1982.05.04_TC_Minutes_Regular TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meeting of Town Commission Regular Meeting May 4.; 1982 1:30 P.M. Mayor Horton called the Regular Meeting of the Town Commission to order at 1:30 P.M. Those in attendance were: Mayor Louis Y. Hortd n, Vice Mayor Harold C. Storm and Commissioners John J. Basso, Mary Louise G. Blosser and Edward J. Sullivan. Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E. Sliney, Town Attorney; Police Chief Kenneth Jones and Jane E. Barker, Town Clerk. There were several people in the audience. Pledge of Allegiance Approval of Minutes March 30, 1982 April 6, 1982 April 15, 1982 • MOTION by Vice Mayor Storm/ be approved as written. So - Workshop Meeting - Regular Meeting - Special Meeting commissioner Blosser that the minutes ordered, Mayor Horton said. Public Requests and Comments Mr. M.H.W. Dent, a Town resident, addressed the Commission regarding the water plant and the entrance to Bel Lido. The Oath of Office was then given to Mary Louise G. Blosser, the new Vice Mayor, and Harry Walker, the new Commissioner, by the Town Clerk. The former Vice Mayor Storm then spoke and gave a brief history of his life, after which he was presented with gifts. Mayor Horton read Resolution No. 430 which honored Vice Mayor Storm for his service to the Town, and presented it to him. The new officials then took their seats. _Reports - Town Commission • (a) Mayor Louis Y. Horton - No report (b) Vice Mayor Mary Louise G. Sullivan - No report (e) Commissioner Harry Walker - Commissioner Walker said that he was pleased to be sitting on the Commission and looked forward to serving. Reports - Boards and. Agencies of the Town (a) Board of Adjustment - Mrs. Roberts said that this Board would be meeting May 5, 1982 at 7:30 P.M. and the Commission had been given copies of all the material for this Special Meeting. They still need an Alternate #2 on this Board. (b) Code Enforcement Board - This Board will be meeting on May 19, 1982 at 9:30 A.M. n LJ (c) Community Appearance Board - Mrs. Amelie Leng, Chairman of the Community Appearance Board, first gave a verbal bouquet to former Vice Mayor Storm, thanking him for all he had accomplished for the Community Appearance Board. Mrs. Leng then said that she wished to discuss the proposed criteria amendments, and review of single family homes. Mayor Horton informed Mrs. Leng that Town Counsel was looking into this matter in depth and it would be discussed further at the next workshop Meeting on May 25, 1982. Mrs. Doris Rome, also a member of this Board, talked about the Greening of AlA and said that twenty more trees would be planted. They would not ask for any more money from the Town at this time. She then spoke of the plaque they wanted to put in the new building with names on of people who had donated $250.00 or more to the Greening of AlA. Discussion took place regarding this as to the size and where it should be located. Mrs. Roberts said that the Community Appearance Board • had recommended that Mrs. Nita Martin be appointed as Minutes of Highland Beach Town Commission • Regular Meeting May 4, 1982 Page 3 of 11 Alternate No. 2 to this Board, and A MOTION was made by Commissioner Basso and seconded by Vice Mayor Blosser that Mrs. Nita Martin be appointed as Alternate #2 to the Community Appearance Board for a term of one year, ending May 1983. All Commissioners voted Aye. (d) Financial Advisory Board - Mr. Storm spoke of the meeting the Financial Advisory Board held on May 3, 1982. (e) Health Officer - No report. (f) Housing Board of Adjustment & Appeals - Mrs. Roberts reported that this Board had met in March and their next meeting would be in June. • (g) Planning Commission the Commission that well on the Compreh~ that a panel of two look at landscaping - Dr. the their ~nsive or the plans Gil Weiss, Vice ©hairman of Planning Commission, informed Board was proceeding very Plan. He also recommended ree landscape architects re the site plan review. Discussion took place. Mrs. Roberts then told the Commission that Mrs. Ruth Wagy's resignation had been received and this was accepted with regrets by the entire Commission. (h) Police Committee - Mr. Lowell Blum, Chairman of the Police Committee, then spoke, saying he was glad that Mrs. Roberts and the Police Chief had been in attendance at their meeting on Monday, May 