SPECIAL MEETING Monday, July 7, 1986 9.30 A M A Special Meeting of the Town Commission of the Town of Highland Beach, Florida, was called to order by Mayor Edward J. Sullivan at 9:30 a.m. on Monday, July 7, 1986, in the Town Commission Chambers at Town Hall. Vice Mayor Mary Louise G. Blosser, Commissioner John J. Basso, and Commissioner William A. Grier were also present. Commissioner Betty Jean Stewart was absent. Also present were Town Attorneys Thomas E. Sliney and David Friedman, Building Official Bruce Sutherland, Town Manager Hugh D. Williams, Alan Ciklin (Attorney for Broadview), Neal Janov (Engineer for Broadview), a Representative for Broadview Savings and Loan, Deputy Town Clerk Elizabeth L. Kolek, and members of the general public. Mayor Sullivan announced the purpose of the Special Meeting: • (1) To discuss the Joint Stipulation Agreement regarding the Hoffman Property, and (2) To discuss authorization for study and report from C.D.M. for submission to D.E.R. in re transition to ammonia based water treatment. 'av , Attorney Sliney reviewed the main concerns of the Joint Stipulation and `~ introduced Mr. Villevicenzio, F.P.L. engineer who recently went through a~ similar situation in Delray Beach, who could answer questions that the G':-F_1 Town Commission may have. The main concerns are: V (1) Depth of the dredging. ~ (2) Protection of the water and electric lines under the IWW. ~ (3) The permit is for dredge and fill and not a permit for a boat basin, some sort of riprap is needed, from the erosion stand- point. (4) Contingincy plan, satisfactory to the Town's engineers, for water supply to the Town in the event of damage, needs to be discussed in detail. (5) Date certain to start the project. i (6) Length of the dredging and whether it extends beyond the Hoffman property itself, per the permit. Town Commission Special Meeting July 7, 1986 Page 2 of 5 Attorney Alan Ciklin addressed the Town Commission and quoted from the permit given them to dredge by the U. S. Army Corps of Engineers (Permit No. 81B-0195) and D.E.R. (Permit No. 50-31527) which state the required depth for dredging is 16 feet MLW, 31,847 cubic yards of sand and silt to be removed from 2550 feet by (length) by 125 feet (width) by -16 feet MLW (depth) with 16 inch overdepth. Since this has also been endorsed by the F.I.N.D. (Florida Inland Navigational District), he stated they have no control over it and unless this issue is resolved, there would be no reason to go any further on this matter because it is in the State agencies hands. Mayor Sullivan asked the F.P.L. representative how deep their electric conductor was in the IWW and if he had any concerns regarding the dredging and any dangers that may involve their conductor. Mr. Mike Villevicenzio, Engineer for Florida Power and Light (FPL), said that FPL's conductor is 17 to 17 1/2 feet deep, is eight (8) inches in diameter, with a metal covering which is armored and protected by itself, and is somewhat flexible. He stated that the Town's water line is most likely rigid and he is not familiar with what damage can possibly happen to it by the dredging. He did not consider the dredging to be dangerous to the FPL conductor if one (1) foot to 1 1/2 feet distance was used. He • also stated that, in the past when this type of dredging was done in the area of a conductor line, a diver places buoys on the surface above the lines, prior to the start of dredging and a diver also monitors the entire dredging in progress. He agreed that claw-type of equipment is the most dangerous method to use in dredging when you do not know what is down there. Much discussion ensued. It was determined that the Town's engineers would have to determine to their satisfaction how this stipulation was structured and must satisfy the Town Commission before the rest of the permit is issued. Mr. Neal Janov, Engineer for Broadview, displayed some diagrams of the proposed dredging and the location in respect to the property lines and the IWW (IWW is 300 feet wide in this area), depths of the dredging, and location of the required barrier island (350 feet long by 50 feet wide). Mr. Janov stated dredging is done for the public's benefit and his client's benefit. They would not use claw machinery, but would use a dredge with a sucking device on a barge which would remove the sand and muck, blow it onto the land temporarily, until it was dried and hauled away. It would not be used for fill. Mr. Janov reassured Commissioner Basso that this dredging would have no effect on the seawall at Regency Highland. Mr. Janov recommended that a diver be present al all times of the dredging, which would not be at the Town's expense. The barrier island will be constructed of imported materials and will include riprap Town Commission Special Meeting July 7, 1986 • Page 3 of 5 to prevent erosion. Mangroves and vegetation will be planted on the barrier island only to help stabilize it and the barrier island will be used for nothing else, Mr. Janov said. Mr. Ciklin stated the FIND parcel of land will be a permanent preserved area, environmentally sensitive, and can never be used for anything. All docks and piers will be dealt with later. Mr. Janov stated