1982.02.23_TC_Minutes_Workshop • TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission Workshop Meeting February 23, 1982 1:30 P. M. Mayor Horton called the Workshop Meeting to order at 1:30 P.M. This meeting was the second meeting held in the new Commission Chambers. Those in attendance were: Mayor Louis Y. Horton, Vice Mayor Harold C. Storm and Commissioners John J. Basso, Mary Louise G. Blosser and Edward J. Sullivan. Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E. Sliney, Town Attorney; Police Chief Kenneth Jones and Jane E. Barker, Town Clerk. There were several people in the audience. Mayor Horton made a few comments about the comparatively neat construction sites in the Town, which is due mainly to the constant checking by the police as well as the building department employees. He mentioned the m®ssy appearance at Sea Ranch of Boca and said that would be prohibited • in Town inasmuch as the Town makes the developers put up fences around the building sites. 82.1 Vacancies on Boards There are vacancies for an Alternate #2 member on both the Board of Adjustment and Community Appearance Board, however, Mrs. Roberts did not have any recommendations to make at this time. 82.2 Proposed Ordinance No. - An ordinance of the Town of Highland Beach, Florida to amend Chapter 282-31(b)(2) - Historic Specimen Trees. This proposed ordinance had a First Reading on February 2, 1982 with a Final Reading and possible adoption set for the Regular Meeting on March 2, 1982. 82.3 Status of Fire Study by Del Trail Fire District Mrs. Roberts said that work had been started on this study with all multiple units of three or more being notified that the study was being conducted. Mr. Al deClercq, Fire Marshall, was • provided with a list of those notified. 82.5 Possible discussion of Appleby Street issue Mrs. Roberts informed the Town Commission that Arturo's Restaurant Minutes Highland Beach Town Commission • Workshop Meeting February 23, 1982 Page 2 of 8 had been approved by the Boca Raton City Council, however, a permit had not been issued as yet. She further said that one of the conditions of the permit is that P.ppleby Street is to be improved to include a barrier for motor vehicle traffic from N. E. 7th Street and it will be worked out that traffic will be encouraged to go in from U. S. 1. 82.6 Possible discussion regardinq' M.P.H. Homes request Mrs. Roberts reported that she had been unable to reach Mr. Heise on this matter. This item will be placed on the agenda for the next Workshop Meeting on March 30, 1982. 82.7 Recommendations received from Police Committee regardinq Amendment to Resolution No. 413. Discussion took place regarding this matter. Mayor Horton reviewed all the correspondence which had been exchanged, along with the original Resolution that set this Committee up. Commissioner • Blosser commented on the simplicity of the Resolution which covered the Financial Advisory Board and felt both of these committees were operating under the same arrangement - that of being strictly an advisory board. Mayor Horton and Vice Mayor Storm both felt that the responsibility and authority should be up to the Town Manager and should not be divided. Commissioner Sullivan suggested that Chief Jones be asked his opinion of the value of this Police Committee and should it be operated under the Town Manager. Chief Jones' answer was that he felt it was valuable at budget time when the issue of raises came up, however, insofar as assisting the Police Chief, he felt the Town was too small to need this. Vice Mayor Storm then asked Chief Jones about the calls people receive from representatives of the Police Benevolent Association seeking donations. Chief Jones informed Vice Mayor Storm that people should ask questions as to whom was calling and whether they could call back. To continue with the Police Committee, Commissioner Blosser stated that she felt this Committee should have an alternate inasmuch as if one member is absent, the Committee is left with • only two members. After more discussion, the consensus was that Mayor Horton would draw something up for the Commission's consideration and the 1 s Minutes Highland Beach Town Commission Workshop Meeting • February 23, 1982 Page 3 of g matter will be discussed further at the next Workshop Meeting on March 30, 1982. 82.8 Possible discussion regarding work by Gee & Jenson Mrs. Roberts said that Gee & Jenson would be appearing before the Planning Commission on March 3, 1982 which will be an unadvertised Public Hearing. Then on March 10, 1982, they will attend the Regular Meeting of the Planning Commission, at which time they should have final recommendations to present. After that, advertised Public Hearings can be held. These advertised Public Hearings are mandated by the State. 