1980.06.24_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meeting of Town Commission Public Hearing and Workshop Meeting June 24, 1980 9:30 A.M. Mayor Horton called the Workshop Meeting to order at 9:30 A.M. Those in attendance were: Mayor Louis Y. Horton, Vice Mayor Harold C. Storm and Commissioners Harry Bauer, Mary Louise G. Blosser and Peter J. Genovese. Also in attendance were: Elaine W. Roberts, Town Manager, Police Chief Kenneth Jones and Jane E. Barker, Town Clerk. Mayor Horton announced that the first item would be the Public Hearing which Mrs. Roberts had called for the purpose of discussing the use of Federal Revenue Sharing Funds. This Public Hearing had been advertised in the Sun-Sentinel on June 14, 1980, and is according to law. There were no written or oral comments from citizens of the Town of Highland Beach. The amount of this Federal Revenue Sharing ~o uld be $3,600.00 according to Mrs. Roberts. Mayor Horton then explained that Item No. 80.39, although last on the Agenda, would be discussed at this time, inasmuch as Mr. Stuart Lesley, E911 System Coordinator, Division of Emergency Communications, Palm Beach County, was in the audience, Mayor Horton stated that he did not wish to hold Mr. Lesley up until the end of the meeting. Item No. 80.39 - 911 Mr. Lesley spoke very informatively on the subject of the 911 number which is a single telephone number put aside as an emergency number. Palm Beach County is the only county in this part of Florida which is not covered under the 911 system. Mr. Lesley explained the basic system of 911 along with the options of A.N.I. (Automatic Number Identification) which automatically gives the calling number and the second option of A.L.I. (Address Location Identification), which supplies the address for that telephone. Mr. Lesley explained various costs for the benefit of the • Commission with Vice Mayor Storm asking several questions. Minutes Highland Beach Town Commission • Public Hearing and Workshop Meeting June 24, 1980 Page 2 of 9 It was determined that Highland Beach pays 1.25/ of the total cost of operating the Cooperative Dispatch Center and this same figure should apply when the 911 number goes in. Mrs. Roberts said that the 911 number is not state mandated for operation by 1981. Mayor Horton thanked Mr. Lesley for the information and then read two letters from Mr. and Mrs. Canova, Town residents, thanking Mr. Hamzik for his cooperation regarding their seawall and Officer Guthlein for his alertness in discovering a broken patio door and calling them in Maryland to inform them. 79.76 Status of S. A. Healy Company Dr. Richard Orman, representing Healy, addressed the Commission and answered their questions regarding the Guest Lodge on the • west side of AlA. He explained that there were no kitchen facilities and there will be no Manager's apartment. Commissioner Genovese stated that he had talked with Dr. Orman and Mr. and Mrs. Raab regarding interval ownership. Commissioner Genovese asked Mr. Raab if he would sign an agreement that there would never be a sale, exchange, deed or lease on the amenity that was under discussion. Both Dr. Orman and Mr. Raab agreed to do this . For the benefit of all, Mr. Raab described the entire plan of the Guest Lodge and much discussion took place. Mayor Horton requested that Mr. Raab have his attorney draw up a statement regarding the deed restrictions which would permit Healy to proceed with their plans. This would then give the Commission the assurance they have been looking for. Mr. Raab suggested that the Town, through Commissioner Genovese, put in writing just how they wanted the restrictions to read. Commissioner Genovese said that he would do this. This matter will be discussed further at the Regular Meeting on July 1, 1980. • Minutes Highland Beach • Town Commission Public Hearing and Workshop Meeting June 24, 1980 Page 3 of 9 80.11 Hoffmann RPUD - Known as Hidden Harbor Mayor Horton reported that the Commission had received a copy of an ordinance amending the Hoffmann RPUD from Mr. Sliney. He said that this will have a First Reading at the Regular Meeting to be held on July 1, 1980. Mr. F. Kendall Slinkman, representing Hoffmann, addressed the Commission and stated that the Planning Board had approved the revised plans for a total of 620 units rather than the original 846 units. Mr. Paul Hoffmann, Developer, spoke to the Commission, going into great detail of what they have done aver the years in order to complete their project. Vice Mayor Storm voiced his objections to the RPUD, with Commissioner Genovese stating that he felt Hoffmann had compromised enough and that their RPUD could not legally be denied. • Mayor Horton said that the Commission would look over their new plans, the proposed ordinance concerning this RPUD would have a first reading on July 1, 1980 with further discussion on the matter at the Workshop Meeting on July 29, 1980. 