1984.02.14_TC_Minutes_Special • TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission SPECIAL MEETING Tuesday, February 14, 1984 9:15 A.M. A Special Meeting of the Town Commission was called to order by Mayor Louis Y. Horton at 9:15 a.m. in the Town Commission Chambers. Also present were Vice Mayor Mary Louise G. Blosser, Commissioners William E. Paul, Betty Jean Stewart and Harry Walker. Also present were Town Attorneys Thomas E. Sliney and Ed Cohen; Town Manager Elaine W. Roberts; Town Clerk Mary Ann Whaley; citizens and the general public. Mr. Arthur Keller addressed the Town Commission requesting per- mission for the use of 10 parking spaces at Ambassadors' East fur sunning purposes. As this will not permanently renovate the existing parking, no objection was expressed by the Town Commission. Commissioner Paul was requested to attend the next meeting of the • Palm Beach County Task Force on Erosion, after which a possible appointment from the Town of Highland Beach may be made. Clarification of a request for changes in the garbage charges to include residential rentals in the multi-family unit charges was discussed and approved. A request from the Planning Commission regarding the retention of an independent attorney re RPUD time limits vis-a-vis Ordinance No. 282 was then addressed. It was the consensus of the Town Commission that the Planning Commission retain an independent architectual consultant to provide a specific list of questions to pose to an independent attorney. Mr. Saunders and Mrs. Rome of the Planning Commission who were present were directed to convey this action to the Planning Commission. The Delray Beach/Highland Beach Sewer Issue was then discussed. Attorney Ed Cohen and Mediating Board Member John Basso were present and took part in the discussion. Mayor Horton gave a synopsis of the issue to date. It war noted that corresponds ce had been received indicating Delray Beach's abolishment of the Mediating Board. It was the consensus of the Town Commission that as far as Highland Beach was concerned, this Mediating Board Town Commission February 14, 1984 . Special Meeting Page 2 of 3 was still active. Attorney Cohen submitted a re-drafted Stipulation drawn up by the attorneys for Highland Beach and Delray Beach with a recommendation for approval of same. MOTION was made by COMMISSIONER WALKER/COMMISSIONER PAUL to execute the Stipulation as drawn by joint counsel, which MOTION carried unanimously with favorable votes. Mayor Horton will write a letter to the officials of Delray Beach indicating the Town of Highland Beach`s intention of continuing to work with the Mediating Board . A proposed letter as drafted by Attorney Sliney to Attorney James regarding negotiations in the Milani matter was then discussed. The proposed letter was approved with a change recommended by Commissioner Stewart to include a provision that would not limit the negotiations to only that in the letter as drawn and submitted. All other discussion regarding the Milani matter was deferred until the February Workshop Meeting. Attorney James and Dr. Orman were present. • The Highlands Place matter was then discussed with specific emphasis on the commencement date. It was the opinion.. of Attorney Sliney that due to Town records and documentation researched, the developers of the Highlands Place project did commence. Further discussion ensued regarding a possible abandonment of the project between October of 198 and June of 1983 with further study to be done on this. MOTION was made by COMMISSIONER STEWART/ VICE MAYOR BLOSSER to defer further discussion on this matter until the February Workshop. Mr. Arbuck, Mr. Hollohazy and Attorney Faircloth were present. Commissioner Paul expressed hie desire to set a date at the February Workshop to have the Moratorium Variance Appeals Board make a determination on this matter. Mrs. Roberts reported that a request had been reeeived from the Enclaves of Boca Cove for a final C/O, however the necessary inspections had not been completed by the Town Manager, BuA.lding Inspector and CAB. Mrs. Roberts indicated that the request was for two of eight units. Commissioner Paul raised the point that the building permit was issued for all eight units and therefore the final C/O must be issued for all eight units. The Town Attorney concurred in this fact. Mrs. Roberts will advise Enclaves of the Town Commission's determination in this matter. j Town Commission February 14, 1984 Special Meeting Page 3 of 3 The Town Manager reported that the Town had received an additional $13,300 toward the fine imposed on the Massengill project, however, the fine was still in arrears and would be further reported on at the February Workshop Meeting.
