Minutes of Meeting of the Town Commission
Regular Meeting
February 1, 1983 1:30 P. M.
Mayor Horton called the Regular Meeting to order at 1:30 P. M.
Those in attendance were: Mayor Louis Y. Horton, Vice Mayor Mary Louise
G. Blosser, Commissioner John J. Basso, Commissioner Edward J. Sullivan,
and Commissioner Harry Walker. Also in attendance were: Elaine W.
Roberts, Town Manager; Thomas E. Sliney, Town Attorney; Chief Kenneth
Jones; and Elizabeth L. Kolek, Deputy Town Clerk.

MOTION was made by Commissioner Harry Walker/Vice Mayor Blosser that
the minutes be approved as written. Without objection, the minutes were
approved.
• 4. Public Recruests and Comments
Town residents, Doris Rome, Michael Dent, and Dr. George Linn
voiced their opinions against consolidation of the fire depart-
ments in the County. In answer to a question, Mayor Horton gave
a history of Del Trail Fire District and the consensus, after
discussion, of the Town Commission was that service by the Del
Trail Fire District was very good. The Town Commission stated
they are against consolidation of the fire districts in the County.
The Town Commission directed the Town Manager to write a letter to
the County Commissioners to go on record that they are against
consolidation of the fire districts in the County.
Betty Weatherford, President of Friends of the Highland Beach
Library, asked the Town Commission for a full-time employee for
the library as soon as it can be arranged, with supplemental help
by the volunteers who reside in Town. She suggested that the
library hours remain the same, which presently are 10 a.m. to 3 p.m.,
Monday through Friday, with possible shortened hours during July
and August. Mayor Horton commended Mrs. Weatherford and her staff
for their excellent work.
Ed Davis expressed his opinion that a temporary Certificate of
Occupancy should not be issued to Coronado before final completion
of the complex, due to safety hazards and incomplete items.

(a) Letter from Trafalgar Developers (Coronado Pro-iect), dated
January 12, 1983.
No new information has been received, the Town Manager stated.
5. Reports--Boards and Committees
(a) Board of Adjustment--At their meeting on January 17, 1983, they
recommended that Harold Cohen be appointed as Alternate No. 2
member, Mrs. Roberts reported.
MOTION by Commissioner Basso/Commissioner Sullivan that Harold Cohen be
appointed as Alternate No. 2 Member of the Board of Adjustment. All
voted AYE.
(b) Code Enforcement Board--Will hold their next meeting on
February 9, 1983.
(c) Community Appearance Board (CAB)--Vice Chairman Doris Rome
reported: the Board approved the Sunny Surf permanent sign
at their January 27, 1983 meeting and tabled two other sign
applications; they will inspect Evanton Baye, Carron House,
and Braemer Isle on February 3, 1983; and Tom Delaney's request
for changes to the North Guard House Entrance at Boca Hi was
• discussed.
Frank Savino, C.A.B. member and Chairman of the Greening of
A-1-A Committee, thanked Mayor Horton for his supportive article
in the monthly BULLETIN and asked when he could expect the
funds due from the Town Commission so that the trees could be
ordered and planted. Mayor Horton stated that the amount would
be forwarded soon.
(d) Financial Advisory Board--No meetings scheduled.
(e) Health Officer--A report was received from Dr. Harry Weiss
regarding his inspection of the Holiday Inn on January 24, 1983.
Kitchen, utensils, china, bar, and dinina3~tables were all right.
He was assured that the garbage disposal will be promptly re-
paired. Renovations were in progress to the outdoor lounging
area, but there was no evidence of a shower for the pool users.
The pool was dirty with oil and sand and did not pass inspection.
He recommended that the County close the pool if the outdoor
shower was not installed soon because they have known about this
for some time. Locks have been changed on rooms as a preventive
against burglaries.
(f) Housing Board of Adjustment and Appealsr~-At their meeting on
January 11, 1983, they recommended that Elsie Oakley be re-
• appointed.
MOTION by Commissioner Basso/Commissioner Sullivan to reappoint Elsie
Oakley for another term. All voted AYE.

(g) Planning Commission--Will hold a Public Hearing on February 16,
1983 regarding: (1)Eliminating temporary Certificates of
Occupancies; (2)Two years for completion, instead of one year,
with no extensions (of building permits); and (3)Building
Moratorium extension. The Town Commission directed the Town
Manager to advertise one-fourth page ads regarding the
Comprehensive Plan Public Hearings in the Boca Raton News
instead of the Sun Sentinel Newspaper because of the large
savings.
(h) Police Committee--Chairman Lowell Blum recommended that pur-
chase of a beach buggy and other life-saving equipment not yet
purchased be tabled for the present, until their feasibility is
studied more thoroughly.

