Minutes of Meeting of Town Commission
Workshop Meeting
February 24, 1981 1:30 P. M.
Mayor Horton called the Workshop Meeting to order at 1:30 P.M. Those
in attendance were: Mayor Louis Y. Horton, Vice Mayor Harold C. Storm:
and Commissioners Mary Louise G. Blosser, Peter J. Genovese and John J.
Basso.
Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E.
Sliney, Town Attorney; Police Chief Kenneth Jones and Jane E. Barker,
Town Clerk.
81.1 Vacancies on Boards
Mrs. Roberts stated that there are still vacancies on the
Community Appearance Board. At their last regular meeting,
Mrs. Roberts said, they had recommended that Mrs. Giglio
• and Mr. Conte, both alternates, be moved up as regular members.
She also said that a letter of resignation had been received
from Mr. Norman Hile, so she will await word as to this Board's
recommendations.
There is also an alternate vacancy on the Code Enforcement
Board and three vacancies on the Housing Board of Adjustment
and Appeals, Mrs. Roberts said.
Mayor Horton said that he had placed another notice in the
monthly Bulletin asking for names of people interested in
serving.
Action will be taken on Mr. Hile's resignation at the Regular
Meeting on March 3, 1981.
Proposed Ordinances
80.43 Proposed Ordinance No. - Cable TV Franchise - First
Reading - February 3, 1981
Mr. Tom Gullett, Highland Beach Cable TV, informed the Commission
that he would be unable to attend the Regular Meeting next
• week, when the Cable TV Franchise Ordinance comes up for a
second reading and possible adoption. Mayor Horton stated
that he didn't feel it would be necessary for Mr. Gullett to
be present.

Commissioner Basso stated that he had received some detailed
reports concerning the entry into a contract for a Cable TV
Franchise and talked for quite sometime on this subject. In
summary, the three points Commissioner Basso was concerned
with were:
1. the cost of drawing up the franchise agreement
2. the placement of the antenna and the distribution area
and 3. sending the franchise to a consultant for review.
Discussion took place regarding this being considered a
"business in Town" with Mr. Sliney stating that it was
a franchise and Florida Power & Light, Southern Bell
Telephone and Florida Public Gas were all franchise agreements
yet were not considered as "businesses in Town". Mr. Sliney
further stated that the disc itself would be considered in
the same class as a telephone pole or an electric pole. Mr.
Gullett stated that he would locate his business office in
either Delray Beach or Boca Raton.
• Discussion also took place as to whether the Highland Beach
Cable TV should be incorporated or remain as a partnership.
81.10 Proposed Ordinance No. - Amending Chapter 22 of
the Code of Ordinances
entitled "Sewers" and rescinding the Sewer Franchise.
Mrs. Roberts stated that she did not have this proposed
ordinance ready as yet; however, she felt that by waiting
she would be able to include the proposed increase in
fees. Mrs. Roberts explained that the Commission needed to
rescind the sewer franchise; however, parts of the franchise
must be included in Chapter 23.
She said that she and the Mayor had met with Mr. Lou Martin,
Director of Utilities, from Delray Beach, to discuss the
proposals to increase the sewer charges. Mrs. Roberts said
that when the new contract with Delray Beach is approved,
the fees would increase.
Discussion took place with Mayor Horton stating that there was
a possibility the increase would amount to $6.75 at the present
time; however, future costs will probably increase.

81.5 Bel Lido Bridge
Mrs. Roberts reported that the Commission had awarded the
surfacing contract to Carr who should be starting on the work
shortly. She :said a check will be made to see if the guardrails
have been relocated. Discussion took place regarding the
sprinkler system.
81.9 Water Plant Operator's Contract
Mayor Horton said that the Commission had received a copy of
the old contract under which Mr. Graham is now working. He
stated that the Palm Beach County Health Department required
coverage at the plant sixteen hours a day and this is being
done.
The two helpers' salaries will be included in Mr. Graham's
revised contract. Vice Mayor Storm questioned the amount of
overtime submitted by Mr. Graham and, after discussion, Mrs.
Roberts was instructed to request a monthly statement from
Mr. Graham, showing his overtime hours.