3, 1982 at 10:00 A.M. Reports - Town Attorney - Mr. Sliney said that it had been his pleasure working with former Vice Mayor Storm. He then referred to the ordinance regarding parking of commercial vehicles or vans and said that Attorney • Lew Petzold of their office had recommended leaving the ordinance as it was for the present time. Mr. Sliney said Minutes of Highland Beach Town Commission • Regular Meeting May 4, 1982 Page 4 of 11 that he is working on the counter-agreement for Massengill- Moore and he has heard nothing further on the Sanibel case. He spoke of the proposed TV Antenna ordinance, saying that it could be amended and that Lew Petzold was working on the Lauderdale Contracting case. Reports - Town Manager - Mrs. Roberts spoke about her pleasure working with former Vice Mayor Storm. She reported that the Palm Beach County Municipal League Board meeting was held on April 22, 1982 and their regular meeting was held on April 29, 1982 which Mayor Horton and Chief Jones attended. She said the Treasure Coast Regional Planning Council will be meeting in Stuart. Mrs. Roberts said that she had met with all of the Boards; C.D.C.; Developers and Representatives; Delray Beach Fire Department representatives; Delray Beach representatives • regarding sewer rates; she attended a meeting on dual taxation in Boynton Beach with Tom Sliney; she met with DOT represen- tatives; Sandpiper; Hardrives; CDM; Jim Zumwalt; and Earl Harvel. Correspondence - to and from the Municipal League regarding the Sanibel case; to and from the Legislature regarding the Public Deposit Program and from the State of Florida, Depart- ment of Labor regarding the inspection of the Municipal facilities. Mrs. Roberts then told of the maps and exhibit from the DOT; studies by Del Trail and the Florida Public Utilities Co., the Fire Study Committee and the Delray Beach Sewer rate proposal. She said that Betty Ulitsch was back to work full time; and spoke of the Open House at Maravilla for the Library, the Post Office remuneration; the Greening Committee and said that the Turtle Program would hold their first meeting of the season on May 12, 1982 at 2:00 P.M. Mrs. Roberts then reported on the following departments: Building - This department issued a temporary C.O. for the Ceprano residence; a final C.O. to the Schubert residence and Minutes of Highland Beach Town Commission • Regular Meeting May 4, 1982 Page 5 of 11 the Masciarells four-plex, as well as the Coram tri-.plea. Mrs. Roberts told of the inspections she had made with Tony Abbate. Finance and Internal Auditor - Mrs. Roberts reported that monies collected included: $515,475 in taxes; $3,975 in Road and Bridge money; $8,675 from Florida Power & Light through February 1982; $1,029 from the Court through March 1982; and $8,433 from investment earnings. Mrs. Roberts further reported that the Town's portion of the sales tax increase will amount to $62,913.00 and will be received after the first of October. Health - No report. Maintenance - Mrs. Roberts said that the Maintenance men moved the furniture in the Town Hall into new offices. • Police - Mrs. Roberts said that all the Commissioners had received their copy of the monthly Police Report. Chief Jones explained about the accident that happened in Town and that four people were taken to the hospital but were released. Mrs. Roberts said that Officer Oehl's course on "Operation and Leadership"will be completed on May 6, 1982. Mrs. Roberts continued by saying that Chief Jones furnished her with a very complete report on the "Hurricane Seminar" which he attended in Orlando. She said that she had attended the CDC meeting held this morning and the budget had been discussed. She also gave the I~reakdown of calls received. Town Clerk - Everything is fine in this department, Mrs. Roberts said. Public Utilities and Works - Mrs. Roberts said the water consumption for April was raw water - 27,435,000 and treated water - 29,092,000. For March it was - raw water 27,903,000 and 27,274,000 for treated water. She told about the U.S.G.S. report and said that Strock Engineering has completed their last shooting of the elevated • water tower. The settlement of the tower is not significant to warrant any work at the present time. Minutes of Highland Beach Town Commission • Regular Meeting May 4, 1982 Page 6 of 11 Mrs. Roberts said that Mike Coppola had