Regular Meeting
April 6, 1982 1.30 P M
Mayor Horton was in attendance but left due to illness. Vice Mayor
Storm called the Regular Meeting to order at 1:30 P.M. Those in
attendance were: Vice Mayor Harold C. Storm and Commissioners John J.
Basso, Mary Louise G. Blosser and Edward J. Sullivan. Also in attendance
were: Elaine W. Roberts, Town Manager; Thomas E. Sliney, Town Attorney;
Police Chief Kenneth Jones; Francis Hamzik, Building Official; and Jane
E. Barker, Town Clerk.
There were several Townspeople in the audience.

MOTION by Commissioner Blosser/Commissioner Sullivan that the minutes
be approved as written. A11 Commissioners voted Aye.
Public Requests and Comments
Mr. Phillip Liggett of the Monterey House addressed the Commission
explaining to them that the beach walkover belonging to the
Monterey House had been partially lost due to a recent storm. He
said that the residents were most anxious to replace this walk-
over and he showed their. plan to the Commission.
Mr. Liggett stated that the Town Commission would first have to
approve their plan; they would then seek approval from Tallahassee
and then return to the Town Commission for final apprw al.
MOTION by Commissioner Basso/Commissioner Sullivan that the plan as
submitted met with no objections from the Commission and they could
now submit their plan to Tallahassee. All Commissioners voted Aye.

Mr. John Waldron, of Regency Highland, then spoke to the
Commission, saying that Regency Highland was willing to try
a smaller antenna than originally requested to see if it would
serve as well as the taller one.
Discussion took place with Mr. Cormac Conahan, Attorney for
Highland Beach Cable TV, asking if the revised ordinance
concerning TV dishes would require another introduction and
re-advertising? He also talked about size limits for the
antenna and wind safety.
Reports - Town Commission
(a) Mayor Louis Y. Horton - In Mayor Norton's absence, Mrs.
Roberts brought up some questions
that he had wanted to ask. The first pertained to the proposed
Resolution petitioning the County for tax relief. Mrs. Roberts
said that she would be attending a meeting on April 13 with
fellow managers regarding this matter and would be very happy
• to ask any questions the Commission might have. Adoption of
this proposed Resolution will be postponed until a later meeting.
Mrs. Roberts said that the Mayor also wanted to discuss a
proposed Resolution concerning the Election that was to have
taken place on May 4th, but was now unnecessary.
Resolution No. 428 - A Resolution of the Town of Highland Beach,
Florida, declaring the Election to have been
held on the 4th day of May, 1982, to be unnecessary since the
only candidates who qualified are unopposed.
Commissioner Blosser read this Resolution in full.
MOTION by Commissioner Basso and seconded by Commissioner Sullivan
that the Resolution be adopted as read. All Commissioners voted Aye.
Resolution No. 429 - A Resolution of the Town of Highland Beach,
Florida, sponsoring Mayor Louis Y. Horton
for consideration to receive the Philip D. Lewis Statesman Award.
This proposed Resolution was read in full by Commissioner Basso.

investment earnings for the
month of March amounted to $7,049.21.

(e) Commissioner Edward J. Sullivan - Commissioner Sullivan
reported that-the Open
House on Saturday, March 20, 1982 had been very successful with
400 people in attendance. Commissioner Sullivan also said that
there is a man in Town by the name of Eddy Davis who is interested
in starting a Community Theatre if enough interest is shown and
space available.
S He also reported that he and Mrs. Roberts would be meeting with
a small group of mayors from the smaller communities against the
encroachment of Palm Beach Commission, and to see if other areas
could be found to cut back on taxes, i.e., school taxes.
Commissioner Blosser congratulated Commissioner Sullivan on the
Open House.
Reports - Boards and Agencies of the Town
(a) Board of Adjustment - Mrs. Roberts reported that the Board
of Adjustment had changed the night
of their meeting from Monday, April 19th to Tuesday, April 20th.
(b) Code Enforcement Board - This Board will be meeting on
Wednesday, April 21, 1982. They

