The Workshop Meeting of the Town Commission was called to order by Mayor Betty Jean Stewart in the Town Commission Chambers at Town Hall. Also present were Vice Mayor Mary Louise G. Blosser and Town Commissioners John J. Basso, David T. Robinson and Robert F. Scholz. Also present were Town Attorney Thomas E. Sliney, Town Manager Hugh D. Williams, Town Clerk Mary Ann Mariano and members of the general public. 87.1 Public Comments and Requests: Mr. Joe Nastri, whose daughter owns property in Bel Lido, addressed the Town Commission requesting permission to place an "Open House" sign on AlA for the property located in Bel Lido. Mr. Nastri was directed to the Building Official. Mr. Michael Dent of Casuarina expressed concern regarding the Town Manager's public comments to the newspaper regarding the Milani/Jap Rock matter, stating that it was his opinion that Mr. Williams did not • adequately express the concerns of the Town. Mr. Dent also noted his opposition to the proposed land use amendment ordinance being taken up later in the meeting. Attorney Ken Slinkman, representing Paul and Camille Hoffman, was advised that he would be given an opportunity to address the Town Commission during their discussion of the proposed land use amendment ordinance. 87.2 Boards and Committees: The vacancies on the various Boards were noted. There were no Talent Bank Applicants to be interviewed. 87.3 Proposed Ordinances and Resolutions: 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE "TOWN OF HIGHLAND BEACH, FLORIDA, FUTURE LAND USE PLAN 1982-2000" CONTAINED IN THE COMPREHENSIVE PLAN (ORDINANCE N0. 494) BY REDESIGNATING THAT PORTION OF TOWN LOT 2 A.N. THAT WAS FORMERLY KNOWN AS THE "B" AND "C" SITES OF FORMER RPUD-1 (NORTHERLY PORTION OF BOCA HI COMPLEX), TOWN LOTS NOS. 59, 60, 62, 65 AND 69 (WEST OF A-1-A ONLY) FORMERLY KNOWN AS RPUD-2, TOWN LOTS NOS. 15S AND 15N AND TOWN LOTS NOS. 56, 57, 58 AND 71 (WEST OF A-1-A ONLY) FROM MFM (MULTIPLE FAMILY MEDIUM) • TO MFL (MULTIPLE FAMILY LOW); PROVIDING FOR THE MINUTES OF TOWN COMMISSION WORKSHOP MEETING April 28, 1987 • Page 2 of 6 APPROPRIATE REVISION OF THE PLAN; PROVIDING AN EFFECTIVE DATE. (1st Reading 4/7/87 - Published 4/16/87) This proposed ordinance was deferred until the end of the meeting. 2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING SEC. 29-23 OF THE CODE OF THE TOWN OF HIGHLAND BEACH A5 RELATES TO WATER CONNECTION FEES (1st Reading 3/3/87 - Published 3/13/87) (Report to be submitted by CDM) Mr. Williams noted that he had discussed this matter with Camp Dresser and McKee, the Town's engineers, and asked them to review the proposed fees and submit their report. CDM advised that they could not come up with any appropriate fees until they know what long term water supply the Town is planning on. The Town Manager advised them to plan on 3 million gpd in order to submit a report. This report is expected by Friday of this week in order that this matter be considered at the May 5, 1987 Regular Meeting. 3. AN ORDINANCE PROVIDING FOR THE PROTECTION OF SEA TURTLES. • The submission of the proposed County ordinance was noted. Also noted was the fact that Boca Raton had adopted a similar ordinance in October. Vice Mayor Blosser requested that the Town Manager get a copy of the Boca Raton ordinance. Mayor Stewart noted that Boca Raton's ordinance was similar to that under consideration by the County. Vice Mayor Blosser expressed concern regarding the prohibition of beachfront lighting as cited on page 9 of the County ordinance. Mayor Stewart stated that the County was soliciting comments regarding their proposal. After substantial discussion, it was the consensus of the Town Commission that the Town should look to adopt a protecting ordinance more tailored to the needs of Highland Beach rather than follow the County proposal. The Town Manager will make an analysis of the County and Boca Raton ordinances by the May Workshop Meeting at which time the Town Commission will consider the drawing of a Town ordinance. 87.12 Discussion re proposed amendments to sign ordinance as recommended by the Community Appearance Board: Discussion ensued regarding a provision to require uniformity in the wooden structures used for the mounting of "for sale" or "for rent" signs. Also to be considered will be the permitting of "for sale" or "for rent" signs. Commissioner Robinson felt that the Town needs to be tough on this issue in order to beautify the community. The recommenda- tions as submitted by the Community Appearance Board will be put in the form of an ordinance and scheduled on the May 5, 1987 Regular Meeting • Agenda for first reading. MINUTES OF TOWN COMMISSION WORKSHOP MEETING April 28, 1987 • Page 3 of 6 REPORTS - TOWN COMMISSION: Mayor Betty Jean Stewart Mayor Stewart advised the Town Commission that on April 21, 1987, she had executed an agreement on behalf of the Town to obtain government subsidized funding for the review of the Comprehensive Plan. Mayor Stewart recommended that a listing be made of those items as brought out in the Legislative Bulletin of interest to the Town for purposes of follow up through the Town's legislators of municipal importance. Vice Mayor Mary Louise G. Blosser