Workshop Meeting
April 27, 1982
1:30 P.M.
Tony Abbate, Building Inspector, took pictures of the Town Commission
prior to Mayor Horton's calling the meeting to order.
After the above, Mayor Horton called the meeting to order at approxi-
mately 1:40 P.M. Those in attendance were: Mayor Louis Y. Horton,
Vice Mayor Harold C. Storm and Commissioners John J. Basso, Mary
Louise G. Blosser and Edward J. Sullivan.
Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E.
Sliney, Town Attorney, Police Chief Kenneth Jones and Jane E. Barker,
Town Clerk.
There were several Townspeople in the audience.
82.1 Vacancies on Boards
• Mrs. Roberts stated that there were still the same two
vacancies as before - Alternate #2 for both the Board of
Adjustment and Community Appearance Board. She said that in
addition to that, Mrs. Ruth Wagy, a regular member on the
Planning Commission, had missed three meetings and would not
be able to continue serving on this Board. Mrs. Roberts has
the names of two people from Regency Highland which Commissioner
Basso submitted to her, which she will pass on to the Planning
Commission. Possibly, they will have an alternate move up
and then a second alternate can be chosen, Mrs. Roberts said.
She also stated that Nita Martin had also missed three
meetings of the Community Appearance Board, but would be
interested in serving on the Board as an alternate. Action
will be taken on this item at the Regular Meeting on May 4, 1982.
82.28 Proposed Ordinances
(a) Proposed Ordinance No. - An ordinance of the Town
of Highland Beach, Florida
entitled "Satellite Television Antenna System"; providing
definitions; providing regulations. (First Reading -
April 6, 1982)

Mayor Horton announced that Counsel had provided the
Commission with a proposed ordinance regarding this subject.
Commissioner Basso commented that he felt the Town Commission
did not have the power to grant the Community Appearance Board
authority to make recommendations as to the necessity and
appropriateness of a Satellite Television Antenna System.

• (b) Proposed Ordinance No. - An ordinance of the Town of
Highland Beach, Florida,
amending Chapter 7 entitled "Buildings", Section 7-21(b),
entitled "Condition of Road Signs, Pavement, Premises before
Occupancy". (Proposed First Reading - May 4, 1982)
Mrs. Roberts said this proposed ordinance had been omitted
from the Items left over from the Workshop Meeting of
March 30th and hopefully, this could have a First Reading
on May 4, 1982.
(c) Proposed Ordinance No. - An ordinance of the Town of
Highland Beach, Florida
amending Section 29-5, 29-10, 29-11 and 29-24, entitled "Water
System" of the Code of Ordinances. (First Reading - April 6,'82)
Mayor Horton stated that this proposed ordinance would arrange
for an increase in the cut-in fee as well as an increase in
the water rate. It had been suggested the water rate be
increased from 46~ per thousand gallons to 70~ per thousand
gallons.

Mayor Horton felt that this increase was a bit too high
and suggested 60~ or 65~. Discussion took place with Vice
Mayor Storm saying that by raising it to 70~, the Town
would be operating on good, safe ground.
Commissioner Basso agreed with Vice Mayor Storm saying that
the water plant should support itself and money should not
be taken out of the General Fund to run the plant.
Mr. Sliney suggested a few changes to the ordinance saying
that since the base rate of 70~ per thousand gallons would
be used, "rates, rentals, and fees" should be made singular.
Mayor Horton stated that this proposed ordinance would come
up for final reading on May 4, 1982.
82.40 Community Appearance Board Criteria - Proposed
Amendments
•
The Community Appearance Board had submitted an amendment
to their Criteria for Town Commission's approval and dis-
cussion took place regarding this.
The main items concerned TV Satellite dishes and dune walk-
overs. The entire Commission also talked with Mrs. Leng,
Chairman of the CAB, about the Community Appearance Board
controlling the landscaping on single family homes.
Mrs. Leng then spoke of real estate signs and the fact that
she, herself, had used a walker in order to see how wide a dune
walkover would have to be to accommodate a handicapped person.
Mr. M.H.W. Dent, A Town resident, spoke very strongly against.
the Community Appearance Board regulating landscaping for
single family homes. It was finally the consensus of the'
Commission that the Community Appearance Board's criteria
met with approval with the exception of the TV dishes and
single family homes.

