MEMORANDUM DATE: December 10, 2009 TO: Michael Desorcy, Building Official FROM: Valerie Oakes, Deputy Town Clerk RE: Boat Lift Application - 2540 S. Ocean Blvd. At the Regular Planning Board meeting, the Town Attorney gave a legal opinion regarding the application that under the Town of Highland Beach Code of Ordinances section 30-68(h)(2), a public hearing is required for boat lifts on a canal; however, there is no such requirement that a public hearing be held for boat lifts on the Intracoastal Waterway. Both Federal and State Agencies have the jurisdiction for applications on the Intracoastal Waterway. Jerry Whitton of Broward Piling presented the application and stated that permits have been from the Florida Department of Environment and the Army Corps of Engineers. There are no environmental impacts, nor do they have any navigational issues. The Board reviewed the application and noted that the preliminary review from the Building Department states that the plans meet the Town of Highland Beach Zoning Code. Since the Planning Board does not have jurisdiction, the Board transmits the application back to the Building Department to finalize the application and monitor the construction of the boat lift. Supplemental district regulations. (h) Dolphins, freestanding pilings, boat lifts, and moorings: (1) Installation. In order to be installed, dolphins, freestanding pilings, boat lifts, and moorings shall comply with all standards listed below: a. The installation is approved by the planning board at an advertised public hearing. b. The mooring facilities will be located in a canal or waterway at least eighty (80) feet in width. C. The mooring facilities will not create a hazardous interference with navigation, endanger life or property, or deny the public reasonable visual access to public waterways. d. Construction of all mooring facilities shall require a building permit. (2) Public notice. In addition to the requirements of section 30-45, written notice must be provided by certified mail, return receipt requested, to owners of property abutting the canal and located within one thousand (1,000) feet, as measured from both property lines along the canal bank, of the property in question. Written notice shall be provided by the applicant at the applicant's expense. (3) Documentation. The building official or planning board may request evidence, prepared by a recognized marine expert, demonstrating the proposed mooring facilities will not be a hazard to navigation and will not deny reasonable visual access to public waterways. (4) Adjacent property. Installation of the mooring facilities shall not adversely affect the enjoyment or value of adjacent property. (5) Navigation. Installation of such mooring facilities shall not infringe upon standard navigational practices that are or may be used by abutting property owners. (6) Floating docks. The project is located in the Intracoastal Waterway, at 2540 South Ocean Boulevard (Section 28, Township 46, Range 43), Highland Beach, FL. Coordinates: 26.4325/-80.0672. Your project, as depicted on the enclosed drawings, is authorized by Regional General Permit (GP) SAJ-17. This authorization is valid until November 7, 2011. Please access the Corps' Regulatory webpage to view the special and general conditions for SAJ-17, which apply specifically to this authorization. The drawings shall include the X -Y coordinates of the most waterward point of the structure and a point at the mean high water line (MHWL) or the face of the bulkhead/seawall, if present. The drawings shall include: (1) The dimensions of the structure, (2) depth of water (at mean low water) at the waterward end of the structure, and (3) the distance from the waterward end of the structure to the near bottom edge of the channel. b. List any deviations between the work authorized by this permit and the work as constructed. In the event that the completed work deviates, in any manner, from the authorized work, describe on the As -Built Certification Form the deviations between the work authorized by this permit and the work as constructed. Clearly indicate on the as -built drawings any deviations that have been listed. Please note that the depiction and/or description of any deviations on the drawings and/or As - Built Certification Form does not constitute approval of any deviations by the U.S. Army Corps of Engineers. C. The Department of the Army Permit number. d. Include pre- and post -construction aerial photographs of the project site, if available. 2. The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, __--or- other --alteration, of --the- structures_ or- work --herein --authorized-; or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.-. 3. The applicant shall remove all six existing dolphin piles that are waterward of the existing dock. 4. Prior to the initiation of any work authorized by this permit, floating turbidity curtains with weighted skirts shall be -3 - placed around the work area. Turbidity curtains must completely enclose all active in -water construction areas and shall not be removed until turbidity levels within the enclosed area return to background levels outside the curtain. Turbidity curtains must be adequate in length to control turbidity, yet of such length to preclude scouring of resources whether weighted or staked in place. Curtains shall be monitored at low tide to ensure that no resource impacts occur as a result of use. S. Manatee Conditions: The Permittee shall comply with the "Standard Manatee Conditions for In -Water Work - July 2005", attached to this permit. 6. Sea Turtle and Smalltooth Sawfish Conditions: The Permittee shall comply with National Marine Fisheries Service's "Sea Turtle and Smalltooth Sawfish Construction Conditions" dated March 23, 2006, attached to this permit. 