Minutes of Meeting of Town Commission.
Regular Meeting
April 1, 1980 1:30 P.M.

Mayor Horton, called the Regular Meeting to order at 1:30 P.M. on April 1,
1980. Those in attendance were: Mayor Horton, Vice Mayor Storm and
Commissioners Bauer, Blosser and Genovese. Also in attendance were:
Elaine W. Roberts, Town Manager;Town Attorney Thomas E. Sliney; Pmlice
Chief Kenneth Jones and Jane E. Barker, Town Clerk.
There were several Townspeople in the audience.

MOTION by Vice Mayor Storm, seconded by Commissioner Blosser that the
minutes be approved as written. The voice vote was unanimous in favor.
Public Requests and Comments
Mr. M. H. W. Dent, a Town resident, addressed the Commission
regarding Mr. Arney's retirement.
(a) Hoffmann - Extension for RPUD Request
Mr. Kendall Slinkman, representing Paul Hoffmann, addressed the
Commission regarding the extension to their RPUD. Mr. Slinkman
stated that Mr. Hoffmann kas been trying to get approval from the
Department of Environmental Regulation and the Army Corps of
Engineers to dredge and fill his lot for a matter of years.
Inasmuch as they have not received this approval as yet, they
are seeking another extension to their RPUD.
Mr. Sliney informed the Commission that it would be necessary
• to amend the original ordinance concerning this RPUD.
Vice Mayor Storm made the MOTION that a six months' extension be granted.
Commissioner Blosser asked if this could be a final extension? Mayor
Horton stated that this would be an amendment to the MOTION and he seconded

the original MOTION.
Discussion then took place with Mr. Slinkman stating that he
did not really know that permission would be received from the
D.E.R. and Army Corps of Engineers within that six months and
was hopeful that the Town would not make this the final extension.
Commissioner Blosser then withdrew her request to make this a final
extension and Mayor Horton repeated the MOTION - "that the extension be
granted for six months with a letter being forwarded covering the
reservations of the Town Commission". All Commissioners voted Aye.
(b) Drexel Management Request to Discuss Litigation and Possible
Compromise
Mr. Earl Totz, representing Drexel Management, referred to the
letter from Drexel Management sent to the Town Commission dated
March 13, 1980 and spoke of the meetings he and Commissioner
Genovese had held regarding this subject. Commissioner Genovese
• then explained in detail just what had transpired in these meetings.
After much discussion, a
MOTION was made by Commissioner Genovese and seconded by Commissioner
Blosser that Commissioner Bauer be appointed as an arbitrator to meet
with Mr. Totz and Mr. Latz, Vice President of Drexel Management, to
see if a compromise could be arranged. The MOTION was carried three to
two - with Vice Mayor Storm and Mayor Horton voting Nay.
~c) Request from Arthur Strock regarding Lot 113W - Bulkhead and Fill
Mrs. Roberts explained this request for the benefit of the Commission.
MOTION by Commissioner Bauer and seconded by Vice Mayor Storm that this
request be granted. All Commissioners voted Aye.
Mrs. Roberts then read for .the record the biological water
quality assessment.
(d) Boca Hi Request - C/O Extension - Sales Office
Mayor Horton explained the reason for this request, which was that
temporary structures can obtain a Certificate of Occupancy for a
• two year period only. Their C/O has expired and they are seeking
an extension.

MOTION by Commissioner Bauer/Commissioner Genovese that Boca Hi be
granted an extension on their Certificate of Occupancy for a two
year period, expiring on March 31, 1982. All Commissioners voted Aye.
Reports - Town Commission
(a) Mayor Louis Y. Horton - Mayor Horton reported that the WET
Group had met last Thursday and
stated that it was gratifying to see the excellent response from
the people in the condominiums. Ambassadors South won the Water
Saver Award for the month of March and Mr. Orville Edlund and Mr.
Joseph Del Barto, President of the Association, were in the
audience. Also the Manager, Mr. Robert W. Hines, was present.
Mayor Horton spoke again on water conservation and mentioned the
fact that there had been no rain. He said that the expansion
work at the water plant was going quite well and according to
schedule.
• (b) Vice Mayor Harold C. Storm - Vice Mayor Storm spoke regarding
the financing on the sewer
indebtedness and that every effort was being made to correct this
situation. He also stated that he would be attending the "208"
meeting in Palm Beach on April 9, 1980.
(c) Commissioner Harry C. Bauer - No report.
(d) Commissioner Mary Louise Blosser - Commissioner Blosser said
today, April 1, 1980, was
Census Day, and if some residents had not received their Census
form, they should call the Palm Beach Census Bureau office.
(e) Commissioner Peter J. Genovese - Commissioner Genovese read for
the record his letter addressed
to the Mayor and Town Commission, dated April 1, 1980, concerning
"Restriction in Building Code". He stated that he was concerned
about the "Interval Time-Sharing" concept starting up in Town.
Mayor Horton suggested that a proposed amendment be added to the
Zoning Ordinance. This matter should first be referred to the
Planning Commission, he said, and
• Commissioner Genovese made a MOTION, seconded by Commissioner Bauer that
this entire matter be referred to the Planning Commission for their perusal
and thoughts on the matter. All Commissioners voted Aye.

