1983.02.24_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH, FLORIDA • TOWN COMMISSION WROKSHOP MEETING February 24, 1983 1:00 P.M. Mayor Horton called the meeting to order at 1:00 P.M. Those in attendance were Mayor Louis Y. Horton, Vice Mayor Mary Louise G. Blosser, Commissioners John J. Basso, Edward J. Sullivan, and Harry Walker. Also in attendance were: Attorney Louis Petzold; Bernice Smith, Admin- istrative Assistant; Francis Hamzik, Building Official; and Rita Ebersole, Deputy Town Clerk. 83.1 Vacancies on Boards (a) Community Appearance Board - Since Nita Martin has missed the last three meetings, the Board recommended that Mrs. Louise Johnson be appointed as Regular Member and Mrs. Betty Jean Stewart be reappointed as Alternate. (b) Financial Advisory Board - Alternate vacancy - no • recommendation. (c) Police Committee - Mr. John Sudbay was recommended by the Committee to fill the alternate vacancy. Commissioner Walker said he would like to see and meet the members proposed before voting on appointments. Commissioner Basso concurred and the consensus was to do this in the future. Mayor Horton instructed Bernice Smith to notify Mr. Sudbay and invite him to appear at the next regular meeting on March 1, 1983. 82.49 Delray Beach/Highland Beach sewer issue After some discussion, the consensus was that the time has come for action. The Town Counsel was asked to relay to Delray Beach that without answers to our questions, we will ask the Court for a judgement. April 1st was set as a deadline. 82.75 Proposed Resolutions (or Ordinances) (a) Planning Commission - qualifications, duties and respon- sibilities. Vice Mayor Blosser said "special exceptions" are interwoven in the Code. The Commission must decide • who will handle them. 'Commissioner Basso asked that it be taken up at the next workshop meeting. All agreed. (b) Community Appearance Board - Vice Mayor Blosser agreed to continue this study. 82.96 Holiday Inn - Real Estate office issue Mr. Petzold submitted a first draft drawn up by Tom Sliney which he said was patterned after the Ocean Ridge Ordinance. After much discussion, Mayor Horton said we should include in the ordinance some clause which would also hold or restrain the landlord from renting properties for a non-conforming use. This item will be on the March Workshop agenda. 82.100 Southern Bell request • Attorney Petzold advised that the Town should get more detailed information from Southern Bell regarding this request for a land lease. This item will be put on the next Workshop agenda. Mr. Steinhart requested to be heard re the Comprehensive Plan. Since he was not listed on the agenda, he was advised to submit a request to be placed on the next agenda. Commissioner Sullivan asked that the people from Braemer Isle be allowed to speak. Mayor Horton read into the record a memorandum received by the Town Commission from Amelie Leng, Chairman, CAB dated 2/24{'83. "At a regular meeting held on Thursday, February 24, 1983, the Community Appearance Board voted to grant a Certificate of Occupancy for the Braemar Isle Tower, excluding the garage. The vote was unanimous. The reason for excluding the garage was due to unresolved controversy regarding openings of garage building, lighting, landscaping, shape of building and bare roof. " 1 • Town of Highland Beach Town Commission • Workshop Meeting February 24, 1983 Page 3 of 8 "Since the whole problem of the garage had been directed to the Town Commission previously, we feel that any issuance of a Certificate of Occupancy on the garage building should be done by the Town Commission . " Mr. Romanoff of Dalton Place said an agreement was reached between Mr. Delaney (Boca Hi) and the CAB last July 1981. Mr. Romanoff feels the agreement was not fulfilled as far as landscaping is concerned but Mr. Delaney contends that they planted over and above what the agreement specified. Mr. Romanoff requested that a C.O. not be issued until this complaint is satisfied. After discussion, Mayor Horton directed Bernice Smith to contact the CAB; get a copy of the agreement; and make certain by contacting Mr. Delaney and Mr. Romanoff that this is, in fact, the agreement. The Town Commission will then study the matter. Fran Hamzik, Building Official, advised that he is having other • problems with Braemer Isle and will not issue a C.O. at this time. He also mentioned that a C.O. is issued on the whole package; it could not be issued on the building only. Mr. Romanoff said he would yield to the decision of the CAB and Mayor Horton then directed Bernice Smith to tell the CAB theTown Commission would like them to make a determination. Mrs. Ellen Gerber, representing the Code Enforcement Board, raised some questions regarding citations against Evanton Baye and Braemer Isle. Mr. Delaney requested the Commission to consider releasing some of his funds and was advised that no funds would be released until the Certificate of Occupancy is issued. 83.15 Proposed Ordinances - had first reading (a) An Ordinance of the Town of Highland Beach, Florida amending the Code of Ordinances of the Town of Highland Beach, Chapter 3, entitled "Air Conditioning Code," Section 3-1 entitled "Standard Mechanical Code Adopted" and Section 3-l.l entitled "Same---Amendments, • Deletions and additions." (c) An Ordinance of the Town of Highland Beach, Florida amending. the Code of Ordinances of the Town of Highland Beach, Cahpter 12 entitled "Gas" Section 12-1 entitled "Southern Standard Gas Code---Adopted." (d) An Ordinance of the Town of Highland Beach, Florida amending. the Code of Ordinances of the Town of Highland Beach, Chapter 19, entitled "Plumbing", Section 19-1, entitled "Standard Plumbing Code---Adoption." All seven were mentioned, but only Chapter 23 amendment (e) and Chapter 15 amendment were discussed in detail. • Town of Highland Beach • Town Commission Workshop Meeting February 24, 1983 Page 5 of 8 Commissioner Sullivan suggested an article be published in the Town Newsletter advising the residents about restrictions in parking at the rear of the Town Hall. Fran Hamzik suggested that large trucks or trailers could be parked behind the fence thereby freeing more parking space. 