Mrs. Leng then spoke of Trafalgar Development and the letter
Mrs. Roberts wrote to Mr. Alguire regarding his signs. Mrs.
Leng stated that the job of the Community Appearance Board is
to keep signs at a minimum in Town.
Mrs. Leng further stated that the CAB had approved the plans
for Highlands Place passive park and gave their approval for
a final C.O. for Beachwalk East and the Townhouses of Highland
Beach.
She then informed the Commission of their field trip to the
Sylvester property and read the minutes from their Special
Meeting immediately following.
She told the Commission that Mrs. Nita Martin, a member of their
Board, had missed three meetings and must be replaced. .Mrs.
Leng introduced Mr. Guy Galizia and recommended that he be
appointed as a Regular Member.
• (d) Financial Advisory Board - Vice Mayor Storm informed the
Commission that the main topic
this Board had been discussing was the water rate. He said
that a proposed ordinance would have a First Reading today
proposing to raise the rates from 464 a thousand gallons to
704 a thousand. Vice Mayor Storm also said that the sewer
rates would be discussed at a future Financial Advisory Board
meeting, as well as next year's budget.
Mrs. Roberts said that from now on, the Health Department would
be included in these reports and said that Dr. Harry Weiss, the
appointed Health Officer, would be making another inspection at
the Holiday Inn very shortly.
(e) Housing Board of Adjustment & Appeals - Mrs. Roberts said
the Board's
quarterly meeting would be held this month.
(f) Planning Commission - Mrs. Roberts said the Planning
Commission would be holding an advertise
Public Hearing on the Comprehensive Plan on Wednesday, April 14,

(g) Police Committee - Mr. Lowell Blum, Chairman of the Police
Committee, addressed the Commission,
saying that the Police Committee held a meeting on April 5, 1982
when it was decided that the Radar gun purchase should be held
in abeyance.
He also talked about the Police Committee, saying that apparently
there was nothing for them to do any more. In the year and a
half that they have been in operation, neither the Police Chief
nor the Town Commission have gone to this Committee for help.
This Committee would like to attend the Workshop Meeting of the
Town Commission on April 27, 1982.
Mr. Blum further recommended that the Town purchase a dune buggy
for patrolling the beach and also a small boat so that the
Intracoastal could be patrolled. Commissioner Basso felt that
several towns could go together and share the expense of such
a boat. Vice Mayor Storm said that this matter would be discussed
• at the Workshop Meeting of April 27th.
Reports - Town Attorney - Mr. Sliney reported that Mr. Tuthill,
Attorney for Massengill-Moore, indicated
to him that Mr. Sliney's letter of April 1, 1982, wherein the
Town requested several considerations, would be no problem.
Mrs. Leng asked some questions of Mr. Sliney which he answered
for her..
Reports - Town Manager - Mrs. Roberts said that she had received
correspondence from the Town Attorney's
office concerning Regency Highland, as well as new developments
on Lauderdale Contracting's suit.
Mrs. Roberts said that the Palm Beach County Municipal League
held a luncheon meeting in Lake Worth on March 25th' the Treasure
Coast Regional Planning Council will be meeting at Howard
Johnson's in Stuart on April 16th. She said she had met with
all the Boards, Hardrives, Southern Bell, Florida Power & Light,
the architect, the landscaper, Sandpiper, the sprinkler company,
and the alarm company. Mrs. Roberts said there was still a lot
• of work to be done here in Town Hall. She said she had met at
the Area Planning Board office regarding the Flood Insurance.

