1980.07.01_TC_Minutes_Regulari ,w TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meeting of Town Commission Public Hearing Zoning July 1, 1980 5.00 P M Mayor Horton called the Public Hearing to order at 5:00 P.M. on Tuesday, July 1, 1980. He stated that this meeting was called for the purpose of reviewing a possible change in zoning in the Bel Lido District. Two Public Hearings have been held - one on June 17, 1980 and the one today - July 1, 1980 - both at 5:00 P.M. The Public Hearings concern Section 5.3(e) "Noncommercial Docks, Piers, Launching Facilities and Mooring Devices" of the Zoning Code, Chapter 30, of the Code of Ordin- ances of the Town of Highland Beach, Florida. These Public Hearings were advertised in the Sun-Sentinel on June 10 and June 24, 1980. Those in attendance were: Mayor Louis Y. Horton, Vice Mayor Harold C. Storm and Commissioners Harry Bauer, Mary Louise G. Blosser and Peter J. Genovese. Also in attendance were Elaine W. Roberts, Town Manager and • Jane E. Barker, Town Clerk, as well as several Townspeople. Mayor Horton stated that a letter from the Chairman of the Planning Commission dated April 23, 1980 was received by the Town Commission and he read this letter for the record. Mayor Horton had pictures to show to the Commission of boats docked at corners, showing the distance between boats. Mayor Horton then read for the record a letter from the Bel Lido Prop- erty Owners' Association, dated January 8, 1980, signed by Mr. Earl Totz. Before discussion opened up for the public, Commissioner Harry Bauer went down into the audience and presented a drawing of the lots involved, which he explained to the residents in attendance. Mayor Horton stated that a Public Hearing did not necessarily call for a decision to be made at that meeting. More information might be needed and possibly Totem Counsel would be asked to draw up a proposed ordinance which could be discussed. The purpose of the Public Hearing was to listen to comments from the audience, taking these into consid- eration when the Town Commission does make a decision. Mayor Horton then stated that every person could speak once for five minutes. • Mayor Horton then invited members of the audience to speak. r Minutes Highland Beach Town Commission • Public Hearing July 1, 1980 Page 2 of 3 Mr. Alfred Agreen, 4206 So. Ocean Blvd., addressed the Commission stating that he felt that property owners in multi family districts with 100' on the water should be allowed a 15' setback instead of 25'. Mr. Edward Schmidt, owner of Lot 31, Block 4, spoke about a boat having to have slack due to the tides; therefore, docks could not possibly be situated too close together. He also talked about the lot next to him having no water at low tide. He stated that he wanted other people to be helped, but he didn't want any of his rights taken away from him. Mr. Leonard Harrison, owner of Lot 8, Block 3, addressed the Commission regarding boating accidents, and stated that he was in favor of the Planning Commission's recommendations. Mr. John J. Nestor, whose daughter owns Lot 4, Block 3, spoke to the Commission and said that when his daughter bought her house, • there was a dock there. When she closed on the deal, the dock was still there, however, the next day the dock was gone. He asked how his daughter could go about getting the dock back. Another question that he asked was "why Mr. Joseph Boscove did not disqualify himself when ruling on the Planning Commission regarding this subject?" (possible conflict of interest) Mr. M. H. w. Dent,. owner of Lot 1, Block 3, stated that he was the one who wrote the letter for the Bel Lido Property Owners' Association and the letter dealt only with the four corners under discussion. He also talked about the Planning Commission's letter of April 23, 1980. Mayor Horton asked if any one else cared to speak, and since no one did, stated that the section of this meeting, during which the public could make comments, was completed. Mayor Horton then discussed Planning Commission Chairman Boscove's letter in detail, talking about the three recommendations made by the Planning Commission. More discussion took place .among the Commissioners, with Mayor Horton saying that he would draw up a proposed ordinance which • would accomplish what had been talked about, consisting of the ~ R Minutes Highland Beach Town Commission Public Hearing July 1, 1980 Page 3 of 3 three parts the Planning Commission had proposed. This could then be discussed further. Mrs. Roberts stated that she hoped Mr. Schmidt was not misinformed by any staff member in Town Hall regarding obtaining permission from adjoining property owners as to the size of his dock; Boca Raton uses the amount of land that is on the water to determine the size of a dock; and people who have continuous docks have put their combined properties in a Unity of Title. Vice Mayor Storm agreed with Mayor Horton in that this matter should be studied thoroughly before acting upon it.
