TOWN COMMISSION REGULAR MINUTES
CALL TO ORDER:
A Regular Meeting of Town Commission of the Town of Highland Beach was called to order by
Mayor Carl Feldman in the Commission Chambers at Town Hall at 1:30 PM on Tuesday, August
1, 2017.

Pledge of Allegiance: The Pledge of Allegiance was led by Commission, followed by a moment
of silence.
Civility Pledge: Town Clerk Gaskins recited the Civility Pledge.
1. ADDITIONS,DELETIONS OR ACCEPTANCE OF AGENDA:
Mayor Feldman called for any additions or deletions to the agenda.
Town Clerk Gaskins explained that New Business was added to the agenda as Item 7. The
remaining agenda items would follow in the appropriate numeric order.
Mayor Feldman added Appointment of a New Member to the Ad Hoc Citizen Streetscape
Committee as Item 7A under New Business.
2. PUBLIC COMMENTS AND REOUESTS:
Paul Schlanger, 3912 South Ocean Boulevard provided comments about the August 2016
meeting and noted Commission voted to remove SAFEbuilt and to the Building Department
services in-house. Mayor Feldman explained that contract were signed by Town Commission.

Marilyn Rubin, 3912 South Ocean Boulevard noted that she had researched SAFEbuilt and was
not in favor with outsourcing the Building Department.
Richard Zivalia, 3912 South Ocean Boulevard provided comments regarding SAFEbuilt and the
delay with hiring a Code Enforcement Officer. He inquired why the residents were not made
aware of the new contract and outsourcing the Building Department. Mayor Feldman provided
comments about the contract and encouraged Mr. Zivalia to speak with the Town Manager about
the documentation.
Robert Klupt, 3912 South Ocean Boulevard commented on the support given to the
Commissioners during the past election. He inquired why the Town could not find a qualified
Code Enforcement Officer. He was not in favor of SAFEbuilt and asked Commission to consider
tabling the SAFEBuilt item to do further research to find a qualified code enforcement person.
He commented about a newly constructed house on the east side of AIA just south of Regency
Highland and he felt the house exceeds the height limitation allowed.

MOTION: Vice Mayor Weitz made a motion to approve Consent Agenda Items 6A through 613
as presented. The motion was seconded by Commissioner Zelniker, which passed unanimously.
7. NEW BUSINESS:
A) Appointment of New Member to Ad Hoc Citizen Streetscape Committee: (THIS ITEM
WAS ADDED TO THE AGENDA)
Mayor Feldman explained that a member Paul Resnick resigned from the committee. He
requested that Donald"Don" Gill be appointed to the Ad Hoc Citizen Streetscape Committee.
MOTION: Vice Mayor Weitz moved to appoint Donald "Don" Gill to the Ad Hoc Citizen
Streetscape Committee. The motion was seconded by Commissioner Kelvin.

8. MISCELLANEOUS—ITEMS LEFT OVER:
A) Appoint One (1) Member to the Financial Advisory Board to Serve a Three (3) Year
Term Ending August 2020:

Town Manager Oakes explained that John Ross was not able to attend this meeting and was out
of town until September. Based on this information, the consensus of the Commission was to
appoint David Stern to the Financial Advisory Board.
MOTION: Vice Mayor Weitz moved to appoint David Stern to the Financial Advisory Board
for a three-year term ending August 2020. The motion was seconded by Commissioner Zelniker.
B) Authorize the Mayor to Execute the Professional Services Agreement between the
Town of Highland Beach and SAFEbuilt Florida, LLC
Discussion ensued with regards to continued outsourcing the Building Department services to
SAFEbuilt, Florida LLC.
Commissioner Zelniker and Commissioner Riesa was not in favor of this item.
Commissioner Kelvin, Vice Mayor Weitz and Mayor Feldman was in favor of this item.
MOTION: Vice Mayor Weitz moved to approve the agreement as presented. The motion was
seconded by Commissioner Kelvin.
AMENDED MOTION: Commissioner Riesa moved to amend the agreement to give
SAFEbuilt 50% of the revenues instead of 60%. The motion was seconded by Commissioner
Zelniker.

services to SAFEbuilt Florida LLC.

