1984.03.27_TC_Minutes_Workshop • TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, March 27, 1984 9:30 A.M. A Workshop Meeting of theTown Commission was called to order by Mayor Louis Y. Horton at 9:30 a.m. in the Town Commission Chambers at Highland Beach Town Hall. Also present were Vice Mayor Mary Louise G. Blosser, Commissioners William E. Pau1,~Betty Jean Stewart and Harry Walker. Also present were Town Attorney, Thomas E. Sliney; Town Manager Elaine W. Roberts; Town Clerk Mary Ann Whaley; citizens and the general public. Public Comments and Requests - Mrs. Doris Rome addressed the Town Commission regarding a complaint involving the entrance to the Milani property; opposition to the Milord project being allowed to proceed without a construction fence; complimented the publicity given to Boca Raton regarding Sanborn Park and suggested Highland Beach try to gain such positive publicity; and questioned the legality of a red van which has been parked on an east side vacant lot. Mr. Harry Abrahamson and Mr. Charles Arbetmen both expressed their concern regarding the policy of Boca Highland selling real estate (re-sales) and dockage space through the sales center. Mr. Larry Sorenson of Federal Maintenance addressed the Town Commission desiring the balance of $6,225 owed to that firm. The Building Official will inspect the pedestrian path along with Mr. Sorenson, Mike Coppolla of the Maintenance Department and the Town Manager to determine whether the project has been completed satisfactorily prior to payment to Federal Maintenance. Mr. Sorenson cited Federal Maintenance's one year warranty on the job. Mr. Lowell Blum, Chairman of the Police Advisory Board addressed the Town Commission and indicated that the PAB had held a Special Meeting regarding recommendations for promotions, the hiring of personnel to fill anticipated vacancies and a letter from the Civic League opposing any change in the police protection presently provided. It was noted that Mr. Bevilaqua of the PAB had met with a represent - ative of the Boca Raton Police Department regarding an alleged request of the Town Manager that Boca Raton make a proposal regarding the r Town Commission Workshop Meeting • March 27, 1984 Page 2 of 11 provision of Police Services to the Town of Highland Beach. Mr. Blum was advised that this information was incorrect and thanked for his retort. 84.2 Boards and @ommittees- Vacancies - CAB - 1 Regular Member (Mrs. Leng's term expires) CEB - 1 Alternate Member Planning Commission - 1 Alternate Member Financial Advisory Board - 1 Regular Member The Town Commission will wait until applications are received as requested from Talent Bank applicants. The Town Clerk will telephone those outstanding for their prompt response. This matter will be scheduled for the April 24, 1984 Workshop Meeting. A memorandum from Vice Mayor Blosser was read into the record regarding • the proposed Ad Hoc Evaluation Committee, scope of the project and those stipulations as set out in the March 8, 1984 Special Meeting regarding this subject. The Town Manager was requested to get information regarding public official's liability for this Committee. The formal appointments to this Committee will be made at the April 3, 1984 Regular Meeting. Substantial discussion was held regarding the establishment, make up and criteria of the Greening Committee. Mr. Savino, Chairman of the Greening Committee will submit the recommendations of that Committee in writing to the Town Commission regarding their pre- ferred form of establishment and criteria for discussion at the April Workshop Meeting. Alternatives expressed were that the Greening Committee be made a sub-committee of the CAB; be made a formally appointed advisory board of the Town; be treated as an Ad Hoc Committee; or be disbanded with the duties of same being absorbed by the CAB. The Application for Boards and Committees was then discussed. It was Commissioner Stewart's recommendation that the Educational Background portion of the application be amended to omit reference to any university or degree received as this could be considered discriminatory. The application will be re-drawn with this amendment • and submitted for approval at the April 3, 1984 Regular Meeting. Town Commission March 27, 1984 • Workshop Meeting Page 3 of 11 84.3 Proposed Ordinances and Resolutions- a) An Ordinance of the Town of Highland Beach, Florida, amending Chapter 15'~ of the Code of Ordinances of the Town of Highland Beach entitled "Land Filling", Section 15'~-3 entitled "Issuance of permit, fee, etc" relating to sand or fill generated by excavation. Commissioner Stewart recommended that the first sentence of the proposed Ordinance be amended to read: Sand or fill generated by excavation on oceanfront property under development within the Town shall be deposited upon beachfront property and not removed from the Town. Discussion ensued regarding comments made at the last meeting by Dr.Richard Orman involving the infringement of the Town on the rights of property owners by mandating that the sand or fill • generated remain on the east side of AlA. Attorney Sliney recommended that the Town investigate the practices of neighboring municipalities before taking any action on this matter. The Town Manager was also asked to get a recommendation from Red Taylor of the DNR regarding this matter. b) Ordinance amending Southern Bell Franchise- Mr. Passmore of Southern Bell was present and recommended that the following language be inserted into the present franchise ordinance in place of the first sentence of Section 3: In consideration of the rights and privileges herein granted, the Company shall pay to the City annually a sum equal to one percent (1/) of the gross receipts of the Company from recurring local telephone line charges for such lines in use within the corporate limits of the City. Discussion was held regarding shortfalls expected due to the Southern Bell/AT&T breakup, the possibility of increasing the franchise