informed her the water tower had rust spots on it and she has written a letter to Mr. Moyer, the man who painted it two years ago. Mrs. Roberts then told of the reports from Tom Graham, Water Plant Operator, and gave the data regarding the proposed water level gauge. Sewer - Mrs. Roberts told of the inspections at the Lift Stations and that Carl Howard's son had to take two pumps to Orlando to be repaired. She requested approval from the Town Commission for this expense. Mrs. Roberts said she had met with Mr. Gordon Tiffany, City Manager of Delray Beach, regarding sewer rate increases and Russell & Axon advised her they would like to meet with her re sewer main inspections. • Zoning - Mrs. Roberts stated that she is in contact with Gee & Jenson just about every day regarding the land use map and things are progressing nicely. She said that she was disappointed that the Planning Commission had not set their second public hearing as yet. Mrs. Roberts said she was taking bids for painting the inside of the old building inasmuch as it has not been painted since it was built. Commissioner Basso talked about the bike path in front of Carron House and said that in front of Clarendon, the bike path has been completely destroyed. He said the developer should restore it before a final C.O. is given. Proposed Ordinances (a) Proposed Ordinance No. 440 - An ordinance of the Town of Highland Beach, Florida, entitled "Satellite Television Antenna System", providing definitions; providing regulations. First reading April 6, 1982. This proposed ordinance was read in full by the Town Clerk. Minutes of Highland Beach Town Commission • Regular Meeting May 4, 1982 Page 7 of 11 Discussion took place regarding this ordinance as to whether these antennae should be placed on the roof or should they be on the ground. The safety feature was also brought up. The subject of how many dishes would be needed for a complex was also mentioned. Several changes were made in this proposed ordinance which Mr. Sliney will finalize. After which A MOTION was made by Vice Mayor Blosser and seconded by Commissioner Walker that this ordinance be adopted as amended. In polling the Commission, the vote was as follows: Commissioner Basso - Aye; Commissioner Walker - Aye; Mayor Horton - Aye; Vice Mayor Blosser - Aye; and Commissioner Sullivan - Aye. Maintenance of these antennae will be discussed further at the next Workshop Meeting. For the present, this ordinance will be placed in the electrical chapter of the Code of • Ordinances. (b) Proposed Ordinance No. - An ordinance of the Town of Highland Beach, Florida, amending Chapter 7., entitled "Buildings", Section 7-21(b) entitled "Condition of Road Signs, Pavement, Premises Before Occupancy". This proposed ordinance was read by title only by Mayor Horton - First Reading. (c) Proposed Ordinance No. 439 - An Ordinance of the Town of Highland Beach, Florida, amending Section 29-5, 29-10,29-11 and 29-24, entitled "Water System" of the Code of Ordinances. This proposed ordinance was read in full by the Town Clerk. Betty Jean Stewart, a Town resident, questioned the 30 days delinquent time and was informed by Mrs. Roberts that this is very seldom enforced. Much discussion took place regarding the rate being changed from 464 to 704 per thousand gallons. Commissioner Walker felt that a charge should be set that would • not necessitate changing in a year's time. Mayor Horton stated Minutes of Highland Beach Town Commission • Regular Meeting May 4, 1982 Page 8 of 11 that he strongly felt 654 would suffice and it would not be right for the water users in Town to subsidize other Town expenses. Mayor Horton made a MOTION that the ordinance be amended to read 654 increase instead of 704. MOTION died for lack of a second. MOTION by Commissioner Basso/Commissioner Walker that the proposed ordinance as read be adopted. In polling the Commission, the vote was as follows: Commissioner Sullivan - Aye; Vice Mayor Blosser - Aye; Mayor Horton - Nay; Commissioner Walker - Aye and Commissioner Basso - Aye. MOTION passed four to one. Items Left Over from the Workshop Meeting of April 27 and April 29, 1982. Request for Boardwalk for Sylvester • Discussion took place regarding the steepness of a slope for handicapped persons - Federal guidelines say it cannot be any more than one inch for a foot. Mrs. Roberts read the letter