A Public Hearing of the Town Commission of the Town of Highland
Beach, Florida was called to order by Mayor Edward J. Sullivan at
5:PJ1 p.m. in the Town Commission Chambers at Town Hall. Also in
attendance were Vice Mayor Mary Louise G. Blosser and Town
Commissioners Betty Jean Stewart, John J. Basso, and William A.
Grier.
Also present were Town Attorney David K. Friedman, Town Manager
Hugh D. Williams, Town Clerk Mary Ann Mariano, and various members
of the general public.
Attorney Friedman noted that the purpose of the Public Hearing was'
to receive input into the Town's consideration of a proposal to
amend the Future Land Use Plan contained in the Town's Compre-
hensive Plan to change the land use of the following described
properties from Multiple Family Medium (MFM) to Multiple Family
Low (MFL):
HOFFMAN/BROADVIEW PARCEL
• BOLA HI PARCEL, "B" AND "C" SITES
ENCLAVES OF BOCA COVE AND BOCA COVE PARCELS
REGENCY HIGHLAND PARCEL
CONNAUGHT PARCEL
BEAGLE PARCEL

• After discussion, COMMISSIONER BASSO/COMMISSIONER STEWART moved:
"That the Planning Board, having unanimously recommended
that the future lans use plan be amended in accordance
with Exhibit "A" attached, entitled " Proposed Comprehensive
Plan Changes" and Exhibit "B" attached, entitled "Town of
Highland Beach, Florida, Proposed Future Land Use Plan Modi-
fications" prepared by Gee and Jensen, Engineer and Archi-
tects, Planners, dated October 3, 1986, I move that it be
forwarded to the State of Florida, Department of Community
Affairs for review for compliance."
Further discussion was held among the Town Commission as evidenced
in the aforementioned verbatin transcript, after which the Town
Clerk conducted a roll call vote as follows:

The purpose of this memorandum is to provide an environmental
permitting chronology of the referenced property. Some of the dates
listed have been reconstructed from my notes and there may be a slight
variance from the actual date that the event occurred.
1. A joint permit application was submitted to the State of
Florida Department of Pollution Control (forerunner of the Department of
Environmental Regulation) and the Army Corps of Engineers on 14 May
1975. This application sought dredge and fill permits for the purpose of
constructing a marina and residential structures. It was assigned permit
application no. 50-25-3391.
• 2. In May of 1977 revised drawings were submitted to modify
the permit application.
3. On 7 December 1977, DER issued an Intent to Deny permit
application no. 50-25-3391. A final administrative hearing was scheduled
for 23 August 1978. In the meantime, the parties conducted discovery and
otherwise prepared for that final hearing.
4. At this time it became apparent that there was a possibility
to arrange a settlement. Accordingly, _in April of 1979, revised drawings
were provided DER, and DER was notified ,of the Hoffmanns` wish to
modify .the application on 21 May 1979.
5. The revised application received a favorable biological
assessment by DER, which was. forwarded to the Town under cover of a
letter by Forrest Fields, project manager, on 21 February 1980 Exhibit
A) . On 4 March 1980, the Town of Highland Beach gave its approva -#o
-~ tt°se dredge and fill project and forwarded same under cover of a letter of
7 March 1980 from Elaine W. Roberts, Town manager, to Forrest Fields
(Exhibit B).

6. A significant aspect of the modification was the Hoffmanns'
agreement to remove an existing Australian pine community in a Florida
Inland Navigation District (FIND) parcel situated roughly in the center of
the Hoffmann property. The Hoffmanns proposed to mitigate the
elimination of mangroves for the placement of their marinas by scraping

