Minutes of Meeting of Town Commission
PUBLIC HEARING
Tuesday, September 19, 1989 4:410 P.M.
Mayor Joseph A. Boulay called this advertised Public Hearing of the
Town Commission to order at 4:00 P.M. in Commission Chambers at Town
Hall. Also present were Commissioners Doris R. Rome and Betty Jean
Stewart. Vice Mayor John J. Basso and Commissioner Marvin A. Waldman
were absent.
Others present were Town Attorney David K. Friedman, Town Manager Mary
Ann Mariano, Jim Park of Gee and Jensen, Deputy Town Clerk Doris
Trinley, and members of the general public.
The Mayor announced that the purpose of this advertised Public Hearing
was to obtain input into the Town's Comprehensive Plan.
Prior to receiving public comments, Mr. Park noted the placement of
Page IV-12 in the Recreation Element to note the County Park property
had been classified as Recreation/Open Space on the Future Land Use
• Map. Senior Planner Jim Park of Gee and Jenson will consider the
feasibility of creating a separate zoning district for properties upon
which zoning has been reduced through settlement agreements.
The Town Commission then reviewed the final version of the Capital
Improvements Element. It was noted that under Rule 9J-5, this element
must be reviewed and submitted to the Department of Community Affairs.
This may be done during budget review each year.
On page X-8 of the Capital Improvements Element, under Development
Orders, etc., it was noted that additional development orders (agree-
ments) had been issued since printing of the draft, which only cited
the 68 units on Lots 101E and 101W. Therefore, MOTION was made by
COMMISSIONER ROME/COMMISSIONER STEWART to amend this paragraph to cite
116 units, which would also include the 34 units approved for the Boca
Hi B & C sites, (beachfront and sales office parcels), as well as the
14 units approved on Lots 20 - 28 owned by Highland Ocean Associates,
noting that although permitting had not occurred, approvals had been
given on these lots. This MOTION carried unanimously with favorable
votes.
On page X-4 of the Capital Improvements Element under Fiscal Implica-
tions, MOTION was made by COMMISSIONER STEWART/COMMISSIONER ROME that a
statement be included citing the Town's adoption of the recreation and
open space fee ordinance as a means of financing a portion of the needs
listed in the Capital Improvements Element. This MOTION carried unani-
mously with favorable votes.
Upon a request by the Mayor for Public Comments, Mr. A.G. Voress a Town
resident, stated that it was difficult to understand the ramifications

of the Comprehensive Plan from attending this meeting. Mr. Voress was
advised that the compilation and review process of this Plan had gone
on through a series of Public Meetings held by the Planning Board and
Town Commission over approximately two (2) years.
Attorney Nancy Graham and Agent Richard Orman, representing Lucia
Milani, addressed the Commission opposing the reduction of Lot 10E to
single-family residential from multi-family low classification. It was
noted that this lot was and had always been utilized as single-family
residential, as had some of the adjacent properties. Dr. Orman sub-
mitted a letter previously sent to the Town on June 10, 1989.
Attorney Graham also opposed the Future Land Use proposed for the
Connaught property, stating that it was her opinion that under pending
litigation her client had vested rights to a previously approved site
plan.
Roy Schaeffer, Vice President of Broadview Savings and Loan, expressed
opposition to the proposed Future Land Use classification of the Hid-
den Harbor lots based on current litigation.
It was then announced that a Special Meeting would be held following
• this Public Hearing to consider the adoption of an ordinance adopting
the Comprehensive Plan.
There being no further business to come before the Town Commission at
this time, this Public Hearing was adjourned by Mayor Boulay at 5:02

TOWN COMMISSION MEETING MINUTES
PUBLIC HEARING
Friday, September 8, 1989 5:01 PM
Mayor Boulay called the Public Hearing to order at 5:411 PM in
Commission Chambers of Town Hall. Others present were Vice Mayor
John J. Basso and Commissioners Doris R. Rome, Marvin A. Waldman,
and Betty Jean Stewart.
Also present were Town Manager Mary Ann Mariano, Chief Accounting
Officer Stanley M. Novak, Deputy Town Clerk Doris M. Trinley and
members of the general public.
Mayor Boulay stated that the purpose of this Public Hearing was to
receive citizen input regarding the 1989/90 Fiscal Year Budget and
invited those present to address the Commission. There was no re-
sponse from those in the audience.
At this time, Town Manager Mary Ann Mariano noted that the next
Public Hearing will be held on Tuesday, September 19, 1989, at
which time the Commission will consider the adoption of the
1989/90 Fiscal Year Budget.
There being no further business to come before the Commission, a
• MOTION was made by Commissioner Waldman/Vice Mayor Basso to ad-
journ the meeting.
Mayor Boulay adjourned the meeting