fee • and the elimination of language regarding occupational charges etc. now present in Section 4. Attorney Sliney will work on a proposal for submission at the April Workshop Meeting. Town Commission • March 27, 1984 Workshop Meeting Page 4 of 11 The Town Commission then took up Item 84.8 Water Treatment Plan as Mr. Jay Ameno of CDM was present. Mr. Ameno discussed the feasibility of implementation of a chloramine system in order to make the Town's water compatible with that of the neighboring municipalities. Mr. Ameno indicated that in view of the recent testing done in Highland Beach, CDM would still recommend the changes as outlined in their December 1983 letter. Details including. time frames, technical training, etc. were discussed. Also discussed was Joe Moss' memorandum regarding backflow prevention, a copy of which will be frurnished to CDM for comment. (S aid letter attached) The meeting was recessed from 12:00 until 1:15 p.m. for lunch. The following proposed Ordinances were then taken up by the Town Commission: 84.3 c) Ordinance regarding recreational vehicles - • Attorney Sliney advised that the CEB was still studying this matter and a recommendation would be coming from that Board for the April Workshop Meeting. d) Ordinance regarding parking of boats - It was the consensus of the Town Commission that the literal translation of this section me ant that as long as a boat was sheltered from view the distance from AlA didn't matter. Attorney Sliney indicated that additional study of this section should be had and he would report on this at the April workshop Meeting. Discussion was then had with Public Utilities Director Joe Moss in- volving the implementation of a backflow prevention program for the Town to be in compliance with county regulations. The Mayor will draft a letter to Town Residents advising of the program, for approval by the Town Attorney. 84.1b Boca Highland Sales Center-Request for extension of sales center permit - A letter dated 3/5/84 from Mr. Delaney and a letter dated 3/21 from Mr. Rothman were read into the record. Extensive discussion ensued regarding the practice of • re-sales being transacted at the Boca Highland Sales Center. It was noted that numerous complaints had been Town Commission . March 27, 1984 Workshop Meeting Page 5 of 11 received from residents at Boca Highland opposing this practice. It was the consensus of the Town Commission that the Town Attorney draft an Ordinance regulating the use of sales centers and sales trailers to new sales only throughout the Town. As for the request of Boca Highland for an extension of the sales center permit, a temporary extex~ ~.a~n will be considered at the April Regular Meeting pending the passage of the requested ordinance, which will also be submitted for first reading at the April Regular Meeting. Harvey Sasso of Discussion took place regarding a letter fro~lStrock Engineers re- questing the Town to advise the DNR as to any objections regarding the requested Holiday Inn seawall 1t was the consensus of the Town Commission that the Town Manager write a letter to the DNR approving the concept of the plan but reserving further comment until recommen- dation is received from the Planning Commission. • 82.49 Delray BeachfHighland Beach Sewer Issue Status- It was noted that a timetable for the project was being set up by the approved engineers. It was the consensus of the Town Commission that the Town Manager act as the contact person within Town Hall to deal with the engineers on this matter. The Town Commission then went back to Item 84.3 to take up the following proposed Ordinance: e) An Ordinance of the Town of Highland Bead, Florida, amending the Code of Ordinances of the Town of Highland., Beach, Florida, Chapter 11, entitled "Garbage and Trash Disposal", Section 11-13, entitled "Charges for dwelling units not on tax roll", to provide for current garbage and trash charges. A revised version of this ordinance changing the classif- ication entitled "Holiday Inn" to "Transient rentals without kitchens" will be submitted at the April 3, 1984 Regular Meeting for first reading. L Town Commission • March 27, 1984 Workshop Meeting .Page 6 of 11 84.74 County Sanitation Contract - The Town Attorney will draft an addendum to the contract eliminating the renewal option and submit same to County Sanitation for comment. It was the consensus that the contract be extended to September 30, 1988. 84.8 Water Treatment Plant Items - a) Landscaping Quotes - Discussion was held regarding recommendations given by Gene Joyner. The Town Manager indicated that all proposals were extended by those who quoted until the end of June for cost purposes. Concern was expressed for access being made available to the pump house. A sprinkler system located approximately 5' inside the perimeter of the water treatment plant property was discussed. Mrs. Roberts will gather further costs • regarding the sprinkler system as well as buttonwood hedge and further will contact Earl Harvel for a cost to place a gravel pad at the well house to hold a truck. 84.15 Discussion regarding seawall emergency measures - Commissioner Paul expressed concern over the Town taking on liability by regulating seawalls further. This matter will be placed on the April Workshop Meeting Agenda for further discussion and consideration. The Boca Raton procedure regarding a hearing process on seawalls in disrepair was cited as a possible solution. The Town Commission discussed a letter received from Mr. Delaney of Boca Highland regarding the Planning Commission's recent disapproval of the request involving the "B" and "C" sites at Boca Highland. A Meeting was set for April 10, 1984 at 1:30 p.m. to review this matter. Town Commission March 27, 1984 . Workshop Meeting Page 7 of 11 84.17 Report on Enterprise/Utility Funds Budget from FAB- The Town Manager indicated that the FAB was awaiting information from other municipalities to make a recommendation regarding wage scales for the water treatment plant employees. The Town Commission indicated that further information was required regarding percentage ratios of income versus expenditures for various quarters of the year prior to any discussion. The Town Commission further requested that Joe Moss, Public Utilities Director be present at the time the Utilities Budget was discussed. This matter will be placed on the April Workshop Agenda. 