2017.07.25_TC_Minutes_Workshop TOWN OF HIGHLAND BEACH 3614 South Ocean Boulevard, Highland Beach, Florida TOWN COMMISSION WORKSHOP MINUTES CALL TO ORDER: A Workshop Meeting of Town Commission of the Town of Highland Beach was called to order by Mayor Carl Feldman in the Commission Chambers at Town Hall at 1:30 PM on Tuesday, July 25, 2017. PRESENT UPON ROLL CALL: Commissioner Elyse Riesa Commissioner George Kelvin Commissioner Rhoda Zelniker Vice Mayor William Weitz, Ph.D. Mayor Carl Feldman Town Attorney Glen Torcivia Town Manager Valerie Oakes Town Clerk Lanelda Gaskins Pledge of Allegiance: The Pledge of Allegiance was led by Commission, followed by a moment of silence. Civility Pledge: Town Clerk Gaskins recited the Civility Pledge. 1. ADDITIONS,DELETIONS OR ACCEPTANCE OF AGENDA: Mayor Feldman called for any additions or deletions to the agenda. There being none, the agenda was accepted as presented. 2. PUBLIC COMMENTS AND REQUESTS: Carl Gehman, 1123 Highland Beach Drive thanked Town Manager Oakes for the landscaping on Highland Beach Drive. Paul Schlanger, 3912 South Ocean Boulevard inquired about the agreement with SAFEbuilt and provided comments about the Streetscape and Beautification Program. 3. C) Board Vacancies: Financial Advisory Board —One Vacancy (Three Year Term) The following residents submitted a Talent Bank Application for consideration and nomination of one (1) individual to fill one (1) vacancy on the Financial Advisory Board for a Three Year Term. Mr. John Ross of 3606 South Ocean Boulevard #1103 was not available to attend this meeting. He submitted a letter to Commission expressing his interest to serve on this advisory board. Mr. David Stern of 2901 South Ocean Boulevard #804 was present and provided a brief description of his professional background past and experiences serving on various Town advisory boards. It was the consensus of the Commission to place Item 4C on the August 1, 2017, Regular Meeting agenda under Miscellaneous—Items Left Over. PROPOSED ORDINANCES AND RESOLUTIONS: A) ORDINANCE NO. 17-0010 (SECOND READING SCHEDULED FOR 8/21/2017) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA AMENDING THE TOWN CODE OF ORDINANCES BY AMENDING CHAPTER 20, "PLANNING AND DEVELOPMENT", ARTICLE VI, "FLOODPLAIN MANAGEMENT", DIVISION 1, "ADMINISTRATION", SECTION 20-341, "APPLICABILITY", SUBSECTION (C), "BASIS FOR ESTABLISHING FLOOD HAZARD AREAS", OF THE CODE OF ORDINANCES TO UPDATE THE DATE OF THE FLOOD INSURANCE STUDY AND FLOOD INSURANCE RATE MAPS; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY, AND AN EFFECTIVE DATE (FIRST READING WAS 7/5/2017). Town Clerk Gaskins read the title of Ordinance No. 17-0010 into the record. Town Manager Oakes introduced this item which was presented to Commission at the June 27, 2017, Workshop meeting. Second reading of Ordinance No. 17-001 O will be on August 1, 2017, Regular Meeting agenda for discussion and adoption. B) ORDINANCE NO. 17-002 O (FIRST READING SCHEDULED FOR 8/1/2017) AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA AMENDING THE TOWN CODE OF ORDINANCES BY AMENDING CHAPTER 30, "ZONING CODE", ARTICLE IV, "ZONING DISTRICTS", SECTION 30-67, "USES PERMITTED, SPECIAL EXCEPTION, AND PROHIBITED USES", AND ARTICLE VIII, "DEFINITIONS", SECTION 30-131, "DEFINITIONS OF TERMS", TO PROHIBIT MEDICAL MARIJUANA TREATMENT CENTER DISPENSING FACILITIES WITHIN THE TOWN OF HIGHLAND BEACH; PROVIDING FOR CODIFICATION, CONFLICTS, SEVERABILITY,AND AN EFFECTIVE DATE. Town Clerk Gaskins read the title of Ordinance No. 17-002 O into the record. Town Manager Oakes explained at the Town Commission Regular meeting on July 50', the Commission asked staff to prepare an ordinance that included language which prohibited Medical Marijuana Treatment Center Dispensary Facilities within the Town of Highland Beach. Mayor Feldman inquired if this ordinance is passed, does it the State supersede this ordinance. Town Attorney Torcivia stated that there cannot be a place in Town that could sell medical marijuana. It was the consensus of the Commission to place Item 5B, Ordinance No. 17-002 O on the August 1, 2017, Regular Meeting agenda for First Reading. RESOLUTION NO. 17-014 R A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, PURSUANT TO FLORIDA STATUTE SECTION 166.041(3)(C)(2)(A) HEREBY ELECTS TO HOLD BOTH ADVERTISED PUBLIC HEARINGS ON ORDINANCE NO. 17-002 O AT ITS REGULAR COMMISSION MEETING TIME OF 1:30 PM ON AUGUST 1, 2017, AND ON SEPTEMBER 5, 2017; PROVIDING AN EFFECTIVE DATE. Town Clerk Gaskins read the title of Resolution No. 17-014 R into the record. Town Manager Oakes referred to Ordinance No. 17-002 O whereby two (2) Public Hearing meetings must be held with one public hearing meeting to be held after 5:00 PM. This Resolution would allow the Commission to hold two (2) Public Hearing meetings at 1:30 PM on August 1, 2017, and September 5, 2017. It was the consensus of the Commission to place Item 513.1, Resolution No. 17-014 R on the August 1, 2017, Regular Meeting Consent Agenda. C) RESOLUTION NO. 17-013 R A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, SUPPORTING THE COUNTYWIDE OFFICE OF INSPECTOR GENERAL, AND FURTHER SUPPORTING THE FUNDING OF SAID OFFICE THROUGH COUNTY AD VALOREM TAX DOLLARS; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. Town Clerk Gaskins read the title of Resolution No. 17-013 R into the record. Town Manager Oakes presented this item. The County recently