MINUTES OF TOWN COMMISSION
REGULAR MEETING
Tuesday, June 6, 2017 1:30 PM
Mayor Carl Feldman called the Regular Meeting to order in the Town Commission Chambers at
1:30 PM.
CALL TO ORDER:
Roll Call: Members Present: Mayor Carl Feldman; Vice Mayor William Weitz, Ph.D.;
Commissioner George Kelvin; Commissioner Elyse Riesa and Commissioner Rhoda Zelniker.
Also present: Town Attorney Glen Torcivia; Town Manager Valerie Oakes; Town Clerk
Lanelda Gaskins; Police Chief Craig Hartmann; Finance Director Cale Curtis; Library Director
Lois Albertson; Public Works Director Edward Soper; Building Official Valentino Perez and
Building Department Office Manager Carol Holland.
Pledge of Allegiance: The Pledge of Allegiance was led by Commission, followed by a minute
of silence.
Civility Pledge: The Civility Pledge was recited by the Town Clerk.
1. ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA:
Mayor Feldman called for any additions or deletions to the agenda.
Item 7A: Commissioner Kelvin added discussion regarding Milani Park.
Hearing no further additions, the agenda was accepted as amended.
2. PUBLIC COMMENTS AND REOUESTS:
Tim Burnich, 45 Ocean Boulevard asked that everyone take a moment to remember the
invasion of Normandy that took place 73 years ago today.
Bernard Featherman, Former Mayor of Highland Beach commented on the Code
Enforcement Board and the appointment of a Special Magistrate, which he is not in favor of
having. He also commented on the two previous cases that came before the Code
Enforcement Board.

5. PROPOSED ORDINANCES AND RESOLUTIONS:
A) RESOLUTION NO. 17-010 R
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF
HIGHLAND BEACH, FLORIDA, SUPPORTING A PLEDGE OF THE
MUNICIPALITIES OF PALM BEACH COUNTY ENDORSING THE MAYORS'
CLIMATE ACTION PLEDGE, AFFIRMING SUPPORT FOR THE
SOUTHEAST FLORIDA REGIONAL CLIMATE CHANGE COMPACT,
AGREEING TO CONSIDER IMPLEMENTING THE REGIONAL CLIMATE
ACTION PLAN IN WHOLE OR IN PART AS APPROPRIATE FOR EACH
MUNICIPALITY, AND URGING ALL MAYORS OF PALM BEACH COUNTY
TO SUPPORT THE MAYORS' CLIMATE ACTION PLEDGE.
Town Clerk Gaskins read Resolution No. 17-010 R into the record.
Town Manager Oakes gave a summary and background of the Regional Climate Action
Plan (RAP) which is modeled after the U.S. Mayors' Climate Protection Agreement that
has over 1,000 municipal participants nationwide. The RCAP is not a mandate,nor does
it obligate the Town to implement any particular actions.
Commission Discussion:
Discussion ensued amongst the Commission regarding the importance of participating in
this plan. Commissioner Kelvin was not in favor since there was no climate action plan
submitted.
MOTION: Vice Mayor Weitz moved to adopt Resolution No. 17-011 R. The Motion
was seconded by Commissioner Zelniker.

B) RESOLUTION NO. 17-011 R
A RESOLUTION OF THE TOWN COMMISSION OF THE TOWN OF
HIGHLAND BEACH, FLORIDA, TERMINATING THE BEACHES AND
SHORES ADVISORY BOARD AND PROVIDING FOR CONFLICTS;
PROVIDING AN EFFECTIVE DATE
Town Clerk Gaskins read Resolution No. 17-011 R into the record.
Town Manager Oakes — Commissioner Riesa gave us an update from the Beaches &
Shores Advisory Board meeting she attended on May 9th. At that meeting, the board
made a recommendation to the Town Commission to be disbanded. If that is the desire
of the Commission, it would have to be done by Resolution. After reviewing the
Resolution, there was one change that was made to Section 2. Town Manager Oakes
read the change into the record.
Katharina Braun, 2727 South Ocean Boulevard, a member of the Beaches & Shores
Advisory Board confirmed the decision made to disband this board stating the reasons
for this consensus. She thought it a wonderful idea to have a beautification club with
volunteers to keep the beaches safe and clean and able to do more.
Mayor Feldman assured Ms. Braun that the Commission would support this club for
whatever supplies needed since it would benefit the Town. Monies could be put into the
budget for these supplies. Mayor Feldman asked that she come forward before the next
budget to inform the Town Manager what monies would be needed.
Carol Stern, 1115 Russell Drive made the motion to disband this board. She feels there
should be a program where this club could meet at least once a month or every other
month and recruit as many members as possible.
MOTION: Vice Mayor Weitz moved to adopt Resolution No. 17-011 R. The motion
was seconded by Commissioner Zelniker, which passed unanimously.

