Roll call was taken by Town Clerk Lanelda Gaskins followed by the Pledge of Allegiance. CALL TO ORDER: Members Present: Vice Chair David Axelrod; Board Member Evelyn Weiss; Board Member Charles Shane; Board Member Warren Lewis and Board Member Michael Kravit. Members Absent: Chair Louis Reidenberg and Board Member Harvey Mart. Also Attending: Assistant Town Attorney Brian Shutt; Town Clerk Lanelda Gaskins; Building Official Mike Myers; Mayor Carl Feldman; Town Manager Valerie Oakes; Commissioner Elyse Riesa and Commissioner Rhoda Zelniker. Town Clerk Gaskins made the following announcements: o Town Hall will be closed on May 29th in observance of Memorial Day. o Town Commission Workshop Meeting—May 30th— 1:30 PM o Planning Board Special Meeting—May 31St—9:30 AM 1. ADDITIONS,DELETIONS OR ACCEPTANCE OF AGENDA: Vice Chair Axelrod called for a motion to accept the agenda as presented. MOTION: Member Shane moved to accept the agenda as presented. Member Weiss seconded the motion, which passed unanimously. 2. PUBLIC COMMENTS AND REQUESTS: There were no comments or requests from the public 3. PRESENTATIONS: • Welcome New Member Michael Kravit Vice Chair Axelrod welcomed new member Michael Kravit. Member Kravit gave a brief description of his qualifications and background. MOTION: Member Lewis moved to approve the March 8, 2017 Regular Meeting Minutes as presented. The motion was seconded by Member Shane, which passed unanimously. 5. OLD BUSINESS: There was none. 6. NEW BUSINESS: A) Application No. 17-0186—4302 Intracoastal Drive CONSIDERATION OF A SITE PLAN APPROVAL FOR THE INSTALLATION OF A 5,000 LB. JET SKI LIFT TO THE EXISTING DOCK IN THE RS (RESIDENTIAL SINGLE FAMILY)ZONING DISTRICT APPLICANT: Jean LeClerc Vice Chair Axelrod read the title into the record. He asked the Board were there any disclosures and/or ex parte communications and there were none. The Public Hearing was opened and all witnesses giving testimony were sworn-in. Staff Presentation: Building Official Mike Myers presented this item. He reviewed the documents and the application meets the setbacks and requirements of Highland Beach code of ordinances. Upon approval from the Planning Board, the applicant will need to obtain approval from the Environmental Protection Agency(EPA) or the Army Corp of Engineers. Member Shane—They will need to apply to both entities. If one declines any authority, they will need to send a letter to that effect; otherwise, you will need both letters of approval. Petitioner's Presentation: Kyle Martinez, Ray Qualmann Marine—We have filed with both the EPA and the Army Corp of Engineers. The lift will accommodate two Jet Skis and will be perpendicular to the existing dock. Public Comments: There were no public comments. Vice Chair Axelrod closed the Public Hearing. MOTION: Member Weiss moved to approve Application No.17-0186, 4302 Intracoastal Drive. The motion was seconded by Member Kravit. B) Application No. 17-0267—4408 Intracoastal Drive CONSIDERATION OF A SITE PLAN APPROVAL FOR THE INSTALLATION OF AN 8 X 20 TEMPORARY TRAILER ON THE NORTHEAST CORNER OF THE PROPERTY IN THE RS (RESIDENTIAL SINGLE-FAMILY)ZONING DISTRICT. APPLICANT: Frankel Estate Homes Vice Chair Axelrod read the title into the record. He asked the Board were there any disclosures and/or ex parte communications and there were none. The Public Hearing was opened and all witnesses giving testimony were sworn-in. Staff Presentation: Mike Meyers, Building Official presented the item. A building permit has been issued for the construction of the new home. This is a temporary construction trailer being used for an office and tool storage area and does not contain any restrooms. It is in compliance with the codes of Highland Beach. Vice Chair Axelrod commented on the fact that this approval is for a period of six months. If longer, an approval of extension will be required. Petitioner's Presentation: John Shahzade, Owner Frankel Estate Homes stated that the trailer would not be used for storage of tools; only as an office. Public Comments: There were no public comments. C) Discussion Regarding Possible Expansion of the Role of the Planning Board • By: Commissioner Elyse Riesa Commissioner Riesa — The Planning Board is very professional and so worthy of our Town. On behalf of the Town Commission, I have been chosen to be the liaison to represent the Commissioners. The Planning Board reviews site plans, plat reviews for subdivisions and any other division of land, with a recommendation of approval,approval with conditions or disapproval by a majority vote. Acting as the local planning agency, the Planning Board is responsible for annual reviews of the comprehensive plan and zoning code, making recommendations to the Town Commission. We are looking for various ways this board can collaborate with the Commission as this Commission starts to collaborate with other municipalities regarding climate change. One of your tasks would be to review changes