TOWN OF HIGHLAND BEACH, FLORIDA

Mayor Horton announced that prior to convening the Special Meeting,
opening of the bids for the new Municipal Complex was scheduled for
1:30 P.M.
Mayor Horton stated that the time has passed for receiving any more
bids and just one had been received. Others that had been interested
had bowed out within the past few hours.
Mayor Horton opened and read the bid from James Bushouse and Assoc-
iates of Margate, Florida. Attached was a U. S. Fidelity & Guaranty
Company Bond. The bid submitted for the new building (Phase I) was
$228,850. and remodeling of the present building (Phase II) was
$37,850.
Mayor Horton then marked the date and time of receipt of this bid
and passed it on to Mr. Roy Simon, Architect. Mayor Horton said that
• the Town had the right to reject any and all bids. A Special Meeting
will be held on April 28, 1981, at which time a decision can be reached.
Mayor Horton requested Mrs. Roberts to obtain a resume of finances
that are available for the new Municipal Complex.
Mayor Horton also made the statement that in the past, the Town has
ended up acting as their own general contractor and subbing out
various parts of the job.
Mayor Horton then called the Special Meeting to order at 1:50 P.M.
Those in attendance were: Mayor Louis Y. Horton; Vice Mayor Harold
C. Storm and Commissioners Mary Louise G. Blosser, John J. Basso and
Peter J. Genovese. Also in attendance were: Elaine W. Roberts, Town
Manager; Thomas E. Sliney, Town Attorney; Police Chief Kenneth Jones
and Jane E. Barker, Town Clerk.
Before proceeding with the meeting, Mayor Horton expressed his thanks
to Mr. Tom Gullett, Highland Beach Cable TV, for the use of his tele-
vision set for the touch-down of the Columbia shuttle.
Cable TV Lease Agreement
• Mrs. Roberts told the Commission that she had been asked several

technical questions by people in Town, which she referred to
Mr. Gullett. Due to no commercialization in Town, she re-
quested a telephone number and address for Mr. Gullett's
office which has to be located in either Delray Beach or
Boca Raton. Mr. Gullett informed her that his office address
was 4228 N. W. 2nd Ave., Boca Raton, Florida 33431 and his
telephone number was 994-6758.
Discussion took place regarding the lease agreement made up
by Mr. Sliney between Mr. Gullett and the Town of Highland
Beach for the rental of land behind Tall Hall. Vice Mayor
Storm voiced several strong objections to the amount of
rent being paid and how Mr. Gullett could place a dish and
a building on the amount of space Mr. Gullett was renting.
Mr. Gullett explained how this could be accomplished.
Quite a long heated discussion took place.
MOTION by Commissioner Genovese and seconded by Commissioner Blosser
• that the agreement as distributed by Town Counsel be approved.
More discussion took place regarding the number of antennas
to be installed. Commissioner Basso felt that the number
of antennas should be spelled out in the Contract.
Commissioner Genovese restated his MOTION that the lease be con-
summated between the respective parties as is, with the further
stipulation that no more than six antennas will be installed. This
was agreeable with the seconder. Mayor Horton added the following
words: plus he may also mount adjacent water tower CATV antennas
"not to exceed six"; the words in quotation marks being appended to
that sentence.
Mrs. Roberts asked a question concerning the right to
negotiate the terms of the agreement, other than the amount
of rent, and was informed that this agreement was conterminous
with the franchise agreement.
Mayor Horton brought up the subject of the date of this
agreement and the consensus was to date it the same as the
franchise agreement, which is March 3, 1981.

