week. These were just changes in Job
Description Titles. Mayor Gilday called for a Motion to
approve the Job Ratings and Job Descriptions as previously
submitted and as now amended by the recommendation of the
Town Manager.
MOTION by Commissioner Clark/Commissioner Joy: "I so move".
Discussion followed pertaining to Job Titles, Job Ratings,
authority of employees, line of command, the Assistant to
the Town Manager, Executive Secretary, the Town Clerk,
related administrative work, Deputy Town Clerk, etc.
ROLL CALL on the Motion Carried Unanimously.
Mrs. Roberts asked the Mayor if this Motion is to become
effective immediately. He answered in the affirmative.

Status of C.D.C.
Mrs. Roberts reported on a meeting held on Thursday, June
30, 1977 held by the City Managers of Boca Raton, Delray
Beach and Boynton Beach, sitting as the Board of Directors.
This Board has decided that Highland Beach and Gulfstream
may join the C.D.C. at a cost of $5,000. for the first year
only. Mrs. Roberts spoke on the history of the C.D.C. and
previous costs. She asked for Commission approval for the
expenditure of the $5,000. to participate in the C.D.C. -
first year cost only
Discussion followed relative to response time, first year
cost, new equipment, Federal grant, etc.
Commissioner Clark asked if the C.D.C. was going to give
the Town of Highland Beach $8,000. worth of equipment
that the Town will not pay anything for. Mrs. Roberts
stated that the Town will receive equipment in the amount
of $8,000. and that the Town will not be billed for it.
Commissioner Clark stated his own personal views on the
acceptance of C.D.C.
• Mr. Horton stated that the Town can not keep what it has
now in the way of communication for the Police. He
explained the reason why.

Chief Jones gave his views on the safety of the officers
on the road.
Mayor Gilday called for a Motion to approve the expenditure
of $5,000. for the first year.
MOTION by Vice Mayor Hults/Commissioner Mumford: "I so move".
ROLL CALL on the Motion Carried 4 - 1. Commissioner Clark voted
"No"
PUBLIC REQUESTS - None
REPORTS AND/OR RECOMMENDATIONS - TOWN MANAGER, ELAINE W. ROBERTS
Mrs. Roberts attended the Palm Beach County Municipal League
meeting on June 10th in Delray Beach. She gave a brief
report on this meeting.
• She stated that a book has 'been made available to the Town
prepared by Richard Orman in conjunction with the Treasure
Coast Regional Planning Council -- "Overall Program Design"
(Preliminary Draft).
She also informed the Commission that she was nominated and
elected as a Board Member of the Palm Beach County Municipal
League.
The Planning Congress met on Monday, June 13th, in West Palm
Beach, the Treasure Coast Regional Planning Council met on
the 9th of June; their next meeting will be held on July 14th.
Several meetings are scheduled as follows: -- South Florida
Water Management District - July 14th at 2:00 P.M. A
meeting called by the President of the Palm Beach Town
Council - July 12th at 7:30 P.M. to discuss assessments
increase.
Mrs. Roberts informed the Commission that Tom Hayes, Aide
to Senator Chiles was in Town Hall June 30th.
• Alice and Lou Winoker of Seagate have written a book entitled
"Joy In The Mountains". They have donated an autographed
copy of the book for the Library.

Mrs. Roberts read a letter from Judge Scholts, Chief Judge,
Fifteenth Judicial Circuit, thanking the Municipality for
its cooperation during his term as Chief Judge.
A letter from the Property Appraiser's office acknowledged
the copy of the Town Map sent to them by Mrs. Roberts
along with her request to include the Town lot numbers
on the Tax Roll in November.
The Town Manager reported on Town Departments:
Building Department
Mrs. Roberts reported receipts of $91.50 from licenses and
$1,516. for permit fees for the month of June. Permits
have been issued for new buildings as well as additions
and alterations. No Certificates of Occupancy have been
issued this past month.
• The status report on the garage shows that the framing is
complete, the plumbing is roughed in and now the exterior
is being stuccoed and the office and storage area are
being dry walled. The building should be complete within
a week to ten days. On June 29th the slab support for the
gas tank was poured. The tank is on the property at this
time and installation will begin today. The Building
Official has been attending many meetings on code revisions
which will be presented to the Commission after the Town
Attorney looks them over.
Finance Department Report
Work has been done on the preliminary budget. The
preliminary assessed valuation has been received by the
Town from the Property Appraiser. Mrs. Roberts stated
she would like the Commission to review the budget at
the July 19th Special Meeting. At this meeting the
Revenue Sharing will be discussed in the appropriate
manner. Discussion followed relative to meeting, dates
and times. The Town Attorney has sent letters to
delinquent utility accounts requesting payment.

Health Department Report
There has. been received by the Town a petition and request
to pass an ordinance relative to the use of spear guns.
Boca Raton or Delray Beach do not have an ordinance re; this.
Mrs. Roberts reported that she will continue research on
this subject.
Bus service status - Mrs. Roberts has received no reply to
her letter to the Director, County Bus Service.
Police Department Report
Officer Cecere will be in charge during the Chief's
vacation which will start Friday, July 8, 1977 for two
weeks, Mrs. Roberts reported.
Town Clerk's Department
• Considerable research has been done on the Financial
Disclosure Forms.
Public Works and Utilities Department
The sewage system reports were submitted by Carl Howard.
Only seven properties within the Town are not connected
to the sewage system and the Town Attorney will coordinate
with the Town Manager on a letter to be sent to these
property owners.
Mrs. Roberts asked the Commission if they would approve
the proposal from Southern Bell on the installation of
control circuits monitoring system in the Fire Station
as well as the contract with Carl Howard, not to be
effective until Mr. Howard receives his insurance.
Discussion followed relative to Mr. Howard's insurance.
Mr. Sliney noted that Mr. Howard's contract can not be
effective in view of his lack of insurance. He did
state the contract could be run on an interim basis.
Vice Mayor Hults suggested that the Town remain on the
• basis it has been on until Mr. Howard obtains his
insurance.