6. CONSENT AGENDA:
Town Clerk Gaskins read the Consent Agenda into the record.
A) Authorize Town Staff to Execute the Renewal Agreements with Blue Cross Blue Shield
for the Employee Health Insurance Program for Fiscal Year 2017-2018 for BCBS HMO
Blue Care 14251, Blue Options 14001 and Blue Options 14006 Plans
B) Authorize Town Commission to Select the Base Bid Plus Alternative No. 2 Concealment
Wall Option for the Remineralization Project and Authorize the Town Manager to Issue
a Work Change Order Directive to TLC Diversified, Inc.
C) Consider Changing the Town Commission Regular Meeting Date from July 4, 2017
(Independence Day)to July 5, 2017
D) Approval of Town Commission Meeting Minutes:
• April 25, 2017—Workshop Meeting
• May 2, 2017—Regular Meeting
MOTION: Vice Mayor Weitz moved to approve the Consent Agenda as presented. The
motion was seconded by Commissioner Zelniker, which passed unanimously.
7. NEW BUSINESS:
A) Discussion Regarding Milani Park
Commissioner Kelvin asked the Town Attorney if Palm Beach County has the right to
do whatever they want on this property since they own the land. Town Attorney
Torcivia stated that they do not have that right. Their agreement with the Town is to
have a park at that site. They gave Comcast permission to use that land until June 1St
because they were doing a project in the Town. The County is aware that the Town has
objected to their allowing Comcast to use that property, and that is why they were given
until June 1St to vacate. Commissioner Kelvin stated that they are still there, it is now
June 6d' and feels the Code Enforcer should assess the situation, take immediate action
and levy fines. It is very unsightly.
Town Manager Oakes — Comcast has completed their re-cabling project. Their new
date for completion is June 9th unless there is a problem with all the rain. What is
currently there is their lift truck and bucket truck and all other materials were removed.
Part of our dilemma is that parking is a problem here in Town, and this is a project that
benefits our entire community. This is not a typical code enforcement violation. If we
hinder the progress of this project in any way, it will affect the entire community.
Vice Mayor Weitz commented on the status of Milani Park and the agreement with the
Town. Since the County owns this property, he cautions the Commission to be careful
about any conflict or dispute with the County.

Mayor Feldman asked Town Manager Oakes if they could obtain some completion
dates. Town Manager Oakes stated that the lead on this project is Florida Power &
Light(FP&L), and that staff has a meeting with them this week.
8. MISCELLANEOUS—ITEMS LEFT OVER:
A) Selection of a Special Magistrate and an Alternate Special Magistrate:
o William P. Doney, Esquire
o Diane James-Bigot, Esquire
o Susan A. Ruby, Esquire
Ballots were passed out to the Commission to vote on a Special Magistrate and an
alternate.
Town Manager Oakes announced that William P. Doney was appointed as the Special
Magistrate and Diane James-Bigot appointed as an alternate.
MOTION: Commissioner Kelvin moved to appoint William P. Doney as the Special
Magistrate. The motion was seconded by Vice Mayor Weitz, which passed
unanimously. Note: For the record, Commissioner Zelniker was absent and did not
vote.
MOTION: Vice Mayor Weitz moved to appoint Diane James-Bigot as the alternate
Special Magistrate. The motion was seconded by Commissioner Kelvin, which passed
unanimously. Note: For the record, Commissioner Zelniker was absent and did not
vote.
B) Authorize the Mayor to Execute an Agreement for Special Magistrate Services
MOTION: Vice Mayor Weitz moved to authorize the Mayor to execute an
Agreement for Special Magistrate Services. The motion was seconded by
Commissioner Kelvin, which passed unanimously. Note: For the record,
Commissioner Zelniker was absent and did not vote.
C) Authorize the Mayor to Execute an Agreement for Alternate Magistrate Services
MOTION: Vice Mayor Weitz moved to authorize the Mayor to execute an
Agreement for Alternate Special Magistrate Services. The motion was seconded by
Commissioner Kelvin, which passed unanimously. Note: For the record,
Commissioner Zelniker was absent and did not vote.
9. REPORTS—TOWN COMMISSION:

