1983.06.07_TC_Minutes_Regularr _ .~~,~ TOWN OF HIGHLAND BEACH, FLORIDA • TOWN COMMISSION Regular Meeting June 7, 1983 Mayor Horton called the Regular Meeting to order at 1:30 P.M. Those in attendance were: Mayor Louis Y. Horton, Vice Mayor Mary Louise G. Blosser, Commissioner William E. Paul, Commissioner Betty Jean Stewart, and Commissioner Harry Walker. Also in attendance were Tom Sliney, Town Attorney; Elaine W. Roberts, Town Manager; and Rita Ebersole, Deputy Town Clerk. 2. Pledge of Allegiance 3. Approval of Minutes March 29, 1983 - Workshop and Special Meeting March 31, 1983 - Special Meeting April 5, 1983 - Regular Meeting April 12, 1983 - Public Hearing April 26, 1983 - Workshop Meeting, Special & Public Hearing May 4, 19 83 - Canvassing Board and Regular Meeting • Commissioner Stewart recommended two changes in the minutes of May 4th and all minutes were approved as corrected by a MOTION by Commissioner Walker, seconded by Vice Mayor Blosser, and all agreed. 4. Public Requests Mr. Walter Wanick of Stevenson Builders and owner of the property directly North of the Highland Beach Water Treatment Plant intro- duced himself. He wants to develop his property into offices with a showroom. Since the Boca Raton Fire Department needs access to his back parking lot, he requested permission to repair the dirt road, landscape and maintain part of the Water Plant property. After some discussion, Mr. Wanick said he would submit the proposal in writing and Mayor Horton advised that the Commission would review and discuss the material at their first opportunity. • Mr. Michael Dent, resident, inquired about the Delray Beach/Highland Beach lawsuit concerning sewer charges. Mayor Horton advised that if Delray gets all they want, our charges would be approximately $16.00 per month. Because of the surcharge residents are now paying, our costs could be pretty well covered. r . Town of Highland Beach Town Commission • Regular Meeting June 7, 1983 5. Reports - Boards and Committees Page 2 of 11 (a) Board of Adjustment - next meeting is set for July 11, 1983. (b) Code Enforcement Board - next meeting June 15, 1983. (c) Community Appearance Board - Mrs. Roberts advised that Mr. Savino checked and approved the trees at Carron House. They will probably get their final C/O Wednesday, 6/8/83. (d) Financial Advisory Board - next meeting is June 13, 1983. (e) Health Officer - no report. (f) Housing Board of Adjustment & Appeals - next meeting will be July 14, 1983. (g) Planning Commission/Local Planning Agency - no report. (h) Police Committee - Mr. Lowell Blum, Chairman reported the results of this Committee's meeting on June 6, 1983. He said the Committee recommends that the Town Commission give consideration to paying z of the medical coverage for the staff with dependents; consider one hour for meal time instead of the present z hr.; and explore the possibility of a 5/ night differential. Mayor Horton requested Mr. Blum to submit a summary in writing to the Financial Advisory Board. He will do this after the next meeting of the Police Committee on June 27th. 6. Proposed Ordinances and Resolutions (a) Proposed Ordinance of the Town of Highland Beach, Florida, regulating News Racks. This will be discussed at the Special meeting on June 14, 1983. (b) Proposed Ordinance No. - An Ordinance of the Town of Highland Beach, Florida, amending the Code of Ordinances of the Town of Highland Beach, Chapter 2, entitled "Administration", Article I entitled "In General", Section • 2--5 entitled "General Supervision Over Town Affairs; ' t Town of Highland Beach Town Commission Regular Meeting • June 7, 1983 Page 3 of 11 Suspension of Town Officers"- and Article II entitled "Town Officers," Section 2-20 entitled "Powers and Duties (b)." This Proposed Ordinance will be on the agenda for the next Workshop meeting on June 28, 1983. (c) Proposed Ordinance No. - An Ordinance of the Town of Highland Beach, Florida, amending the Code of Ordinances of Highland Beach Chapter 7, entitled "Buildings," Section 109.3 entitled "Temporary Occupancy." This Ordinance was read in full by Mrs. Roberts constituting a first reading. (d) Proposed Resolution No. - A Resolution of the Town of Highland Beach, Florida, honoring former Commissioner John J. Basso. This