81.11 Town of Highland Beach vs. Ocean Properties, Ltd., et al
Prolonged discussion took place regarding a stipulation prepared
by Mr. Sliney concerning John P. O'Grady and his Real Estate
Office which is located in the Holiday Inn. Commissioner
Genovese's comments were also given to the Commission. It was
finally determined that Mr. O'Grady would be prohibited from
using his Highland Beach office or telephone number in any
advertising. Mrs. Roberts suggested that Mr. Sliney notify
Mr. John Hilly, Attorney for Mr. O'Grady, that this matter will
appear on the agenda for the Regular Meeting on March 3, 1981.
81.12 Friends of the Highland Beach Town Library, Inc.
Mayor Horton asked Mr. Sliney regarding Articles 6 - 7 and 8
of the incorporation papers, and Mr. Sliney answered this to
Mayor Horton's satisfaction. Mr. Sliney stated that you need
three or more subscribers, not less than eleven directors,
and at least four officers. These members will then choose
their own officers when they have their organizational meeting.
81.13 Possible Arrangements with Boca Raton Regarding
Appleby Street
Mrs. Roberts explained that "Appleby Street" takes in several
different issues - the office building north of Appleby
• Street that wanted to do some landscaping at the water plant
and Arturo's Restaurant south of Appleby Street which would

like to lease land from the Town for parking purposes.
She stated that there would be a Public Hearing held in Boca
Raton City Hall on Thursday, February 26, 1981, concerning
Arturo's. The Town is interested in having Appleby Street
paved before the Open House in April. At this point in time,
Mrs. Roberts brought in the plans showing the water plant and
the entire Commission studied them.
After this, Mayor Horton stated that the Town wanted the
following:
Appleby Street paved at Boca Raton's or Arturo's expense.
Landscaping of the strip from the plant out to Federal
Highway.
Access to water mains in easement to be kept open
twenty-four hours a day and the road lighted.
It was suggested that a security bond be posted. Mrs. Roberts
inquired as to which Commissioner would be able to attend
the Public Hearing on Thursday in Boca Raton and Commissioner
Genovese said he might be able to go.
Commissioner Genovese then announced that he had some pleasant
news to utter which was the settlement of the Van Lennep
matter and wanted to thank Mr. Sliney. Mr. Sliney said he
was most happy to report on this case, which has been going
on for ten years, and he thanked Mrs. Roberts and Commissioner
Genovese for all their help.
Mrs. Roberts, in turn, spoke highly of the way Mr. Sliney
and Mr. Petzold presented their facts during the trial.
Discussion took place regarding some changes to the Zoning
Code which would affect the Byrd Beach Section: RS 1. ..-..~~.- -~-~
Mr. Sliney suggested that the Town hire a planning consultant
who could act as an expert witness in case of litigation. ' """""`"""'-
81 14 South Florida Water Management District Report
Mayor Horton announced that the draft report from the South
Florida Water Management District-had been received and
they found that the per capita saving of water during the
conservation period was almost 15/. This took place when
the WET group was in existence and everybody in Town was
urged to save water.
South Florida Water Management District will publish this
report and will make it available to everybody in South
• Florida.
Mrs. Roberts then spoke of Mr. Carberry's letter of resignation
as the SFV~TMD liaison. Action will be taken at the Regular

Meeting on March 3, 1981. If, at any time in the future,
Mr. Carberry's services would be needed, it was felt that
he could be called upon.
Commissioner Blosser spoke of having a copy of Boca Raton's
agendas in which there is an item called "Council Members'
Reports and Requests". If this could be adopted by the Town,
it could cover any miscellaneous items the Commission might
wish to discuss.
Commissioner Blosser also spoke of CATV and antenna rulings.
Mayor Horton stated that possibly the antenna ruling might
be researched by the Planning Commission.
Discussion took place regarding a cruise boat trip on the
Intracoastal with dinner at the Holiday Inn, the dangers of
crossing AlA, and the commercial aspect. Time-sharing on
boats was also discussed.
Vice Mayor Storm asked if the Town would soon be ready to
go out for bids on the new Municipal Complex and was answered
in the affirmative.
• Town Manager's Reports
Mrs. Roberts reported that the State of Florida had received
almost four million dollars to cover the costs of the Cuban-
Haitian influx. The Town's costs were $25.00; however,
the paper work would not warrant the work of applying for
this small amount.
Mrs. Roberts reported on the Coordinating Meeting at the
water plant, the nice looking appearance that the plant
now has, the problem of water overflowing onto neighbors
yards at the plant, and the surplus equipment that was
brought over here and placed behind the fence until sold.
She also spoke of the brightness of the lights at the water
plant, and other items of interest.
Mayor Horton then informed the Commission of the concrete
spiractor pad which should be placed underneath the spiractor
inasmuch as the sand falls on the ground. This will cost
$1,200.00, but will be money well spent.
Mayor Horton then proceeded to explain about the doors at
the plant which are rusting and should be replaced. The
• total cost to replace these doors should be about $4,000.00.
Mayor Horton continued by saying that Coronado would be pay-
ing their complete tap-in fees for both of their buildings