Reports of Boards and Aciencies of the Town

(a) Board of Adjustment - Mrs. Roberts announced that this Board
would be holding a Public Hearing on
April 29, 1980 at 7:30 P.M. This concerns a request from Healy
Company for variances under Chapter 30 of the Code of Ordinances.
(b) Code Enforcement Board - Mrs. Roberts stated that this Board
would be meeting in April. There
are vacancies for two alternates on this Board.
(c) Community Appearance Board - Mrs. Roberts stated that the
Commissioners had received a
recommendation to fill the position of second alternate on this
Board. Mayor Horton requested that a resume be submitted by this
person.
(d) Housing Board of Adjustment & Appeals - Mrs. Roberts announced
that this Board would
• be meeting on Wednesday, April 9, 1980 at 10:15 A.M. Mr. Leon Allen
had been recommended as second alternate to this Board.
MOTION by Vice Mayor Storm and seconded by Commissioner Blosser that
Mr. Allen be appointed as second alternate to the Housing Board of
Adjustment & Appeals. The Aye vote was unanimous. Mr. Allen's term
will be for one year ending April 1, 1981.
(e) Planning Commission - Mr. Robert Myers, a member of the
Planning Commission, stated that the
Hoffmann matter had been covered already as well as the matter
Commissioner Genovese had brought up.
Reports - Representatives Re:
(a) Metropolitan Planning Organization & Transportation (Don Wilson)
Mrs. Roberts stated that Mr. Wilson was ill and there was no report.
(b) South Florida Water Management District (Frank Carberry)
Mr. Carberry spoke very highly of the cooperation received from the
• people in Highland Beach during the current water shortage and .reported
the percentage of savings realized. He added that the Townspeople
could not relax as yet as the rainy season is still 22 days away.

Reports - Town Attorney
Mr. Sliney reported that there was still no decision on the Van
Lennep case - the matter is still in the hands of Judge Rudnick.
He stated that he had heard from Mr. Galbraith, City Attorney for
Boca Raton, who said that the proposed lease for the well field
will be forthcoming very shortly. Mr. Sliney also stated that he
had been in contact with Bond Counsel in Jacksonville in
connection with the point raised by Vice Mayor Storm re: sewer
indebtedness.
Vice Mayor Storm questioned another commercial establishment at
the Holiday Inn. This will be checked out by the Building Official.
Reports - Town Manager
Mrs. Roberts said that the Palm Beach County Municipal League
Meeting was held in Riviera Beach in the middle of the month.
• Representative Edward Healey, Chairman of the Legislative
Delegation, was in attendance.
The Treasure Coast Regional Planning Council will be meeting on
April 10, 1980 in Stuart, Mrs. Roberts said, and she attended a
local government review meeting on March 18th for the Census,
and met with Department of Transportation officials regarding a
pedestrian cross-walk at Boca Hi and "no parking" and "no passing"
signs. She stated that the Town will be getting some "no parking"
signs to be placed temporarily at construction sites.
She also met with Mr. .MacDonald regarding the Retirement Plan and
the paper salvage people about some of their problems.
Correspondence was received concerning a bike seminar being held
at Palm Beach Junior College on Friday and Saturday, April 11 and 12;
a notification from the Governor about a hurricane seminar in
Orlando; an energy report; and a funding application from the
Area Planning Board by the State of Florida Department of
Community Affairs for a State Grant for the continuing of "701
Comprehensive Planning and Management Assistance". The consensus
of the Commission was against the above.
• Mrs. Roberts reported on receiving an in-depth report from the
Water Management District; good news from the Post Office increasing
the renumeration from $4,000.00 to $6,000.00 annually; and
correspondence from Roy Simon regarding the cost of the municipal
complex.

Mrs. Roberts said that a request had been received from Del Trail
Fire District to supply gas for the rescue van. This item will be
placed on the agenda for the Workshop Meeting on April 29, 1980.
Mrs. Roberts reported on the following departments:
Building - A final Certificate of Occupancy was issued to the Terry
Lee home and to a triplex in Highland Beach Isles.
Building permit fees collected for March amounted to $14,235.
John Helfrich, Building Inspector, is in Veterans' Hospital in Miami,
having had surgery. Mrs. Roberts informed the Commission of the
total value for single family residence and multi-family residence
permits for 1979, thus enabling them to see what the tax base will
be for 1980.
Finance - A total of $373,287. has been collected in tax monies;
$34,753. has been received for the Road and Bridge Fund;
$4,820. Franchise money from Florida Posner & Light; $38.00 from
• Durbin Paper and so far this year, $539.00 from the Court. Mrs.
Roberts reported on investments that had been made.
Maintenance - Mrs. Roberts said that Michael will be attending a
Water Meter School in Tallassee, Alabama on April 28
thru April 30, 1980.
Health Department - No report.
Police - Vice Mayor Storm questioned whether the large increase
in parking citations was due to construction in Town,
however, Chief Jones stated that it occurred more on Saturdays
and Sundays, especially with the nice weather, and more people
going to the beach.
Mayor Horton asked Chief Jones to have his men watch more closely
for vandalism in the parking lots, as good tires have been stolen
from automobiles and replaced with old ones.
Mrs. Roberts reported that the C.D.C. meeting had been postponed
until next Tuesday.
• Town Clerk - Mrs. Roberts said that this department is continuing
to update the Bulletin Mailing List and obtaining
more facts concerning microfilming and records' retention.

