Minutes of Meeting of the Town Commission
WORKSHOP MEETING
Tuesday, September 26, 1989 1:30 P.M.
Mayor Joseph A. Boulay called the Workshop Meeting of the Town Commis-
sion of the Town of Highland Beach, Florida, to order in the Commission
Chambers at Town Hall at 1:30 P.M. Others present were Commissioners
Doris R. Rome, Marvin A. Waldman and Betty Jean Stewart. Absent was
Vice Mayor John J. Basso.
Also in attendance were Town Attorney Thomas E. Sliney, Town Manager
Mary Ann Mariano, Deputy Town Clerk Anne M. Kowals and members of the
general public.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
Commissioner Stewart proposed, and the Members of the Town Commission
agreed, to amend the Agenda by moving Item 89.16 (Discussion re Itco
Properties settlement proposal) to a position following Item 89.1
(Public Comments and Requests). The Agenda was adopted as amended.
89.1 Public Comments and Requests
Ms. Elizabeth Barnes, a resident of Seagate of Highland Beach, addressed
the Town Commission relative to the condition of the beach in Town. Ms.
Barnes urged the Town Commission to consider a total sweep of the beach
by a beach cleaning company. Commissioner Stewart noted that, at one
time, the Town had considered a total sweep of the beach, however, the
cost of same was very expensive. Mayor Boulay advised that "Operation
Clean Sweep", chaired by Dale Echeverria, took place on Saturday,
September 23, 1989; and, the main purpose of this particular project is
to afford the people of "Operation Clean Sweep" the opportunity to
analyze the beach trash to determine where the trash is coming from.
The Mayor noted that "Operation Clean Sweep" will be scheduled to take
place again in four months.
Mrs. Evelyn Houck of 1023 Russell Drive addressed the Town Commission
and urged the Members to improve the conditions under which the Town's
water meter readers are working by requesting the Community appearance
Board to be mindful of meter locations before approving landscaping
plans.
89.16 Discussion re Itco Properties settlement proposal
Attorney Patricia M. Silver, representing Itco Properties, submitted
plans for, and addressed the Town Commission with regard to a proposal
to construct 34 units within 70' height on lot 102 W located North of
• Villa Costa. Town Attorney Sliney advised that he would look favorably
on this settlement which would come under the Settlement Agreement
Ordinance (recently adopted by the Town Commission) if the Members

approve the proposal; and, he would confer with Attorney Silver to draft
the appropriate documentation. The Town Commission expressed approval
of the concept of said proposal and directed the Town Attorney, in
conjunction with Attorney Silver, to prepare the necessary documents and
public hearing schedule which should be submitted for consideration at
the Town Commission Regular Meeting set for October 3, 1989.
89.2 Boards and Committees
Mayor Boulay noted the various Board vacancies and recommended the Town
Commission consider acting on same at the October Regular Meeting. The
Mayor requested that with regard to Mr. Gregerson's Alternate Member
position on the Planning Board, no action be taken prior to the November
Regular Meeting as Mr. Gregerson, who is presently convalescing at home,
has expressed an interest in continuing to serve on that Board.
It was noted that the Mayor submitted a memo advising there are nine
current Talent Bank Applicants interested in serving the Town. Mayor
Boulay noted there were no Applicants present for interview by the Town
Commission.
The Mayor noted that no correspondence was received from any Boards or
Committees.
89.3 Proposed Ordinances
1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING
CHAPTER 9, ENTITLED "ELECTRICAL CODE", SECTION 9-3 ENTITLED
"SCHEDULE-ELECTRIC PERMIT FEES", SPECIFICALLY REPEALING
MUNICIPAL FEE REQUIREMENTS FOR FIRE SPRINKLER SYSTEMS.
The proposed ordinance had first reading on 9/5/89 and was published on
9/15/89. Same was read by title only, by Mayor Boulay, and will be
placed on the Agenda for the October Regular Meeting of the Town
~~ommission .
2. AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE TOWN OF
HIGHLAND BEACH, FLORIDA, CHAPTER 29, ENTITLED "WATER SYSTEM"
SECTION 29-11 ENTITLED "BILLING DATES, DELINQUENT BILLS,
DISCONNECTION".
Mayor Boulay read, by title only, the proposed ordinance which was given
first reading on 9/5/89 and was published on 9/15/89. Same will be an
Agenda Item for the Regular Town Commission Meeting on October 3, 1989.
3. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING
ORDINANCE N0. 565, WHICH APPROPRIATED FUNDS FOR FISCAL YEAR
1988 WHICH BEGAN OCT. 1, 1988 AND WILL END SEPT. 30, 1989.