In polling the Commission, the vote was as follows: Mayor Horton
- Aye; Vice Mayor Storm - Nay; Commissioner Blosser - Aye;
Commissioner Genovese - Aye and Commissioner Basso - Aye. The
MOTION carried four to one.
Mrs. Roberts reported that Mr. Gullett had received
correspondence from the American Insurance Management
Corporation, re the Bond which Mrs. Roberts read for the
record.
Water Plant Operator Contract
Mayor Horton stated that all Commissioners had copies of
the Contract. Discussion took place regarding the various
points in the Contract.
Mr. Sliney questioned the date and business name contained
in the Contract. Commissioner Genovese inquired about the
• fact that the Contract was made out to Tom Graham, d.b.a.
BST Enterprises, Inc. The consensus was to make it out in
the name of BST Enterprises, Inc., with Tom Graham signing
as President.
Mayor Horton stated that the items that had to be clarified
should be handled by Town Counsel and Tom Graham and be
prepared in final form for the Special Meeting on April 28,
1981 for Town Commission approval.
More discussion took place regarding the monthly salary,
including the salary for two operators.
Town of Highland Beach vs. Ocean Properties.
Commissioner Genovese stated that he had contacted John O'Grady
who said that the whole matter should be dropped. Mr. O'Grady
objected to the stipulations regarding the square footage of
his office and the number of people he was allowed to employ.
Commissioner Genovese stated that he could not find anything
in the Town's ordinances concerning this and felt that these
two stipulations were out of order.

Mayor Horton explained that he felt the original thought was
to accept the situation as it was; the Town would be willing
to drop the suit provided that there was no change in the
current situation. In other words, Mayor Horton, said that
he did not think Mr. O'Grady should be given "carte blanche
to build a huge empire" at the Holiday Inn.
Discussion continued on this subject for quite some time
with Mr. Sliney stating that he felt copies of the leases
for the present two tenants at Holiday Inn should be
furnished the Town, showing the amount of square feet
being rented, thereby, prohibiting any increase in rental
space.
Both Vice Mayor Storm and Commissioner Genovese offered a
few words on this matter. Mayor Horton stated that he felt
the Commission should wait until they get the proposals
from Town Counsel and then discuss the matter further.
Urbanetics Bond
Mrs. Roberts stated that there was no action needed on this
matter inasmuch as she had spoken with Mr. Brandt from
Royal Highlands, who stated that the bond should be kept
the way it is.
Bills for Approval
Mrs. Roberts presented the bills for approval.
MOTION by Commissioner Basso/Vice Mayor Storm that the bills be
approved for payment. All Commissioners voted Aye.
Mayor Horton talked of the Open House at the Water Plant
this past Sunday, saying that it was a successful day with
about 150 people attending. Brochures and water samples
are located on tables in the Commission Chambers.

The Mayor next asked Mrs. Roberts regarding the workmen's
Compensation Hearing on Monday in connection with Mr.
Gilpin. Mrs. Roberts informed the Commission that Mr.
Gilpin's attorney requested a postponement and the new
hearing should be set within the next two weeks.
Commissioner Blosser asked a question concerning Dalton
Place which Mrs. Roberts answered for her. She said this
problem has been going on for some time and concerned
lights on the Dalton Place building. The lights were shown
on the original plans yet the Community Appearance Board
will not permit a final Certificate of Occupancy be issued
until the lights are removed. The Board at Dalton Place
has retained the services of Jay Reynolds, Attorney, not
choosing to come before the Town Commission at this time.
Mrs. Roberts reported that she had received a call from
• Mrs. Siebert, who is in the Engineering Department at
Boca Raton. She told Mrs. Roberts that Southern Bell
Telephone is asking for a 25' easement through the
abandonment and did the Town of Highland Beach want to
be included. Mrs. Roberts explained just where the
easement would run. After discussion, it was decided
that the Commission would make a decision after obtaining
some more facts.
Mrs. Roberts then reported that she had received an
invitation to the dedication of the new Manalapan Town
Hall on Friday, April 24, 1981, at 2:30 P.M.
Mrs. Roberts reported receiving a letter from the engineers
regarding pine tree needles falling in the wash water
recovery basin at the water plant. The engineers are taking
this problem to the Community Appearance Board in Boca Raton
tonight at 7:30 P. M.
Mrs. Roberts told of a telephone call from the Area Planning
Board regarding the Corps of Army Engineers' notification

in connection with Coronado Towers. It is important that any
comments be submitted to the Corps by April 27, 1981.
