Minutes of Meeting of Town Commission
Regular Meeting
December 1, 1981 1:30 P.M.
Mayor Horton called the Regular Meeting to order at 1:30 P.M. Those
in attendance were: Mayor Louis Y. Horton, Vice Mayor Harold C.
Storm and Commissioners John J. Basso, Mary Louise G. Blosser and
Edward J. Sullivan. Also in attendance were: Elaine W. Roberts,
Town Manager; Thomas E. Sliney, Town Attorney; Police Chief Kenneth
Jones and Jane E. Barker, Town Clerk.
There were several Townspeople in the audience.

MOTION by Commissioner Sullivan/Vice Mayor Storm that the minutes be
approved as written. All Commissioners voted Aye.
Public Requests and Comments
None
Reports - Town Commission
(a) Mayor Louis Y. Horton - Mayor Horton brought up the subject
of charging a fee for motor homes
that have been parking in the lot to the rear of Town Hall. It
was stated that some of these motor homes have been parked there
as long as five months at a time. The Commission talked about
limiting the time one could park, charging a daily fee and whether
space could be cleared behind the Australian Pines, thus making
more room.
The question of lighting was also discussed. Commissioner Sullivan
stated that it would have to be properly policed so that people
from out of town did not use the lot. Chief Jones said that he
has already told one individual that he will be allowed to park

only seven days, after which he will be given a citation. It
was decided to workshop this matter.
Mayor Horton then said that he felt Mr. Frank Carberry, our
representative to the South Florida Water Management District,
should be given an honorarium, the same as other Board Members,
inasmuch as he gives his time to travel to and attend their
meetings. There were no objections to this request.
Mayor Horton spoke of another letter being received from Mr.
Clement Winke of Seagate of Highland regarding Coronado. He
will answer this in the same manner as he has the others regarding
this same subject.
Mayor Horton then spoke of the bid from Florida Protection Service
for the burglar alarm system for the new building. Inasmuch as
they are getting ready to plaster, the system should be installed
immediately. There is one installation charge with a yearly
• maintenance contract, amounting to approximately $50.00.
Discussion took place with Vice Mayor Storm stating that he
thought more than one bid should have been obtained and that
Mr. Roy Simon, Architect, should have notified the Town of this.
It was determined that the alarm system was not included in the
contract with Mr. Simon.
MOTION by Commissioner Basso/Commissioner Blosser that the bid be
awarded to Florida Protection service in the amount of $1,285.00 for
the new alarm system. The vote was four to one with Vice Mayor Storm
voting Nay.
Mayor Horton then reminded everyone that there would be a Flood
Insurance Meeting in the Chambers on Wednesday, December 2, 1981
at 2:00 P.M.
He then went on to say that he and Mrs. Roberts had met with
Mr. Simon on Monday, November 30, 1981, regarding the landscaping
for the new building. The Community Appearance Board gave general
approval but wanted more specifics before giving final approval.
Mr. Simon will submit new plans and will meet with the Community
Appearance Board on December 17th.

Mayor Horton then read for the record a letter from Mrs.
DeJoseph on Bel Air Drive, requesting that a lower speed be
posted on their street. This matter will be referred to the
Police Committee for their thoughts.
(b) Vice Mayor Harold C. Storm - Vice Mayor Storm reported
that there were many people
in his building (Penthouse Towers) most unhappy with their tax
bills. Some had doubled, he said, and even tripled. He inquired
as to whether information could be published in the Bulletin,
informing the residents that the fault lay with the County and
the School District, not the Town of Highland Beach. Mayor
Horton and Vice Mayor Storm will work on this matter.
Vice Mayor Storm told then of the meeting next week with the
auditors when they will present their preliminary audit report.
He also spoke of the "208" meeting being held next Wednesday.
• The Vice Mayor said that income from investments is going down
at a rapid rate; the Town had been receiving $15,000.00 in a
month's time, however, last month only $4,686.66 was realized.
Commissioner Sullivan asked if a notice could be placed in the
Bulletin and on the Bulletin Boards, telling people how to
appeal their assessed property valuations. Vice Mayor Storm
also commented that the meetings for the Town were not shown
in the Sun Sentinel last Sunday. Pete Gordon, reporter for the
Sun Sentinel answered Vice Mayor Storm's query.
(c) Commissioner John J. Basso - Commissioner Basso brought
up the subject of the TV Dish
that he is seeking for Regency Highland. Mayor Horton explained
that Regency Highland was an RPUD Ordinance which is separate
from the regular Zoning Ordinance, and he wanted to do some
research into this RPUD Ordinance for Regency before making any
decision.
Much discussion took place for quite sometime with Mayor Horton
stating that just as soon as the information could be located,
the matter would be referred to the Town Attorney for his legal
opinion.