83.16 Ordinances for Introduction (a) Regarding the Town Manager's duties - Commissioner Basso requested this Ordinance be workshoped so that there will be time to study it. (b) Regarding amplified sounds - This ordinance is still being worked on. (c) To regulate News racks - • Commissioner Basso recommended that even without an Ordinance we notify the newspaper publishers that the news racks will be put outside the Town Hall. Attorney Petzold presented an Ordinance which he said was a Palm Beach Ordinance doctored up for Highland Beach. After some discussion, it was decided to study this Ordinance and discuss it at the next Workshop meeting. 83.18 Casuarina Digby Bridges and Bertram Schwartz, Manager-Partner of Joint Venture presented a plan that included an access easement to the Town leased F.I.N.D. parcel (west of Casuarina) requested by the Town Manager, a park at the rear of Casuarina which would include walks, lighting, and benches and dockage on the Intracoastal, if it is granted by the Town. After discussion, the Mayor pointed out that policing, liability, etc. would have to be studied. We will contact them when a decision is reached. • 83.10 Discussion re Fire Prevention measures in apartment buildings. Fran Hamzik advised sprinkler systems in common areas and smoke detectors in each apartment is the most effective method of Town of Highland Beach Town Commission Workshop Meeting February 24, 1983 Page 6 of g protection. However, the sprinkler systems are very costly. The recommendation was that the Town require smoke detectors in the common areas, distance apart to be determined by the Fire Marshall with three years to comply. The Fire Marshall could go into each condo and explain the necessity of the Ordinance. 83.11 Items specifically not budgeted: (a) At least $25,000 to match the County grant for bike walk path. It was noted by Vice Mayor Blosser that the construction must begin at least one month prior to the new fiscal year. Mayor Horton will meet with Mrs. Roberts concerning financing of this project. (b) Paving for parking near the Fire Station. The Commissioners felt this was a low priority item which could be postponed. • (c) Quotes re Emergency lights in Municipal buildings such as Town Hall, Fire and Police Stations and Garage. Although the low bid was $2,000, the Commission felt this expenditure a necessary investment. (d) Switches for ground light fixtures. No bids were received. Lower wattage bulbs have been installed and every other bulb could be removed to further dim the premises if required. (e) Augmented landscaping at the Municipal Center. This item was tabled. 83 14 Proposed member for a County Blue Ribbon Marina Committee. This item was set aside for the time being. 83.17 Job description for full-time Librarian. Mrs. Smith reported that eleven applications have been received. It was requested that library salaries be procured from Delray Beach and Boca Raton for comparison study; also part-time library salaries. Town of Highland Beach • Town Commission Workshop Meeting February 24, 1983 REPORTS - TOWN COMMISSION: Page 7 of 8 Mayor Horton reported a letter was received from Mrs. Storm saying a "Meet the Author Day" will be held in the Library and inquiring if the Author could sell his books on the premises. The consensus was that selling books for profit would be prohibited. Mrs. Storm will be so advised. Reference was made to a letter received from Ray Blosser suggest- ing a Public Opinion Poll be made regarding the turning lane on AlA. Mayor Horton said he will draw up something to that effect to be considered for the May 3rd Election ballot. Re Jackie Winchester's request that there be a uniform election date, the consensus of the Town Commission was in agreement. It will be considered at the Regular Meeting on March 1, 1983, for • formal action. Vice Mayor Blosser reported re Third Wind beach stairs, which are in violation. She advised the Town Commission that formal action will be required at the Regular meeting, March 1, 1983. She also mentioned that Dr. Pierce of Seagate will honor Mr. Shindler's offer to meet to try to solve the flooding problem near Seagate on AlA. Perhaps a meeting could be arranged with Mrs. Roberts, Mr. Shindler, Dr. Pierce and condo Presidents or Managers, Vice Mayor Blosser said. She also mentioned the possibility of forming a Committee of the Coastal Towns, or perhaps Mrs. Roberts at one of the Manager's meetings could find out if anyone would be interested in forming a monitoring Committee re AlA. She further mentioned some aspects at the Coronado site. Commissioner Basso asked if the Cable TV dish had been inspected by the Building Official and reported newspaper circulation in Town - Sun Sentinel and Boca News. Commissioner Sullivan spoke re school tax dollars from Highland Beach and suggested a watchdog committee whose main job would be to monitor State and County spending and its effect on us. 1 • .~ ,_ Town of Highland Beach Town Commission • Workshop Meeting February 24, 1983 Page 8 of 8 Commissioner Walker asked Betty Jean Stewart to report re the Legislative Delegation meeting after the three Commissioners left the meeting. She gave a brief summary. It was the consensus of the Commission that even though the Town is against consolidation of the Fire Districts, the County will win out. Mayor Horton said it would be October 1984 before it goes into effect and in the meantime the Town could reactivate the Fire Study Committee formed last year and seriously reconsider forming a Highland Beach Fire Department or a Public Safety Department. Attorney Lou Petzold announced that the remainder of paper work had been received from Highland Cable TV transferring from a partnership to a corporation. Mayor Horton said that since the Town Commission had agreed to this transaction when the papers were complete, he would sign same. ® Attorney Petzold advised that nothing new had happened in the Milani versus Town of Highland Beach case. A hearing is set for March 24, 1983. The Building Official reported that he will not be attending the Building Officials Seminar. MOTION by Vice Mayor Blosser/Commissioner Walker to adjourn at 5 P.M.
