1977.11.07_TC_Minutes_SpecialTOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Special Meeting November 7, 1977 7.00 P.M Vice Mayor Horton called the meeting to order at 7:00 P.M. and announced that this was a joint meeting of the Town Commission and the Planning Commission to meet with Richard Orman, Ph.D., to discuss the matter of zoning. He then read the additional items on the agenda. All members of the Town Commission were present with the exception of Mayor Gilday. All members of the Planning Commission were present with the exception of R. B. Myers and O. Edlund. Also present: E. W. Roberts, T. E. Sliney, K. M. Borgemenke and Richard Orman, Ph.D. • With the agreement of the Town Commission, the bills for approval were presented. MOTION by Commissioner Clark/Commissioner Mumford to approve the bills for payment carried 4 - 0. Consideration of the Interlocal Agreement for the Housing and Community Development Program. MOTION by Commissioner Clark/Commissioner Mumford to accept and complete the agreement carried 4 - 0. Any other matters that may properly come before the Town Commission at this time. None Joint Meeting Planning Commission, Town Commission and' Dr. Orman re: zoning. After presentation of the "Land Use Controls Policy Paper" by Dr. Orman, the Town took the following action: ~ Minutes Highland Beach Town Commission • November 7, 1977 Special Meeting Administrative Issues Page 2 of 4 #1 LUI control technique MOTION: No motion. Not included in Land Use Plan. #2 RPUD means of controlling land development. MOTION: No motion. Not included in Land Use Plan. #3 Institute a site plan review process or conditional use designation to replace the present special exception approach to permitting uses other than residential. MOTION: Commissioner Clark/Commissioner Mumford concurring with Dr. Orman's recommendation "Emphasizing once again I am talking about Special Exceptions". Motion carried 4 - 0. #4 Planning Commission to review all applications for building permits to assure compliance with the intent of land development regulations. MOTION: Commissioner Clark/Vice Mayor Horton not to accept the recommendation. Motion carried 4 - 0. #5 Planning Commission approval of all accessory structures before building permit issued. MOTION: Commissioner Clark/Commissioner Joy to accept the recommendation. Carried 4 - 0. Height and Bulk Issues #6 Ordinances to be reorganized to provide nearly all land regulation requirement under a district heading. MOTION: Commissioner Mumford/Commissioner Joy to accept the recommendation. Carried 4 - 0. #7 Minimum square footage of 1400 sq. feet to be established for all residential units. MOTION: Commissioner Clark/Vice Mayor Horton to accept the recommendation. Carried 4 - 0. #8 Buildings in all high density areas to be allowed to reach moderate heights (10-12 stories). • MOTION: Commissioner Joy/Commissioner Clark to accept the recommendation. Carried 4 - 0. Minutes Highland Beach Town Commission • November 7, 1977 Special Meeting Page 3 of 4 #9 Maintain "height limiting plane as a technique for limiting the height". MOTION: Commissioner Joy/"Maintain the present height" Dr. Orman was requested to show the Town Commission the alternative. #10 Moderately tall buildings should be encouraged in moderate and high density districts. MOTION: Vice Mayor Horton/Commissioner Clark to concur with recommendation. Carried 4 - 0. #11 To adopt regulations as low as possible without effecting a "taking" of the property rights. MOTION: Commissioner Clark/Commissioner Mumford to accept the recommendation. Carried 4 - 0. #12 To permit density transfer from ocean front properties to properties west of AIA. No motion - Commission previously expressed opinion. #13 Provide for "density bonus" as a means of encouraging quality development. MOTION: Commissioner Clark/Vice Mayor Horton: "I move that we accept the recommendation with the emphasis on small increase in density as a useful carrot to get the developer to do something else we want him to do". Motion carried 4 - 0. Other Regulation Issues #14 All utilities to be placed underground except in special exceptions. MOTION: Commissioner Clark/Commissioner Mumford to accept the recommendation. Carried 4 - 0. #15 Town to institute a mandatory platting requirement. MOTION: Commissioner Clark/Commissioner Mumford to accept the recommendation. Carried 4 - 0. #16 No commercial accessory uses should be permitted. Convenience services are not likely to remain limited • to the developments in which they are located. MOTION: Commissioner Mumford/Commissioner Clark to accept the recommendation. Carried 4 - 0. #17 The remaining natural dune should be protected in all instances. MOTION: Commissioner Mumford/Commissioner Joy to accept the recommendation. Carried 4 - 0. • Being no further business to come before the Commission, the meeting ADJOURNED at 9:35 P.M.