Public Works & Utilities - In checking out the raw water used for
the month, it amounted to over 27 million
gallons. Mrs. Roberts spoke of correspondence received from the
engineers concerning two subcontractors - this decision is usually
left up to the engineers.
Monthly coordination meetings have been scheduled among the
engineers, contractors, the Mayor and Mrs. Roberts, concerning the
Water Plant Expansion. Everything is on schedule, Mrs. Roberts
said, and the new domestic well is completed and undergoing tests
from the Health Department.
She also reported that the U.S.G.S. Monitor Well is finished and
she would like to see a small fence erected around this to
protect it. Mrs. Roberts stated that she had not received the
monthly sewer report from Carl Howard yet. She also said that the
sewer billing is being updated whereas people who have sales trailers
or construction trailers will now be billed monthly. An ordinance
• proposing this will have a First Reading at today's meeting.
Mrs. Roberts then announced that the Public Hearing on the dock
situation in the Zoning Code had been called by the Planning
Commission for April 9, 1980.
Proposed Ordinances
(a) Proposed Ordinance No. 378 - Amending Section 29-10
entitled "Water Use Rates
and Charges". First Reading. Mayor Horton read Ordinance
No. 378 by title only.
(b) Proposed Ordinance No. 379 - Amending Chapter 23 -
entitled "Signs and
Advertising".
(c) Proposed Ordinance No. 380 - Amending Chapter 22 - entitled
"Sewers".
Proposed Ordinance Nos. 379 and 380 were read by title only by
the Town Clerk.
• These three ordinances will have a Final Reading and Possible
Adoption at the Regular Meeting on May 6, 1980.

Proposed Resolution
(a) Proposed Resolution No. 401 - A Resolution of the Town
of Highland Beach, Florida,
Declaring the Election to have been held on the 6th day of
May, 1980, to be unnecessary since the only candidates who
qualified are unopposed.
MOTION by Commissioner Genovese and seconded by Commissioner Bauer that
Resolution No. 401 be adopted as read. All Commissioners voted Aye.
Items Included from Workshop Meeting of March 25, 1980
Mrs. Roberts stated that approval was needed to continue the
Lethal Yellow Program.
MOTION by Vice Mayor Storm and seconded by Commissioner Bauer that this
program be continued and to purchase 10 cases of Terramycin for $654.00.
All Commissioners ~zo~ed Aye.
• Next item to be considered, Mrs. Roberts said, was the quote for
the retainer fee for earl Harvel in the amount of $2,400. The
language of the proposal was discussed and it was satisfactory
to all concerned.
MOTION by Vice Mayor Storm/Commissioner Blosser to accept the proposal
from Earl Harvel in the amount of $2,400. All Commissioners voted Aye.
Mrs. Roberts said that the last matter for approval was Item No. 17
to be added to the Personnel Rules and Regulations covering per
diem expenses.
MOTION by Commissioner Bauer/Commissioner Genovese that Item No. 17,
covering per diem expenses, be added to the Personnel Rules & Regulations.
All Commissioners voted in favor of this MOTION.
Mrs. Roberts then introduced Dorothy Olsen who has been hired as
an additional secretary to the Town Manager.
Old Business
Mr. M. H. W. Dent., a Town resident, then asked if Mrs. Olsen was
• included in the budget and was informed that she was. He then
inquired as to whether Mr. Arney could be persuaded to remain
with the Town.

MOTION by Commissioner Genovese and seconded }ay Commissioner Bauer
that Mr. Arney's resignation be accepted, time not to exceed June
30, 1980. All Commissioners voted Aye.
Bills for Approval
Mrs. Roberts presented the bills for approval.
MOTION by Vice Mayor Storm that the bills be approved for payment. This
MOTION was seconded by Commissioner Blosser and the Commission voted
unanimously in favor of this MOTION.
Commissioner Genovese then said a few words in praise of the
efficient Town Manager and her oompetent staff.
MOTION by Vice Mayor Storm/Commissioner Bauer that the meeting be
ADJOURNED. All Commissioners voted affirmatively. Time 3:55 P.M.
