1988.12.27_TC_Minutes_Workshopti f TOWN OF HIGHLAND BEACH, FLORIDA Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, December 27, 1988 1:30 P.M. Mayor Betty Jean Stewart called the Workshop Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:30 P.M. in the Commission Chambers at Town Hall. Others present were Vice Mayor John J. Basso, Commissioners Robert F. Scholz and Doris R. Rome. Com- missioner Marvin A. Waldman was absent. Also present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Deputy Town Clerk Anne M. Kowals and members of the general public. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The Agenda was adopted as submitted. 88.1 Public Comments and Requests Planning Board Chairman John E. Ward addressed the Commission with regard to the Planning Board letter of 12/19/88 concerning the proposed amendments to the Building Department Procedures. At the request of the Town Commission, Chairman Ward agreed to return to the Special Meeting set for 3:00 P.M. on this date at which time this matter is scheduled for discussion. Mr. Jose Echeverria, who is in charge of the Turtle Watch Program within Highland Beach, addressed the Town Commission to give a status report on the 1988 Turtle Watch project. It was noted that the Turtle Watch Program experienced a good year with great response from residents of Highland Beach. It was further noted that the Highland Beach Library also participated in the program by displaying jars containing a variety of turtle eggs. Mr. Echeverria explained that the Holiday Inn complied with the Town Ordinance No. 554 relating to lighting on the beach and Ambassadors South also complied with said Ordinance by concealing their lights (they placed asbestos covering on the East side of their globes which resulted in no lights being visible on the beach). Mr. Echeverria advised the Town Commission that Mr. John Wynne donated the necessary stakes used for marking the turtle nests. Regarding the September Countywide Clean Sweep Beach Cleaning Project, Mr. Echeverria noted that program resulted in the removal of 7-1/2 vehicle loads of debris from the beaches of Highland Beach (bottles, cans, plastic containers, papers, etc.) which was delivered to Delray Beach for sorting and disposing. Mr. Echeverria noted that the Clean Sweep Beach Program would like to place receptacles in a certain area where trash could be deposited; this would be picked up periodically for delivery to Delray Beach. Town Commission Workshop Meeting Minutes December 27, 1988 Page 2 of 6 88.2 Boards. and Committees Mayor Stewart noted the following Town Board vacancies exist: ~ One Alternate Member - Planning Board Two Alternate Member - Community Appearance Board One Regular Member - Water Resources Advisory Board Receipt of Planning Board Memo dated 12/19/88 transmitting the Planning Board recommendations of the Comprehensive Plan Elements to the Town Commission was acknowledged. Attorney Sliney advised that a proposed schedule for processing the Comprehensive Plan will be forthcoming. Deputy Town Clerk Kowals was directed to distribute the final draft of the Comprehensive Plan Elements to the Commissioners in advance of the scheduled meetings. Also acknowledged was the receipt of the Planning Board letter of 12/19/88 regarding the Planning Board's proposed amendments to the Building Department Procedures. This matter will be discussed at the Special Meeting set for 3:00 P.M. this date. 88.3 Proposed Ordinances and Resolutions 1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING SECTION 29-23, SUBSECTION (1) OF THE CODE OF THE TOWN OF HIGHLAND BEACH A5 RELATES TO WATER CONNECTION FEES AND AMENDING SECTION 22-1 SUBSECTION (a) OF THE CODE OF THE TOWN OF HIGHLAND BEACH AS RELATES TO SEWER CONNECTION FEES. The proposed Ordinance which had a first. reading on 12/6/88, was published on 12/16/88, was .read by Mayor Stewart, by title only, and will be placed on the Agenda for final reading at the January 3, 1989, Regular Meeting of the Town Commission. 2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING CHAPTER 19 OF THE CODE OF HIGHLAND BEACH ENTITLED "PLUMBING" BY THE REPEALING OF SUBSECTION 1003.7 OF SECTION 19-2 WHICH MANDATES THE USE OF CAST-IRON PIPE. The proposed Ordinance which was given a first reading on 12/6/88, was published on 12/16/88, was read by title only by Mayor Stewart. Same will be on the Agenda for final reading at the January 3, 1989, Regular Meeting of the Town Commission. 3. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING THE TOWN CODE OF THE TOWN OF HIGHLAND BEACH, • CHAPTER 28-1/2 ENTITLED "TREES, SHRUBS AND VEGETATION", SECTIONS 28-1/2 - 14 ENTITLED "APPLICATION OF ARTICLE" ( ~ ~ a Town Commission Workshop Meeting Minutes December 27, 1988 Page 3 of 6 AND 28-1/2 - 15 ENTITLED "PERMIT REQUIRED" TO INCLUDE TREE ABUSE PROVISIONS. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, ADOPTING A BOARD MEMBERS INFORMATION NOTEBOOKS FOR THE COMMUNITY APPEARANCE BOARD. This matter was deferred to the Special Meeting at 3:00 P.M. this date. 6. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, ADOPTING A BOARD MEMBERS INFORMATION NOTEBOOK FOR THE CODE ENFORCEMENT BOARD. This matter was deferred to the Special Meeting at 3:00 P.M. this date. 7. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, ADOPTING A BOARD MEMBERS INFORMATION NOTEBOOK FOR THE BOARD OF ADJUSTMENT. This matter was deferred to the Special Meeting at 3:00 P.M. this date. 8. A RESOLUTION OF THE TOWN OF HIGHLAND BEACH, FLORIDA, ADOPTING A BOARD MEMBERS INFORMATION NOTEBOOK FOR THE FINANCIAL ADVISORY BOARD. This matter was deferred to the Special Meeting at 3:00 P.M. this date. 88.18 Final Review re Board Notebooks Commissioner Rome noted that she studied the final draft of the Board Notebooks and feels they are well done. The Town Commission discussed possible additions to all Board Members Information Notebooks, as suggested in Mayor Stewart's memo of 12/16/88, regarding requests for legal and consultants services, the use of Town Stationary by Boards, composition of minutes and courtesy to staff. r Town Commission Workshop Meeting Minutes December 27, 1988 Page 4 of 6 Action on acceptance of these additions was deferred to the Special Meeting at 3:00 P.M. this date. During the discussion of notebooks, the Town Manager noted that the Town does have rules and regulations as well as a procedures manual for the employees. With regard to departmental manuals, the Town Manager further noted that the Police Department completed their "Operational" and their "Procedures" Manuals and policies in the various departments are being prepared. REPORTS - TOWN COMMISSION Mayor Betty Jean Stewart Mayor Stewart cited a newspaper article reporting the problems that the State of New Jersey is having with recycled newspapers as there is a lack of a market for said material. Vice Mayor John J. Basso No report. Commissioner Robert F. Scholz No report. Commissioner Doris R. Rome Commissioner Rome discussed the possible reinstatement of the policy allowing short term overnight parking (of certain vehicles that are not permitted to be parked at condominiums) at Town Hall. Commissioner Rome questioned if there was any interest on the part of the Town Commission in researching Public Safety Departments as she received information from Indian River Shores Community on this matter. It was the consensus of the Town Commission that this matter should not be pursued at this time. Commissioner Marvin A. Waldman Absent. REPORTS - TOWN ATTORNEY Town Attorney Sliney reported that the Drexel hearing (Royal Highlands) originally scheduled for January 5, 1989, was rescheduled for February 28, 1989. REPORTS - TOWN MANAGER • Town Manager Mariano reported on the injuries Police Officer John Otto sustained on December 17, 1988, when hit by a vehicle. The letter of thanks to the Church for their Per Vice Mayor Basso's inquiry, the Town Manager will write to the Florida Department of Transportation to determine if a flashing light could be installed by the D.O.T. in the vicinity of the Fire Department. Regarding the upcoming painting of the water tower behind Town Hall, the Town Manager noted that Mr. John Moyer held to the $25,000. quote (25~ of the cost will be paid by Centel Cable). In discussing the color of the paint to be used, it was the consensus of the Town Commission that the Community Appearance Board should determine the color. Town Manager Mariano reported that the Royal Highlands trailer and the accompanying debris were removed from that site. The Town Manager noted receipt and distribution of a letter from At- torney Friedman regarding the status of the Board of Adjustment under Florida Law and requested direction from the Town Commission if any changes to the Town Code are in order. At 3:00 P.M., Mayor Stewart recessed the Workshop Meeting for the purpose of conducting the scheduled Special Meeting. Mayor Stewart reconvened the Workshop Meeting at 4:50 P.M. A memo of 12/21/88 from the Town Manager regarding a proposed amendment to Chapter 29 of the Town Code clarifying water use unit charges was discussed. It was the consensus of the Town Commission that the Town Manager should draft an Ordinance to incorporate said recommended amendment. Town Manager Mariano deferred the remainder of her report to the Regular Meeting of the Town Commission on January 3, 1989.