(d) Commissioner Mary Louise G. Blosser - Commissioner Blosser
had no report.
(e) Commissioner Edward J. Sullivan - Commissioner Sullivan
thanked Mrs. Roberts and
Chief Jones for checking into the matter of security at various
other motels and hotels, in an effort to curb the burglaries
at the Holiday Inn located in Town.
Commissioner Sullivan then suggested that Mrs. Roberts forward

(c) Community Appearance Board - Mr. Frank Savino, a member
of the CAB, reported to the
Commission on the progress the Greening Committee has made and
thanked all the members of the Committee and especially
Mrs. Stewart.
He then reported on Phase II of the "Greening of AlA", saying
that the Committee was under the impression a letter was to be
mailed with the December Bulletin, asking for donations for the
Greening Committee. He said that a lot of people would like
their donations shown on this year's tax return. He further
asked that this letter be mailed at once.
Mayor Horton stated that he could not understand how anyone
received the impression a letter was going to be mailed with
the December Bulletin, as this was not the case. Mayor Horton
said that with the new building nearing completion, he felt
that the Library should come first and in February, he would
• then talk about donations for the Greening Committee. This
would still be in time for the spring planting season.
A prolonged discussion took place with Commissioner Basso, the
Mayor and Mrs. Rome, a member of the Community Appearance Board,
all taking part. The consensus was, after the discussion, to
send a solicitation letter with the January Bulletin.
(d) Financial Advisory Board - Vice Mayor Storm said that
this Board's next area of
concern was to review the auditors' report.
(e) Housing Board of Adjustment and Appeals - Mrs. Roberts said
that this board
had a discussion at their meeting in October due to the fact
that they had four regular members and a recent ordinance had
changed this to three regular members. Mrs. Roberts suggested
that this Board keep their four members and have only one alternate.
They have a recommendation that Ms. Elsie Oakley be appointed
as the alternate.
MOTION by Commissioner Basso, seconded by Commissioner Sullivan that
Ms. Elsie Oakley be appointed as an alternate member for one year with
• her term ending December 1982. All Commissioners voted Aye.

(f) Planning Commission - Mrs. Roberts said this Board would be
meeting December 2nd and would go bit
by bit through the zoning code.
(g) Police Committee - Mayor Horton said this Committee had one
vacancy. He said that a Resolution had
been received from this Committee which he felt should be work-
shopped before making the appointment of the third member. Much
discussion took place during which Mr. Bennett, a member of this
Committee, stated that Mr. Blum had recommended Mr. George Schultz
while he himself recommended Mr. Donald Sherbondy.
MOTION was made by Commissioner Sullivan that Mr. Schultz be appointed
as the regular member and Mr. Sherbody be appointed as alternate member.
This MOTION was seconded by Commissioner Basso.
Mayor Horton stated that under the present Resolution there is
no provision for an alternate member.
• Commissioner Sullivan then AMENDED his MOTION that Mr. George Schultz
be appointed as a regular member of the Police Committee. Commissioner
Basso seconded this MOTION. The vote was three to two with Commissioners
Basso, Blosser and Sullivan voting Aye and Mayor Horton and Vice Mayor
Storm voting Nay. MOTION carried.
Mrs. Roberts then spoke of money awarded to the Town from the
1981 Legislature for Law Enforcement Assistance. Chief Jones
recommended that a machine be purchased in order to show
slides and give a crime presentation to the condominiums.
Cost would be $944.00 and it could be purchased locally. Vice
Mayor Storm and Commissioner Sullivan objected to this, saying
that bids should be obtained first.
Mrs. Roberts then informed the Commission that there was a
total of $998.00 in the Police Academy Fund and it was
suggested by the Police Committee that this be used for
furthering the education of police officers. Chairman Blum
desired the Town Commission's opinion as to whether the Town
would fund a health program for overweight officers. The
decision was no.

