1984.11.27_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission WORKSHOP MEETING TUESDAY, NOVEMBER 27, 1984 9:30 A. M. A Workshop Meeting of the Town Commission was called to order in the Town Commission Chambers at 9:30 a.m, on November 27, 1984 by Mayor Louis Y. Horton. Also present were: Vice Mayor Mary Louise G. Blosser and Commissioners John J. Basso, William E. Paul, and Betty Jean Stewart. Also present were: Town Attorney Thomas E. Sliney, Building Official Bruce Sutherland, Finance Director Maree M. Fowler, Acting Town Manager Mary Ann Whaley, Deputy Town Clerk Elizabeth L. Kolek, citizens, and the general public. 84.1 PUBLIC COMMENTS AND REQUESTS: Mr. Michael Dent, a Town resident, addressed the Town Commission stating his opposition to the proposed County park within the Town and that he stated his opinion to Palm Beach County Commissioner Dorothy Wilken. He also asked that an announcement be placed in the • Bulletin to advise Town residents to state their opposition to this park to all the County Commissioners. He also felt that not only would the park bring the unwanted public into Town but would also place an additional burden on the Town's Police Department. In reply to his question about when the new property tax bills can be expected, Commissioner Basso stated that he had been in contact with the County office, who told him they would be mailed in December. Mr. David Custage agreed with Mr. Dent that he did not know anyone in Town who was for the proposed County park. He also stated that regarding the North gatehouse at Boca Highland, the Town Commission should see that it was built according to the approved plans. Mayor Horton replied that no one could be forced to build anything unless they were ready to build. 84.2 BOARDS AND COMMITTEES: Ms. Jeanne Jackson and Mr. Raymond Masciarella were interviewed as applicants for vacancies on the Board of Adjustment. Mr. Masciarella also expressed interest in membership on the Planning Board. It was the consensus of the Town Commission to discuss the vacancies on the various boards in Town at the next Workshop Meeting scheduled on December 18, 1984, since none of the vacancies were urgent at the present time. • MINUTES of Town Commission Workshop Meeting Highland Beach, Florida November 27, 1984 84.3 PROPOSED ORDINANCES AND RESOLUTIONS Page 2 of 6 (a) AN ORDINANCE AMENDING CHAPTER 10 OF THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH, FLORIDA, ENTITLED "FIRE PREVENTION" BY ADDING A SECTION ENTITLED "APPLICATION OF PALM BEACH COUNTY FIRE CODE." There were no comments nor objections. This Ordinance will have a final reading and possible adoption at the Regular Meeting of the Town Commission on December 4, 1984. (b) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE CODE OF ORDINANCES OF THE TOWN OF HIGHLAND BEACH, CHAPTER 22, ENTITLED "SEWERS", SECTION 22-2 ENTITLED "SEWER SERVICE CHARGES" TO ELIMINATE CURRENT SURCHARGE. Because the Town Commission may wish to recommend that some changes be made in the recent final preliminary report received from the engineers, Greeley & Hanson, after hearing the report made by Mr. Dan Anderson and Mr. E. Lawrence Adams, Jr. (of Camp, Dresser & McKee Inc., the Town's consulting engineering firm) regarding the latest Greeley & Hanson report today, no action was taken by the Town Commission today except to ask that the Finance Department and Town • Attorney give the matter further study so that a new sewer service charge for Town residents could be determined in time for the January billing, if possible. Larry Adams recommended that a yearly year-end audit be made to adjust the rate and also that an independent audit be made every two to three years. Acting Town Manager Ms. Whaley stated that the Utilities Director Mr. William Joseph Moss recommended that the sewer line seepage be repaired as soon as possible to measure the correct flow of sewage before a new charge be determined and also suggested that a TV study be done costing between $5,000 and $7,000. This item will be discussed at the Regular Meeting of the Town Commission on December 4, 1984. (c) PROPOSED ORDINANCE AMENDING CHAPTER 2 RELATING TO BOARDS AND COMMITTEES TO TRACT ZONING ORDINANCE. This Ordinance will be discussed further at the next Workshop Meeting on December 18, 1984. (d) PROPOSED ORDINANCE REGARDING MANDATORY SEAWALL INSPECTIONS. After much discussion, it was the consensus of the Town Commission to ask the Code Enforcement Board for its recommendation. This Ordinance will be further discussed at the Workshop Meeting on December 18, 1984. • (e) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, REPEALING ORDINANCE NUMBER 482, ADOPTED NOVEMBER, 1, 1983, DECLARING AN EXEMPTION TO THE PROVISIONS OF CHAPTER 83-498 OF THE LAWS OF THE STATE OF FLORIDA PROVIDING MINUTES of Town Commission Workshop Meeting Highland Beach, Florida Page 3 of 6 November 27, 1984 FOR UNIFORM FILING DATES AND UNIFORM ELECTION DATES FOR MUNICIPAL ELECTIONS. This Ordinance was scheduled for first reading at the Regular Meeting on December 4, 1984. 82 49 Highland Beach/Delray Beach Sewer Issue Status There were no further comments since the matter was discussed earlier in the meeting. 84.42 Status of Drexel Management Project Mayor Horton stated that Drexel Management has received a copy of Attorney David Friedman's Report regarding gaps in Drexel Managements' calendar and the Town Commission expects to receive their reply when this matter is discussed at the Regular Meeting of the Town Commission on December 4, 1984. 