No report. c: Commissioner John J. Basso No report. Commissioner David T. Robinson Commissioner Robinson reiterated his request made at the April Regular Meeting for the provision of a four way stop at the intersection of Bel Lido and Tranquility Drive, with a "stop ahead" sign at the bridge. Commissioner Robinson submitted pictures of the intersection noting the visibility problems found there. It was the consensus of the Town Commission to provide the signs, and therefore, this matter will be placed on the May 5, 1987 Regular Meeting Consent Agenda. should be handled by the individual condominium associations. Enforcement was raised as a concern. Commissioner Robinson will research this matter further. With regard to a proposed new ordinance prohibiting open grill barbecues on balconies of multi-family dwellings, Commissioner Robinson noted a memorandum from the Building Official which indicated that the Fire Marshall supported such a measure if the Town wanted to control the problem. Several members of the Town Commission felt that this matter Commissioner Robert F. Scholz Commissioner Scholz noted a memorandum dated April 1f~, 1987 from the Town Clerk regarding consideration of the acceleration through the salary schedule at her evaluation time of June 8, 1987. This matter will be placed on the May 5, 1987 Regular Meeting Agenda. Payroll information for all employees was requested by the Vice Mayor and will • be supplied prior to the May 5th Regular Meeting. Commissioner Scholz stated that he had engaged in discussion with the Utilities Director which indicated that there was a lack in response from Camp Dresser and McKee, the Town's engineers, when approached by MINUTES OF TOWN COMMISSION WORKSHOP MEETING ~ April 28, 1987 Page 4 of 6 • Town Staff. A written communication will be forwarded to CDM expressing the Town's concerns in this regard. Further, the Town Manager will look into the process of the negotiations necessary to procure proposals from other engineers. REPORTS - TOWN ATTORNEY Attorney Sliney noted that the opposing attorney in the Ocean Terrace litigation had until the end of April in which to file an appeal in the matter. The Itco litigation and the Boca Highland litigation are in the process of being re-assigned to different judges. With regard to the proposed purchase by the County of the Milani/Jap Rock property, the County Commission will be considering the contract for same at their May 12, 1987 Meeting. The Town Attorney will be submitting a position paper to the County for this meeting. Attorney Sliney noted that in Lakewood, Ohio, a lead case involving newsracks was being acted upon by the Supreme Court which may have an effect on newsrack ordinances throughout the country. The Town Attorney will keep the Town informed on this matter. • REPORT - TOWN MANAGER Charles H. Perron and Roscoe Burnham of Russel and Axon were present and addressed the Town Commission regarding the repairs to the Bel Lido Bridge wingwalls. Mr. Burnham made a presentation which explained the use of aluminum versus gunite for the repair of the wingwalls. This work can be completed prior to the residents returning for the season if the bidding is approved at an early date. It was the consensus of the Town Commission to place the approval of bids for the repair of the wingwalls using aluminum on the May 5, 1987 Consent Agenda. The Town will be notifying the Bel Lido residents of the upcoming repairs. With regard to the item of the water source report by Camp Dresser and McKee, this item was deferred until the May 5, 1987 Regular Meeting. With regard to the policy regarding the maintenance of the Bel Lido entrance and rights-of-way, Mr. Williams indicated that he had a rough draft ready for submittal to the Bel Lido Homeowners' Association and would have their comments for the Town Commission in approximately 10-12 days. The Town Manager requested permission to attend a Florida City/County Managers Meeting on May 21, 22 and 23 in West Palm Beach. There was no opposition to this request. Vice Mayor Blosser requested a written report. Upon reconvening the meeting, discussion regarding the proposed land use amendment ordinance was taken up. Mayor Stewart noted that this item would be scheduled as a discussion item at the May 5, 1987 Regular Meeting. Further, a Public Hearing and Special Meeting would be held at 5: g1 P.M, on May 5, 1987 at which time public in-put would be solicited and action could be taken to adopt the ordinance. The public was then invited to give their in-put into the proposed ordinance. The following persons spoke in opposition to the proposed land use amendment ordinance: * Ken Slinkman, Attorney for Paul and Camille O. (Submitted letter which is made a part of these Minutes.) * John Corbett, Attorney represent the Connaught Property. (Notes submission of earlier correspondence and submitted a newspaper article re water preservation which is made a part of these minutes.) * Lee Worsham, Attorney representing Broadview Savings and Loan. * Substantial discussion took place by those addressing the Town Commission. A verbatim transcript of this portion of the meeting is attached to and made a part of these Minutes.