The proposed ordinance, read by title by Mayor Boulay, received first
reading on 9/5/89, was published on 9/15/89, will be on the Agenda for
the October 3, 1989 Regular Town Commission Meeting.
4. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, PROVIDING
FOR UTILITY RATES, FEES, AND/OR CHARGES SPECIFICALLY AMENDING
HIGHLAND BEACH CODE SECTION 11-13 OF CHAPTER 11, RELATING TO
GARBAGE AND TRASH CHARGES.
The Mayor read, by title only, the proposed ordinance which was given
first reading on 9/5/89, was published on 9/15/89, and will be an Agenda
Item for the October Regular Meeting of the Town Commission.
5. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING
THE TOWN CODE OF THE TOWN OF HIGHLAND BEACH, FLORIDA, AMENDING
CHAPTER 28-1/2 ENTITLED "TREES, SHRUBS AND VEGETATION",
SECTION 28-1/2 - 15 ENTITLED "PERMIT REQUIRED: TREE ABUSE
PROHIBITED", TO INCLUDE SPECIFIC PROVISIONS REGARDING
SPECIMEN, HISTORIC AND TREES PLANTED AS PART OF THE GREENING
OF A-1-A PROJECT.
• The above proposed ordinance, read by title only, had first reading on
9/5/89, was published on 9/15/89, and will be placed on the Agenda for
the October Regular Town Commission Meeting.
89.15 Discussion re allocation of recreation and omen space funds
It was the consensus of the Town Commission that the discussion regard-
ing recreation and open space funds be deferred to the October Workshop
Meeting of the Town Commission due to Vice Mayor Basso's absence at
today's Meeting. As requested by the Town Commission, proposals to
prepare a survey of the Town Hall Property (funds for which have been
allocated as of 10/1/89) will be submitted by Town Manager Mariano at
the October 3, 1989 Regular Meeting of the Town Commission.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
At the request of Commissioner Stewart, the Status of Building Develop-
ment Report, prepared and submitted by the Building Official, will
include the scheduling of monitoring reports expected on the
Broadview/Hoffmann property. Mayor Boulay noted the exclusion of the
Boca Hi and Highland Ocean Associates Properties on the most recent
Report; same will be included on the next Status of Building Development
Report.

Minutes for approval at October Regular Meeting
Seven sets of Minutes to be submitted for approval at the October
Regular Meeting were reviewed. Amendments to the August 29, 1989
Workshop Meeting Minutes were suggested by Commissioner Stewart and the
August 29, 1989 Public Hearing Minutes by Commissioner Rome.
REPORTS - TOWN COMMISSION
Mayor Joseph A. Boulay
Mayor Boulay, noting the wrath of Hurricane Hugo, urged all residents to
be prepared should another hurricane occur. The Mayor further noted
that the Highland Beach Police Department conducts a hurricane prepared-
ness meeting annually, however, they are poorly attended. The Mayor
requested that residents be more mindful of these meetings in the
future. It was noted that the Town Newsletter should include a state-
ment to remind residents that Highland Beach is a barrier island and all
should evacuate during a hurricane.
• The Mayor extend thanks to Highland Beach resident Dale Echeverria who
headed the Operation Clean Sweep Project that occurred on Saturday,
September 23, 1989, and gave statistical information as to the items
collected.
Mayor Boulay acknowledged receipt of a letter from Highland Ocean
Associates Attorney Schulman offering the sum of $14,00. to assist in
improving the beach access held by the residents of Highland Beach
Isles. The Mayor commended the cooperation between the two groups
involved in this matter.
The Mayor suggested that the Town Commission, as a body, arrange to walk
the bike path and note the necessary improvements. Mayor Boulay invited
the citizens of the Town to join the Commission Members in this walk.
Vice Mayor John J. Basso
No report - absent.
Commissioner Doris R. Rome
Commissioner Rome stated that she had no report but she would have some
questions for the Town Attorney and the Town Manager at the time of
their reports.
Commissioner Marvin A. Waldman
• Commissioner Waldman questioned if Attorney Dan Rosenbaum received re-
quested information with regard to the Broadview litigation. The Town
Commission was advised that the Town Manager had been in contact with

Attorney Rosenbaum on the previous day and that he was in possession of
all the information necessary to proceed with attempting settlement
negotiations in this matter.
Commissioners Waldman and Rome expressed their opinion that Attorney
Rosenbaum should be supplied any documentation requested in a timely
manner .
Town Manager Mariano noted that she had received input from individual
Members of the Town Commission and would proceed in accordance with the
majority opinion with regard to her memorandum of September 19, 1989.
Commissioner Betty Jean Stewart
Commissioner Stewart stated that she would like to see everything
possible done in order to effectuate the settlement of the Broadview
matter.
An article in the September 25, 1989 Monday Paper which stated that a
Fire Advisory Board was being created by the County Commission was noted
by Commissioner Stewart. The Town Commission requested the Town Manager
write a letter to the County Commission urging the consideration of a
Town appointee to said Advisory Board.
REPORTS - TOWN ATTORNEY
Attorney Sliney reported that the closing on the Boca Highland Property
is scheduled for October 9, 1989. The Attorney further reported that
the amenities building on the Ince and Hertel site has been demolished
therefore the "Release of the Unity of Title" will be submitted to their
attorney, Robert Eisen, who will have same recorded.
The Town Attorney noted that, as direction by the Town Commission, he
met with Drexel Investments' Attorney Deuschel in early June with regard
to the Drexel matter; Attorney Deuschel, after conferring with his
client, was to get back to the Town Attorney. Attorney Sliney heard
nothing from Attorney Deuschel until 9/18/89 when Attorney Deuschel sub-
mitted a letter. Commissioner Stewart suggested that attorney Sliney
respond to Attorney Deuschel's letter of 9/18/89.
REPORTS - TOWN MANAGER
Town Manager Mariano reported that the Condo Managers met in September;
they will work with the Town Manager in trying to resolve any problems
associated with a future recycling program.
The Town Manager further reported that an Ordinance adopting the
Comprehensive Plan was approved on September 19, 1989; the Comprehensive
Plan has been submitted to the Florida Department of Community Affairs.

Town Manager Mariano noted that the Town's fiscal 1989/90 Budget was
adopted on September 19, 1989; same will be bound and distributed to the
Members of the Town Commission.
The Town Manager reported that the proofs of the Town's Code Recodifica-
tion have been received from Municipal Code Corporation. Town Manager
Mariano and Town Attorney Sliney, following their review of the proofs,
will make a joint recommendation to the Town Commission at an early
date.
There being no further business to come before the Town Commission at
this time, Mayor Boulay adjourned the Workshop Meeting at 3:08 P.M.
