TOWN COMMISSION
SPECIAL MEETING
March 31, 1983
1.35 P.M.
Mayor Horton called the Special Meeting to order at 1:35 P.M. for
the purpose of: possible final C/O for Braemer Isle Building and
possible final C/O for Coronado East Tower Building.
Those in attendance were: Mayor Louis Y. Horton, Vice Mayor Mary
Louise G. Blosser, Commissioners John J. Basso and Edward J. Sullivan.
Commissioner Harry Walker was absent (ill).
Also in attendance were: Tom Sliney, Town Attorney; Elaine W. Roberts,
Town Manager; Francis Hamzik, Building Official; Tony Abbate, Building
Inspector; and Rita Ebersole, Deputy Town Clerk.
1. Braemer Isle - possible final C/O
Mayor Horton, Vice Mayor Blosser and Commissioner Sullivan
individually examined the garage lighting one evening at
Braemer Isle and said they did not find it objectionable.
Commissioner Basso did not have the opportunity to survey
the lights.
There was much discussion about whether or not these garage
lights created a nuisance to neighboring buildings.
Mr. Hamzik gave a report on a light reading taken by Mr.
Abbate at the Coronado after they had blackened their light
fixtures around the sides. He said between two Lights on
floor level there was total darkness. This does not meet
Code requirements. More discussion followed. Tony Abbate
will also take readings at Braemer Isle.
Mayor Horton read into the record a memo received from the
Community Appearance Board dated March 31, 1983 re Braemer
Isle garage (see attached).
Mr. Delaney said the building was completed according to the
South Florida Building Code and the Town Code and approved
plans and he did not think it fair to delay the final C/O
because of a possible nuisance factor.
It was then decided that a determination would be made at
the Town Commission Regular meeting to be held April 5, 1983.

In the meantime, the Commission will take a tour of Braemer;
lamination will be checked and Mr. Abbate will submit his
findings.
2. Coronado - possible final C/O East Tower
Mayor Horton read into the record a letter from the
Community Appearance Board dated March 31, 1983 (attached).
Mr. Mass, Vice President, Trafalgar Developers, stated that
they have tried to accomodate the concerns of the Community
Appearance Board and they have taken steps to shield the
lights but must go along with the Code.
Mr. Hamzik and Mr. Abbate stated that all requirements of
the Codes have been met; the building is safe.
• Mr. Tim Smith, attorney for Trafalgar stated "that the bonds
issued to the Town are meant to guarantee performance of
requirements which Trafalgar now accept as part of its
building plans and specs and which are required for the
final C/O."
After discussion on several other items, a MOTION was made
by Commissioner Basso, seconded by Vice Mayor Blosser that a final
Certificate of Occupancy be granted for the Coronado East Tower with
the following conditions to be agreed upon:
1. The developer agrees to have the bonds and Indemnification
Agreement revised to the Town Commission's satisfaction
which would include amended language providing "within one
year, assurances of the Federal Insurance Company, and the
proviso that the bonds cannot be withdrawn, cancelled or
revoked except with Town Commission approval."
2. The developer agrees to include the language that "the
bonds are meant to guarantee performance of requirements
which Trafalgar now accepts as part of its building plans
and specifications, and which are required for the Final
Certificate of Occupancy."

3. The screening of the balconies will be completed
April 1, 1983.
4. Any drainage problems will be taken care of by the
developer as stated, upon notification by the Town.
ALL VOTED AYE.

MOTION by Commissioner Basso, seconded by Vice Mayor Blosser that
a Certificate of Occupancy be granted for the Guard House. All
voted Aye.
MOTION by Commissioner Sullivan, seconded by Vice Mayor Blosser to
ADJOURN. All agreed. Time 4:35 P.M_

We recognize the fact that you have to make a decision on the
Braemer Isle garage C/O. Please consider these comments.
1. We have accepted the fact that the largest building of its
kind in Highland Beach was given a building permit without
a CAB approval or even a review.
2. We have tried for almost 2 years to minimize its massive size
and ugliness by asking the developer to landscape the garage
roof, put louvers or decorative blocks on garage openings to
reduce the lighting glare and to extensively landscape all four
sides of the building. (South side still has 2, 3-story elevator
towers not landscaped).
3. We have been willing to compromise - the developer hasn't given
an inch and has been most uncooperative.
4. Our recorded minutes will substantiate the above claims.
5. Mr. Delaney promised he would give the CAB alternative plans in
changing the sign at Braemer entrance by today's meeting - this
has been going on for three months - he has not submitted
anything. The entrance is part of the C/O. (You have already
addressed the guard house situation).
6. We are still concerned by the mangrove trees leaning, which have
been bulldozed along AlA creating an ugly site at the entrance.
The entrance is part of the complex and therefore part of the C/O.
How can a C/O be granted when the entrance as it now stands is
dangerous, hidden from the road,and the sign unseen by passing cars.
We definitely feel that a C/O should be granted only when the entire
project is completed.

We recognize the fact that you have to make a decision on the
Coronado ~~ C/O. Please consider these comments.
We realize that plans for Coronado East side Clubhouse were
reviewed by CAB. But, the roof over the entrance is identical
to that which was removed on the West side and the Clubhouse
building is small and parking limited. We did not realize
from reading flat plans how huge this porte cochere would be.
Perhaps the CAB could request a landscape review to increase
foliage and tree size and number in order to minimize the
roof overhang or perhaps the Town Commission can request removal
of the gas station type structure as they did on the West side.