All of the Above ordinances were read by title only by Mayor Horton
constituting a first reading.
7. Reports--Town Commission
(a) Mayor Louis Y. Horton--Mayor Horton stated that the report from
our engineers regarding the calculations from Delray Beach and
the sewer issue will be on the February 22, 1983 Workshop Agenda.
(b) Vice Mayor Marv Louise G. Blosser--Vice Mayor Blosser reported
on the drainage problem on A-1-A at Seagate, at the South end of
• the complex. She requested that this issue be on the Special
Meeting Agenda for February 15, 1983, with representatives from
the DOT in attendance.

(c) Commissioner John J. Basso--Commissioner Basso reported that
the bicycle-path in front of Beach Walk East has a drainage
problem--3 inches of standing water--and requested that the
path be raised 3-4 inches. Mrs. Roberts stated that she spoke
to Fran Hamzik, Building Official, who has requested Beach
Walk East to correct this. Commissioner Basso stated that the
hearing date for the Milani Lawsuit against the Town is
scheduled for March 24, 1983. Commissioner Basso discussed
an ordinance to limit businesses in Town, similar to an Ocean
Ridge ordinance and also discussed an ordinance regarding
news racks. The Town Commission asked Tom Sliney, Town
Attorney, to draw these up.
(d) Commissioner Edward J. Sullivan--Commissioner Sullivan stated
he was in favor of beach cleaning, but discussion that
followed revealed that it would be too costly to the Town
(according to bids received) with legal problems that may arise,
since this would involve private property.
(e) Commissioner Harry Walker--No report.

8. Reports--Town Attorney
Had no further reports.
9. Reports--Town Manager
A land survey has been made by Southern Bell regarding the request
for property to be leased. The consensus of the Town Commission
is that there are many points that still need further study
regarding this lease to Southern Bell so they could not approve
this at this time. It will be added to the Workshop Meeting Agenda
on February 22, 1983.
Damon Smith, Assistant to Senator Lawton Chiles, met with six Town
residents on January 31, 1983, in Town Hall.
Mrs. Roberts reported that she had many conversations with resi-
dents regarding assessed valuations, taxes, and homestead exemptions
and she also met with boards and committees.
An invitation was received from the Palm Beach County Municipal
League for a luncheon meeting on February 22, 1983, at 12 Noon,
with the Legislative delegation in attendance.

Correspondence has .been received from: (1) Department of Environ-
mental Regulation regarding the Drexel Management request for removal
of mangroves; (2) Kelton & Associates regarding the dual taxation
issue requesting 1982 totals and services by the Palm Beach County
Sheriff's Department (Chief Jones and Mrs. Roberts will meet with
a Kelton representative on February 2, 1983); (3) Resident, Dick
Brunton complained that Cable TV was interfering with his regular

• tv reception. He was referred to Highland Beach Cable TV; (4) The
Kaltenbachers wrote a letter regarding poor drainage in front of
their home on Intracoastal Drive; (5) A letter was received from
the Bellas family, who own a four-plex across from the present news
stands near Royal Highlands, complaining about the traffic;
(6) Pictures were received from Mr. Bernhard (resident of Ambas-
sador's East) of the December 1 drowning; (7) Sweetwater Realty
asked for permission to place an "Open House" sign and a flag
near Bel Air Drive on A-1-A. The Town Commission consensus was to
disapprove the flag but allowed a small "Open House" sign during
the daytime when a salesman was in attendance, and only for the
month of February, 1983; (8) No reply was received from Mr. Moss,
attorney for Royal Highlands, regarding our letter of January 25,
1983.
Notice was received from Gee & Jenson that they would complete
what was contracted for regarding the Comprehensive Plan and
Zoning Code within budget but anything else would be additional.
Information was received from Jackie Winchester, Supervisor of
Elections, regarding a legislative bill for uniform election dates
which would result in tax savings. The Town Commission directed
the Town Manager to notify the Supervisor of Elections that they
approve of this but it would involve a change of the Town's Charter.
A letter was read into the record from a resident, Mr. Rothang,
who complained about too many high rises and congestion of buildings
in Town, he was against 3-laning of A-1-A, he recommended entrance
signs for the Town, he commended the Town Commission regarding
the resolution about cleaning up after pets and no dogs allowed
on the beach, and also recommended that trash barrels be placed
along A-1-A .
A letter was read into the record from a resident, William Burns,
who was against the Town spending $25,000.00 to improve the bike-
path because bikes do not use it but go on the roadway.
The Florida League of Cities requested via their Datagram---road
projects the Town will need in the next five years.
An invitation was received from the Palm Beach Civic League to
attend a Beach Erosion Seminar on February 14, 1983.
A notice of Public Hearings in February and March by Southern
Bell and Florida Public Utilities (gas) for rate increases has
been posted in Town Hall.
The State Supreme Court has been asked to review the dual taxation
suit.
• Mrs. Roberts inquired if Mr. Stutting would qualify for the
Carnegie Foundation awards for heroism, but Mayor Horton felt that
he would not qualify, but recommended that Michael Dent could
recommend this to the Highland Beach Civic League.