80.30 Status of Water Treatment Plant Expansion and Well Field Mayor Horton told of a memo from the Town Manager to the Town Commission dated June 10th regarding two items to be deleted in the contract with Inter-County Construction. He read this letter for the record and said that the matter would be brought up for disposition at the Regular Meeting next week. Mayor Horton also spoke of a letter from the Engineers concerning a change-order to the Inter-County Contract which would increase the contract price by $64.00. This too will be voted upon next week at the Regular Meeting. This letter was dated June 16, 1980. Mrs. Roberts reported that things are going very smoothly with the water plant expansion and they are a little ahead of schedule. The new spiracter was installed on Friday, June 13, 1980. • Minutes Highland Beach Town Commission • Public Hearing and Workshop Meeting June 24, 1980 80.34 PROPOSED ORDINANCES Page 4 of 9 Proposed Ordinance No. 381 - An Ordinance of the Town of Highland Beach, Florida, Amending Ordinance No. 360, Providing a Fee Schedule for the following applications to the Town of Highland Beach: Rezoning, Change to the Zoning Ordinance, Special Exception, Variance, Appeal to Board of Adjustment, Nonconforming Use Permit, Special Permit, Site Plan Review (Preliminary), Site Plan Review (Final Development Plans), Subdivision Plan Review (Preliminary), Subdivision Plan Review (Final), Plat Review (New Plat), Plat Review (Amendment of Existing Plat), and Applications Not Specifically Set Forth. There were several changes to the fees in this Ordinance which Mrs. Roberts read for the Commission. Discussion took place regarding these changes with several suggestions being made by members of the Commission. This Ordinance will be due for a Second Reading and Possible Adoption at the Regular Meeting on • July 1, 1980. Proposed Ordinance No. 382 - An Ordinance of the Town of Highland Beach, Florida, to amend Chapter 2, Art~.cle V, Community Appearance Board, of the Code of Ordinances of the Town of Highland Beach, Florida. Mrs. Roberts explained the one change that Mr. Sliney had made in this Ordinance, after which discussion took place concerning the Community Appearance Board calling in consultants at the expense of the petitioner. Mayor Horton requested that this Ordinance be tabled for the time being. Proposed Ordinance No. 383 - An Ordinance of the Town of Highland Beach, Florida, Amending Chapter 2, Article VI, Code Enforcement Board, specifically Section 2-63, Applicability, of the Code of Ordinances of the Town of Highland Beach, Florida. A change was made in this proposed ordinance in that Chapter 27-7 was deleted. This will come up for a final reading and possible . adoption at the Regular Meeting July 1, 1980. Minutes Highland Beach • Town Commission Public Hearing and Workshop Meeting June 24, 1980 Page 5 of 9 Proposed Ordinance No. 384 - An Ordinance of the Town of Highland Beach, Florida, to Amend Chapter 17, entitled "Nuisances" of the Code of Ordinances of the Town of Highland Beach, Florida. This Ordinance will have a final reading and possible adoption at the Regular Meeting next week. Proposed Ordinance No. 385 - An Ordinance of the Town of Highland Beach, Florida, Amending Chapter 27, entitled "Traffic and Motor Vehicles", of the Code of Ordinances of the Town of Highland Beach, Florida. This Ordinance will come up for final reading and possible adoption at the Regular Meeting on July 1, 1980. proposed Ordinance No. 386 - An Ordinance of the Town of Highland Beach, Florida, Amending Chapter 22, • Section 22-2, entitled "Sewer Service Charges" of the Code of Ordinances of the Town of Highland Beach, Florida. This proposed Ordinance will change the sewer charge from $3.00 to $4.00. It will come up for final reading and possible adoption at the Regular Meeting on July 1, 1980. Proposed Ordinance No. 387 - An Ordinance of the Town Commission of the Town of Highland Beach, Florida, Amending Chapter 25 entitled "Subdivisions" of the Code of Ordinances of the Town of Highland Beach, Florida. Commissioner Blosser raised a question about this change deleting the setback line and after discussion, it was decided to set this ordinance aside for one month. This will be discussed further at the Workshop Meeting on July 29, 1980. Proposed Emergency Ordinance No. 388 - An Emergency Ordinance of the Town of Highland Beach, Florida, to retain the sewer connection fees with the Town pending a Resolution to purchase the sewage system. Mrs. Roberts stated that the purpose of this proposed emergency Minutes Highland Beach • Town Commission Public Hearing and Workshop Meeting June 24, 1980 Page 6 of 9 ordinance was to freeze the sewer connection fees immediately. This meets the approval of Mr. Urbanek and Mr. Delaney, Mrs. Roberts said, and Mr. Delaney will provide a letter to this effect. Said letter will be attached to the Ordinance. Action will be taken at the Regular Meeting on July 1, 1980. Proposed Resolution No. 404 - A Resolution of the Town of Highland Beach, Florida, in regard to the Cuban and Haitian Refugees. After discussion concerning had already passed the vote help the State of Florida in 8esolution became moot. 80.36 Plan of Organization this, it was determined