Resolution was read in full by Mrs. Roberts and a • MOTION was made by Commissioner Walker, seconded by Vice Mayor Blosser and Commissioner Paul and Commissioner Stewart to approve. Passed unanimously. (e) Proposed Resolution No. - A Resolution of the Town of Highland Beach, Florida, honoring former Commissioner Edward J. Sullivan. This Resolution was read in full by Mrs. Roberts and a MOTION was made by Vice Mayor Blosser, seconded by Commissioner Walker, and Commissioner Stewart and Commissioner Paul to approve. Passed unanimously. (f) Proposed Resolution No. - A Resolution of the Town of Highland Beach, Florida, honoring Friends of the Highland Beach Library President Betty Weatherford. This Resolution was read in full by Mrs. Roberts and a MOTION was made by Vice Mayor Blosser, seconded by Commissioner Paul, and Commissioner Stewart and Commissioner Walker to approve. Reports - Town Commission Page 4 of 11 (a) Mayor Horton - The Mayor referred to a letter from the Highland Beach Library presenting their furniture and fixtures to the Town, and a MOTION was made by Commissioner Walker, seconded by Commissioner Stewart to accept. All voted Aye. (b) Vice Mayor Blosser - No report. (c) Commissioner Paul - No report. (d) Commissioner Walker - No report. (e) Commissioner Stewart - No report. 8. Reports - Town Attorney • Mr. Sliney reported that on June 3rd a motion to consolidate the several issues was granted by the South County Court concerning the Delray/Highland Beach Sewer Issue. He said the case would probably take about three years. He also reported on the status of the Milani case, and the Lauderdale Case, which is scheduled for August 29, 1983. 9. Reports - Town Manager Mrs. Roberts reported on meetings during the month of May with: citizens, Boards, Committees, Engineers, City Managers, Gee and Jenson and County Sanitation. She said County Sanitation is requesting a review of rates which will be taken up at the Financial Advisory Board meeting on June 13, 1983. Mayor Horton inserted that since the County has imposed an increase in dumping, it was expected that an increase would be requested. Mrs. Roberts attended the dedication of the new Del Trail headquarters at which she was the key speaker. She also met with Friends of the Library (annual meeting); Palm Beach County Municipal League; developers; CDC; and our engineers - Camp, Dresser and McKee. Mrs. Roberts announced that Mayor Horton will be awarded the Phil Lewis Statesman Award and a dinner is • being scheduled for receipt of that award at a Palm Beach County Municipal League dinner in June. Regular Meeting June 7, 1983 Page 5 of 11 Mrs. Roberts received correspondence from P,S,C. announcing a Workshop meeting at Tallahassee on June 9th regarding deregulation on street lighting and/or outdoor lighting. During the month Mrs. Roberts had considerable correspondence with the legislators because of the Town's interest in Certification of Building Inspections; Fire Consolidation; warning devices on bikes; uniform election date (unless the Municipality opts out). She has also received correspondence from Delray and Boca concerning the 35 mph on AlA. Mrs. Roberts mentioned a resident who was using 3407 South Ocean Blvd. as a business address for "Celular Technology". After she wrote to them,a phone call was received from New York advising that they were opening an office in Boca Raton, and would cease using the above address. Letters were received from Risk Management regarding their . recent inspection and from Arthur B. Strock and Associates stating there was a possibility that Highland Beach may get sand from the replenishment programs due to take place in Boca Raton and Delray Beach. Mrs. Roberts reported an "Open House" sign was posted at the O'Keefe property but was removed when requested by the Police Department. Mayor Horton restated the Commission's view that "Open House" signs are permitted on new sales only with a sales person in attendance, if they are off A1A. Mrs. Roberts said she had received a copy of the letter that Mr. Marcy sent to the Department of Natural Resources, and compared the problem with that of Third Wind. The decision was to wait awhile and see what action would be taken by DNR. Mrs. Roberts spoke to other City