Minutes of Meeting of Town Commission
Special Meeting
October 19, 1982 10:30 A.M.
A Special Meeting was called by the Town Commission of Highland Beach for
Tuesday, October 19, 1982 at 10:30 A.M. Subjects on the Agenda were:
1. Town Clerk's Pending Retirement and 2. Lift Station Number 1, Pump
Number 1--purchase of a new one or repair of existing one. All Commis-
sioners were present, Elaine W. Roberts, the Town Manager; the Town Attorney
and Bernice Smith, Recording Secretary. Several people were in the audi-
ence.
Mayor Horton reported on the ad hoc meeting regarding our position with
Delray Beach on the sewage charges. The problem was discussed with a
possible solution agreed upon. He recommended to the Town Commission
that Mr. Slater, as the Town's representative, attend the Delray Beach
Council Meeting tonight and suggest that this matter be handled through
the arbitration process rather than going into court. The arbitration
process would be equitable and the person doing the arbitration would be
more qualified than any court. A consensus of the Commission was that
Mr. Slater proceed as suggested by the ad hoc committee. Due to personal
reasons, Mayor Horton had to leave the meeting at 10:40. Vice Mayor
Blosser then conducted the rest of the meeting. Commissioner Basso sug-
gested that the meeting be postponed. until all of the Commissioners
would be present, however, Commissioner Walker suggested that the meeting
continue following the agenda. Mayor Horton did state that his personal
opinion was that Commissioner Sullivan's letter of August 25, 1982 be used
as a basis for retirement severance, although more back up could be pro-
vided. Mrs. Roberts reported that the actual retirement figures were
given to the Commission this morning, prepared by the Finance Department.
Commissioner Basso felt that before a determination is made as to what
should be done, he would like to know more about the Town Clerk's length
of service, if she requested this retirement, is this due to health
reasons, and are errors in her work caused by illness. Vice Mayor Blosser
noted receiving nothing stating that Jane Barker wishes to retire. Nor,
Commissioner Sullivan remarked was there anything from the Town Manager
recommending she be fired. Employees are hired by the Town Manager,
but the Town Clerk is appointed by the Town Commission. Commissioner
Walker stated that he understands that the Town Clerk's husband. said
that her Physician has made the statement that she is totally disabled.

He has also been in touch with Mr. Ron Bonner, Manager of the Claims
Department of Florida Municipal Health Trust, to ask what papers he needs
to process a disability claim. Mr. Bonner said the Company will accept
the opinion of attending Physician and the Town Commission. The opinion
of an independent Physician will not be required. He also asked them
how it would affect our premium rates, but was told that the rates are
not dependent on our experience solely, but on pooled claims. Accord-
ing to Commissioner Sullivan's memo, Mrs. Barker could receive a dis-
ability pension, with the Town paying the remainder to equal her full
salary for six months until April 21, 1983, when she is eligible for
Social Security.
The consensus was that before further action was taken, a letter should
be received from her Physician stating that she is unable to perform
her duties, and a letter from Mrs. Barker and also from her husband,
(although this letter could be signed jointly), that she wanted to re-
tire. Then they could go along with the solution as presented in Com-
missioner Sullivan's memo of August 25, 1982. A determination will then
be made at a Special Meeting.
Item 2 on the Agenda was whether or not to have the number one pump at
Lift Station Number One repaired or to purchase a new one. Mrs. Roberts
gave the Commission a history of the problems with this pump, and that
although there has been much correspondence with SAS, they have refused
to replace the pump at no charge. The repair of the pump could cost
$4,700, a new pump would be $8,600. After discussion, a motion was made
by Commissioner Basso, seconded by Commissioner Sullivan to purchase a
new pump for $8,600. All voted aye. Mrs. Roberts will request some
credit for the old pump.
Mrs. Roberts then reported that she had received adjusted gross assess-
ment figures, $340,479,552. There is an option to change the millage
rate within the next three days and notify the Property Appraiser's Of-
fice. The opinion of the Commission was to forget it.
Mrs. Roberts also reported that Officer Shoeman, who was to start working
for the Town this week, had written to the Chief stating that he will
not be coming to work for the Town.

A motion to adjourn the meeting at 11:15 A.M. was made by Commissioner
Walker, seconded by Commissioner Sullivan.