down the FIND parcel and allowing it to revegetate with mangroves. FIND
would not release the spoil parcel unless the Intracoastal Waterway (ICW)
in the vicinity was dredged to a self maintaining depth. The Hoffmanns
then applied for permits to so dredge that portion of the ICW on 3 June
1980. This application was issued- DER file no. 50-31527.
7. Meanwhile, the Hoffmanns met with DER and requested
issuance of the dredge and fill permit for the marinas and residential
structures. DER declined to issue the permit until such time as the
Hoffmanns had received a permit to -dredge the ICW. DER did, on 30 June
1980, send to the author of this memorandum a letter signifying its intent
to -issue the first permit application (Exhibit C) .
8. On 16 April 1981, DER issued an intent to deny permit
application no. 50-31527, the ICW application. The Hoffmanns filed a
petition for administrative hearing, final hearing for which was scheduled
in July of 1981. Less than a week prior to the final hearing, DER
relented and agreed to issue the permit to dredge the ICW.
• 9. This permit was issued on 21 August 1981 (Exhibit D) and
on 14 October 1981 permit no. 50-25-3391, for the dredge and fill portion
of the project, -was issued- (Exhibit E).
10. By this time, Hidden Harbor Associates had procured an
option on the property. An intensive period of negotiations commenced
with the Corps of Engineers and the various federal environmental
agencies. Finally, on 16 August 1982, a. Corps of Engineers permit was
issued but only for the northern portion of the project. -The southernmost
300 feet were withdrawn from that permit application.
11. On 10 November 1983, Paul and Camille Hoffmann again
applied for a Corps permit for the southern 300 feet of, the project
(Exhibit F) . Notice of the permit application was published by the Corps
of Engineers and responses to that public notice were forwarded to the
applicant in March of 1984. The Hoffmanns then undertook a detailed
scientific and legal inquiry into the matter and submitted on 29
March 1985, their memorandum and response. (Exhibit G).
And there you have, more or less, a ten-year odyssey.

transmit it to the Corps to "close the file". After th Corps has completed
their report, Mike will ask for a meeting to discuss final resolution. Hoff-

JANUARY 6, 1987 REGULAR MEETING. (TAKEN VERBATIM FROM TAPE)
I would like to address myself to some of the comments contained in the
February 28th, I'm sorry, December 28th article in the Sun Sentinel
relative to the Town and their Commissioners and what their thoughts
are.
In the first place, I do believe that the Town Commission is to be highly
commended on its handling of the Town's water problems. They faced up
to the problems of THM's and to the question of a new standby well in
the current west wellfield and to the matter of an additional wellfield
which is hopefully in progress.
As to whether we have a streamlined government, better employee morale,
I question as to whether the case has been somewhat overstated. When
as a new Commissioner just under two years ago, I first heard the talk
of some $45,000 or so for a computer for a Town of our size, I spoke
with two of my friends, both of whom are middle management or higher
executives. One with IBM and the other with Digital Equipment. Each
of them expressed serious reservations about this particular idea,
particularly as to its cost and to the availability of software to a
Town of this small size. I mentioned this to the Town Manager at the
time, and he agreed. to meet with the. man from Digital Equipment, but
r~:before I could arrange a date, a purchase had already been made. So
we have computer. It turns out nice neat water bills. The payroll
preparation has to be farmed out, and based on the recommendations made
to the Financial Advisory Board yesterday, is going to continue to be
fanned out indefinitely as being more economic than doing it ourselves.
We hope to get our money back from the software supplier without a
lawsuit, but we still cannot be certain. We think we have some software
now that will serve the purpose. It remains to be seen whether it really
will serve the needs of this small town. At least at the level of the
Town Manager I raised the caution in advance but we plunged ahead never-
theless. Hopefully, 1987 will see us hopefully home with a truly
efficient Town government. In the meantime, the Town Manager made
statements to the Financial Advisory Board, this goes back a bit, about
h e anticipated intentions of certain personnel which he did not know
to be true, and which in fact were not true. Rita Ebersole, I suppose,
was the final example of our cost-effective government. This lady was
a highly capable employee, who knew the department, the Building Depart-
rent, its workings and its files, who had dealt with the public and who
was uniformly respected by the public and had a long record of fine
service both here and in the federal government. She was deemed, by
our Town Manager in his wisdom, to be overpaid so she quit. The Commissioners
are without question dedicated public servants, and in some respects
~~r~oteably waterwise and they merit considerable praise, in my judgement.
In other respects, noteably streamlining cost-effective government, and
employee morale, I think considerable improvement can be made.