(a) Metropolitan Planning Organization - No report.

(b) South Florida Water Management District - No report, however,
Mayor Horton did
say that the water restrictions are being postponed due to having
had some rain. Vice Mayor Storm then questioned Mr. Carberry's
status on this committee and Mayor Horton answered his question.
Reports - Town Attorney
Mr. Sliney said that he has not yet received the written
proposal from the attorney representing Massengill-Moore but
he understood it was being sent. He also said that he had
heard the property was up for sale.
Mr. Sliney also said that he and Lou Petzold had put together
a very comprehensive memorandum on liability as it relates to
• AlA and sovereign immunity.
Reports - Town Manager
Mrs. Roberts said that the Palm Beach County Municipal League
met on November 20th at the Delray Beach Country Club. Dr. Gil
Weiss and his wife attended and he was able to talk to the League
concerning the certification of food service workers. Their
next meeting will be December 18, 1981 in Belle Glade.
Mrs. Roberts also said that the Treasure Coast Regional Planning
Council will be meeting this month, however, Mrs. Roberts did
not have the date.
She said she had met with most of the Boards; representatives
from Strock Engineering and Coronado regarding their east side
plans; the Legislative Delegation regarding Solid Waste; Dr.
Orman concerning Milani's property; Mr. Hirshfield; the Safety
Committee; the Greening Committee; C.D.C., the engineers;
Mr. Hollohazy; the Planning Commission with Fran Hamzik and
Tom Sliney and the architects.

Mrs. Roberts reported that Mr. Jim Smith from the Federal Flood
Insurance Program will be in Town Hall on December 2, 1981
at 2:00 P.M. Mrs. Roberts also informed the Town Commission
that a Resolution had been received from the Home Builders and
Contractors regarding sales tax and she spoke of the article
in the Florida Municipal Record by Mayor Bill Frederick of
Orlando regarding the lack of local government funding.
Mrs. Roberts said that she had written to County Commissioner
Gregory. This concerns the Road and Bridge Fund money and Mrs.
Roberts said she should be hearing from Commissioner Gregory very
shortly.
Mrs. Roberts informed the Commission that she had given them
a packet of correspondence regarding the deepening of the
Intracoastal. Mayor Horton stated that he will write the
necessary letter, referring to all prior correspondence and
the Town's current thinking on this matter.
Mrs. Roberts said that the Del Trail Rescue calls will be
continued and she explained the Post Office setup for Christmas.
Mrs. Roberts continued by saying that a new maintenance man has
been hired replacing Eddie Quince, who was relieved of his duties.
Mrs. Roberts informed the Commission that the Library Committee
had asked her if they could place some books on a card table in
the lobby that they wished to dispose of, and put a box there
asking for donations. The consensus was to delay this until after
the new building was finished.
Mrs. Roberts then reported on the following departments:
Building - Mrs. Roberts said that this department had issued two
certificates of occupancy for the alterations and
repairs at Boca Cove Villas. No building permits were issued.
Mrs. Roberts said that calls were being received every day regarding
Coronado East. She said she had Tony Abbate, Building Inspector,
check out the working hours at Coronado West and Mr. Mauer, Project
Manager, wrote a memo to all his sub-contractors regarding this.
Finance and Internal Auditor - Mrs. Roberts said that $12,273.00
had been received from Florida
Power and Light for November; $144.00 from the Court through