MOTION by Vice Mayor Hults as stated above. Seconded by
Commissioner Clark.
ROLL CALL on the Motion Carried Unanimously.
Jesse Arney reported to Mrs. Roberts that Well #2 work
has been completed and testing will be starting within
the next week or two.
Mr. Saarinen, of Ross, Saarinen, Bolton & Wilder, Inc.,
consulting engineers for the Town, called Mrs. Roberts
to state that a full report with recommendation would
be submitted by Friday, July 8th. One June 22nd Mrs.
Roberts received a recommendation from the engineers
relative to the water main on Russell Road. The main
reduces from a 6" cast iron line to a 2" galvanized
line. They suggest the 2" line be replaced with a 4"
cast iron line.
• When Mrs. Roberts has the approximate cost of this work,
she will report back to the Commission.
June Water Report -- a little less than in May.
In May 18,829,000 gallons were pumped and
In June 17,788,000 gallons were pumped
Mrs. Roberts reported on the status of Lauderdale Contracting.
In May authorization was received to pay Underground Suppliers
the amount of $9,710. which the Commission approved. In June
the Town Attorney answered Mr. Reo's letter.
Mrs. Roberts stated that it appeared the Town would not
receive a grant from the Public Works Federal money on
the resubmittal. She appealed to Senator Chiles office
and they suggested that she appeal to the State and the
State refused. She is now appealing to the County Commission.
Congressman Rogers' office suggested that she write that
office and inform them of her intentions and they will
distribute this to all agencies that grant federal funding.
Unfinished Business
• Mayor Gilday noted that the subject of changing the meetings
back to evening meetings had been discussed.

Mayor Gilday called for a Motion that the Town goes back
to the evening meetings on the first Tuesday of each
month starting with either the first Tuesday in September
or October. No one made the Motion.
Commissioner Clark referred to the work that had been
started on various charter changes. He stated that
this work should be discussed at the next Workshop. Mrs.
Roberts noted that Mr. Sliney had been working on these
items.
Mayor Gilday recognized Mr. Peter Genovese who spoke on
the subject of public meetings on the Comprehensive Plan.
He felt this item should not be discussed during the
summer months when a great deal of the citizens were
away from the Town. He requested that this be postponed
to October. Mr. Dent suggested that in the interim why
not submit the plan to Tallahassee for approval. He
disliked the thought of waiting three months for action
• on this item. The Mayor stated that most of the citizens
will have returned before the Town Commission will take
any definite action on the plan as a whole. Mayor Gilday
gave his personal feelings on not being in a rush on
adopting the Land Use Plan. Mr. Genovese then spoke
on the subject of density transfer. Vice Mayor Hults
explained his feelings on this matter.
Mr. Dent asked why this Plan as presented by the Planning
Commission could not be submitted to the State now? Mr.
Sliney stated that Mr. Smoot will be writing the Town a
letter with his suggestions on how the Town should proceed.
He stated he felt the Town should have one more hearing.
Mr. Smoot suggested to the Town Attorney that the Plan be
submitted as accepted from the Planning Commission along
with those changes that the Town Commission has made by
motion, etc., with evidence that it agreed with the
Planning Commission. Mayor Gilday noted that only a couple
of points had been considered by the Town Commission. The
Town Attorney stated that he preferred to have the major
points of disagreement removed and have all the points
submitted to Tallahassee at one time. He noted that the
• Town Commission has taken a negative view of the Commercial
Service District and the Density Transfer and Tallahassee
would be interested in other agreas of disagreement.

Another Public Hearing was recommended by the Town Manager.
At this time the Commission can go over the Plan item by
item. She suggested it be held sometime this month.
Mayor Gilday suggested that the Public Hearing be held
first thing in the morning and each item be discussed.
Mr. Dent asked if the Mangurian property had applied for
a building permit. Mrs. Roberts stated that they had
not applied for a building permit. They were granted
a tree removal permit.
He also spoke on the subject of liability coverage and
the Acting Finance Director will give him the information
• he is seeking.
He then asked if Mrs. Roberts were acting Town Treasurer.
She stated that he was correct and she was still acting
Town Treasurer. He stated that it is generally unwise
for a person who can approve expenditures to also be
responsible for the accounting and payment of same. He
noted that bills are approved through the office of the
Town Manager. He felt that the same officer should not
be Treasurer. Mrs. Roberts agreed with Mr. Dent on this
subject. She stated that under the Charter the Town
Treasurer should receive all of the public monies in
the Town. She felt as Town Manager her duties do not
directly involve the Finance Department, she noted that
she was not an accountant, at this time, and she is not
working in the Finance Department. She felt there was
an obvious separation of powers, in that the Finance
Director and Deputy Finance Director have the duty
for the accounting. She noted that she is in name
only the Town Treasurer.