9. REPORTS—TOWN COMMISSION:
A) Commissioner Elyse Riesa had no report.
B) Commissioner George Kelvin mentioned that they are working on Channel 99 to bring it
into the 20'h Century.
C) Commissioner Rhoda Zelniker had no report.
D) Vice Mayor William Weitz reminded everyone about the upcoming budget meetings and
encouraged residents to attend. He provided comments about several municipalities that recently
adopted an ordinance pertaining to medical marijuana dispensaries.
E) Mayor Carl Feldman provided comments about the recent changes to Highland Beach TV
Channel 99.
He also gave an update on the Ad Hoc Citizen Streetscape Committee and noting the following:
the Committee has agreed upon a new concrete pathway with sea shells within the concrete; the
next meeting will be held on Tuesday, August 2, 2017, at 9:30 AM. The funds from the one cent
surtax would be based on the municipality's population and the Town of Highland Beach will be
$250,000 a year for ten years.
With regards to the street lights, he encouraged the residents to contact Florida Power and Light
or Public Works Director Edward Soper to report light outages
He provided remarks about an email he received from a resident regarding trash near the north
end of Highland Beach entryway sign on the west side of AIA. Building Official Perez and
Public Works Director Soper investigated the problem and found that the property was located in

the City of Delray Beach city limits, and he mailed a letter to Mayor Cary Glickstein of the City
of Delray Beach asking him to look into this issue.
Mayor Feldman mentioned that the City of Delray Beach Fire Rescue was doing a great job and
that the Town will be receiving new equipment by the end of this year which will have the
Town's name on it
10. REPORTS—TOWN ATTORNEY GLEN J. TORCIVIA:
There was no report.
11. REPORTS—TOWN MANAGER VALERIE OAKES:
Town Manager Oakes provided the following updates:
Comcast was nearing completion of their portion of the re-cabling project on A-1-A. They are
only restoring the damaged landscape that was caused by their activities or that of their
subcontractors.
AT&T has repaired many of the damaged junction boxes.
Florida Power and Light has removed temporary electrical services along Intracoastal Drive.
They are planning to remove 18 more of the redundant utility poles along the A-1-A corridor.
AT&T still needs to remove their utility lines off the remaining poles before they can be
removed.
The staff has been working PNC Bank for implementation of an online payment system which
will be going live in the near future. Any questions, please contact the Finance Department.
On Friday, August 4U' the Library will be showing the Light between Oceans movie at 1:00 PM.
The display in the hallway is titled "Artistic Horizons" and it features works by women in visual
arts.
12. PUBLIC COMMENTS AND REQUESTS RELATED TO AGENDA ITEMS:
Robert Klupt, 3912 South Ocean Boulevard mentioned that there is a house on the east side of A-
-lA south of Regency Highland which appears to be higher than the height allowed by Town's
code of ordinance and he would like to know if it is in compliance. Town Manager Oakes noted
that she will speak with the Building Official. Mr. Klupt asked with regards to the concrete that
is proposed for the sidewalk, will there be an issue with it cracking. Mayor Feldman explained
the installation of the concrete and its longevity.

Carl Gehman, 1123 Highland Beach Drive provided comments regarding the SAFEbuilt
agreement and mentioned that he was not supportive of the percentage of funds given to this
company. He also commented on the house mentioned by Mr. Klupt which is located at 4101
South Ocean Boulevard.
13. ADJOURNMENT:
There being no further business, Mayor Feldman called for a motion to adjourn the meeting at
2:50 PM.
MOTION: Vice Mayor Weitz moved to adjourn the meeting at 2:50 PM. The motion was
seconded by Commissioner Zelniker, which passed unanimously.