requested all Municipalities in Palm Beach County voluntarily pay their "fair share" of costs toward the countywide IG Program. The Town Commission of Highland Beach does not support contributing Town tax dollars to pay for the countywide IG Program. Commission Discussion: Vice Mayor Weitz provided comments with regards to the IG Office. He fully supports the IG Office but does not believe the Town should contribute additional Town tax dollars for this program. It should be up to the County to fund them appropriately. Commissioner Riesa Commissioner Kelvin, and Commissioner Zelniker concurred with Vice Mayor Weitz. Mayor Feldman inquired about funding budgeted for the IG Office. Finance Director Curtis explained that funds have been budgeted for the IG Office. Mayor Feldman also concurred with Vice Mayor Weitz. NEW BUSINESS: A) Authorize the Mayor to Execute the Professional Services Agreement between the Town of Highland Beach and SAFEbuilt Florida LLC Town Manager Oakes presented this item detailing the terms and conditions of the agreement as well as the benefits to the Town. She explained that management intends on fast-tracking the Town's Building Department toward automation, code compliance and forward planning of the Town's code of ordinances as it relates to a changing Highland Beach environment. Tom Walsh, Regional Manager with SAFEbuilt provided remarks with regards the fast-track permitting system with SmartGov and a Landscape Consultant. He explained there would be a landscape specialist working with the Building Official to create a checklist to ensure it complies with the Town's code of ordinances. Mayor Feldman asked if SAFEbuilt would review the Town's code of ordinances. Mr. Walsh explained that they provide up to $30,000 worth of work and that they have been looking at the Town's code of ordinances for future updates. Town Manager Oakes explained that there are several projects that she and Mr. Walsh discussed with regards to permit fees, analysis of the Building Department as far as its functionality and existing codes. B) Approval of Town Commission Meeting Minutes: June 27, 2017—Special Meeting June 27, 2017—Workshop Meeting July 5, 2017—Regular Meeting It was the consensus of the Commission to place Item 6B on the August 1, 2017, Regular Meeting Consent Agenda. 7. MISCELLANEOUS—ITEMS LEFT OVER: None. 8. REPORTS—TOWN COMMISSION: A) Commissioner Elyse Riesa welcomed the new employees and thanked Library Director Lois Albertson for sending out notices to the condominium managers. Page 5 of 8 I Town Commission Workshop Meeting Minutes Tuesday,Julv 25,2017 B) Commissioner George Kelvin attended a meeting with the Finance Director, Town Manager and the Town Attorney and he was very impressed with their expertise, knowledge, and support. C) Commissioner Rhoda Zelniker provided comments about the agendas and noted that agenda items such as the SAFEBuilt agreement should have been explained in detail to the residents. Also, these decisions should be made during the season when there are more residents in Town. The distribution of the Highlander needs to be reevaluated since most residents are not in Highland Beach during the summer month to receive the newsletter. D) Vice Mayor William Weitz welcomed the new personnel to Highland Beach. E) Mayor Carl Feldman explained that he received an invitation to attend a Leadership Climate Summit in Fort Lauderdale, Florida on December 14th and 15th. He is not able to attend and asked Vice Mayor Weitz if he could attend in his place. Vice Mayor accepted the invitation. The fee for registration is $125.00. It was the consensus of the Commission to appropriate funds for the registration fee to allow Vice Mayor Weitz to attend the Leadership Climate Summit in December 2017. Mayor Feldman made a comment regarding the Town not having an ordinance for rental parking fees at a condominium or a private residence for parties, etc. He asked the Commission if they would be in favor of an ordinance restricting these parking fees. It was the consensus of the Commission to have staff prepare an ordinance to restrict parking fees. He acknowledged Marci Shatzman, a reporter with the Sun Sentinel Weekly (Boca Forum). Marci Shatzman provided comments regarding her publication indicating that she will now be covering the Highland Beach Town Commission meetings. The articles will appear on the Sentinel website on Wednesdays and in the Sundays Sun Sentinel Community section. He also thanked Rich Pollack for his reporting in the Coastal Star. 9. REPORTS—TOWN ATTORNEY GLEN TORCIVIA: There was no report. Page 6 of 8 Town Commission Workshop Meeting Minutes Tuesday,July 25,2017 10. REPORTS—TOWN MANAGER VALERIE OAKES: Town Manager Oakes welcomed new Deputy Town Clerk Terisha Cuebas and Public Information Coordinator Yude Alvarez. Mayor Feldman mentioned that Yude Alvarez would be working with Commissioner Kelvin to improve Highland Beach TV Channel 99. 11. PUBLIC COMMENTS AND REQUESTS RELATED TO AGENDA ITEMS DISCUSSED AT MEETING ONLY: Tim Burnich, 4505 South Ocean Boulevard provided comments about outsourcing the Highland Beach Building Department. Carl Gehman, 1123 Highland Beach Drive provided comments about several incidetns that occurred during the July 4t` holiday and noted that three (3) vehicles had its windows broken. He would like to have more police presence. Mr. Gehman congratulated the new employees. 12.
