Special Meeting
April 28, 1981 1.15 P M.
Mayor Horton called the Special Meeting to order at 1:30 P.M. on
Tuesday, April 28, 1981. Those in attendance were: Mayor Louis Y.
Horton and Commissioners Mary Louise G. Blosser, John J. Basso and
Peter J. Genovese. Vice Mayor Harold C. Storm was absent.
Also in attendance were: Elaine W. Roberts, Town Manager; Thomas E.
Sliney, Town Attorney; Police Chief Kenneth Jones and Helen Carpenter,
Deputy Town Clerk.
Mayor Horton called for any comments on the agenda and there were none.
Recommendation from Roy Simon regarding' the Municipal
Building Bid
Mr. Roy Simon, Architect, discussed his letter of April 28,
1981 submitting his recommendations regarding the Municipal
Complex Bid.
Much discussion took place with Commissioner Basso stating
that he thought more than one bid should be received for a
municipal building such as this; he asked Mr. Simon if he
had ever acted in the capacity of a construction manager,
serving therefore, as a contractor.
Further discussion followed after which
A MOTION was made by Commissioner Genovese and seconded by Commissioner
Basso that the current bid that had been received be rejected due to
the fact that it was the only bid received. All Commissioners voted
Aye.
Mayor Horton then mentioned the various possibilities that
the Town had; one suggestion made by Commissioner Basso to
obtain a superintendent for the job; a suggestion made by
Commissioner Genovese to build a building not quite so
pretentious or to go out for new bids. Discussion took
• place regarding the money which is still left in the budget.

The consensus was to study this matter further after receiving
more figures from the Finance Department.
Proposed Ordinance No. 409 - An ordinance of the Town of
Highland Beach, Florida, amending
Chapter 7 of the Code of Ordinances entitled "Building Code",
Section 7-l.l entitled "Amendments to the Standard Building
Code" which references Section 109.3 - Temporary Occupancy.
Mayor Horton read this proposed ordinance in full.
Mrs. Roberts brought up the issue that the ordinance had not
been published far enough in advance for adoption today.
Mayor Horton stated this proposed ordinance would be adopted
at the first opportunity.
Forma. Approval for $998.50 for Water Plant Service Pump Motor
• Mrs. Roberts proceeded to inform the Commission that Mr. Sliney
had mailed the Water Plant Operators' Contract which she had
received yesterday. Mr. Sliney was seeking answers to some
questions about the Contract; namely, Paragraph 2 (b) regarding
the number of certified operators providing the 16 hours per
day on-duty operation. The Contract does not speak to the item
of additional compensation for emergency or other service either.
Discussion took place regarding the above and the amount of
money to be paid for emergency overtime service.
MOTION by Commissioner Genovese/Commissioner Basso that in addition
to Paragraph 2 (b), in event of an emergency the company will provide
such additional service, at a fee of $10.00 per hour, as may be re-
quired. All Commissioners voted Aye.
Mrs. Roberts stated that she had called the Commissioners at
home seeking verbal approval of the purchase of a water plant
service pump .motor. She said she was now seeking formal
approval for the sum of $998.50.
MOTION by Commissioner Blosser/Commissioner Genovese that this amount
• be approved for payment. All Commissioners voted Aye.

Town vs. Ocean Properties
Mr. Sliney stated that he had not written the letter to
Holiday Inn as requested inasmuch as this item was appearing
on the agenda for today's meeting, and he thought there
might be changes or additions that should be contained in
his letter. Commissioner Genovese informed the Commission
that Mr. O'Grady had requested this entire matter be dropped.
However, the case is still in limbo, Mr. Sliney said, and he
was instructed to write the letter regarding the restrictions
placed on Mr. O'Grady.
Mrs. Roberts reported that Vice Mayor Storm had seen the ad
in the newspaper regarding the sale of art and picture frames
at the Holiday Inn in Highland Beach. Mr. Sliney stated that
he had seen an ad on television concerning this same matter.
A cease and desist letter will be forwarded to the Holiday
• Inn.
Bills for Approval
Mrs. Roberts presented the bills for approval.
MOTION by Commissioner Basso/Commissioner Blosser that the bills be
approved for payment. All Commissioners voted Aye.
Any and all other matters that might come before the Commission
Commissioner Genovese brought up the subject that the State
Legislature will be meeting on April 30, 1981 to pass a
State Statute approving of interval ownership. He suggested
that the Commission go on record asking for a proviso that
each city or town has the right to approve or disapprove
their action. Mrs. Roberts was instructed to call the
Legislature informing them of the above and this will be
followed up with a formal Resolution.
Mayor Horton then brought up the matter of the Regular Meeting
for May which will be held on Election Day. He asked what
• the desires of the Commission were and the consensus was to
convene the meeting at 7:30 P.M. on Tuesday, May 5, 1981 and~•

after the Election results were obtained, the Commission
would recess the Regular Meeting until the next afternoon
at 1:30 P.M. This was agreeable to all.
Mrs. Roberts announced that she had heard from the engineers,
representing Maravilla, Carl Howard and Earl Harvel regarding
the extension of the sewer line that was to be paid for by
the developers at their site. She said that there was a
problem about room for this line and Mr. Harvel has drawn
up a sketch showing that this would be possible if a short
length of the force main was repositioned at an estimated
cost of $2,875.00.
Mayor Horton explained this complete matter in detail for
the benefit of all. Mr. Richard Raab, developer of
Maravilla, spoke to the Commission for quite sometime.
Commissioner Genovese requested that this matter be placed
on the agenda for the Regular Meeting on May 5, 1981.
Mrs. Roberts then brought up the subject of passing an
ordinance prohibiting any portable, fixed or mobile grout
plants or concrete (batching) mixing plants to be placed
on any premises in the Town of Highland Beach.
She stated that Mr. Hamzik, Building Official, had requested
this ordinance be adopted and after discussion, a short
recess was taken while Mr. Sliney, Town Attorney, drew up
an Emergency Ordinance to be adopted today.
Mayor Horton reconvened the Special Meeting, announcing
that the same Commissioners were present as stated above.
Mr. Sliney then read the Emergency Ordinance in full.
MOTION by Commissioner Basso and seconded by Commissioner Blosser
that this Emergency Ordinance be adopted as read. In polling the
Commission, the vote was as follows: Commissioner Basso - Aye;
Mayor Horton - Aye; Commissioner Blosser - Aye; and Commissioner
• Genovese - Aye. Vote was unanimous.

Mayor Horton then stated that the purposes for which the Special
Meeting had been called were accomplished and the meeting ADJOURNED
at 3:35 P.M.