the plans are not yet drawn to determine where the access road will be. He stated that any affected mosquito ditches would be restored or made better and bug control will be done during the dredging. The property needs to have proper sewers, drainage, parking, and buildings and whether piles will be needed has yet to be determined. He also stated no seawalls are permitted. The Town Commission expressed much concern about the Town's water supply, should the underwater line be damaged and wanted written assurance from Boardview that the same level of water service would be supplied to the Town within 24 hours, possibly via an emergency agreement between the City of Boca Raton and the City of Delray Beach and that the water supply would continue until the Town's water line is functioning again. • Mr. Ciklin stated that the present date to begin is 8/16/86 but an extension may be granted by the State agencies involved. Attorney Sliney stated that a revision of the stipulation, with the items agreed upon today added, would be completed at his office today, with copies distributed later in the afternoon. Points agreed on today are: (1) Required starting date---August 16, 1986, unless extended by a State agency. (2) Agreed to incorporate a minimum three (3) foot cover for pipes in the entire project. (3) Any dredged material must be removed from the site. (4) Method for three (3) foot cover protection of the Town's water line and method of dredging to be approved by engineers for both parties, or otherwise use a third engineer. (5) Contingency plan---if any damage occurs to Town's water main due to excavation and dredging, water supply must be guaranteed to be restored at the same level of service within 24 hours and continue until Town's water main is in operation, this to be accomplished by an up-to-date written agreement with Boca Raton • and Delray Beach, on or before August 16, 1986, or no permit will be issued without this. Town Commission Special Meeting July 7, 1986 Page 4 of 5 Even though the Town Commission felt there was not enough time to get the written agreements from Boca Raton and Delray Beach before August 16, 1986, Mr. Ciklin felt it could be done because of the prior interlocal agreements between the towns for emergency water supply, which could be updated. Commissioner Grier felt these agreements should be looked into to determine what they say and to make sure they are adequate for the Town's protection now and in the future. Mr. Ciklin stated it would be possible to install a temporary, plastic pipeline under the IWW, if needed and which could be in place in 3-4 weeks. It was the consensus of the Town Commission that the contingency plan in the stipulation agreement regarding the engineering aspects should be accomplished to the satisfaction of the Town's engineers and any non- engineering aspects should be accomplished to the satisfaction of the Town Commission. Attorney Friedman added that prior to the issuance of the dredge permit by the Town, the Town Commission should review all documents required under Item No. 4 of the Stipulation. Attorney Sliney asked for authorization to go ahead with the changes made to the stipulation today. • NOTE: COPY OF FINALIZED STIPULATION AGREEMENT ATTACHED TO THESE MINUTES. MOTION was made by Commissioner Grier, Commissioner Basso, that Mr. Sliney be authorized to execute a stipulation on the basis of what has transpired this morning and what he has just indicated the changes to be. A roll call vote showed that all Commissioners present voted AYE. The MOTION carried 4-0. Attorney Sliney asked, for the record, if Mr. Ciklin agreed to the stipulation as modified. Mr. Ciklin said YES and stated he feels Broadview will accept the stipulation, as well as Attorney Slinkman. Mr. Ciklin stated he had the authority from Boardview to approve the agreement, as was verified by the other representative present from Broadview Savings and Loan. Mr. Sliney will send Mr. Ciklin an extra copy for Mr. Slinkman, who was not present today. This stipulation will be presented to Judge Stewart on July gJ 1986 to be finalized and signed by Judge Stewart, Attorney Slinkman, and Attorney Sliney. ---_ In reference to Agenda Item No. 2, Town Manager Hugh D. Williams stated ~~ that he received C.D.M.'s proposal to lower the THM's in our water supply last Thursday or Friday, for $29,300.00, which includes 100% of the ,,d. engineering involved but no construction costs. It also includes °'-~ $15,700.00 for paper work and the balance being for construction l' supervision and bidding procedure. The project would take about 9 months) to turn-on of water. In reply to Commissioner Grier's question, the reason this is necessary is because the County Board of Health and D.E.R. have to see all the test results, stated Mr. Williams. ,, Town Commission Special Meeting July 7, 1986 Page 5 of 5 Mayor Sullivan and the Town Commission felt they needed more time to discuss this matter and called for a Special Meeting to be held at 10:00 a.m. on Thursday, July 17, 1986, at which time several water department matters will be discussed. Commissioner Stewart sill also be back in Town by that time, Mayor Sullivan stated.