82.8 Discussion regarding work by Gee & Jenson, includinct
proposed park.

Commissioner Basso spoke in favor of the proposed park
although he did say that it should be more of a garden
than a park. He also thought that it would be nice if
a Town resident donated a fountain for the garden.
Commissioner Blosser and Vice Mayor Storm were not in
favor of this expense at this time. Mrs. Leng also
expressed the thought that the "Greening of AlA" should
be taken care of first.
82.24 Request regarding cross-over boardwalk received
from Mr. Sylvester
Mr. Doug Cowan, landscape architect from Beasley Landscaping,
stated he was still trying to get approval for the boardwalk
at the Sylvester residence.
The feeling of the Commission was that they had requested
Mr. Cowan to re-submit plans after the Community Appearance
• Board made a field trip to the site and denied the pavilion
and asked that the boardwalk be shortened.
There was an apparent misunderstanding and Mr. Cowan explained
that in shortening the boardwalk, the slopes would be steeper
and a barrier for a handicapped person. Mayor Horton stated
that there must be some statistics through a professional
organization as to the maximum slope allowed for handicapped
persons. Mr. Cowan will provide this information for the
Commission.
Mr. Cowan stated that he could not understand how the
Community Appearance Board had the ability to deny or approve
plans for a single family home. Mrs. Roberts said that the
Town Commission had requested the CAB and Planning Commission
to review docks, dune walkovers, boardwalks, decks, etc.
Mrs. Roberts further stated that the Department of Natural
Resources would permit pavilions east of the coastal construc-
tion line as long as they were of a temporary nature.
82.7 Resolution to amend Resolution No. 413 rectardinQ Police

Mr. Lowell Blum, Chairman of the Police Committee, addressed
the Commission, stating that the entire Police Committee had
wanted to appear at this meeting, however, the other two
members could not be here. He stated that it appears to the
Police Committee that they do not have anything to do inasmuch
as the Police Chief never calls on this Committee for help,
nor does the Town Commission. He said it appears that this
Committee is being dissolved.
Mayor Horton advised Mr. Blum that the Police Committee had
never been intended to be anything more than an Advisory
Board, and discussion took place.
Mr. Blum had also given the Town Commission copies of the
proposed police budget for the fiscal year 1982-83. Vice
Mayor Storm expressed annoyance that the Financial Advisory
Board had not been given copies of the budget prior to
• presenting it to the Town Commission. Mrs. Roberts, likewise,
was annoyed that it had bypassed her since she had requested
it in the first place. Prolonged discussion took place.
Discussion also took place regarding annual physicals for
the members of the Police Department. Mr. Harry Walker,
the new Commissioner as of May 4, 1982, inquired as to
whether the employees are covered by a medical plan, and
was informed that they were.
82.11 Status of Massengill-Moore Issue
Mr. Sliney explained the letter he received today from
Mr. James Tuthill, Attorney for Massengill-Moore, wherein
they indicated they were ready to enter into a written
Agreement with the Town to resolve all of the issues between
the parties. Discussion took place regarding this matter
after which Mr. Sliney said he would draw up a counter-offer
to present to Mr. Tuthill.
At this point in time, it was decided to recess the Workshop
Meeting until Thursday, April 29, 1982 at 1:30 P.M.
• 82.43 Holiday Inn's request for tow-away signs.

Mrs. Roberts said Mr. Edward H. Palmer, General Manager of
the Holiday Inn, was in the audience and would like to be
heard regarding tow-away signs which he wished to erect on
their property.
Mr. Palmer explained that people who were not guests at the
Inn were using the Inn's parking lot and going to the beach.
He wanted the Town's permission to erect signs for the purpose
of having cars illegally parked towed away at their expense.
Mr. Palmer explained that he doesn't even have enough employee
parking because of this situation.
After discussion, Mr. Palmer was instructed to draw up a
sketch of the proposed sign and present it to the Town
Commission at the Regular Meeting on Tuesday, May 4, 1982.
This will be done.
