1989.10.31_TC_Minutes_Workshopw , ~. _ .. TOWN OF HIGHLAND BEACH, FLORIDA • Minutes of Meeting of Town Commission WORKSHOP MEETING Tuesday, October 31, 1989 1.40 P.M. Mayor Joseph A. Boulay called the Workshop Meeting of the Town Commis- sion of the Town of Highland Beach, Florida, to order at 1:40 P.M. in the Commission Chambers at Town Hall. Others present were Vice Mayor John J. Basso, Commissioners Marvin A. Waldman and Betty Jean Stewart. Commissioner Doris R. Rome was absent. Also present were Town Attorney Thomas E. Sliney, Town Manager Mary Ann Mariano, Deputy Town Clerk Anne M. Kowals and members of the general public . ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA The MOTION by COMMISSIONER STEWART/VICE MAYOR BASSO, adopting the Agenda as submitted, carried unanimously. 89.1 Public Comments and Requests None . 89. 2 Boards and Committees There were no Talent Bank Applicants present for interview by the Town Commission. Mayor Boulay noted the existing vacancies on the various Boards and requested the Town Commission Members review the current Talent Bank Applications on file prior to the November 7, 1989 Regular Meeting at which time possible appointments will be considered. The Town Commission received no correspondence from the Town Boards and Committees. However, the Town Manager acknowledged receipt of a memorandum from the Planning Board advising that the Members would require professional planning assistance to implement some of the mandates of the Comprehensive Plan in the upcoming revision of the zoning ordinance. As there were no objections expressed by the Town Commission, Town Manager Mariano will advise the Planning Board that they can access the expertise of Gee and Jenson's Senior Planner, Jim Park. The Town Manager noted that a copy of an outline of those items requiring assistance will be distributed to the Town Commission Members. 89.3 Proposed Ordinances None 87.4 Discussion re November/December 1989 Newsletter A draft of the November/December 1989 Newsletter was reviewed by the Town Commission. The Town Manager was directed to mail same after sug- gested revisions are incorporated (an addition to the water conservation ,~ Town Commission Workshop Meeting Minutes • October 31, 1989 Page 2 of 5 paragraph as well as a statement regarding traffic safety procedures to be followed during the upcoming Holiday Boat Parades). The Town Manager will confer with the Police Chief regarding the traffic safety procedures matter. 89.14 Discussion re addendum to Palm Beach County Fire/Rescue Contract The Town Commission reviewed a proposed addendum to the Palm Beach County Fire/Rescue Contract (submitted by Palm Beach County Fire/Rescue) concerning renovations and possible rental procedures. Following sub- stantial discussion, it was the consensus of the Town Commission that Attorney Sliney confer with the County Attorney with regard to this matter and report back to the Commission at an early date. 89.15 Discussion re allocation of Recreation and Open Space Funds Following a discussion by the Town Commission with regard to upcoming allocations of the Recreation and Open Space Funds, Town Manager Mariano was directed to submit, for review, a few names of park planners; the Town Commission may submit their recommendations with regard to this matter. With regard to the upgrading of the bike path, the Mayor re- • iterated the suggestion he made at a previous Town Commission Meeting that the Members, as a group, walk the bike path to identify the trouble areas. After discussion of this issue, the Town Manager was requested to obtain costs for an engineering study regarding the possible up- grading of the bike path. 89.16 Discussion re ITCO Properties settlement proposal The Town Commission discussed, at length, a Settlement Agreement with regard to ITCO Properties (Town Lot 1f~2 West); ITCO Property representa- tives and the Town Commission agreed to several amendments which were incorporated into the Settlement Agreement. At the conclusion of the Settlement Agreement discussion, Mayor Boulay recessed the Workshop Meeting of the Town Commission at 3:25 P.M. in order to conduct the advertised Public Hearing/Special Meeting which was scheduled for the purpose of receiving public comment on, and to consi- der the adoption of, the proposed Resolution approving the Settlement Agreement. The Workshop Meeting of the Town Commission was reconvened by Mayor Boulay at 4:P10 P.M. 89.17 Discussion re status of code recodification The Town Commission was advised that Town Manager Mariano and Town Attorney Sliney have reviewed the proofs of the code recodification and Town Commission Workshop Meeting Minutes October 31, 1989 Page 3 of 5 will submit joint recommendations to the Commission Members with regard to this matter. The Town Manager noted that a memorandum to the Town Commission listing all sections that were changed, as well as what strategy will be used for adopting the code recodification, will