82.9 Report regarding Municipal:Center work Mrs. Roberts reported that she had a most difficult time getting into the new building for this meeting, as the new building had been locked since last Friday. At 11:00 A.M. this morning she had to obtain a temporary C. O. for the interior of the building as well as a certificate of substantial completion of the interior from Mr. Roy Simon, Architect. She said that she was • quite irritated about this and felt that a letter should be written to the contractor informing them that they should not have started the work in the old building if they did not intend to let the Town use the new one. Mrs. Roberts then said that the telephone booth had been removed for refurbishing and she explained where it would be placed upon its return. She also informed the Commission that the flag pole would be moved to a spot between the two buildings. Mrs. Roberts said that she had received four bids for the sprinkler system and she was in favor of the second lowest bid inasmuch as they were the people who did the sprinkler system for the Town Hall. Mrs. Roberts stated that she had a meeting set up for Wednesday, February 24, 1982 with Mr. Simon, Architect; Hardrives and Mangus, as well as the sprinkler people, in order for them all to work together to complete the entire project by the 20th of March. Dedication of the new building is scheduled for March 20, 1982. She then informed the Commission that the lights had been ordered • from Century Lighting and the telephones in the library and post office would be installed tomorrow (Wednesday, February 24, 1982). 82.11 Massengill-Moore Mr. Sliney stated that he had received no response to his letter Minutes Highland Beach Town Commission • Workshop Meeting February 23, 1982 to Mr. Tuthill, Attorney for Massengill-Moore. Page 4 of 8 Discussion took place among the Commissioners with Mr. Digby Bridges, Architect for Fortuna del Mar, regarding a deceleration lane the DOT wants Mr. Bridges to put in for his four units. Mr. Bridges said that he felt the DOT was going to destroy what the Town now had. It was felt that no less than fifty units warranted a deceleration lane. Commissioner Basso stated that he would like the Town Attorney to look into this, whinh Mr. Sliney said he would do. Commissioner Sullivan felt that somebody from the DOT in authority should be in attendance at the Regular Meeting next week, along with Mr. Bridges and Mr. Ham2ik. Mayor Horton made the remark that the Town Hall generated 50 times more traffic than a four-unit building would, yet there was no left turn lane for the Town Hall. Mayor Horton said that this item will be on the agenda for the Regular Meeting next week with somebody from DOT in attendance, • 82.15 State Department of Revenue regarding stele of gas to Del Trail Fire District Mrs. Roberts said that she had received a letter from the State Department of Revenue, saying that the Town could not sell the Del Trail Fire District gas and_ expect a tax rebate because they are not a municipality. Discussion took place with the consensus being to sell them the necessary gas and then deduct that amount from the tax rebate form. 82.21 Possible discussion of proposed bond issue Mrs. Roberts said that this item, including the park portion, would be on the agenda for the next Workshop Meeting on March 30, 1982. 82.22 Appointment of Retirement Board Treasurer Mrs. Roberts said that Maree Birkbeck, former Treasurer of the Retirement Board, had drawn up a list of the duties of the Treasurer for this Board. Maree would continue to do the actual physical work. Mr. Sliney's opinion was that he didn't think a Treasurer was necessary. Mayor Horton said that until such time • as somebody from the State said the Board had to have a Treasurer, the matter would rest as is. Minutes Highland Beach Town Commission Workshop Meeting February 23, 1982 Page 5 of $ • 82.23 Correspondence (a) Letter of February 2, 1982 from Bureau of Beaches and Shores to Clarendon Mrs. Roberts read from a letter written to Mr. Roy Case, President of Clarendon Condominium Association, from Mr. Richard White of the Bureau of Beaches and Shores, wherein Mr. White advised Mr. Case that the dune could not be excavated nor could vegetation be removed unless authorized by the Department of Natural Resources. It was determined that the Town was involved only as far as information was concerned. 82 23 (b) Letter from Trafalgar developers dated February 5, 1982 requesting review of proposed clubhouse renovation. Representatives from Trafalgar Development were in attendance and explained to the Commission what changes they desired to make in their plans for the Coronado Beach Club. Mayor Horton • questioned why the plans showed a 70' walk-over the dune when the vegetation line was only about 30'. The Trafalgar people said this was adjustable. After considerable discussion, Mayor Horton stated that this matter would come back to the Town Commission after the various Boards had made their recommendations. 82 23 (c) Memo dated February 4, 1982 from Police Chief regarding Police education Chief Jones verified the information that Officers Jack Oehl and Alexander Kirk would be the next two officers taking courses. 