In the above numbered Petition, by vote as shown in the official minutes and recorded on the
form, it was determined and ordered that the requested variance be granted [ ]; denied [ ];

In reaching its decision and order, the Board has found/has not found in the case of the above
numbered Petition that:
1. Special conditions and circumstances exist which are peculiar to the land, structure or
building involved, and which are not applicable to other lands, structures or buildings in the same
district.
2. The special conditions and circumstances do not result from the action of the applicant
3. Granting the variance requested will not confer on the applicant any special privilege that is
denied by the ordinance to other lands, structures or buildings in the same district.
4. Literal interpretation of the provisions of this ordinance would deprive the applicant of rights
commonly enjoyed by other properties in the same district under the terms of the ordinance, and
would work unnecessary and undue hardship on the applicant.
5. The reasons set forth in the applicant's petition justify the granting of the variance, and the
variance granted is the minimum reasonable variance that will make possible the reasonable use
of land, structure or building.
6. Granting of the variance will be in harmony with the general purpose and intent of the
ordinance, and will not be injurious to the neighborhood or otherwise detrimental to the public
welfare.
Chapter 30, Zoning Code/Article III; Sec. 30-40(h): A variance, when implemented in
accordance with the approval granted by the Board of Adjustment and Appeals, shall run with the
land in perpetuity. Unless a lesser time is approved by the Board of Adjustment and Appeals, a
variance that is not implemented shall expire eighteen (18) months following approval.
Extensions of variance approvals shall not be granted by the Board of Adjustment and Appeals.

S. Goldstein and Son, Inc. ("Petitioner") is the owner of the +/- 0.63 acre parcel generally located at the
southwest corner of Intracoastal drive as identified by addresses 4408 Intracoastal Drive (PCNs 24-43-47-
04-02-004-0100) ("Property') in the Town of Highland Beach ("Town"). The Property is designated Single
Family on the Town's Future Land Use Map and is zoned RS, Single Family Residential. On November 9,
2017, The Town's Planning & Zoning Board approved a site plan to redevelop the Property with a single-
family residence ("Project") consistent with the surrounding single family residential community in this
neighborhood. The Project is currently under construction.
The Project, as initially designed and approved by the Town, met all development regulations and code
requirements. Petitioner did not request any waivers or variances from any setbacks or development
regulations outlined in the Town's Code of Ordinances. In reviewing the actual site conditions as
construction progressed, Petitioner became increasingly concerned for the safety of the children that will
be staying in or visiting the residence and playing in certain outdoor areas. More specifically, Petitioner
began reviewing conditions related to access to the pool area and Intracoastal Waterway, and areas
where fencing could be added in order to prevent access to the pool and waterway by children. In
analyzing the means to most effectively prevent such access to the pool, it was determined that an
expansion of pool deck was required adjacent to the pool in order to provide for such a child/baby fence
along the pool and a corresponding shift of the pool towards the Intracoastal Waterway would be required
to allow for this additional security measure. The seawall in this area also extends approximately five feet
eight inches (5'-8") at the southwest corner of the Property. As such, there will be close to twelve feet
(12') of turf area between the pool and Intracoastal Waters adjacent to the vast majority of the pool area.
As such, with the unique circumstances at this southwest corner of the Property, Petitioner is still meeting
the intent of the code provision to provide a sufficient separation between the pool and water. Due to
this shift, the proposed pool will encroach into the ten foot (10') rear setback requirement for swimming
pools. As such, Petitioner is respectfully requesting the following variance:
Variance from Section 30-68(f) of the Town's Code of Ordinances in order to allow for a swimming pool
to be setback six feet (6') from the rear or side property line in lieu of ten feet (10') required.
In support of the Variance, Petitioner will demonstrate the following: (a) special conditions and
circumstances exist which are peculiar to the land, structure or building involved which are not applicable
to other lands, structures or buildings in the same district; (b) the special conditions and circumstances
do not result from the actions of the applicant; (c) granting the variance requested will not confer on the
applicant any special privilege that is denied by this ordinance to other lands, buildings or structures in