84.18 Report on Fair Share Contributions information submitted by Jane Rayner-FAB A report which was submitted by Jane Rayner was discussed for possible action by the Town Commission. It was the Town Attorney's position that the Town was not required to take any action with regard to the report. The Town Attorney indicated that he would discuss the matter with Mrs. Rayner and report back to the Town Commission if any further action was required. REPORTS: TOWN COMMISSION Mayor Louis Y. Horton - Mayor Horton summarized a memorandum submitted by him regarding the proposed implementation of a Highland Beach Fire Department. Vice Mayor Blosser and Commissioner Walker expressed a desire to contract with the County for the first year in order to evaluate the service the Town would get under that arrangement. The Vice Mayor expressed the fact that she had not received much affirmative support of this proposal from Town residents and further that she felt the matter should be studied further and handled through a referendum. This matter will be discussed further at the April 3, 1984 Regular Meeting. r1 Town Commission March 27, 1984 Workshop Meeting Page 8 of 11 The Mayor also reported that the request for a variance for the construction of a 5' wall on the Camino Cove project had been approved by the Board of Adjustment. The Planning Commission has hired Mr. Marvin Sanders as an architectural consultant on the Boca Highland matter. The Hoffman RPUD was discussed with the point of contention being the expiration of the project. Attorney Sliney will study this matter further, and write a letter to the owners. The Mayor reported that the Florida Supreme Court had ruled the Proposition One ballot questions unconstitutional and that the matter would not be placed on the November ballot. The Hof~nnan RPUD was then again discussed with the • Town Attorney reporting that Sue to the request for an extension of the RPUD, the matter would have to be reviewed by the Planning Commission for their recommendation prior to Town Commission action. Vice Mayor Mary Louise G. Blosser - The current status of the proposed "Sunset Bill" was discussed with it being noted that Mr. Slagle had written a letter to representative Ray Liberti opposing the proposal. Commissioner William E. Paul - Reported that he would be unable to attend the April 2, 1984 meeting of the Palm Beach Erosion Task Force and further indicated that there were no important matters on that particular agenda. Commissioner Betty Jean Stewart - Commissioner Stewart asked that County Sanitation be contacted regarding the truck going down the wrong • side of the road to pick up trash. Town Commission March 27, 1984 Workshop Meeting Page 9 of 11 Reported on the unsightly condition of the entrance to the Milani property and that she had observed a young man on a motor bike using the beach access. Reported on the Del Trail employees' friends and dogs using the access to the beach across from the station. Commissioner Stewart thanked the Town Manager and Mayor for the response to her request for a guideline of policy involving Town projects. Asked about the set back requirements for sales models with specific emphasis on the Camino Cove model. This matter will be checked regarding possible infringment into the Bel Air Drive right-of-way. Commissioner Harry Walker - No report. REPORTS: TOWN ATTORNEY - • Attorney Sliney reported on correspondence regarding the settlement of the lime spill matter, indicating that the insurance carrier was offering to settle for $671.14. It was the consensus that the matter be settled for that amount. Attorney Sliney reported that a letter had been written opposing the public being allowed access into the Spaces and Places Townhouses under development in the Boca Highland complex in violation of Town ordinances. Depositions of Ron Hoggard and John Toshner were being taken on the Milani matter. The Town Commission requested that the conceptual or extensive plans regarding the one tower plan for the Milani property be obtained from Attorney James for further study by the Town Commission. Attorney Sliney reported that Attorney Ed Cohen was in the process of gathering information regarding the Coronado matter with regard to the bond for the screening of the garage. Town Commission March 27, 1984 • Workshop Meeting Page 10 of 11 REPORTS: TOWN MANAGER- The Town Manager reported that a meeting would be held on March 29, 1984 by the County School Board regarding emergencies, however, no Town action was required on this. Quotes had been received from Earl Harvel regarding the provision of pump shoes at lift stations 4 and 5 for the amounts of $1,200 and $2,400 which will be submitted for approval at the April 3, 1984 Regular Meeting. Reported that a permit had been issued to Mr. Trionfo for a pool in the front yard and that plans had been received for the same on the Barnes and Kennedy (new house) properties. Mrs Roberts reported that the Building Official was recommending changes in the code • regarding this matter as part of the overall zoning ordinance revisions. Mrs. Roberts then reported that a Resolution was being drawn by the Town Clerk regarding dual taxation,as recommended by Kelton and Associates for submission at the April Workshop Meeting. The Co co de-mer seawall was discussed with a request that the Town Manager ask B & K Marine to come up with alternative plans for same. The appointment of poll workers was discussed for the May 1, 1984 Municipal Election. The Town Manager and Town Clerk will make recommendations for action at tl~e April 3, 1984 Regular Meeting.
