Minutes of Meeting of Town Commission
Workshop Meeting
October 27, 1981 1:30 P.M.
Mayor Horton called the Workshop Meeting to order at 1:30 P.M. Those
in attendance were: Mayor Louis Y. Horton, Vice Mayor Harold C. Storm
and Commissioners John J. Basso, Mary Louise G. Blosser and Edward J.
Sullivan. Also in attendance were: Thomas E. Sliney, Town Attorney;
Police Chief Kenneth Jones; and Jane E. Barker, Town Clerk. Elaine W.
Roberts, Town Manager, was absent, however, Bernice M. Smith,
Administrative Assistant, attended this Workshop Meeting.
81.1 Vacancies on Boards
There are several vacancies on the various Boards, Mayor Horton
said, however, these will be taken care of next week at the
Regular Meeting. Commissioner Blosser mentioned that Mr.
Albert Schiff will be appointed as a Regular Member to the
• Board of Adjustment at that time and Commissioner Sullivan
recommended that Mrs. Amelie Leng be reappointed to the
Community Appearance Board on November 3, 1981.
Proposed Ordinances
81.57 Proposed Ordinance No. _` - An ordinance of the Town of
Highland Beach, Florida,
imposing assessment of costs involved in providing
assistance in utility locations for new construction.
Commissioner Blosser questioned the heading of this ordinance.
Mr. Sliney said that he would take care of that matter and also
Item No. 2 of the ordinance and will have this ordinance in
final form for the Regular Meeting next week.
81.50(a) Proposed Ordinance No. _` - An ordinance of the Town of
Highland Beach, Florida,
authorizing the Southern Bell Telephone and Telegraph
to use the public streets of the Town of Highland Beach,
Florida, for the purpose of erecting, constructing,
maintaining and operating lines of telephone and
telegraph thereon and thereunder.
• Mayor Horton stated that this ordinance would come up for final
reading and possible adoption at the Regular Meeting next week.

Commissioner Sullivan stated that he hoped that in the future
Southern Bell Telephone would be more responsive to the Town's
needs.
81 50(a) Proposed Ordinance No. - An ordinance of the.. Town
of Highland Beach, Florida
amending Chapter 282, Section 34, entitled "Tress, Shrubs and
iTegat tion", to adopt by reference the Palm Beach County Mangrove
Protection Ordinance.
Mr. S iney said that he felt this ordinance was a fine idea and
shoul be adopted by reference inasmuch as it is a County ordinance.
The T wn would look to the County for enforcement should a case arise.
81.65 Pro osed Ordinance No. - An ordinance of the Town of
Highland Beach, Florida,
amending Ordinance No. 381, which amended Ordinance No. 360, providing
a fee schedule for the following applications to the Town of Highland
Beach rezoning, change to the zoning ordinance, special exception,
varia ce, appeal to Board of Adjustment, nonconforming use permit,
speci 1 permit, site plan review (preliminary), site plan review
(fina development plans), site plan review (amended plans),
subdi is ion plan review (preliminary), subdivision plan review
(fina ), plat review (new plat), plat review (amendment of existing
plat) and applications not specifically set forth.
Sched~.tled for First Reading November 3, 1981.
Mayor Horton stated that this proposed ordinance was to make
certa n that the Town would receive the costs to which they are
entit ed from people seeking special exceptions, rezoning, etc.
81.66 Pro osed Emer enc Ordinance N - An emergency ordinance
of the Town of
Highl nd Beach, Florida to be designated as the partial building
permi moratorium ordinance; relating to suspension of applications
for b ilding permits for new construction and issuance thereof;
makin legislative findings of fact; declaring the legislative
inten and purpose of this act; declaring a 60-day moratorium on
appli ations for anti issuance of building permits for new
contt uction; declaring an emergency; and providing for an
immed ate effective date.

November 2, 1981, Mayor Horton said, this new one will be
brought up for adoption at the Special Meeting immediately
following the Workshop Meeting.
81.67 Possible consideration of adoption of Resolution No 424 -
a Resolution of the Town Commission of the Town of Highland
Beach, Florida, requesting the Board of County Commissioners to
adopt rules and regulations for certification of food service workers.
This Resolution will request the Board of County Commissioners
to adopt rules and regulations for certification of food service
workers. Dr_ Gilbert Weiss, a Town resident, spoke briefly on
this matter and Mayor Horton said that this Resolution would come
up for adoption at the Special Meeting to follow. Commissioner
Blosser said that a copy of this Resolution should be forwarded
to the Home Economics Association.
81.68 Uniform Election Date
• Mayor Horton referred to a letter from Jackie Winchester, Supervisor
of Elections, dated September 17th, concerning uniform election
dates. Vice Mayor Storm felt that it would be an excellent idea
to lessen the number of election days, not only because of the
cost but because of confusion.
Mayor Horton explained for the benefit of all just why there are
several election days in Florida which include .individual
municipal elections. Discussion ensued as to which date would be
preferred. This matter will be discussed further at the
Regular Meeting next week.
81.69 Letter of request dated October 8, 1981 from M P H Homes
Mayor Horton stated that this letter was from the organization
that was building next to the Town's westerly well field. For
some time now, Mayor Horton said, there has been talk of having
a road made available as a continuation of 70th Street to the
east, in order for trucks to have access to the Town's wells
without becoming stuck in the sand. Mayor Horton wondered if
something could be worked out with M. P. H. Homes.
Much discussion took place and then Mayor Horton acknowledged
. Mr. Martin P. Heise from M. P. H. Homes, who explained to the
Commission that they were interested in purchasing the small