• A demonstration was given by the National Early Warning Systems on
Ja Hoary 21, 1983, attended by: Vice Mayor Blosser, Fran Hamzik,
Chief Jones, and Elaine W. Roberts.
All the municipal buildings passed the Risk Management safety inspec-
tion recently, regarding Workers Compensation.
The Bel Lido Property Owners Association has reserved Town Hall for
their annual meeting on Friday, February 25, 1983, at 7:30 p.m.
BUILDING DEPARTMENT
The Building Official asked to attend the Building Official's
Conference from February 27 to March 2, 1983 at Daytona Beach. The
consensus of the Town Commission was that he could go for two days
if he is back by March 1, for the Regular Meeting of the Town
Commission .
Bernice Smith attended a Construction Industry Hearing regarding
certification of Building Officials in January. A final decision
will not be made until March.
Tony Abbate submitted a report of his inspections of lights on several
new condominiums in Town, with recommendations.
• The Building Department issued two temporary Certificates of Occupancy
at Maravilla--one for the house and one for the the guest facility.
Sand Pebbles~at 4520 South Ocean Boulevard was asked to "cease and
desist" advertising since they do not have a sales facility.
FINANCE DEPARTMENT AND INTERNAL AUDIT DEPARTMENT
The Town has received $309,000.00 in taxes from the Tax Collector's
Office, with another $93,000.00 due by the end of the week.
Sales tax money received since December totals $12,638.00 averaging
about $4,000.00 per month.
$9,011.00 was received from F.P.L. for the month of December, 1982.
$532.00 was received from the Court. ($74.00 for the Police Acadamy)
$550.00 was received from .investment earnings.
A 1972 Bond Issue payment was made today in the amount of $19,455.00.
A procedure has been instituted to charge a $5.00 fee for bad checks
received, as allowed by Florida State Statutes, Chapter 215.
• The Finance Department and Elaine W. Roberts are reviewing the destruc-
tion of certain records. Approval has to be obtained from the State
Bureau of Archives.

• Due to the reduction of assessments because quite a few property
owners in Town protested, the Town could lose approximately $15,000.00
in tax revenue. This affects our budget because the assessments
are reduced after the budget is adopted.
MAINTENANCE DEPARTMENT
The Maintenance Department reported that outside wattage has been
lowered on all Municipal Center lights. No quotes have been received
yet regarding the outside lighting fixture switches.
POLICE DEPARTMENT
The monthly and annual reports have been received from the Police
Department.
TOWN CLERK DEPARTMENT
The Town Clerk ads have been published in the local newspapers and
will appear in the DATAGRAM. Two interviews have been held.
PUBLIC UTILITIES DEPARTMENT
Total water consumption for January (1983) was 31,000,000 gallons,
• as per the Water Treatment Plant report. The work at the WTP is
progressing well and a building permit was obtained from the City
of Boca Raton.
The agreement with U.S.G.S. has not yet been executed, but the
amount of $5,950.00 was approved. Their new test wells were com-
pleted by January 19, 1983, at their expense.
Weekly reports are being submitted from the Utilities Director
regarding the sewers and lift stations. A copy is sent to our
engineers.
A letter was sent to Victor Pujals (at C.D.M.) requesting that the
broken and damaged stepping stones near Seagate be replaced by their
contractors who refurbished the lift station last year.
TOWN HALL

No quotes have been received yet on the landscaping improvements
but the Garden of Eden has responded and has an appointment to meet
here next week.

Meeting Agenda of February 15, 1983.

83.5 Beach Cleaning Quotes
Mrs. Roberts reminded the Town Commission of quotes received.
The consensus of the Town Commission was that it would be too
costly at this time. After some discussion, it was agreed
that violators of ocean front property with very dirty beaches
would be sent a letter to clean up the property within a
certain period of time or be given a citation. Tom Sliney
will research this further but feels that the report would
be similar to the report concerning the Suzuki going on
private property.
83.6 Proposed uniforms for Water Treatment Plant employees
Tabled until next fiscal year budget for 1983-84.
83.7 Disposition of old rescue vehicle now stored near the Town

After some discussion, the consensus of the Town Commission
was to advertise and sell the 1971 Chevrolet Step-van.
Mayor Horton will write a letter to the Del Trail Fire District
to verify officially receiving the vehicle back from them.
83.8 Letter from DOT containing schedule for three-laning A-1-A
Will be on Special Meeting Agenda of February 15, 1983.
83.9 Bel Lido--bridge wing abutments
After some discussion, since this is not an emergency and will
come out of General Funds, it was tabled. The cost will be
included in the letter to be sent to the Florida League of
Cities as a required item in the 5-year projection for the
Town.
83.10 Fire prevention measures in apartment buildings
This item to be included on Workshop Meeting Agenda of
February 22, 1983.

progress. If the City of Boca Raton will not pave the
street, Mrs. Roberts will write a letter to ask if they
will abandon Appleby Street to us.

More study is needed as to when and where the committee is
to meet and what purpose it serves.

The Town Commission approved one two-sided permanent sign on
a "V" angle and extended the time to April 30, 1983 to take
down the old guard house and install a new North entrance
structure or they will receive a citation.