Managers regarding the bike/walk path signs. She reported that West Palm Beach has posted signs reading "Recreation Path - Cyclist are to use extreme caution." She will work up another model for the agenda of the meeting of June 28, 1983, for the Commission's advice. • i• Town of Highland Beach Town Commission Regular Meeting June 7, 1983 Page 6 ofll Regarding the 4~ gas tax, Mrs. Roberts said we would be receiving an estimate shortly showing the amount to be credited to our Town. Mrs. Rayner reported there was some talk about the Town receiving from $12,000 to $13,000. Mrs. Roberts said we received 25 copies of the Dual Taxation Report yesterday. They have been distributed to the Commission and Town Attorney. The first Turtle Watch meeting was held on June 1st with about 6 people attending. The next meeting is planned for June 29, 1983. Marsha Barsumian will again be in charge. Mrs. Roberts had requested an increase for the contract Post Office from the U.S. Government. She requested $14,000, but was granted $13,000. Effective date will be October 1, 1983. Building Department • Final C/O's were granted to Yachtmen's Cove for three units; to Coronado for the pool and building; to Clarendon for 43 units; to Ocean Dunes for 48 units and to Boca Hi/Braemer Isle for 226 units. Mrs. Roberts explained that a staff member calls once a month to the Condominiums to ascertain the number of unsold units because the Town does not pay garbage pick up on these. In answer to an inquiry by Commissioner Walker she said an apartment goes on the tax roll when the property appraiser's office decides it is 90% completed. Unsold apartments are billed to the developer. She advised that Casuarina picked up all their permits. on May 18th and 19th with fees amounting to $23,000. LeConcord also picked up their permits paying fees of over $14,000. Mrs. Roberts advised that Beachwalk West permits expire today and they have requested a 90 day extension. Mayor Horton said he would entertain a MOTION that they be granted an extension for 90 days. • MOTION was made to this effect by Vice Mayor Blosser and seconded by Commissioner Walker. All voted Aye. y i• Town of Highland Beach Town Commission Regular Meeting June 7, 1983 Page 7 of 11 Mrs. Roberts said she had advised them they must have substantial completion by December 7, 1983. Regarding the Maravilla project which will be on the Workshop meeting, June 28, 1983, Mrs. Roberts advised that the East ,, plat was approved by the Town Commission in November 1981. Mrs. Roberts reported the New Municipal building housing the Library, chambers, and post office, received a final C/O on June 6, 1983. Tony Abbate, Building Inspector, accompanied Soll Roehner, a member of the Code Enforcement Board on a tour of the Holiday Inn, Mrs. Roberts reported. They sent a written list of problems and violations to the Town Manager. Mr. Abbate sent a letter to the Holiday Inn requesting their cooperation in eliminating the hazards. Attorney Sliney will look into the matter to determine whether there are Code violations or • simply maintenance problems. Finance and Internal Audit Department Mrs. Roberts reported monies collected through May 1983 include: Taxes $547,837.23 (balance $65,388); Sales tax $34,837 (balance $22,111); $10,558 in franchise fees from Florida Power and Light; $3,625 in franchise fees and $3,990 in excise tax from Southern Bell and $1,683 in Court fees. A $54,254 payment was made June 1st on our Sewer Revenue Bond. Mrs. Roberts reported that the projected shortfall stated last week has been changed to $47,675. Packets are being prepared and will be available for the next Financial Advisory Board meeting to be held on June 13, 1983 to discuss the 1983/84 budget forecast. Mrs. Roberts said we will continue to receive monies from Real Estate taxes (delinquent). Maintenance Department • This department continues to be very busy with routine duties and will rent a pressure cleaner next week to clean the municipal buildings. y Town of Highland Beach Town Commission • Regular Meeting June 7, 1983 Police Department Page 8 of 11 Mrs. Roberts said the Police Report for the month of May has been distributed. She met with the Police Department on Friday afternoon and will continue to do so each