that Congress to appropriate $100,000,000.00 to this crisis. Therefore, this Discussion took place regarding the Town Manager serving as the • Town Treasurer. Mayor Horton stated that the Town Manager could approve any expenditure up to $500.00 and inasmuch as two Town Commissioners must sign checks, it was felt that this arrangement was satisfactory. Commissioner Blosser, who first questioned this issue, stated that she now felt it should be left as is, with periodic reviews. Mayor Horton then brought up the subject of Mrs. Roberts' memo of June 20, 1980 concerning ad valorem taxes and the short fall the Town has experienced during the past couple of years. Mayor Horton questioned whether the tax-rolls could be checked to determine if there were any large tax bills outstanding. Vice Mayor Storm was quite indi~,npnt to think that the amount of $13,000.00 due in tax money could not be located and he felt that there could be a better system by the County Tax Collector. Mrs. Roberts stated that it is impossible to set up a budget without knowing how much money the Town will be receiving in ad valorem taxes and that this year's budget will be the hardest one she has ever had to work on. Vice Mayor Storm requested Mrs. Roberts to obtain a written statement from the Palm Beach County Tax Collector stating that the Town of Highland Beach • would be receiving the $13,000.00 due them. Minutes Highland Beach Town Commission • Public Hearing and Workshop Meeting June 24, 1980 Page 7 of 9 Town Manager's Reports Mrs. Roberts talked about the Public Hearing on Zoning to be held at 5:00 P.M. on July 1, 1980 and stated that Mr. Hamzik will check the depth of the water on the corners of the lots involved in Bel Lido, which should be of help to the Commission. Mrs. Roberts told of a copy of a letter received last Friday that Mr. Sliney sent to Jack McWilliams regarding the purchase of the Sewage System. Mrs. Roberts then spoke of correspondence between the Milanis and herself regarding the building to the south of their property. They were requested to demolish the building and refused to do this, stating that there should be an increase in surveilance by the police, have stricter enforcement of no parking regulations and closer liaison between property owners and the municipality. • Commissioner Genovese stated that he had talked with the Milanis about this; they did not compose the letter themselves and they were sorry if the letter caused any problem. They also stated that the building will be torn down shortly. 80.38 Discussion Re: Municipal Complex Mrs. Roberts said she wished to bring the Commission up to date on what was happening. She will be making out an application for a preliminary site plan review; Mr. Roy Simon, Architect, will be bringing in more papers; and an up-to-date survey will be made. Mrs. Roberts stated that there is a new paper pick-up man; the Hurricane Seminar was held last Thursday night with about 40 people in attendance; and Commissioner Blosser will be on vacation from September 21st to October 12th. Mrs. Roberts then spoke concerning the Police Department's requests which she itemized for the Commission. One request was for a 10/ increase in the Cost of Living. Much discussion took place regarding this item, with Mayor Horton requesting • Minutes Highland Beach • Town Commission Public Hearing and Workshop Meeting June 24, 1980 Page 8 of 9 more facts before a decision can be reached. Compensation for unused sick leave upon termination of employment was discussed next. It was the consensus of the Commission to establish a committee to obtain facts and figures concerning these items and applications from people willing to serve will be studied. Mrs. Roberts then spoke about the vacancies on the various Boards in Town. Several resumes have been received and recommendations will be forthcoming at the Regular Meeting to be held next week. Mrs. Roberts told of correspondence received from the Treasure Coast Regional Planning Council regarding the Energy Management Program and a request from Delray Beach asking for a donation to the new South Technical Education • Center in Boynton Beach, which trains fire department recruits. Mayor Horton suggested holding off on this for awhile. A letter was received from Tom Gullett, a resident of Town, regarding Cable TV and a letter from the Auditing firm saying the fee would be $8,000.00 for next year's audit. Mrs. Roberts spoke of a new General Aviation Airport for Palm Beach County and ECR No. 3 regarding water pollution and requirements to prohibit same. Commissioner Genovese recommended that Mr. Lester Levine be appointed to the Planning Commission as Alternate No. 2. He also spoke about the Council in Boca Raton being sued by a developer and not being insured; and wanted to pay tribute to Mr. Sliney and Mrs. Roberts for the million dollar liability policy that covers the Commissioners in Highland Beach. Mr. M. H. W. Dent, a Town resident, spoke regarding the Subdivision Ordinance; giving salary increases according to the Cost of Living Index and the Town Treasurer.
