Minutes of Meeting of Town Commission
SPECIAL MEETING
Tuesday, July 30, 1985 1.00 P M
A Special Meeting of the Town Commission was called to order by Mayor
Edward J. Sullivan at 1:00 p.m. in the Town Commission Chambers at
Town Hall. In addition to Mayor Sullivan, those in attendance were
Vice Mayor Mary Louise G. Blosser and Commissioners John J. Basso and
Betty Jean Stewart. Commissioner William A. Grier was absent.
Also present were Town Attorney Thomas E. Sliney, Town Manager Hugh D.
Williams, Town Clerk Mary Ann Mariano and the general public.
The Mayor noted the first purpose of the meeting, being to hold a
public hearing according to the Code to consider a Special Exception
for the installation of a satellite antenna at Seagate.
Mrs. Jane Rayner, President of the Seagate Condominium Association
addressed the Town Commission summarizing the procedures which had
been followed to bring the matter to the point of a Special Exception
for hearing by the Town Commission.
• Attorney Sliney noted the Chapter on Special Exceptions. Commissioner
Stewart noted the fact that the Special Exception involved the
infringement of the satellite antennae 6' into the setback line.
Commissioner Stewart also cited the various criteria necessary in
Chapter 30, Section 5 setting out the Special Exception procedure,
requesting an opinion from the Town Attorney as to whether all the
stated criteria had been met. The Town Attorney stated that all the
requirements had been met including advertising, and that an indemnity
agreement had been supplied to the Town.
Mayor Sullivan noted that recommendations for approval had been
submitted by both the Planning Board and the Community Appearance
Board. He then asked if any member of the general public had any
objections to the proposed Special Exception, with no response.
Vice Mayor Blosser noted that although the plans as submitted included
a cement base, there had been discussion at Seagate for additional
piling to be added to the base as a further safety measure. The Vice
Mayor questioned whether the additional piling would involve an
amended plan which would require further approvals.
Attorney Sliney noted that the approval was being given on the
submitted plans, and subsequent variations i.e. additional piling
should be submitted to the Building Official for his approval.
• Bruce Sutherland noted that the addition of pilings would only affect
the angle of the dish which might need adjustment, however, was a
diminuous change and would not require additional Board or Commission
action.

MOTION was made by VICE MAYOR SLOBBER/COMMISSIONER STEWART that the
request for a Special Exception for the installation of a satellite
antennae as submitted by Seagate be approved. Upon roll call vote,
all those Commissioners present voted aye with the MOTION carrying by
a 4 to 0 vote.
Mayor Sullivan then noted that the second purpose of this Special
Meeting was to approve the tentative millage for the 1985/86 fiscal
year which is to be submitted to the County Tax Assessor prior to
August 1, 1985. The Town Manager noted his memorandum dated July 22,
1985 which proposed the tentative millage be set at 3.3683, the same
millage as last year. Mr. Williams noted that this figure could be
adjusted downward, however, could not be adjusted upward without
specific criteria being used involving appropriate advertising, etc.
MOTION was then made by COMMISSIONER BASSO/VICE MAYOR SLOBBER that the
tentative millage for the Town of Highland Beach for the fiscal year
1985/86 be set at 3.3683. All those present voted aye, with the
MOTION carrying.
There being no further business to come before the Town Commission at
this Special Meeting, same was adjo~ ed at 1;241~~n.