7. Consent to Easement: A portion of the proposed work is located within the Federal right-of-way for the Intracoastal Waterway and requires a Department of the Army Consent to Easement. By copy of this permit, the proposal is being forwarded to the Corps Real Estate Division for action on the Consent to Easement. Prior to commencement of construction the Permittee shall provide written verification to the Corps that the Consent to Easement has been approved. Failure to obtain the Consent to Easement invalidates this authorization. Generally, authorization of activities that have commenced or are under contract to commence in reliance of the GP will remain -in" effect-- provided---the--activity- -is -completed-with-in -12 months---o----- the date a GP expired.or was revoked. In the event you have not completed construction of your project within the specified time limit, a separate application or re -verification will likely be required. This letter of authorization does not obviate the necessity to obtain any other Federal, State, or local permits, which may be required. In Florida, projects qualifying for this GP must be authorized under Part IV of Chapter 373 by the Department of Environmental Protection, a water management district under §. 373.069, F.S., or a local government with delegated authority under §. 373.441, F.S. and receive Water Quality Certification (WQC) and Coastal Zone Consistency Concurrence (CZCC) or waiver thereof, as well as any authorizations required for the use of sovereign submerged lands that must be obtained as part of the associated WQC or CZCC. 'All construction personnel are responsible for observing water -related activities for the presence of these species. b. The permittee shall advise all construction personnel that there are civil and criminal penalties for harming, harassing, or killing sea turtles or smalltooth sawfish, which are protected under the Endangered Species Act of 1973. c. Siltation barriers shall be made of material in which a sea turtle or smalltooth sawfish cannot become entangled, be properly secured, and be regularly monitored to avoid protected species entrapment. Barriers may not block sea turtle or smalltooth sawfish entry to or exit from designated critical habitat without prior agreement from the National Marine Fisheries Service's Protected Resources Division, St. Petersburg, Florida. d. All vessels associated with the construction project shall operate at "no wake/idle"speeds at all times while in the construction area and while in water depths where the draft of the vessel provides less than a four -foot clearance from the bottom. All vessels will preferentially follow deep -water routes (e.g., marked channels) whenever possible. e. If a sea turtle or smalltooth sawfish is seen within. 100 yards of the active daily construction/dredging operation or vessel movement, all appropriate precautions shall be implemented to ensure its protection. These precautions shall include cessation of operation of any moving equipment closer than 50 feet of a sea turtle or smalltooth sawfish. Operation of any mechanical construction equipment shall cease immediately if a sea turtle or smalltooth sawfish is seen within a 50 -ft radius of the equipment. Activities may not resume until the protected species has departed the project area of its own volition. Any collision with and/or injury to a sea turtle or smalltooth sawfish shall be reported immediately to the National Marine Fisheries Service's Protected Resources Division (727-824- 5312) and the local authorized sea turtle stranding/rescue organization. g. Any special construction conditions, required of your specific project, outside these general conditions, if applicable, will be addressed in the primary consultation. All personnel associated with the project shall be instructed about the presence of manatees and manatee speed zones, and the need to avoid collisions with and injury to manatees. The permittee shall advise all construction personnel that there are civil and criminal penalties for harming, harassing, or killing manatees which are protected under the Marine Mammal Protection Act, the Endangered Species Act, and the Florida Manatee Sanctuary Act. b. All vessels associated with. the construction project shall operate at "Idle Speed/No Wake" at all times while in the immediate area and while in water where the draft of the vessel provides less than a four -foot clearance from the bottom. All vessels will follow routes of deep water whenever possible. C. Siltation or turbidity barriers shall be made of material in whichmanateescannot become entangled, shall be properly secured', and shall be regularly monitored to avoid manatee entanglement or entrapment. Barriers must not impede manatee movement. d. All on-site project personnel are responsible for observing water-re.lated activities for the presence of manatee(s). All in -water operations,. including vessels, must bel shutdown if a manatee(s) comes within 50 feet of the operation.- Activities will not resume until the manatee(s) has moved beyond the 50 -foot radius of the project operation, or until 30 minutes elapses if the manatee(s) has not reappeared within 50 feet of the operation. Animals must not be herded away or harassed into leaving. e. Any collision with or injury to a manatee shall be reported immediately to the .FWC Hotline at 1- 888-404--FWCC. Collision and/or injuryshould also be reported to the U.S, Fish and Wildlife Service in Jacksonville (1-904-731-3336) for north Florida or Vero Beach (1-772-562-3909) for south Florida. f. Temporary signs concerning manatees shall be posted prior to and during. all in -water project activities. All signs are to be removed by the permittee upon completion of the project. Awareness signs that have already been approved for this use by the Florida Fish and Wildlife Conservation Commission (FWC) must be. used (see MyFWC.com). Ocean Blvd., Highland Beach, FL DATE OF SURVEY: 9/2/09 HIGH TIDE: 9:09 AM LOW TIDE: 3:36 PM TIME OF SURVEY: 10:20 AM A seagrass survey was performed adjacent to the property located at 2540 S. Ocean Blvd., Highland Beach, Palm Beach County, Florida. The survey was conducted via snorkel and SCUBA by swimming transects parallel to