be forthcoming by the November Workshop Meeting. MISCELLANEOUS - ITEMS LEFT OVER Status of Building Development in Town The monthly Status of Building Development Report, prepared by the Building Official, was reviewed by the Town Commission. Commissioner Stewart noted that the Board of Adjustment granted a side yard setback reduction on Town Lot 30 and questioned the fact that no plans for building have been submitted to the Building Department. Minutes for approval at November Regular Meeting Four sets of Minutes which will be submitted for approval at the November Regular Meeting were discussed. Commissioner Stewart proposed amendments to the September 19, 1989 Public Hearing Minutes and the October 3, 1989 Regular Meeting Minutes. • REPORTS - TOWN COMMISSION Mayor Joseph A. Boulay Mayor Boulay reported attending the Municipal League Meeting at which the Sensitive Lands Ordinance, recently adopted by the County Commis- sion without Municipal input, was discussed. The League will take a firm position in opposing the County Commission procedures which do not include timely Municipal input. It was noted that the County will attempt to pass an extensive bond issue in 1990 and will need the support and cooperation of the Municipalities with regard to this matter. The Mayor noted that there will be a question on the November 1990 election ballot with regard to the prohibiting of State Mandates without providing funding for same. Mayor Boulay further noted that the Town of Highland Beach will host the next meeting of the Municipal League on November 22, 1989 at 11:00 A.M. in the Commission Chambers. The Mayor invited the Town Commissioners to attend this meeting of the Municipal League. As there was no objection expressed by the Town Commission, the Boards Appreciation Luncheon will take place on Thursday, November 30, 1989 at 12:00 noon, at the Holiday Inn. Arrangements will be similar to those of past years. .•., Town Commission Workshop Meeting Minutes October 31, 1989 Page 4 of 5 The Mayor noted that he would like to see the Town hold an "Open House" for all citizens of the Town at Town Hall, as a seasonal get-together, at which cookies and punch would be served. This matter will be brought up for further discussion at the November 7, Regular Town Commission Meeting. Vice Mayor John J. Basso Vice Mayor Basso, having no report, questioned the status of the Town's request for installation of a 'flashing light' in the area of the Highland Beach Fire Station by Palm Beach County Traffic Operations. Commissioner Doris R. Rome Commissioner Rome was absent. Commissioner Marvin A. Waldman Commissioner Waldman had no report; however, he commented on the proposed County Park at the South end of Town and suggested that the Town Attorney request the County require some type of parking fee (i.e. parking meters). The Commissioner also recommended that the name of . Amelie Leng be submitted to the County as a possible appointee to any advisory board pertaining to the proposed County park. Vice Mayor Basso and Commissioner Stewart concurred with this recommendation. Commis- sioner Stewart further concurred with Commissioner Waldman's suggestion that the County require a parking fee. The Commissioner noted receipt of recommends pruning procedures and at least 25 copies of same. eiving, in the mail, the application U.S.A. which the Commissioner gave to a "Trees U.S.A." publication which requested that the Town Manager obtain REPORTS - TOWN ATTORNEY Town Attorney Sliney reported receipt of a letter from Attorney Dan Rosenbaum advising of a settlement conference that was scheduled with Broadview's Attorneys (Dotterrer and Schatz) regarding the Broadview litigation. REPORTS - TOWN MANAGER Town Manager Mariano reported on the status of Town Projects. The Town Manager noted that the Town Hall land survey was completed and is ~,. , Town Commission workshop Meeting Minutes October 31, 1989 Page 5 of 5 available for inspection at Town Hall. It was noted that the Coopers and Lybrand Auditors are conducting the annual audit at Town Hall. The Town is awaiting a copy of the Environmentally Sensitive Lands Ordinance, adopted by the County Commission, in order to determine whether the Town should exercise its right to opt out of said ordinance by the adoption of a local ordinance. With regard to a suggestion made some months ago by Commissioner Rome, the Town Manager will prepare a proposed ordinance to increase the compensation for elected officials far a first reading at the Regular Meeting of the Town Commission on November 7, 1989. Following a discussion regarding "bond issues" which the Town may be facing, the Town Commission expressed its intent to possibly recoup all engineering costs and other fees which may be expended in the event of a bond referendum to provide long term water needs. There being no further business to come before the Town Commission at this time, Mayor Boulay adjourned the Workshop Meeting at 4:3f~ P.M.