to the codes that might reflect climate change such as the seawalls deteriorations. Another concern is boatlifts. It would be helpful to the Commission if you could be proactive and bring back recommendations to them that could reflect changes in our codes to improve conditions in our Town. Does this board feel your role and responsibilities are appropriate the way they are, or do you feel there should be new changes made to assist the Commission? Member Shane — You stated that the Planning Board is responsible for reviewing the codes and making recommendations to the Commission. As a member of this board, I have not been tasked to do so. I don't mind being proactive, but do you want us to study the entire code book and red line it, or have the Commission give us item by item what it is they need. Commissioner Riesa — I have looked into other Planning Boards and have not found anyone that is equivalent to what this board does and has accomplished. There is no way that you can look at every single code. If you see or hear something that you feel needs to be changed, you can bring it back to the Commission for their review. My biggest concern is climate change issues. Vice Chair Axelrod was concerned that they would be stepping on the toes of the Beaches & Shores Advisory Board. Commissioner Riesa stated that at the Beaches & Shores meeting on Tuesday, May 9ffi, they chose to disband and form a group type club for the beautification of the Town. She explained the reason why. Planning Board Regular Minutes Wednesday,May 10,2017 PaEe 5 of 6 Member Shane—The Commission should bring the issues to the Planning Board, and we can then put it on our agenda and further review the issue before the Commission can act on it. You need to tell us what it is we need to do for you. Commissioner Riesa asked that as part of the role of the Planning Board, the members come before the Commission if they have any environmental issues that should be addressed. Member Lewis agreed with the climate change issues and feels there are some boards in the municipalities on the east coast that have addressed this. Perhaps we can reach out to them. Vice Chair Axelrod — Regarding the sand situation, both Delray Beach and Boca Raton have been involved with that and we could reach out to them. Member Weiss also commented on the sand situation. Because we have a coral reef, we cannot do refurbishing, but we do get the benefit from both Delray and Boca Raton. Since the Beaches & Shores Advisory Board is disbanded, how can we help with the mangroves and climate change? Can we have more ordinances that would address the mangroves? Commissioner Riesa—This is one of the issues that will be addressed by the new committee being formed by the former members of that board. Member Shane addressed the responsibility of the Planning Board to annually review the Comprehensive Plan and zoning code, making recommendations to the Town Commission. He suggested that a motion be made to put on the agenda giving us enough time to obtain copies of the codes and review them so that this board can do what they are mandated to do. This should be the first order of business. Town Attorney Shutt explained the role of the Planning Board and the Comprehensive Plan. Commissioner Riesa stated that the Comprehensive Plan was done in 2011 and is a 20-year plan. She commented on all the modernization being done in Highland Beach and the climate change issue. Even though climate change is not part of the board's responsibility, she wanted to be assured that the Planning Board would accept taking on this role. Member Shane asked if the language regarding the Comprehensive Plan and zoning codes be changed to read "reviews as required or otherwise instructed by the Commission" instead of annual reviews. Commissioner Riesa will bring this back to the Commission. Member Kravit— Reviewing the zoning ordinances that affect the Town on a daily basis would be beneficial. I found that some of our ordinances are quite good and others are antiquated based on what we do around the country. With modernization and many buildings going through major alterations, many jurisdictions take that opportunity when a permit comes in to be sure that the project is brought up to current standards for parking, landscaping, etc. In my research on seawater intrusion, I found that our shores, beaches, and our sands do quite well when left alone. In Florida, they will replenish themselves naturally. Commissioner Riesa—As liaison for the Commission, I will bring back your requests and recommendations to the Town Commission at the next workshop meeting. It would be Planning Board Regular Minutes Wednesday,May 10,2017 Page 6 of 6 beneficial if you could attend that meeting so you can be part of the conversation and present any issues that come to mind that I may or may not have covered. Member Shane requested a Town Commission agenda be sent to the Planning Board for each Commission meeting. 7.
