1987.08.25_TC_Minutes_Workshopv TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Town Commission Meeting WORKSHOP MEETING Tuesday, August 25, 1987 1: 3P! P. M. A Workshop Meeting of the Town Commission was called to order by Mayor Betty Jean Stewart at 1:3t~ p.m. in the Town Commission Chambers at Town Hall. Also present were: Vice Mayor Mary Louise G. Blosser and Commissioners John J. Basso, David T. Robinson, and Robert F. Scholz. Also present were: Town Attorney Thomas E. Sliney, Town Manager Hugh D. Williams, Deputy Town Clerk Elizabeth L. Kolek, and members of the general public. 87.1 Public Comments and Requests: Jose Echeverria, resident and turtle watcher, stated that he gave copies of Sea Turtle Hatching information and the Delray Beach Turtle Ordinance to the Town Manager on August 24 and asked that the Town Commission take the material into consideration when drawing the Town's proposed ordinance regarding turtle protection. He stated that turtles have been known to nest in Highland Beach as early as April and as late as September and reported that 5 turtle nests were recorded in Highland Beach in the past week. Mr. Echeverria noted that the biggest problem with lights on the beach were from Villa Nova and North. 87.2 Boards and Committees: Talent Bank Applicant Mr. Robert Gregerson, a resident of Seagate, was present and was interviewed by the Town Commission. Mr. Gregerson expressed an interest in membership on the Planning Board and stated that he had filled out the application in a hurry and, forgot to include that he had attended 3 meetings of the Planning Board in the past. The vacancies on the boards were noted. Regular Member Irving Saunders recent resignation from the Planning Board was noted. A Letter of Appreciation for his service will be sent by the Town Commission. Alternate Member Martha Dempsey's term will expire in September 1987. Alternate Member vacancies exist on the Board of Adjustment and the Police Advisory Board. 87.3 Pro osed Ordinances and Resolutions: AN ORDINANCES OF THE TOWN OF HIGHLAND BEACH, FLORIDA, PROVIDING FOR UTILITY RATES, FEES AND/OR CHARGES SPECIFICALLY AMENDING HIGHLAND BEACH CODE SECTION 11-13 OF CHAPTER 11 RELATING TO GARBAGE AND TRASH CHARGES This Ordinance will have second reading with possible adoption at the • Special Meeting on September 15, 1987. • Town Commission Workshop Meeting Minutes August 25, 1987 Page 2 of 6 AN ORIDNANCE AMENDING THE CODE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, TO REQUIRE THE PROVISION OF IMPACT STUDIES ON PROPOSED DEVELOPMENTS OF 4 OR MORE UNITS It was the consensus of the Town Commission to take out "4 or more units" in the title and add "all new buildings". Vice Mayor Blosser felt total development and pressure requirement should be included in the ordinance. All new units should be able to project amount of water will be required for each unit's use. Commissioner Robinson suggested that the word "alike" should be deleted from the second paragraph. Mayor Stewart suggested that no water cooled air- conditioning systems should be allowed in future building but old systems can be replaced as needed. Additional materials received will be studied further and this ordinance will be discussed further at the September 29 Workshop Meeting. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, TO EFFECT A TAX LEVY BASED UPON THE 1987 TAX ROLL OF THE TOWN OF HIGHLAND BEACH This ordinance will have second reading with possible adoption at the . Special Meeting on September 15,1 987. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, APPROPRIATING FUNDS FOR THE FISCAL YEAR 198788, BEGINNING OCTOBER 1, 1987 AND ENDING SEPTEMBER 30, 1988 This ordinance will have second reading with possible adoption at the Special Meeting on September 15, 1987. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, PROVIDING FOR THE INCLUDION OF THE TERRITORY LYING WITHIN THE MUNICIPAL BOUNDARIES OF SAID TOWN WITHIN THE PALM BEACH COUNTY MUNICIPAL SERVICE TAXING UNIT; PROVIDING FOR INTENT, PURPOSE, AND EFFECT; PROVIDING FOR REFERENDUM; PROVIDING FOR INCLUSION IN THE CODE OF ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE This ordinance will have further input and further discussion with a first reading at the Regular Meeting on September 1, 1987. PROPOSED ORDINANCE REGARDING XERISCAPE AT TOWN HALL This ordinance will be discussed further and have a first reading at the Regular Meeting on September 1, 1987. It was noted that the Community Appearance Board is also studying the xeriscape material. 87.17 Discussion re Long and Associates Personnel Survey • This item was deferred until a recommendation has been received from Town Commission Workshop Meeting Minutes August 25,1 987 • Page 3 of 6 the Financial Advisory Board. 87.18 Discussion re proposed Sea Turtle Protection Ordinance The recent material received was discussed and it was felt that the Boca Raton Turtle Ordinance included many of the items that would be included in this ordinance. Hallogen lights and incadescent lights were discussed. The Town should decide how much it wants to spend to protect the turtles and how the ordinance is to be enforced. It was noted that if municipalities on the coast did not have their own ordinance to protect turtles, they would be covered by the Palm Beach County Ordinance. Mayor Stewart will draw up an ordinance for futher discussion and will have a first reading at the Regular Meeting on September 1, 1987. REPORTS _ TOWN COMMISSION: Mayor Betty Jean Stewart - Reported that she will have a rewrite of the Hurricane Procedures by Wednesday, August 27. Mayor Stewart requested each of the Commissioners to schedule and hold a private interview evaluation of the Town Manager prior to September 4, 1987. Mayor Stewart felt that a policy should be established for