1985.06.14_TC_Minutes_Workshop,~ ~"~ ~ TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission • WORKSHOP MEETING RE ROYAL HIGHLANDS Friday, June 14, 1985 10:P1PJ A.M. A Workshop Meeting of the Town Commission of the Town of Highland Beach, Florida, was called to order at 1(d:0fd a.m. by Mayor Edward J. Sullivan in the Town Commission Chambers at Town Hall. Also present were Vice Mayor Mary Louise G. Blosser and Commissioner William A. Grier. Commissioners John J. Basso and Betty Jean Stewart were absent. Also present were Town Attorney Thomas E. Sliney, Town Manager Hugh D. Williams, Planning Board Vice-Chairman Doris Rome, Town Clerk Mary Ann Whaley, and members of the general public. Mayor Sullivan explained that the purpose of the meeting was to discuss the status of the Teron International project (Royal Highlands). Attorney Sliney cited the action taken by the Town Commission regarding returning the check received from Teron for issuance of building permits, noting that Teron had already filed for an emergency hearing to enforce the terms of the Stipulation. Attorney Sliney advised the Town Commission that the past two days had been spent in Court on this matter and complimented the Town staff for their assistance and partic- ipation in the hearing wherein the Judge granted a ninety day extension to Teron. The Judge will reconsider the matter in ninety days at which time he will determine whether the building permit should be issued and • further determine on what submitted plan said permit should be issued. Inasmuch as neither Teron nor the Town are satisfied with the plans as are now submitted, this ninety day period will allow time for the parties to reach a satisfactory plan. Attorney Sliney indicated that should no compromise plan be reached in the ninety day period, then the Judge would probably mandate a permit be issued on the original plan submitted to the Town. The Town Attorney noted that the Order of the Judge comtemplated a subsequent hearing on the matter. Attorney Sliney requested that the Town Commission give some direction on the matter. Mayor Sullivan stated that he felt the Town needed experts to determine whether the original plans would be adequate due to erosion which has occurred in that area, and further to determine whether any setback violations exist. It was noted that Camp Dresser and McKee, the Town Engineers were not qualified to undertake such a study. Attorney Sliney indicated that engineers in the specific field of marine study should be retained. The Town will contact Red Taylor of the Department of Natural Resources to determine whether erosion has been experienced west of the Coastal Construction Control Line at this site, and if so, if the developer would be allowed to backfill the site. Attorney Sliney noted that Teron indicated they wanted to go ahead with their seawall no matter what is going to be built, and was forwarding a letter with said request. The Town Attorney felt that an expert should be consulted with regard to the seawall also, especially in view of the r~ Town Commission Workshop Meeting re Royal Highlands June 14, 1985 Page 2 of 2 fact that this matter involved a court action. When questioned by the Mayor about what criteria would be used if a permit was issued on the project, Attorney Sliney indicated that Teron would probably be bound by Ordinance 336 and the regulations therein regaring keeping said building permit active. Mrs. Doris Rome, Vice-Chairman of the Planning Board, addressed the Town Commission, indicating that many changes had occurred, not only in the plans, but in the site itself i.e. erosion etc., and felt that the Town Commission should retain experts to resolve some of the questions raised. Mrs. Rome felt that the Planning Board would be agreeable to try to come up with a satisfactory plan to all involved. Mrs. Rome also expressed her concern regarding the exposed seawall on the east side of the Coastal Construction Conrol Line and the allowance of fill by the DNR and requested that Mr. Sutherland, Building Official, contact Red Taylor at an early date to resolve this question. Attorney Sliney recommended that the Town Commission urge the Planning Board to invite the representatives from Teron to their June 19, 1985 • Meeting in order to try to resolve this matter in a timely manner. It was noted that although Royal Highlands had been interested in the artificial seaweed project, the DNR would not extend the permit to allow their participation.
