• Minutes of Meeting of Town Commission
Special Meeting
July 13, 1982 2:00 P.M.
Mayor Horton called the Special Meeting to order at 2:00 P.M. Those
in attendance were: Mayor Louis Y. Horton, Vice Mayor Mary Louise G.
Blosser and Commissioners John J. Basso, Edward J. Sullivan and Harry
Walker. Also in attendance were Elaine W. Roberts, Town Manager;
Town Attorney Thomas E. Sliney; Police Chief Kenneth Jones and Jane E.
Barker. Town Clerk.
Mrs. Roberts reported that she had received a telephone call at
11: 00 P.M. the previous night from a Seagate resident, complaining
about the noisy pump that that was running at the Coronado site.
She said she called the Police Sergeant, to arrange for turning
the pump off. Further checking this morning revealed that it was
necessary for this pump to run a continuous 48 hours in order to
clear all the water out of a pit for their electrical concrete
slab.

Commissioner Blosser indicated that there was not "much choice"
and she would put a notice on the Bulletin Boards at Seagate to
so inform the residents. Mrs. Roberts said she would notify the
Condo Manager.
Commissioner Walker reported that assessed valuation figures had
been received from the Property Appraiser's office so that work
can now proceed on Draft No. 1 of the budget for the fiscal year
1982-83. Mrs. Roberts informed the Commission that they would
have 30 days to set their millage rate and so inform the Property
Appraiser's office. This would be August 11, 1982. Property
assessments were $342.8 million this year as compared to $176.3
million last year.

Mayor Horton then announced that the purpose of the Special Meeting
was to discuss the report received from Attorney John Randolph hired
Mrs. Roberts read Attorney Randolph's report for the record.

Mayor Horton asked Town Counsel regarding zoning in progress
which Mr. Sliney answered for him. Much discussion took
place regarding restricting an owner's ability to use his
own property as he saw fit; density restrictions; zoning
in progress; emergency moratoriums; and putting a property
owner "on hold" according to the guidelines set down by the
Court .
Ex-Commissioner Peter J. Genovese addressed the Commission
saying that he took exception to Mr. Randolph's statement
and pled for consideration of the Milani property.
More discussion ensued concerning the Gee & Jenson report,
and was zoning in progress in effect since they were hired?
Mr. Sliney stated that he did not think the Sanibel case
• could be ignored.
Commissioner Basso felt that the emergency moratorium ordinance,
which expires at the end of the month, should be renewed, as
the Commission has done in the past. Normal procedure would
take 22 months to adopt a regular zoning ordinance.
The Commission also talked about the Moratorium Variance
Appeals Board, which should now possibly be renamed the Zoning
In Progress Appeals Board.
In summary, Mayor Horton said, that it was the consensus that
the zoning in progress had not been stricken down and the
Building Official should be notified that there is no change
in his manner of handling requests for permits. If there are
any questions in his mind, the Mayor said, they will be
resolved at the Special Meeting to be held on Tuesday, July 20,
1982.

that the meeting be ADJOURNED. Time 3:15 P.M.