the same district; and (d) that literal interpretation of the provisions of this ordinance would deprive the
applicant of the rights commonly enjoyed by other properties in the same district under the terms of this
ordinance and would work unnecessary and undue hardship on the applicant.
(a) Special conditions and circumstances exist which are peculiar to the land, structure or building involved
which are not applicable to other lands, structures or buildings in the some district.
There are special conditions and circumstances which are peculiar to the land. The Property is a corner
lot at the end of a cul-de-sac and is somewhat L-shaped. The southeast corner of the Property extends
out on an angle, making the buildable area in this section of the property very narrow. As a result, the
majority of the southeast corner of the Property must remain as open space. As such, when Petitioner
was developing plans for this residential home, the design was centered at the corner, as this provided
the most useable space of this odd shaped lot. Again, it is important to note that the building meets all
development standards of the Town's Code of Ordinances.
As noted above, in reviewing the actual site conditions as construction progressed, Petitioner became
increasingly concerned for the safety of the children that will be staying in or visiting the residence and
playing in certain outdoor areas. As the home is focused on the corner of the lot due to the unique shape
of the Property, the outdoor features, including the pool, are also located at the southwest corner of the
Property. This also allows for unique views and interaction with the Intracoastal Waterways. However,
as this corner of the Property is rounded, this minimizes the area for the pool and pool deck. While the
width of the pool at the center is approximately seventeen feet ten inches (17'-10"), the pool is only a few
feet wide at each end. As such, reducing the size of the pool would be difficult. Again, Petitioner's
reassessment of the site conditions at this corner of the Property stemmed from a safety concern and a
desire to provide a pool fence in order to prevent children from accessing the pool area unsupervised. In
analyzing the means to most effectively prevent such access to the pool, it was determined that an
expansion of the pool deck was required adjacent to the pool in order to provide for such a pool fence
and a corresponding shift of the pool towards the Intracoastal Waterway would be required to allow for
this additional security measure. Due to this shift, the proposed pool will encroach into the ten foot (10')
rear setback requirement for swimming pools.
The Property is also unique as the seawall extends approximately five feet eight inches (5'-8") at the
southwest corner of the Property. As such, there will be close to twelve feet (12') of turf area between
the pool and Intracoastal Waters adjacent to the vast majority of the pool area. As such, with the unique
circumstances at this southwest corner of the Property, Petitioner is still meeting the intent of the code
provision to provide a sufficient separation between the pool and water.
More flexibility for development and the pool area may have been provided if the Property were not
arched at the southwest corner and been more squared in nature, or if the southeast corner of this L-
shaped Property been wider and allowed for more usable area. Further, Petitioner did not understand
the full safety issues in this pool area until construction had already commenced and these conditions
became more apparent when on site. Due to the existing conditions and unique shape of the Property,
along with legitimate concerns to protect children from accessing the pool area, Petitioner is respectfully
requesting a four foot (4') variance in order to allow for a six foot (6') setback for the pool, in lieu of ten
feet (10') required.
(b) The special conditions and circumstances do not result from the actions of the applicant.
The special conditions and circumstances do not result from the actions of Petitioner. As noted above,
the Property is a corner lot at the end of a cul-de-sac and is somewhat L-shaped. The southeast corner of
the Property extends out on an angle, making the buildable area in this section of the property very
narrow. As a result, the majority of the southeast corner of the Property must remain as open space. As
such, when Petitioner was developing plans for this residential home, the design was centered at the
corner, as this provided the most useable space of this odd shaped lot. The southwest corner of the
Property is also rounded, this minimizes the area for the pool and pool deck, and requiring a pool with a
similar curvature, resulting in a narrowing of the pool width at each end. These are existing conditions of
the lot. Petitioner was not responsible for creating these unique site conditions, including the narrowness
and angle of the eastern property line or the curvature of the southwest corner of the Property. As such,
the special conditions do not result from Petitioner's actions.
(c) Granting the variance requested will not confer on the applicant any special privilege that is denied by
this ordinance to other lands, buildings or structures in the same district.
Granting the variance will not confer any special privilege that is denied to other lands in the same zoning
district. Rather, granting the variance will be consistent with previous approvals and board actions that
have allowed the reduction of swimming pool setbacks on similarly situated properties along the
Intracoastal Waterway. In addition, Petitioner is proposing this encroachment in order to provide for a
safety feature to close off the pool area. As such, approval of this variance will not confer any special
privilege, but will ensure access to the pool area and Intracoastal Waterway can be sufficient secured from
children.
(d) Literal interpretation of the provisions of this ordinance would deprive the applicant of the rights
commonly enjoyed by other properties in the same district under the terms of this ordinance and would
work unnecessary and undue hardship on the applicant.
Literal interpretation of this provision would deprive Petitioner of the rights commonly enjoyed by other
properties in the same zoning district. The intent of Section 30-68(f) is to provide sufficient separation
from rear and side lot lines, particularly where two properties share a common lot line. In such instances,
the setback is required to provide a buffer and adequate separation between properties. In the given
situation, the swimming pool is not located adjacent to another residential property, but is proposed along
the Intracoastal Waterway. As such, there is a significant separation that existing between the proposed
pool area and any adjacent residential use because of this large body of water. Furthermore, while the
pool is setback approximately six feet (6') from the property line at this southwest corner, there is actually
an additional five feet eight inches (5'-8") of turf area between the property line and the waterway. As
such, although the literal interpretation of the code cannot be met, Petitioner is certainly meeting the
intent of this provision of the code. Similarly situated properties along the Intracoastal Waterway,
including properties that do not have the additional turf area, have been granted similar requests.
Petitioner is seeking the same rights afforded to similarly situated properties in this same zoning district.
Literal interpretation of this provisions would also work an unnecessary and undue hardship. As noted
above, in reviewing the actual site conditions as construction progressed, Petitioner became increasingly
concerned for the safety of the children that will be staying in or visiting the residence and playing in
certain outdoor areas. This is a legitimate safety concern that has been raised far too often, as small
children found their way to pools and waterways, despite constant supervision by parents and caretakers.
In analyzing the means to most effectively prevent such access to the pool, it was determined that an
expansion of the pool deck was required adjacent to the pool in order to accommodate such a child/baby
fence around the pool and a corresponding shift of the pool towards the Intracoastal Waterway would be
required to allow for this additional security measure. Literal interpretation of the code would require a
much smaller pool deck which would limit the opportunity for the protective fence to block off the pool.
It would also create spaces where a child may be able to climb around the gate to access the pool.
Petitioner is requesting this variance in order to prevent this hazard and ensure the outdoor areas are
baby -proofed for those children staying in or visiting the residence. The literal interpretation of this
provision would create a hazardous situation that, even with the best supervision, has already affected
too many families in South Florida. As such, Petitioner respectfully requests a variance from Section 30-
68(f) of the Town's Code of Ordinances in order to allow for a swimming pool to be setback six feet (6')
from the rear or side property line in lieu of ten feet (10') required.

Any person that decides to appeal any decision made by the Board of Adjustments & Appeals with respect to
any matter considered at this meeting, such person will need to ensure that a verbatim record of the proceeding
is made, which includes the testimony and evidence upon which the appeal is based. The Town of Highland
Beach does not provide such a record.