84 50 Discussion re request for approval of partial Boca Highland North Gatehouse project Mayor Horton stated that the North gatehouse can be built with the present approved plans. After discussion, the consensus was to abide by the position agreed to previously. REPORTS - TOWN COMMISSION MAYOR LOUIS Y. HORTON - The Palm Beach County Municipal League's next meeting will be held on December 14, 1984. All of the preliminary recommendations in the selection of the finalists for the position of Town Manager have not yet been turned in by all the Commissioners. Discussion ensued regarding the quali- fications the Town Commission was most interested in, other fringe benefits, salary is negotiable, experience, etc., in deciding on a new Town Manager. The consensus of the Town Commission was to discuss this matter further as the last item on the agenda of the Regular Meeting on December 4, 1984 Mayor Horton has just received word that the Department of Environ- mental Regulation of the State of Florida has denied his request (on behalf of the property owner involved) to extend the Artificial Seaweed Project at the South end of Town an additional 200 feet to the North. The project will proceed with the planned 1200 feet. Mr. Edward Fanning (of Boca Highland) has requested that the North • gatehouse be discussed at the Regular Meeting on December 4,1984. BLOS5ER - The Ad Hoc Evaluation Committee has scheduled their next meeting on December 11, 1984 at 1:3g p.m. The proposed sign ordinance will be discussed with the Chairman of the Community Appearance Board on December 11, 1984. Weak FM radio signals were reported recently. FM reception is guaranteed by the cable television company. Acting Town Manager Ms. Whaley stated that Attorney Conahan will respond to this problem regarding Centel Television Company of Florida, Inc. COMMISSIONER JOHN J. BASSO - No report. COMMISSIONER WILLIAM E. PAUL - Commissioner Stewart will give their combined report re beach erosion. COMMISSIONER BETTY JEAN STEWART - Beach erosion is very bad in Town between Sunny Surf and Boca Hi, the beach access stairway for Bel Lido residents is hanging in mid-air, some homes in that area are affected by erosion only two to three feet from the walls of their residence and a resident, Mr. Terrance Lee, was present to confirm this. Commissioner Stewart felt that Governor • Graham and his cabinet should be contacted to designate this a disaster area and ask for financial assistance via low-cost loans from the state to the property owners to save their homes. Another storm could be very devastating to the Town. This matter will be discussed further at the Regular Meeting on December 4, 1984. Commissioner Basso asked that "no wake" signs be placed along the Intracoastal Waterway throughout the length of the Town to see if it works. Discussion ensued. The Acting Town Manager will advise the Town Commission of the costs of the signs, how many will be needed, and where they are recommended to be placed. Mayor Horton stated that the Milord project will soon be requesting a Certificate of Occupancy and has one sold unit (sale to be consumated on December 1). The Building Official stated that the property should be ready for an inspection by the Community Appearance Board by Wednesday or Thursday. Attorney Sliney stated that the property sold cannot be deeded out unless the replatting of said property has been recorded. Attorney Sliney will verify that the plat was recorded and do a title check, also. REPORTS - TOWN ATTORNEY Southern Bell has submitted a report. There are no new developments in any of the lawsuits involving the Town. It is now up to the plaintiffs to move forward. • "MINUTES of Town Commission Workshop Meeting Highland Beach, Florida November 27, 1984 Page 5 of 6 Discussion ensued as to Charter Election Requirements. A candidate for public office in the Town must be a qualified elector in Town for one year prior to filing for office. Attorney Sliney will submit an ordinance at the Regular Meeting on December 4, 1984. REPORTS - TOWN MANAGER Ms. Whaley will contact Mr. Fanning at Boca Highland to confirm if he would like the subject of the North gatehouse to be discussed at the Regular Meeting on December 4, 1984. A letter was received from Mr. Jay Ameno (of C.D.M.) regarding the resurfacing of Bel Air Drive. He recommends that bids be advertised in January and the resurfacing be done in April 1985. Ms. Whaley stated that it has come to her attention that past charges for site plan reviews with a minimum fee of $2Plg were repealed via an Ordinance in November 1982 and recommends that this be changed back to a minimum of $20P1 plus $10 per each additional unit. The consensus of the Town Commission was to make the change. The Acting Town Manager recommended that Town Hall be closed on December 24, 1984 (all day) and that this be considered a bonus for the employees, since the Christmas holiday is on a Tuesday this year, • thereby saving utilities by not opening up the building for a day or part of a day and then be closed again for one day. This matter will be discussed at the Regular Meeting on December 4, 1984, as well as working hours on Monday, December 31, 1984. Vice Mayor Blosser stated that C.D.C. in Boca Raton is looking for new quarters for its equipment and it is expected that Boca Raton will install its own equipment within 3 years. Even though we may never have use for one, Vice Mayor Blosser recommended that the Town apply now for its own frequency to reserve it in the event that we may need it at a later date (if it should work out that we, too, may have to supply our own equipment), if we cannot get such a service from a near-by town. Commissioner Stewart stated how difficult it was for her to reach our Police Department on a weekend recently on a non-emergency basis and suggested that the Town purchase a mobile phone. Mayor Horton stated that the C.D.C. non-emergency number 276-4548 can still be used, which goes through the 9-1-1 system.
