Regular Meeting
September 6, 1977 1.30 P.M
Vice Mayor Hults called the meeting to order at 1:30 P.M.
Present were:
Vice Mayor William S. Hults
Commissioner Ruth E. Mumford
Commissioner Leslie W. Joy
Commissioner Robert D. Clark
Absent: Mayor Morton E. Gilday
Vice Mayor Hults announced that the Mayor was still ill and unable
to attend this meeting.

(b) Vice Mayor William S. Hults -
The Vice Mayor read his letter of resignation for the record.
This resignation will become effective September 15, 1977.

(c) Commissioner Ruth E. Mumford -
Mrs. Mumford gave a very concise report on the findings of
the committee she chaired; namely, the Recreation Committee.
Commissioner Mumford stated that a number of people (approx-
imately 400 of which signed a petition against) were very much
opposed to a very expensive recreation complex. (Petition
is on file with Town Clerk) Mrs. Mumford suggested that
perhaps the Town Commission would wish to consider putting
this as a question during the next Municipal Election in
May. The preamble to the petition was read by the Town Clerk.
Mrs. Mumford reported on a response she had received relative
to the tar on the beach from a Lt. Calhoon, United States
Coast Guard.
(d) Commissioner Joy - No Report.
(e) Commissioner Robert D. Clark -
Commissioner Clark stated that he felt that perhaps the
Commission should act on the sad duty of accepting Vice
Mayor Hults' resignation.
MOTION by Commissioner Clark/Commissioner Mumford: "I move with
great reluctance that we accept Bill's resignation, only because
we have to, we have no other choice".
ROLL CALL on the Motion Carried 4 - 0.
Vice Mayor Hults stated his pleasure in serving the Town and
the citizens, working with the Commission and the Town Staff.
Reports of Various Agencies of the Town
(a) Planning Commission
Mr. Nicholas Johnson stated that a meeting would be held on
September 7, 1977 at 7:30 P.M.

(b) Board of Ad-iustment
Mrs. Roberts stated that Mr. Horton had no report.
(c) Housing Board of Adjustment and Appeals

Mrs. Roberts stated that a meeting would be held on September
14, 1977 at 10:15 A.M.
(d) Community Appearance Board - No Report.
(e) Police Committee
Mrs. Roberts stated that Mr. Horton reported that this
committee did not have a regular meeting during August.
A special meeting scheduled for the month of August did
not have a quorum but Mr. Horton did listen to those
citizens who were in attendance.
• Ordinances - Proposed - Second and Final Reading
(a) Amending Chapter 282 entitled "Trees, Shrubs and
Vegetation" was read in its entirety by the Town
Clerk (Ordinance No. 316).
MOTION by Commissioner Mumford/Commissioner Clark: "I move
that this be adopted".
ROLL CALL on the Motion Carried 4 - 0.
(b) Amending Chapter 2 entitled "Administration"
Vice Mayor Hults stated that this Ordinance will be set aside
until the Mayor returns.
Ordinances - Emergency - Pro osed
(a) Adopting Budget 1977-78 Fiscal Year. This Ordinance,
No. 317, was read in its entirety by the Town Clerk.
MOTION by Commissioner Clark/Commissioner Mumford: "I move the
• adoption of the Ordinance as read".
This Ordinance will become effective October 1, 1977.

(b) Adoption Millage 1977-78 Fiscal Year. This Ordinance,
No. 318, was read in its entirety by the Town Clerk.
MOTION by Commissioner Clark/Commissioner Mumford: "Move the
Ordinance be adopted as read".
This Ordinance will become effective October 1, 1977.
ROLL CALL on the Motion Carried 4 - 0.
(c) Building Moratorium Extension. This Ordinance, No.
319, was read in its entirety by the Town Attorney.
MOTION by Commissioner Clark/Commissioner Joy: "I move the
adoption of the Ordinance as read".
ROLL CALL on the Motion Carried 4 - 0.
Mr. Sliney, upon direction by the Vice Mayor, replied
to a question relative to the Comprehensive Plan asked
by Mr. Totz. Discussion followed relative to the
submission of the Plan to various state and local agencies.
Mr. Sliney stated that a new classification should be set
pertaining to zoning where the Town Commission has deleted
Commercial Service district. This change should be noted
on the map also. Discussion then followed between the
Town Manager and the Town Attorney.
Commissioner Clark stated that the Commission is well
advised on the subject of "Density Transfer" and at this
time he offered the following:
"I move here and now that the "Density Transfer" paragraphs
be eliminated from the Plan - I move that the Commission reject
that portion of the Plan." Commissioner Mumford seconded.

Resolution No. 332
Resolution No. 332 - Appointment of Acting Mayor was read
. in its entirety by the Town Attorney. Commissioner Robert
D. Clark was appointed Acting Mayor.