C) Commissioner Rhoda Zelniker—No report.
D) Vice Mayor William Weitz thanked Tim Burnich for remembering and honoring those
who served at the Invasion of Normandy on this date. Thank you to the members of the
Beaches & Shores Advisory Board for attending this meeting and advising the
Commission how they can better serve the community. Also, many thanks to the staff
for providing the very informative monthly reports.
E) Mayor Carl Feldman referred to the new proposed law for the tax break for
homesteading. Finance Director Curtis referred to the new bill that provides an
additional $25,000 homestead exemption to eligible homesteaded properties. If this bill
is passed, in relation to the Town, it would be implemented in fiscal year 2019. The
effect, as it relates to our current tax rate, would be a reduction in taxes of$131,000.
Town Attorney Torcivia stated that it passed and will be on the ballot November 2018.
Mayor Feldman also referred to the second report received from the Finance Director
regarding the extra monies the Town will be receiving this year. Finance Director
Curtis reported that the Town's new estimated value is $2.39 billion dollars which is an
increase of approximately $173 million year over year. As it relates to our current tax
rate, it would bring in an additional $564,000 in tax revenue. The calculated rolled
back rate for 2018 would be 3.08 mils.
Mayor Feldman referred to Resolution No. 791 adopted in 2002 which states how a
resident can request an agenda item and also how a Commissioner can address an
agenda item. A copy of the resolution was distributed to each Commissioner for their
review.
Code Enforcement is being done and Carol Holland informs the Commission as to what
is going on in Town.
Mayor Feldman read the thank you note both he and Town Manager Oakes received
from Shannon Hourigan, a resident of Highland Beach and a student at Boca Raton
High School.
10. REPORTS—TOWN ATTORNEY GLEN J. TORCIVIA:
No report.
11. REPORTS—TOWN MANAGER VALERIE OAKES:
o Last week I attended the Florida County City Managers' Annual Conference in Orlando,
Florida. The theme this year was "Innovative and Entrepreneurial Leadership in Times
of Change". Thank you to the Commission for allowing me the opportunity to attend
this event. Two names within our organization were brought to my attention which
praised their professionalism, their knowledge, and positive attitude. Thank you to our
Finance Director Cale Curtis and our Accreditation Manager and Police Officer Eric

Aronowitz for their positive interaction with Highland Beach personnel and their
representation to the Town.
o Update on the Remineralization Project: Demolition for the concrete pad for the lime
slurry tank began on May 18th. Town Manager Oakes explained the details of the project.
o Comcast has addressed the unsightly cable drops on Bel Air Drive. They are only
temporary measures and will require additional work.
o Staff is meeting with Florida Power and Light to discuss a host of issues such as the
double poll removal project,poor illumination pattern and streetlight outages along AlA.
o Upcoming Library Events include a concert by Harpist Darlene Weingarten on June 8th at
5:00 PM and for our children,the Palm Beach Zoo will be here with live animals on June
13th at 4:00 PM.
o We are starting a new Intern Program and I would like to welcome Terisha Cuebas to the
Highland Beach team. She is attending Florida Atlantic University working to obtain her
Master's in Public Administration.
12. PUBLIC COMMENTS AND REQUESTS RELATED TO AGENDA ITEMS:
Katharina Braun, 2727 South Ocean Boulevard—It would be a great idea to invite the youth
of this Town to help with our new club. It would also help to contact all the condominiums
to have captains to organize groups in their condominiums to help with keeping our beaches
clean and safe.
Tim Burnich, 4505 South Ocean Boulevard commented on Comcast and their vehicles
being parked on the Milani Park site. They have a facility on Federal Highway where they
can park this equipment.
Bernard Featherman, Former Mayor commented on the Milani Park discussion and the
possibility of buying back the park.
John Ross, 3606 South Ocean Boulevard commented on Milani Park and feels that the use
of this park should become a joint process and meet regularly to discuss its use and seek
approval from both boards.

13. ADJOURNMENT:
There being no further business, Mayor Feldman called for a motion to adjourn the meeting
at 2:42 PM.
MOTION: Vice Mayor Weitz moved to adjourn the meeting at 2:42 PM. The motion was
seconded by Commissioner Zelniker, which passed unanimously.
