Minutes of Meeting of Town Commission
• PUBLIC HEARING/SPECIAL MEETING
Monday, July 6, 1987 5:01 P M
A Public Hearing/Special Meeting was called to order by Mayor Betty
Jean Stewart at 5:01 p.m. in the Town Commission Chambers of Town Hall.
Also present were Vice Mayor Mary Louise G. Blosser and Commissioners
David T. Robinson and Robert F. Scholz. Commissioner Basso was absent.
Also present were Town Attorney Thomas E. Sliney; Town Attorney David
K. Friedman; Town Manaqer Hugh D. Williams; Town Clerk Mary Ann Mariano
and various members of the general public.
The purpose of this meeting was to consider a Building Permit Moratorr
ium Ordinance, after receiving public input in compliance with Florida
Statutes. It was noted that a previous Public Hearing had been held in
compliance with the applicable laws on June 22, 1987 at 5:01 p.m.
Mayor Stewart welcomed the public to the meeting noting the Town's con-
cern in trying to balance all the facts in order to resolve this matter
to most effectively serve the community.
Attorney Sliney read the proposed Moratorium Ordinance noting that it
had been revised and factually updated since its first reading on June
2, 1987. Attorney Sliney read the proposed ordinance in its entirety,
• which ordinance is entitled as follows:
AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, TO
BE DESIGNATED AS THE BUILDING PERMIT MORATORIUM ORDINANCE;
RELATING TO SUSPENSION OF APPLICATIONS FOR BUILDING PERMITS
FOR NEW CONSTRUCTION AND THE ISSUANCE THEREOF; MAKING
LEGISLATIVE FINDINGS OF FACT; DECLARING THE LEGISLATIVE
INTENT AND PURPOSE OF THIS ACT; DECLARING A MORATORIUM
ON APPLICATIONS FOR AND ISSUANCE OF BUILDING PERMITS FOR
NEW CONSTRUCTION; AND PROVIDING FOR AN IMMEDIATE EFFECTIVE
DATE.
Mayor Stewart then opened the Floor to public comment, during which the
following persons addressed the Town Commission opposed to the proposed
Moratorium Ordinance:

Nancy Graham, Attorney, representing Broadview Savings
and Loan
Thomas Tessier, Hydrogeologist with Geraghty & Miller, Inc.
Ground Water Consultants, on behalf of Broadview

Mike Wolsey, representing Bill Frederick (noting only
opposed if single family is included)
Mrs. Amelie Leng addressed the Town Commission in favor of .the proposed
Moratorium Ordinance.
Attorney Sliney noted for the record the numerous studies and reports
which had been utilized by the Town Commission in their deliberations
on this matter. Attorney Sliney further discussed the ramifications of
the recent Supreme Court Ruling in the Glendale, California land use
case, noting that same had been remanded to the California State Court
system.
Discussion was then held between the Town Commissioners, with MOTION
being made by VICE MAYOR BLOSSER/COMMISSIONER ROBINSON to consider the
Ordinance under discussion. During discussion, the following amendments
to the proposed ordinance were suggested:
In the third paragraph of the third page involving traffic, it
will be noted that AlA within Highland Beach lies in a flood
zone;
The effective date will be July 7, 1987;
The expiration date will be six months from today;
Add that single family use on all zoning as defined in the
Town Code will be excluded.
VICE MAYOR BLOSSER amended her MOTION to move that the proposed Ordi-
nance be adopted as amended. This amendment to the MOTION was accepted
by COMMISSIONER ROBINSON. A roll call vote resulted as follows:

The MOTION failed and the Ordinance was not adopted.

There being no further business to come before the Town Commission at
this Public Hearing/Special Meeting, same was adjourned at 6:4U p.m.