and felt that this amount should be used to replace the
doors.
Mrs. Roberts spoke further of the lights and another proposal
from Camp, Dresser & McKee regarding Lift Stations 4 and 5
in the amount of $4,900.00. She asked if the Commission
would be ready to vote on this next week.
Mrs. Roberts brought up the Hidden Harbor project and stated
that the east side model was too far east and Hidden Harbor
people were fined $250.00 by the Department of Natural
Resources. This building has been stopped. Mrs. Roberts
further reported that there would be a delay on the west
side inasmuch as the Hidden Harbor people have gone to the
Army Corps of Engineers for permission to dredge the Intra-
caostal to a depth of eighteen feet. This will be heard
before the Area Planning Board.

Mrs. Roberts said she had received a call from Mr. Mark
Weiner, Architect from Peabody and Childs, regarding the final
plans for Hidden Harbor. The building is longer than what
the Town approved and they would like to be on the agenda
for the Regular Meeting on Tuesday, March 3, 1981. Mrs.
Roberts requested a letter from them along with a copy of
the plans. She received the letter, but no plans, so she
is holding this up until Mr. Hamzik returns from the Build-
ing Officials' Conference in St. Petersburg.
Mayor Horton then gave a brief history of the Intracoastal.
Originally, the entire length of the system was to be some
sixteen feet deep for the purpose of commercial traffic or
defense purposes. However, in Florida the traffic was used
more for pleasure craft and the intent of dredging this
area was never pursued. However, from time to time, they
have permitted developers to dredge to the Corps' requested
depth and this is what Mr. Hoffmann (Hidden Harbor) wants to
do with his property.
Discussion took place as to whether there would be an increase
in c anmercial traffic if the entire length of the Intracoastal
were dredged to a depth of sixteen feet. Objections have
been raised in the past due to the fact that it might disturb
seawalls.

Mrs. Roberts announced that the Palm Beach County Municipal
League will be presenting atrophy each and every year to
the person most valued as an elected official in Palm Beach
County. Legislator Phil Lewis was the first to receive this
award and it will be known as the Philip D. Lewis Statesman
Award. Mrs. Roberts wanted to suggest Mayor Norton's name

for this Award and Commissioner Genovese immediately agreed
with her. Commissioner Genovese said that he will draw up
a Resolution for Commission approval.
Mrs. Roberts said that the Commission should have her annual
report_by the coming week. She told about two other Public
Hearings being held in Boca Raton concerning property near
the Town's Water Plant.
Mrs. Roberts then informed the Commission of a recommendation
received from the Del Trail Fire Marshall that the Town
follow the National Fire Code rather than the Town's amend-
ments, in order to avoid confusion. Mrs. Roberts said that
she would need the Commission's direction on this matter.
She then told of a letter that she had received from Ned
Brooke, Executive Secretary for the Metropolitan Planning
Organization, suggesting the-Town draw up a Resolution regard-
ing road funding for the south part of the State.
More discussion took place regarding the National Fire Code
• and sprinkler systems. Mayor Horton said that he felt this
matter needed more study and that the Town was not ready to
take action on this as yet.
Mr. M. H. W. Dent, a~Town Yesident, then addressed the
Commission concerning the following items: Cable TV, the
Bel Lido bridge, hiring a consultant to help with the
zoning, Hidden Harbor, Boat Time-Sharing, and the Fire
Department limits.