She commented on the correspondence received concerning the
Open House; from the legislators; the Water Management District;
the Del Trail Fire District; the U.S.G.S.; a letter from
Senator Lawton Chiles, regarding bridge openings, and the Del
Trail Rescue Log, as well as the Del Trail Audit Report.
She said she would be meeting with the Finance Officer of
Delray Beach the next day re sewer rates. Mrs. Roberts reported
that Betty Ulitsch was back at work for half days only for two
weeks.
She commented on the offer from Richard Raab, after which
Commissioner Blosser read the memo. Mr. Raab has offered
to have an Open House at Maravilla for the benefit of the
Library.
Mrs. Roberts spoke of meetings regarding the Dual Taxation, one
of which she and Mr. Sliney will attend in the Civic Center in
• Boynton Beach on April 13th.
Mrs. Roberts then spoke of complaints she had received concerning
the Post Office and discussion ensued on this matter.
Mrs. Roberts then reported on the following departments:
Building - Mrs. Roberts said this department is still busy.
They issued a temporary C.O. for the Carron House;
A final C.O. for The Townhouses of Highland Beach; a temporary
C.O. for Ocean Dunes; a final C.O. for Beachwalk East; a final
C.O. for the Jim Schubert house and a four-plex on the corner
of Bel Lido Drive and AlA.
Mrs. Roberts said the Building Department compiled a list of
C.O.'s given in 1981 and the dollar amount, in answer to a
request from Rebecca Walker, Property Appraiser. She also said
that Fran and Tony had attended a Seminar in Daytona Beach and
the eleventh revision memo of the building status in Town had
been distributed.
Finance and Internal Auditor - Mrs. Roberts reported on monies
received: including $516,000 in
taxes; $85.00 in delinquent taxes; $2,573. on investments;
$3,800. from the Road and Bridge Fund; $9,124. from Florida

Power & Light for January; $316. in court fines; $175 from
Code Enforcement Board violations; and from alcoholic beverages
$332.50, (Holiday Inn).
She stated that Maree Birkbeck had attended a Seminar in
Jacksonville.
Health - No report
Maintenance - Mrs. Roberts reported that Larry and Ted had
been extremely busy picking up bales of marijuana
which had floated in from the ocean this past week. They were
then picked up by the Sheriff's Department.
Police - Mrs. Roberts stated that the monthly report indicated
that this is the worst time of the year for crime and
Commissioner Basso commended the Police Department for their
excellent work.
• She said that Officers Oehl and Kirk had completed the courses
that they were taking.
Mrs. Roberts reported that the C.D.C, meeting this morning had
a long agenda - Highland Beach had 87 calls last year from
January 1 to March 28, 1981 and in the same period this year,
Highland Beach had 107 calls. She then reported on all the
subjects discussed at the C.D.C. meeting.
Mrs. Roberts continued by reading a memo from Police Chief
Kenneth Jones concerning dedication of duty by Sgt. Henry Maher
and Patrolman Harold Paul in their attempts to rescue Haitians
along the beach and along South Ocean Boulevard late Sunday
night and early Monday morning, March 28 and 29, 1982.
The Town Commission unanimously directed Mayor Horton to write
letters of commendation to Sgt. Maher and Patrolman Paul on
their behalf. Mrs. Roberts reported she had also sent memos
of commendation.
Mrs. Roberts then read a letter of commendation concerning
Officer Widelitz. She reported on a complaint call from Dr.
• Manley Boss concerning the marijuana on the beach.

Mrs. Roberts further stated that Chief Jones would be attending
a Hurricane Seminar in Orlando April 14th through April 16th.
Lt. Cecere and Patrolman Kirk attended a Civil Defense Seminar
in Boca Raton on March 12th.
Town Clerk - Mrs. Roberts said that the Town Clerk attended the
same seminar that Maree attended in Jacksonville
and Bette was still trying to work out a Defensive Driving
Course to be held in Town Hall.
Public Utilities and Works - Mrs. Roberts reported that water
consumption for March was 28,000,000
gallons. She said that Tom Graham, Water Plant Operator, had
inquired regarding raises for himself as well as his staff.
Mrs. Roberts stated that his contract expired September 30, 1981.
She then reported on the lime feed malfunction at the Water Plant.
Over the weekend, a line feed belt broke about midnight last
• Friday night. Mrs. Roberts also spoke of the noise from the
pump at the Water Plant which she will check out tonight.
Commissioner Sullivan then questioned Mrs. Roberts about the
lime feed malfunction at the Water Plant. Mrs. Roberts answered
Commissioner Sullivan. Commissioner Sullivan then reminded
Mrs. Roberts that he and Commissioner Basso had stated a year ago
that the Water Plant should be manned twenty-four hours a day.
Discussion took place. Vice Mayor Storm requested that Mrs.
Roberts have a complete report prepared for the Workshop Meeting
on April 27th in order to meet this problem "head on".
Mrs. Roberts reported on the sewer system and said that Lift
Station #2 was totally completed. Lift Station #4 is also
completed and work is proceeding on Lift Station #5. Carl
Howard's report indicated there was a problem with one of the
pumps at Lift Station #1 and Mrs. Roberts will try to get a
free pump due to all the problems this one has caused.
Mrs. Roberts continued by saying that Carl Howard had obtained
a price for an automatic chlorine tank switch in the amount of
$1,161. which Mrs. Roberts approved and it is now installed.