MOTION for Nomination by Commissioner Mumford/Commissioner Joy:
"I would like to nominate Bob Clark".
ROLL CALL on the Motion Carried 4 - 0.
MOTION by Commissioner Mumford/Commissioner Joy: "I move to
adopt this Resolution".
ROLL CALL on the Motion Carried 4 - 0.
Commissioner Clark stated he will do everything he can.
He also noted that it was his wish that the Mayor is
soon able to return. He then thanked the other
Commissioners for their vote and confidence.
Vice Mayor Hults brought the Commission and audience
up to date on the Mayor and stated that perhaps in the
near future the Mayor will be returning to Town Hall.
• Reports and/or Recommendations - Town Manager, Elaine W. Roberts
Mrs. Roberts reported on the meeting of the Palm Beach
County Municipal League, the next meeting of the League
will be Friday, September 9, 1977. Treasure Coast
Regional Planning Council will meet on Thursday,
September 8, 1977. The Planning Congress met on
August 8, 1977.
Mrs. Roberts noted that the Town Attorney is working on a
contractual agreement with Mr. Donald Wilson who is
representing the Town at the Technical Coordinating
Committee for the West Palm Beach Urban Area Transportation
Study.
Mr. Urbanek's administrative hearing has been mo~szed from
September to November 7th and 8th.
Responses to questionnaire in Bulletin re: Cable TV - were
approximately 100, with about 90% requesting the service.
The Area Planning Board has submitted a request for comments
• relative to Coastal Zone Management funding. Discussion
followed regarding this and it was the consensus of the
Commission that, due to lack of time, the Town Commission
has no comments.

Mrs. Roberts reported on:
Building Department

The total of all of the permits issued for the month of
August is very nearly $100,000. They issued no Certificates
of Occupancy. The status report on the garage - the sewer
line, fence and asphalt paving is yet to be done and,
weather permitting, this should be finished in a week.
Finance Department
Work on the budget has been completed and the auditors
have started preliminary work. The amount of $44,993.49,
Franchise Payment from Florida Power and Light, for the
period ending for the year 1977, was received.
Health Department
Much correspondence and replies relative to the tar on the
beach have been received.
The Florida Shore and Beach Preservation Association will
hold their annual meeting on October 5, 1977.
At this time, Mrs. Roberts spoke on the subject of the
recreation plan - brief history re: proposed use of land
behind Town Hall and regrets about not communicating
sooner to the Town Commission on the status of the citizen
committee's proposed plans.
Police Department
Officer Leonard Tremitiedi is ill. Mrs. Roberts read a
letter of appreciation from the Police Department regarding
the salary schedule revision approved by the Town
Commission.
A contract pertaining to the CDC is being reviewed by the
Town Attorney before being presented to the Town Commission
for approval.
• Mrs. Roberts noted that she had submitted copies of
information about the Police Department to the Town
Commission and an approximate cost of hiring an additional

patrolman, purchasing a new car and the cost of additional
equipment.
Town Clerk's Department
Work on interrogatories and other informational work has
been continuing in that office.
Public Utilities and Public Works
The consulting engineers have been working re: their Tasks.
Water consumption for the month of August was less than in
July.
The U.S.G.S. has submitted a proposal to the Town to continue
to monitor (for salt water intrusion). Approximate cost for
Fiscal Year would be $1,000.00. It was the consensus of the
Commission that this project be continued.
• Vice Mayor Hults called for a Motion to renew the contract
in the amount of $1,000.00 with the U.S.G.S.
MOTION by Commissioner Clark/Commissioner Mumford: "I so move".
ROLL CALL on the Motion Carried 4 - 0.
Mrs. Roberts reported that the cost of the repairs to the Bel
Lido bridge were less than approved by the Town Commission.
Mrs. Roberts noted that the new truck was picked up last week
and is located in the Town Garage. A hitch and crane will be
installed on the truck when received.
A full report relative to the Town's request for "No Parking"
signs along AIA from the DOT was read by the Town Manager.
The request was, at this time, denied.
Mrs. Roberts notified the Town Commission of a Public Hearing
to be held pertaining to the 12th Street Bridge. The meeting
will be held in the Delray Beach City Hall, 7:30 P.M. on
September 21, 1977. A notice is posted on the front door

Vice Mayor Hults recognized Dr. R. Murphy who requested to
be heard relative to the building moratorium.
Mr. Schott reported on the status of Building "D" - Boca Hi.
There has been no building permit issued to date.
Bills for Approval
M. Maree Birkbeck presented the bills to the Town Commission.
MOTION by Commissioner Mumford/Commissioner Clark: "Move that
we pay these bills".