piece of land from the Town. Mayor Horton stressed the fact
that the Town had need of a good road in that area due to
having to move the generators into there.
Mrs. Roberts will be asked to look into this matter further and
report back to the Commission.
Commissioner Basso then brought up the subject of Holiday Lights
and Mayor Horton suggested that the Town Manager discuss this
item with the Community Appearance Board and report back to the
Commission.
Town Manager's Memo of October 23, 1981: Items not on the Agenda
for the Workshop Meeting of October 27, 1981
1. Mayor Horton stated that Victor Pujals of Camp, Dresser and
McKee, recommended awarding the contract to H and H Engineering,
Inc. (low bidder) for Lift Stations 2, 4 and 5. The consensus of
the Commission was to do this and formal action will be taken at
• the Regular Meeting next week.
2. Mayor Horton then spoke of the recommendation received from
Chief Jones and the Town Manager regarding the bids for .the
new police car. The consensus of the Commission was to follow
their recommendations and accept the low bid.
3. Mayor Horton inquired as to whether the Commission would
like to discuss the possibility of the Town picking up the
25 feet which has been under discussion in connection with Arturo's
Restaurant. The City of Boca Raton is not interested in this
piece of property and it was felt that the Town could work
something out with Boca Raton. Mrs. Roberts will be asked to
check with the City Manager of Boca Raton.
4. Mayor Horton reported on the memo dated October 22, 1981
from the Planning Commission regarding the Maravilla East
plat. The Planning Commission has agreed to accept the plans
presented by Maravilla - this was the original plan and back
to the original dimensions. Mr. Sliney stated that Public
Hearings would have to be held.
5. This item concerns correspondence from the D.O.T. regarding
Crime Watch Neighborhood signs. Discussion took place
regarding the signs. Commissioner Basso inquired as to how
often the police went to the shooting range. Chief Jones

informed him that the officers went twice a year. Mayor Horton
advised that the DOT had written to Mrs. Roberts informing
her that Crime Watch signs could not be placed on AlA, but they
could be placed on private property.
6. This item concerned a letter from the Town Attorney regarding
the Police Committee/Sunshine Law: the Police Committee
is subject to the dictates of the Sunshine Law. Discussion ensued.
7. Mayor Horton then stated that the next issue had to do with
dual taxation by the County for unused services. Mr. Sliney's
thought on this was to take no action at the present time. Mayor
Horton stated that he had asked Mrs. Roberts to get some facts on
the matter but that there was no high priority.
8. Clarendon deceleration lane. Mayor Horton asked Mr. Digby
Bridges to bring the Commission up to date on this and Mr.
Bridges said it seemed like the DOT was forcing him to do
exactly what the Town did not want. Mr. Bridges needs action
• from the Town within two or three weeks as to how he should
proceed. Discussion took place regarding the dangers of two-lane
highways vs. three-lane highways.
9. Road and Bridge Fund money. Mayor Horton said that for some
reason or another, there might be a shortfall of some $40,000.
this year. Vice Mayor Storm stated that each year conditions
seem to worsen, which he could not understand and he requested that
Mrs. Roberts get in touch with Mr. John Sansbury, County
Administrator, to see if she could get some definite information
from him.
10. Mayor Horton made mention of the fact that Dick Orman, former
Planning Consultant for the Town, had now been hired by
Mr. Milani for the purpose of giving him opinions about the
zoning of his property. Mr. Sliney stressed the fact that it
was important for the Town to retain their present Planning
Consultants, in order to prevent occurrences such as this.
Vice Mayor Storm then asked regarding Cable TV and said thst
nobody in Penthouse Towers had been contacted as yet, concerning it.
Mayor Horton said that he had had it for three weeks and the Cable
• TV Company was starting at the south end of Town and working north.
Mr. M. H. W. Dent, a Town resident, enlightened the Commission
on the status of this matter. Mayor Horton also added that there

had been a change in personnel and this might have a bearing
on the delay.
Regarding the Gee and Jenson Proposal, Mayor Horton stated
that three letters had been received from Gee and Jenson
dated September 29th, October 19th and October 23rd. The
first two letters did not refer to a retainer fee whereas
the third one quoted a retainer fee of $12,000. a year.
Discussion took place with the consensus being that this retainer
amount should be lowered with the Town then paying for their
services when needed. The Commission and Town Attorney also
discussed a six months' termination date instead of a year.

be any pending litigation, Gee and Jenson would have to remain
on the case. Their total fee for the Comprehensive Plan and
Zoning Code work was also discussed in detail. This will be
discussed in further detail at the Regular Meeting next week.

Mayor Horton then acknowledged Mr. E. I. H. Bennett, a member of
the Police Committee. Mr. Bennett felt that police matters should
be brought before the Police Committee who would then make their
recommendations to the Town Commission. He referred specificially
to the police officers doing directly to the Town Commission,
however, Mayor Horton reminded him that the police had appeared
at a Public Hearing. Discussion prevailed on this subject for
