1977.10.27_TC_Minutes_Workshop • TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Workshop Meeting October 27, 1977 9:30 A.M. Vice Mayor Louis Y. Horton presided in the absence of the Mayor. The Meeting was called to order by Vice Mayor Horton at 9:30 A.M. Present were: Vice Mayor Louis Y. Horton Commissioner Ruth E. Mumford Commissioner Leslie W. Joy Commissioner Robert D. Clark Absent: Mayor Morton E. Gilday Also present: Elaine W. Roberts, Town Manager • Thomas Sliney, Town Attorney Kathryn M. Borgemenke, Town Clerk Vice Mayor Horton gave a very brief report on a visit he had with Mayor Gilday about four days previous. The Mayor had expressed his desire to attend today's meeting but was unable to do so. 77.34 Discussion - Richard G. Orman, Ph.D.. Dr. Orman reviewed, for the Town Commission, his work with the new zoning ordinance to date. He asked the TEawn Commission for their particular problems with the zoning ordinance. Dr. Orman noted that a tentative meeting had been scheduled for Monday, November 14, 1977 at 7:00 P.M. for a joint meeting with the Planning commission and the Town Commission to discuss his report to all the agencies of the findings that he has made relative to the Codes. It was the consensus of the Town Commission that Monday, November 14, 1977 would be an agreeable meeting date. Each Commissioner expressed his personal opinion to Dr. Orman relating to the zoning of the Town. Minutes Highland Beach Town Commission • Workshop Meeting October 27, 1977 Page 2 of 5 Mr. Sliney noted that he worked out a schedule to mesh the comprehensive plan with the zoning. He recommended dates for the final hearings (February 13 and 27, 1978 at 7:00 P.M.). He noted that there would be other hearings in between. A definite notice must be given of the final adoption date when the comprehensive plan is to be submitted. Hearings on the zoning ordinance before adoption of the comprehensive plan will be held. 77.41 ORDINANCES - Proposed (a) Repealing Chapter 132 of the Code of Ordinances entitled "Interim Services and Facilities Fees"; providing for an effective date. The Town Attorney gave his reason and intent for recommending this ordinance. (b) Amending Chapter 7 of the Code of Ordinances entitled "Buildings" by adding Subsection 7-21(d). No discussion. • (c) Appropriating Funds for the Fiscal Year 1977-78, Beginning October 1, 1977 and Ending September 30, 1978. (Previously adopted as Emergency 9/6/77) - No discussion. (d) Effecting a Tax Levy Based upon the 1977 Tax Roll of the Town. (Previously adopted as Emergency 9/6/77) No discussion. (e) Amending Ordinance No. 299 which appropriated funds for the Fiscal Year 1976-77, which began October 1, 1976 and ended September 30, 1977. It was noted that this Ordinance had been recommended by the Auditors for the Town. The above proposed Ordinances were advertised on Monday, October 17, 1977, Boca Raton News. Second Reading and proposed adoption is scheduled for the Regular Meeting, Tuesday, November 1, 1977. 77.42 ORDINANCES - Discussion - Not Advertised (a) Amending Chapter 2, Section 2-52 (a) , 2-52 (b) , 2-52 (c) and Section 2-54, entitled "Administration". After a . brief discussion Section 2-52 (a) will not be amended. First Reading of this Ordinance was held on October 11, 1977. Minutes Highland Beach Town Commission • Workshop Meeting October 27, 1977 Page 3 of 5 (b) Amending Sections 1.06, 3.02, 3.03, 3.04, 3.05, 3.08, 4.01, 4.02, 4.03, 4.04, 7.03, 7.05, 7.06, 8.03, 8.04, 8.05, 8.06 and 10.01 of the Charter of the Town. The Town Attorney stated that he had not had time to review this ordinance and suggested that some of these items may have to be changed by referendum and not ordinance. He requested further time to research this ordinance. It was the consensus of the Commission that this ordinance be set aside for the time being. 77.43 RESOLUTION - Proposed -"To the Florida Public Service Commission Protesting the Inverted Rate Structure Established by the Commission in recta rd to the rates of Florida Power & Lig'ht Company." After discussion this item will not appear on the agenda for the Regular Meeting, November 1, 1977. 77.44 BOARD OF ADJUSTMENT - Vacancies Regular Member, Louis Y. Horton 3 year term Alternate, Frank J. Carberry 1 year term Alternate, vacant 1 year term See list attached. 77.45 HOUSING BOARD OF ADJUSTMENT AND APPEALS - Vacancies Regular Member, Robert Santangelo 3 year term Regular Member, Walter Butler 3 year term 77.46 POLICE COMMITTEE - Vacancies Two vacancies created by resignation of Louis Y. Horton and Edward Miles. Minutes Highland Beach Town Commission • Workshop Meeting October 27, 1977 Page 4 of 5 The following items that appeared on the agenda were not discussed. 77.48 Request from Palm Beach Junior College 77.49 Unemployment Compensation Contribution Program 77.50 Spearfishing Regulations 77.51 Police Officer to Fill Vacancy Mrs. Roberts noted that the Town Commission had been given copies of a memorandum that the Chief had submitted to her. The proposed person to fill the vacancy will be invited to the Regular Meeting, November 1, 1977. The Town will not send a representative to the Florida League of Cities in Orlando, October 28, 29 and 30, 1977. REPORTS CORRESPONDENCE AND CONTINUING REPORTS - ELAINE W. ROBERTS, TOWN MANAGER In order to finalize plans to install an additional gas tank in the repump station for the emergency generator, Mrs. Roberts requested a consensus as to the cost; approximately $200.00. She noted that the Feiner case settlement did not cost the Town any money. $16,500. was paid by the insurance company covering Lauderdale Contracting. The Town will receive a rebate for the cost of the Tmwn Attorney ($174.60). Mrs. Roberts reported that there is sand in the sewer system and she had received estimates to have it removed. She was instructed to have the work done. Mrs. Roberts had received bids to have repair work done in the Fire Station and Police Department.