October; and $20.00 was received for the Police Academy.
Losing the Road and Bridge Fund money this year is County-wide,
not just South County, it was determined.
Charlotte Reece and Maree Birkbeck attended a Seminar in Ft.
Lauderdale on Monday, November 30th. The preliminary audit
review will be on Tuesday, December 8th at 10:00 A.M.
Mrs. Roberts said that the funds status will be brought up to
date after the preliminary audit report next week.
Health - Mrs. Roberts said there was nothing to report, except
what she had already told the Commission about
Dr. Gil Weiss.
Maintenance - One staff member replaced.
Police - Mrs. Roberts said the monthly report had been distri-
• buted. There were no questions. Mrs. Roberts said
that the C.D.C. will be handling all the 911 Emergency calls
after December 15th. Their next meeting will be December 29th
at 9:00 A.M. at which time there will be a demonstration of the
C.D.C. setup. Discussion took place regarding the 911 stickers
for the police cars. Mrs. Roberts further reported that all
the policemen had qualified at the shooting range in November.
Town Clerk - Mrs. Roberts reported that new election laws have
been received by the Town Clerk and she (Bette
Barker) and Charlotte Reece attended a week long Seminar at Rivera
Beach November 16th through the 20th.
Public Utilities and Works - Mrs. Roberts said that the raw
water consumption was 25,000,000
gallons for this month while last month was 24,000,000. She
said she and Maree Birkbeck had met during the month with the
engineers to go over the final payment recommendation for the
water treatment plant, the general service projects and the lift
stations work. The sodium content for the water is 13.2 ppm.
Mrs. Roberts said the filters work had been finished; there is
some minor settling of the elevated water tower and this will
• be checked again in four months.

Mrs. Roberts stated that she had received one application for
the position of water treatment operator, from Larry Simpson,
who is presently working at the plant right now. Mrs. Roberts
asked the Commission if she should advertise for this position.
Much discussion took place regarding the utilities' contractors
hired by the Town, after which Mayor Horton asked if Commissioner
Basso would like to suggest that a study be made concerning a
Public Works Department? Commissioner Basso stated that he had
wanted this sometime ago. The consensus was to have Mrs. Roberts
request a proposal from the engineers for the cost of performing
a study regarding the establishment of a Public Utilities and
Public Works Department vs. the contract basis we now have.
Mrs. Roberts reported the lift station work has not been started
yet, due to a holdup on the bond. Mrs. Roberts stated that she
had informed residents in Town to write letters making their
views known regarding the zoning changes, if they were not going
• to be here when the zoning hearings will be held.
Vice Mayor Storm then brought up the subject of losing 15 to 20/
of the Town's employees in a period of two months. Mayor Horton
explained that two of the three employees were still in their
probationary periods. Mrs. Roberts told Vice Mayor Storm that
she. would give him a report on this.
Proposed Ordinance
(a) Proposed Ordinance No. - An Ordinance of the Town of
Highland Beach, Florida
amending Ordinance No. 381, which amended Ordinance No. 360,
providing a fee schedule for the following applications to the
Town of Highland Beach: Rezoning, change to the Zoning Ordinance,
Special Exception, variance, appeal to Board of Adjustment,
nonconforming use permit, special permit, site plan review
(preliminary), site plan review (final development plans), site
plan review (amended plans), subdivision plan review (preliminary)
subdivision plan review (final), plat review (new plat), plat
review (amendment of existing plat), and applications not
specifically set forth.
• This ordinance was read in full by the Town Clerk. A last sentence
was added under Section C reading "Fees paid are non-refundable".