week for awhile. Regarding CDC, Mrs. Roberts reported the three Chiefs - (Delray, Boca Raton and Boynton) expressed their desire to sit as the Board of Directors instead of the City Managers doing so. However, the City Managers suggested they sit instead as the Administrative Board. Public Utilities and Public Works Department Mrs. Roberts reported water consumption very high for the month at 37,421,000 gallons. • She said the Water plant staff have gone on with 2:00 a.m. to 6:00 a.m. being unmanned. is on the clipboard. Mayor Horton reported was originally planned to be unmanned under and saw no objections to the plant being uni 10 hour shifts Their schedule that this plant automatic operation panned for 4 hours. During the next couple of months, the staff will check for leaks going into our sewer pipes, and do maintenance work on hatch covers and manhole covers. Items Left Over from the Workshop Meeting May 31, 1983. 82.100 Southern Bell Equipment Building. Mr. Bill Burson explained that they want to bring a conduit system from AlA underground to the equipment building behind Town Hall. This is called a voice grade circuit which can be changed to a digital circuit. The agreement was discussed. Commissioner Stewart suggested the wording on item 4 be changed from "having everything removed" to "remove if requested by the Town," and Commissioner Walker suggested that item 9 be changed to eliminate the second sentence entirely and add "or otherwise" to the first sentence. i• Town of Highland Beach Town Commission Regular Meeting June 7, 1983 Page 9 of 11 Mayor Horton summarized by saying we agree to a 15 year. term with review of rent every 5 years and Commissioner Stewart added $100 per month rent and 1% of receipts. Attorney Sliney pointed out the benfit to residents by improved services. Mayor Horton reminded Mr. Burson that they $ad agreed to pick up our attorney cost for working on this and Mr. Burson said he will take care of it. 83.1 Vacancies on Boards - This item is included on the agenda for June 14th (which will be a Special meeting). MOTION by Commissioner Walker, seconded by Commissioner Stewart to accept the resignations of Dr. Gilbert Weiss and Claude Nastri from the Planning Commission. All agreed. • 83.26 Roger Zona to present letter of ReQuest for Coronado garage final Certificate of Occupancy. Mr. Zona did not appear nor present a letter for this request. Therefore, item postponed. 83.28 Red Cross Cooperative Agreement. It was the consensus of the Commission that no problem existed in this agreement. Mrs. Roberts was directed to prepare same for execution. 83.36 Piatt - formerly - SAHCO - formerly Maravilla to be included on the Workshop June 28, 1983. 83.40 Eagle Scout Hap Crowell project request. Commissioner Walker said we all applaude his efforts but must make a decision regardless of the person. Commissioner Paul felt there is no call for a park as we already have some unwanted activities on vacant property. It was the consensus of the Town Commission to disapprove this • project proposal by Hap Crowell, Bel Lido resident. As much as the Commission would like to help the endeavor, they could not. MOTION by Mayor Horton, seconded by Commissioner Walker to spend $2,921 on the Ground water storage transmitter. All agreed. Regarding Third Wind, it was the consensus of the Town Commission to send a letter to the Department of Natural Resources stating that the Town had "no objection" to their building wooden stairs. Concerning the Massengill-Moore property, after some discussion, the consensus was to inform the owners that "We are taking this under advisement. A decision will be made based on what you say to us on June 14th. We reserve the right to fine you starting June 8, 1983." Mrs. Roberts will so advise them. After much discussion, the Town Commission decided to sit as the Moratorium Variance Appeals Board on the request for • Highlands Place application for permits. Mrs. Roberts will supply all the necessary information before the meeting of June 14, 1983. There was a good deal of discussion concerning the Town Clerk position and a ' MOTION was made by Commissioner Stewart, seconded by Commissioner Walker to hire Mary Ann Whaley as Acting Town Clerk for six months. All voted Aye.