reimbursement for town related education for employees and be considered at the Regular Meeting on September 1, 1987. Mayor Stewart stated that the City of Boca Raton was not in favor of the 1/4 cent Local Option Gas Tax as proposed by the County. It was the consensus of the Town Commission to agree with Boca Raton. Vice Mayor Mary Louise G. Blosser -- Section 3.4.2, Potential Programs and Measures, 6/6/87 C.D.M. Report, Memo from Town Manager Williams of August 25, 1987 was tabled for further discussion at the Regular. Meeting on September 1, 1987. It was noted that the Town should formally adopt the C.D.M. Report, even if they don't agree with it 100, in order that it can be forwarded to the proper State agencies. This report will be discussed at the Regular Meeting on September 1, 1987, with possible adoption of a Resolution which is to be submitted by Town Attorney Sliney. Vice Mayor Blosser reported that C.D.M. does not do demographic surveys and sked the Town Manager to find out what information is requested by C.D.M. to be included in a demographic survey prior to the Regular Meeting on September 1, 1987. Vice Mayor Blosser stated that she would like the Planning Board to review the County "Use it or Lose It" Ordinance. Vice Mayor Blosser asked the Town Manager to report on the telecommunications tax at the Workshop Meeting on September 29, 1987. Commissioners Basso, Robinson, and Scholz had no reports. Commissioner Robinson commented that a water leak than had probably been in existence for about two years was recently corrected at the Town Commission Workshop Meeting Minutes • August 25, 1987 Page 4 of 6 Regency Highlands and suggested that the other larger condominiums should check for the same type of problem. It was suggested that a meeting be held soon with the managers of the condominiums in Town to ~--- decide a plan of action to take in determining water leaks in an effort to conserve water. Mayor Stewart suggested that the water be turned off during the night hours to determine water leaks, if any. Town Manager Williams suggested a meeting on Wednesday evening, September 16, 1987. The Town Manager is to submit a report to the Town Commission and advise as to the contents of the letter to be sent to the condo managers regarding measures to be taken to determine water usage and if any leaks are suspected, as a part of the Town's survey of water usage and projected needs. REPORTS - TOWN ATTORNEY: Attorney Sliney reported that the Broadview case was transferred from Circuit to Federal Court and is not a new case and are complying with our Motion to Dismiss. Regarding Boca Hi, Judge Rutter issued an Order of Denial for Bramer Isle intervention in the case. Mr. Colman's appeal is pending. Attorney Sliney is to send a letter to Mr. Colman to advise him of the appropriate procedures regarding a petion for • variance via the Board of Adjustment. He has not received a reply from York~Hannover regarding his letter of inquirey about their proposal. Drexel answered interrogatories. Attorney Sliney sent a letter to the Town Manager on August 19, 1987 regarding the Jap Rock case. Is in the court now. The zoning aspect is the base of the case, which involves the Town changing the Land Use Plan to provide for a park. REPORTS -- TOWN MANAGER: Status of pending Town projects -- Lift Station No. 1 refurbishing is now completed with new paint and landscaping. The contractor is moving equipment in to begin work on the repair of the Bel Lido Bridge wingwalls. A flagman will be used for traffic control, as needed for this project. The contractor is late is starting, but once begun, should be completed within two weeks, with a final completion date in the contract. The permit for the THM project has been applied for and takes 90 days. A permit is expected from the Boca Raton environmental department regarding the chlorine storage. There will be a two to three week construction time followed by one month of testing before the system is on line. The new well still lacks appropriate approvals from Boca Raton. The Boca Raton Community Appearance Board still has to review the property since it involves the removal of some trees to accommodate the pipe line from the old to the new well. This will take one week to ten days for actual construciton, once begun. Town Manager Williams stated that C.D.M.'s report on conservation is • now due. c,~ Town Commission Workshop Meeting Minutes August 25,1 987 Page 5 of 6 Fire tax legislation (MSTU) ordinance had first reading earlier in the meeting. Chief Cecere submitted a sample parking permit to be used by workers on the Bel Lido Bridge project which specifies times and dates of expiration. Town Manager Williams reported that he will submit the grant proposal for the xeriscape project within the week and will go to the S.F.W.M.D. office on August 26. Town Manager Williams reported that the payment is not at fault on Russell Drive and that the problem is high manholes. To resurface Russell Drive like Bel Air Drive would cost approximately $200,000.00. The Town is expecting some monies from the County Road and Bridge Fund Suit (approximately $35--50,000.00) and can possible use those funds for lowering the manholes on Russell Drive by 6 inches. The Town Manager will report further on this at the Workshop Meeting on September 29. A Voting Delegate is needed for the Florida Municipal League Meetings and Town Manager Williams suggested the Mayor with the Town Manager as • the Alternate. This will be on the Consent Agenda of the Regular Meeting of September 1, 1987. Commissioner Scholz inquired as to the status of the removal of the expired sales trailer permits in Town. Town Manager Williams stated that they were notified and had 45 days to comply (mid~September). The Building Official will be following up on this.