MOTION by Commissioner Basso/Commissioner Sullivan that this ordinance
be adopted as read with the above addition. In polling the Commission,
the vote was as follows: Commissioner Sullivan - Aye; Commissioner
Blosser - Aye; Mayor Horton - Aye; Vice Mayor Storm - Aye; and
Commissioner Basso - Aye.
Resolution No. 425 - A Resolution of the Town Commission of the
Town of Highland Beach, Florida, in support
of the proposed Special Act for Palm Beach
County, providing for a Uniform Election
Date for Municipal Elections.
This Resolution was read in full by Mayor Horton. Two slight
changes were made in paragraphs 2 and 3 as well as the words
"subject to local governmental approval" were added after Palm
Beach County in the last sentence.
MOTION by Commissioner Basso/Commissioner Sullivan that the Resolution
• be adopted as read with the above changes. All Commissioners voted
Aye.
Mrs. Roberts said that another Resolution had been forwarded
to the Town by the Florida League of Cities for the property
tax relief, urging that a state-wide 1~ sales tax be added
to the present 44 sales tax.
Vice Mayor Storm said that he would be interested in this
Resolution if there could be a way this money could be used
so as to lower property taxes. After discussion, it was the
consensus that Mrs. Roberts write Tampa Mayor Bob Martinez,
Chairman of the Florida League of Cities Strike Force for Property
Tax Relief, informing him that the Town Commission was very
interested in this and would like distribution of this additional
revenue made as follows: 98 percent to the municipality, one
percent to the counties and one percent to the State.
Mrs. Roberts reminded the Commission that the Moratorium Ordinance
expires on December 27, 1981. The Town Commission decided to
hold a Special Meeting on December 22, 1981 at 1:30 P.M. for
the purpose of considering the extension of the Moratorium
Ordinance.

Items Left Over from the Workshop Meeting of November 24, 1981
81.70 Gee and Jenson Proposal
Mrs. Roberts informed the Commission this would cover the
completion of the comprehensive plan and the zoning ordinance.
Gee and Jenson are requesting that the Town notify them in
writing the name of the person who would represent the Town in
future meetings with them.
Five Minute Recess
Discussion ensued regarding Gee and Jenson's Proposal in
the amount of $31,000.00; the necessary Public Hearings that
have to be held and the person acting as liaison for the Town
with Gee and Jenson.
MOTION by Commissioner Basso/Commissioner Sullivan that the Gee and
Jenson Proposal in the amount of $31,000.00 as set forth in their
• letter of October 19, 1981 be approved. All Commissioners voted Aye.
The Commission then asked that Mrs. Roberts be the Town liaison
with Gee and Jenson.
81.73 Holiday Decorations
Discussion took place regarding where the Christmas tree should
be placed; whether it should be an artificial tree; or buy a
new one every year. The Commission also discussed the possibility
of purchasing a Norfolk Island Pine, however, Mayor Horton said
he had been informed that these trees could snap off in a 55 mile
an hour wind. Mrs. Roberts will call Mr. Lloyd Mangus and ask
his opinion as to the type of tree. It was determined that small
white lights will be used.
81.74 Clarendon Deceleration Lane
Mrs. Roberts advised that another letter dated November 25th
had been received from Mr. Digby Bridges as well as a memo from
the Community Appearance Board dated today. Prolonged discussion
took place regarding deceleration lanes and whether a simple
driveway would suffice at the Clarendon location. It was the
• consensus of the Commission that Mr. Digby Bridges and the D.O.T.
be advised that a simple driveway would be sufficient in this
case.

81.75 New Municipal Building
Mrs. Roberts told of the different proposals received concerning
carpeting, colors, window treatments, etc. and it was decided
that rather than going through interior designers, the Town
would work through Roy Simon, Architect. Other items involving
the new building had already been taken care of.
81.87 Correspondence with the DOT
This item has already been covered.
Mrs. Roberts informed the Commission that the municipalities
would not receive monies re: proposed Tourist Tax. It will be
used to promote tourism.
Mrs. Roberts reported that according to the form that the Town
sends to the Department of Revenue for reimbursement of the State
tax on gasoline, it is stated that only the Town vehicles are
to be involved in this rebate. Del Trail Fire Department was
interested in purchasing gasoline from the Town so Mrs. Roberts
will get a determination from the Department of Revenue.
Mrs. Roberts then reported that the representatives from the
Property Appraiser's office will be in Town Hall on Wednesday,
January 27, 1982 from 9:00 A.M. to 4:00 P.M. to accept Homestead
Exemptions.
Mrs. Roberts said she had been requested to supply certain
information to the D.O.T. in regard to flashing traffic signals
requested. She will furnish this information to them.
Bills for Approval
Mrs. Roberts presented the bills for approval.
MOTION by Commissioner Basso/Commissioner Sullivan to approve the
bills as presented. All Commissioners voted Aye.