the existing wood dock at different depths. Benthic organisms were to be observed and noted with special emphasis being placed on seagrass. A wood dock exists at the property which consists of a terminal end approximately 20' long by 7' wide and the marginal end approximately 30' long by 7' wide. Transects began on the east side of the marginal dock adjacent to the sloping rip rap wall on the property's edge. The substrate in this area consisted of loose sand with unattached algae. Water depth was approximately 3.5 feet. No seagrass was observed in this area. Transects continued on the west side of the marginal dock including the north and south ends of the property where there is no dock. Water depth at the west edge of the dock was 4.5' and increased to 6' at the mooring piles. Scattered but consistent mixed patches of Halophile decipiens and H. johnsonii were observed on the west side of the marginal dock extending west to the mooring piles for approximately 20'. Overall cover of the seagrass patches ranged from 30% to 50% and extended to the north and south ends of the property with the same coverage. Thick patches of algae, Dasycladus vermicularis, were interspersed with the seagrass in this area giving a cover of 50%. Seagrass, H. decipiens, continued west of the mooring piles for approximately 6' on the south end of the piles and increasing to approximately 20' from the piles on the north end. The drawings shall include the X -Y coordinates of the most waterward point of the structure and a point at the mean high water line (MHWL) or the face of the bulkhead/seawall, if present. The drawings shall include: (1) The dimensions of the structure, (2) depth of water (at mean low water) at the waterward end of the structure, and (3) the distance from the waterward end of the structure to the near bottom edge of the channel. b. List any deviations between the work authorized by this permit and the work as constructed. In the event that the completed work deviates, in any manner, from the authorized work, describe on the As -Built Certification Form the deviations between the work authorized by this permit and the work as constructed. Clearly indicate on the as -built drawings any deviations that have been listed. Prior to the initiation of any work authorized by this permit, floating turbidity curtains with weighted skirts shall be -3 - placed around the work area. Turbidity curtains must completely enclose all active in -water construction areas and shall not be removed until turbidity levels within the enclosed area return to background levels outside the curtain. Turbidity curtains must be adequate in length to control turbidity, yet of such length to preclude scouring of resources whether weighted or staked in place. Curtains shall be monitored at low tide to ensure that no resource impacts occur as a result of use. 5. Manatee Conditions: The Permittee shall comply with the "Standard Manatee Conditions for In -Water Work - July 2005", attached to this permit. 6. Sea Turtle and Smalltooth Sawfish Conditions: The Permittee shall comply with National Marine Fisheries Service's "Sea Turtle and Smalltooth Sawfish Construction Conditions" dated March 23, 2006, attached to this permit. 7. Consent to Easement: A portion of the proposed work is located within the Federal right-of-way for the Intracoastal Waterway and requires a Department of the Army Consent to Easement. By copy of this permit, the proposal is being forwarded to the Corps Real Estate Division for action on the Consent to Easement. Prior to commencement of construction the Permittee shall provide written verification to the Corps that the Consent to Easement has been approved. Failure to obtain the Consent to Easement invalidates this authorization. Generally, authorization of activities that have commenced or are under contract to commence in reliance of the GP will remain in effect provided the activity is completed within 12 months of the date a GP expired or was revoked. In the event you have not completed construction of your project within the specified time limit, a separate application or re -verification will likely be required. This letter of authorization does not obviate the necessity to obtain any other Federal, State, or local permits, which may be required. In Florida, projects qualifying for this GP must be authorized under Part IV of Chapter 373 by the Department of Environmental Protection, a water management district under §. 373.069, F.S., or a local government with delegated authority under §. 373.441, F.S. and receive Water Quality Certification (WQC) and Coastal Zone Consistency Concurrence (CZCC) or waiver thereof, as well as any authorizations required for the use of sovereign submerged lands that must be obtained as part of the associated WQC or CZCC. All vessels associated with the construction project shall operate at "no wake/idle" speeds at all times while in the construction area and while in water depths where the draft of the vessel provides less than a four -foot clearance from the bottom. All vessels will preferentially follow deep -water routes (e.g., marked channels) whenever possible. e. If a sea turtle or smalltooth sawfish is seen within 100 yards of the active daily construction/dredging operation or vessel movement, all appropriate precautions shall be implemented to ensure its protection. These precautions shall include cessation of operation of any moving equipment closer than 50 feet of a sea turtle or smalltooth sawfish. Operation of any mechanical construction equipment shall cease immediately if a sea turtle or smalltooth sawfish is seen within a 50 -ft radius of the equipment. Activities may not resume until the protected species has departed the project area of its own volition. f. Any collision with and/or injury to a sea turtle or smalltooth sawfish shall be reported immediately to the National Marine Fisheries Service's Protected Resources Division (727-824- 5312) and the local authorized sea turtle stranding/rescue organization. g.