82 23 (d) Letter dated January 27, 1982 from Highland Beach Cable TV Attorney to Town Attorney Mrs. Roberts explained about the various pieces of correspondence which had been received concerning Highland Beach Cable TV and the antenna which Regency Highland wished to place on their building. Commissioner Basso stated that there was absolutely nothing in the Town laws which prohibited them (Regency Highland) • from putting an antenna on their building. He also said that Mr. Tom Gullett, President of the Highland Beach Cable TV, had no right to interfere with the condominiums and that he was creating a disturbance within the condos. 1 - w. Minutes Highland Beach Town Commission Workshop Meeting February 23, 1982 Page 6 of g After a great deal of discussion, Vice Mayor Storm asked why the Town Commission was " in the middle of this" ? He said that if no Town ordinances were being broken, he could not understand the Town's involvement. The height of Regency Highland was brought up next with Mr. Hamzik checking the plans and determining that Regency Highland was 123 feet high. Commissioner Sullivan then brought up the subject of the antenna being able to sustain winds up to 60 to 75 miles an hour. He said that under the Town Charter, the Town Commission is required to protect the safety of their citizens. Mr. Sliney summed up the matter by saying that Mr. Gullett was aware of the fact that he had a non-exclusive franchise with the Town; Mr. Lew Petzold of Mr. Sliney's office had written an opinion on this matter back in September 1981; and he then read from an article in the Wall Street Journal concerning Cable TV. • It was determined. that tapes from past meetings would be listened to in order to ascertain whether "zoning in progress" would be involved in this matter, after whil~h the Commission could come to their conclusions. Commissioner Sullivan asked that the other Commission members listen to the tapes and try to bring this matter to a completion by next Tuesday. 82 23 (e) Letter dated January 7, 1982 from U. S. G. S, regarding recommendation for installation of three additional shallow wells Mrs. Roberts said that the U.S.G.S. had advised that the Town might need some more wells. She was informed that Boca Raton had an auger and after they drilled their wells, they might very well drill the wells for Highland Beach at no charge. 82 23 (f) Letter from LeConcorde Attorney dated January 29, 1982 Mr. Arthur C. Koski, Attorney for LeConcorde, addressed the Commission explaining the matter to them. He said that the Planning Commission had no objections to the fact that the • balconies on their project were overhanging the seawall. He claimed that the original plan had been approved by the Town as well as the State of Florida and his permit with the State expired on March 10th. 1 LJ Minutes Highland Beach Town Commission Workshop Meeting February 23, 1982 Page 7 of 8 Mr. Koski said that he and his clients were willing to do whatever the Town Commission wished and Mayor Horton summed it up by saying that the Commission will discuss this matter at the Regular Meeting with the idea of making a decision that would cover the location of the seawall on the coastal construction line with balconies overhanging. He said it would be the responsibility of the Commission to decide whether the location of the seawall is of more importance to the Town than the overhang of the balconies. Mr. Koski inquired whether he would have to appear before the Community Appearance Board again and Mrs. Roberts told him yes. 82.23 (q) C.D.M. (Engineers} • Mr. Victor Pujals of Camp, Dresser & McKee spoke to the Commission regarding the content of Trihalomethanes in the water in Town. He said that it is higher than the recommended level but not enough to cause too much concern. Victor submitted a report to the Commission entitled "General Information and Background on Trihalomethanes". Discussion then took place regarding the lime sludge pit at the Water Plant which is causing Tom Graham problems. Mayor Horton discussed this problem with Tom, offering suggestions as to how it could be handled. There is a lack of drying land at the Water Plant. 82.24 Request regarding cross-over boardwalk received from Mr. Sylvester dated February 3, 1982 Mr. Douglas Cowan, the representative from Beasley Landscaping, was in attendance and explained the landscape plans for the Sylvester property to the Commission. Discussion took place regarding the boardwalk structure - whether it would be considered temporary or permanent and the dune line. Mayor Horton said that the State does not want anything permanently built that goes east of the coastal construction line, and the Planning Commission will be asked to include items such as this in the Zoning Ordinance. • 82.26 Job Description for Maintenance Worker #1. She then spoke of the Safescape demonstration and wanted to know if any of the Commissioners would like to have it at their building. She said the qualifying dates for the Election will be March 5 through March 22, 1982. Vice Mayor Storm said that the Financial Advisory Board would be meeting Wednesday morning (February 24, 1982) at 10:00 A.M. Commissioner Sullivan told of the Open House for the new building being March 20, 1982 from 1:30 to 5:30 P.M. 'IYhere will be no speeches. Meeting ADJOURNED at 4:40 P.M. APPROVED: J.