Mr. Lowell Blum, a resident of Regency Highland, spoke at some
length regarding this issue. Commissioner Sullivan questioned
Mr. Sliney as to whether a permit could be issued today; if so.
would it involve "zoning in progress"; and if that is the case.
would it have to be taken out of the zoning ordinance and put
into the Electrical Code? Mr. Sliney answered all of Commissioner
Sullivan's questions.
Mr. Cormac Conahan, Attorney for Highland Beach Cable TV, also
• addressed the Commission, as well as Mr. John Waldron, also
a resident of Regency Highland.
Several questions were asked by the Commissioners and discussion
went on for a long time. Mr. Harry Walker, Mr. M.H.W. Dent
and Mr. Lowell Blum spoke.
Eventually, the permit was given to Regency Highland for the
installation of the dish on their elevator tower.
At this point, Mr. Sliney read the above mentioned proposed
ordinance by Title only. First Reading.

Ordinances.
This proposed ordinance was read by Title only by Mrs. Roberts.

Items left over from the Workshop Meeting of March 30, 1982
Mrs. Roberts stated that several items had already been taken
care of and the next one would be the Sylvester boardwalk.
Mr. Doug Cowan, representing Thomas Beasley, Landscape
Architect, spoke to the Commission at this time. Mrs. Roberts
informed the Commission that the Community Appearance Board,
after making a field trip to the site and holding a Special
Meeting immediately thereafter, denied the pavilion and wanted
the boardwalk shortened.
Mr. Cowan thanked Mrs. Leng and the Community Appearance Board
• for their consideration and read the letter he had written to
Mr. Red Taylor, Department of Beaches and Shores. He explained
that there were handicapped people in the Sylvester family and
if he made the boardwalk shorter, it would be a barrier to a
wheel chair or a walking apparatus. The proposed viewing
pavilion would permit the members of the Sylvester family to
enjoy the ocean view and his planting plan would screen this
pavilion from sight.
Mr. Hamzik, Building Official, said that the DNR's recommen-
dation and his were that they liked to see a walk for the
handicapped and that the layout looked large but really
wasn't compared to the size of the property.
Mrs. Leng expressed her surprise at Mr. Hamzik's remarks and
said, too, that she felt sorry for the handicapped but felt
that the Town Commission should not be swayed by this plan.
Much more discussion took place after which the Town Commission
went along with the Community Appearance Board's decision and
asked Mr. Cowan to submit new plans for further discussion
at the Workshop meeting on~April 27, 1982.

Next item to be discussed, Mrs. Roberts said, was Highlands
Place. According to the 1979 edition of the Standard
Building Code, fifty feet (50') are required from the
furthest point of the apartment to the front entrance.
Mr. Kenneth Rubsamen, Architect for Highland Place,
addressed the Commission, which was now sitting as a
Variance Appeals Board. He explained that the Southern
Building Code, in a case like this, advised the petitioner
to go before the Appeals Board. In talking also with
Mr. Al deClercq, Fire Marshall, it was determined that
this entire building was sprinklered and it was so insig-
nificant, that they would have no objection to the
variance.
After discussion, the consensus of the Commission was that
• they had no objections to this and
A MOTION was made by Commissioner Basso and seconded by Commissioner
Blosser that the changes be allowed. All Commissioners voted Aye.
MOTION by Vice Mayor Storm and seconded by Commissioner Blosser that
the entire staff be given one day off in appreciation for their
faithful attendance during the trying period of reconstruction.
All Commissioners voted Aye. This time to be given upon approval
by the Town Manager.