received from Mr. Douglas Cowan, landscape architect, which she will answer. She also said that she had a member of her staff make a verbatim record of the last two meetings attended by Mr. Cowan concerning this. Holiday Inn request Mrs. Roberts informed the Commission that Mr. Palmer will appear at the Workshop Meeting on May 25, 1982 with a sketch of the sign he would like. Financial Advisory Board Mayor Horton read Resolution No. 431 - A Resolution of the Town of Highland Beach, Florida, establishing a Financial Advisory Board. MOTION by Commissioner Basso/Commissioner Walker that this Resolution be adopted as read. All Commissioners voted Aye. • Three members were chosen for this Board - namely, Harold C. Storm, Jane Rayner and Robert E. Slater. Minutes of Highland Beach • Town Commission Regular Meeting May 4, 1982 Page 9 of 11 MOTION by Commissioner Basso/Commissioner Sullivan that the above three people be appointed to the Financial Advisory Board. All Commissioners voted Aye. Resolution No. 432 - A Resolution of the Town Commission of the Town of Highland Beach, Florida petitioning the Board of County Commissioners of Palm Beach County pursuant to Section 126.01 (6) (a) and (7) Florida Statutes (1979), to provide relief from taxes unlawfully levied upon property situate within the Town of Highland Beach to finance services rendered specially for the benefit of the property or residents in unincorporated areas of Palm Beach County by remitting to the Town of Highland Beach the identified cost of such services levied and collected during the 1977-78, 1978-79, 1979-80, 1980-81 and 1981-82 fiscal years, and by financing such services from revenues derived specifically from or on behalf of a municipal service taxing unit, special district, unincorporated area, service area or program area, • or by any other lawful method, during the 1981-82 fiscal year: and for other purposes. Resoltuion No. 432 was read in full by Mrs. Roberts. Several changes were made as Mrs. Roberts read it. MOTION by Commissioner Basso/Commissioner Sullivan that this Resolution be adopted as read with the corrections indicated. All Commissioners voted Aye. Mrs. Roberts requested the Commissioners to kindly sign new signature cards for the bank. Mrs. Roberts then asked the Commission their wishes regarding new stationery with the new names. The consensus was to order new stationery. Mrs. Roberts sought approval for lateral file cabinets - low bid was $2,022.15 for three cabinets from Halsey Griffith. MOTION by Commissioner Walker/Mayor Horton that these cabinets be purchased. All Commissioners voted Aye. • Minutes of Highland Beach Town Commission • Regular Meeting May 4, 1982 Page 10 of 11 The low bid for vertical blinds, Mrs. Roberts said, was $753.00 from Sultans. MOTION by Commissioner Basso/Mayor Horton that this purchase be approved. All Commissioners voted Aye. Mrs. Roberts then sought approval for raising the bike path at the south exit where it meets AlA. Hardrives' bid was $1, 175. MOTION by Commissioner Basso/Commissioner Sullivan that this be approved. All Commissioners voted Aye. Mrs. Roberts then spoke of the coming meeting with the Boca Raton City Council on May 27, 1982 at 3:30 P.M. in the Highland Beach Town Hall. Items to be discussed will be the proposed water interconnection for sale of water, patrolling the Intracoastal, and possible contractural fire service. • It was decided to hold a Workshop Meeting of the Town Commission immediately proceding at 2:30 P.M. Mrs. Roberts then requested approval from the Commission for an upper limit of $5,000.00 to enter into the dual taxation suit. MOTION by C ommissioner Basso and seconded by Commissioner Sullivan that an upper limit of $5,000.00 be approved for joining in the dual taxation suit. All Commissioners voted Aye. Mrs. Roberts said that the last item was appointing some one to the "208" Committee. Mr. Harold Storm gave a brief summary of the work the "208" Committee does and said the "road ahead for water was a serious one". He urged that some one attend these meetings. A delegate will be discussed at the Workshop Meeting on May 25, 1982. Mrs. Roberts then mentioned that a Commissioner should be appointed to the Board of Trustees - Retirement Paln. MOTION by Commissioner Sullivan/Commissioner Basso that the bills be approved for payment. All Commiss~.oners voted Aye.
