1982.09.14_TC_Minutes_Special (2)TOWN OF HIGHLAND BEACH, FLORIDA • TOWN COMMISSION - SPECIAL MEETING September 14, 1982 1:30 P.M. Mayor Horton called the meeting to order at 1:30 P.M. Those in attendance were Mayor Louis Y. Horton and Commissioners John J. Basso, Edward J. Sullivan and Harry Walker. Also in attendance were Elaine W. Roberts, Town Manager; Thomas Sliney, Town Attorney; and Rita Ebersole, Secretary. Vice Mayor Mary Louise G. Blosser was absent. The first item for discussion was a proposed Variance Resolution. Proposed Resolution - A Resolution of the Town Commission of the Town of Highland Beach, Florida providing for the processing, hearing and administrative disposi- tion of real estate developments pending on the effective date of Ordinance No. 443, providing for a moratorium variance, establishing the Town Commission of the Town of Highland Beach as a Moratorium Variance Board, establishing a procedure for variance applications and establishing the criteria under which variances may be granted and building permits issued. • This Resolution was submitted by Counsel and read in full with proposed changes suggested by Commissioner Walker. Commissioner Basso requested that in Section 5. Criteria for Issuing Variances - wording in sentence 2 "in the process of" remain as is rather than changed to "under consideration for." The same phrase to remain as is in Section 5(a). Commissioner Sullivan, seconded by Commissioner Basso moved to accept this Resolution as read and corrected. All voted Aye. The second item on the agenda was a Petition from Attorney James re Lots 4 and 5 East. Presentations and comments were made by Attorney James, Dr. Orman and Digby Bridges,, Mrs. Leng, Mrs. Rome, Dr. Weiss, Mr. Wernecke, Kurt Kettlehut, Landscaping Architect for the project. All expressed their opinions. Mayor Horton summarized by saying it was his thought that if an elected body (Town Commission) had passed a Zoning Ordinance, it cannot be negated by an Advisory Board (CAB). However, Town of Highland Beach Town Commission • Special Meeting 9/14/82 Page 2 of 3 Commissioner Basso felt the CAB had the authority to deny a petition according to their criteria on aesthetics. After a great deal of discussion, the Commission decided to render their decision on this matter at a Special Meeting to be held on September 21, 1982 at 4:30 P.M. The last item on the agenda was The Road and Bridge Fund Lawsuit information. Tom Sliney advised the Town Commission that the Lead Counsel would protect the Town's interest and he felt it unnecessary to have the Town Attorney represented. MOTION by Commissioner Basso, seconded by Commissioner Sullivan to approve the expenditure of $6,000 in the Road and Bridge Fund law- suit. All voted Aye. Mrs. Roberts announced that she had met with Tom Graham and • told him of the Town Commission's decision to start a Utilities Department. Tom will work at the Water Plant to the week of Oct. 4th at which time he will receive one month severence pay. William Joseph Moss (Joe) will start work September 20th and Vernon Brown, Utility Director, will start October 4th. The salary scale for the Utility employees is subject to the Town Commission approval. The landscaping has been started at the Plant, Mrs. Roberts reported. Regarding the television interference mentioned at the last meeting, Mrs. Roberts contacted Transitronics at a cost of less than $200. They found the power output was not normal and corrected situation. They recommend an annual checkup. Mrs. Roberts said Betty Weatherford, President of the Library was unable to establish credit with Halsey & Griffith for supplies without a sponsor because the Corporation is less than 5 years old. The Town Commission decided the Town could sponsor this venture. Mrs. Roberts had drafted a letter to Boca Hi advising that only • new sales can be handled from their office in Highland Beach. Revisions were discussed. Town of Highland Beach Town Commission • Special Meeting 9/14/82 Page 3 of 3 Commissioner Basso said the DOT had not been cutting the grass on AlA and suggested we buy the necessary equipment and do the work ourselves. Costs and labor will be investigated. Commissioner Basso expressed displeasure concerning trash and garbage especially around the Beekman property and south of Bel Lido. Mrs. Roberts suggested drawing up an Ordinance stating that trash could not be placed curbside before a certain time Friday proceeding the Saturday trash pick up. The Town would then have the power to issue citations. MOTION by Commissioner Basso, seconded by Commissioner Sullivan to Adjourn the meeting. Time 3:50 P.M. All agreed. APPROVED: is Y.
