Minutes of Meeting of Town Commission
SPECIAL MEETING
Friday, July 21, 1989 4:42 P.M. ___
The Special Meeting of the Town Commission, Town of Highland Beach,
Florida, was called to order by Mayor Joseph A. Boulay at 4:42 P.M. in
the Commission Chambers at Town Hall. Others present were Vice Mayor
John J. Basso, Commissioners Doris R. Rome, Marvin A. Waldman. and Betty
Jean Stewart.
Also present were Town Attorney Thomas E. Sliney, Attorney George
Roberts of Roberts & Reynolds Law Firm in West Palm Beach, Attorney Dan
Rosenbaum of Becker, Poliakoff & Streitfeld, P.A., Town Manager Mary Ann
Mariano and Deputy Town Clerk Anne M. Kowals.
Mayor Boulay noted that the Special Meeting was called for the purpose
of receiving an opinion from Attorney Rosenbaum with regard to the
Broadview litigation.
Attorney Rosenbaum addressed the Town Commission and stated it would be
best to continue with an open discussion on the part of the Town
Commission with regard to how the Commission wants to proceed in this
matter.
• Commissioner Stewart noted that with regard to the Broadview litigation,
the Town should be going in two directions at one time: continue with
the law suit and continue with the negotiations (without any implied
weakness on the part of the Town). Commissioners Waldman, Rome and Vice
Mayor Basso were in agreement.
Mayor Boulay noted that the Town, after receiving a proposal as to what
Broadview wanted (except for the total monetary damages), did not submit
a counter proposal on the matter. The Mayor also stated that the Town
should not negotiate from a position of weakness but from a position of
strength.
When Commissioner Stewart inquired as to what would be necessary to give
Attorney Rosenbaum the authority to go ahead with the litigation and
negotiations as discussed, Attorney Sliney advised a Motion would be in
order.
Following substantial discussion, the following MOTION was made by
COMMISSIONER ROME/VICE MAYOR BASSO:
I move that Attorney Dan Rosenbaum be empowered to negotiate and
try to affect an equitable solution with Broadview Savings Bank
after consulting with the other attorneys (Attorney George Roberts
and Town Attorneys Sliney and/or Friedman) and that he report back
to the other attorneys and to the Town Commission as to how the
negotiations are progressing.

When Mayor Boulay questioned if all the attorneys were agreeable to this
type of Motion, the response was in the affirmative. A roll call vote
resulted as follows:
Commissioner Stewart "AYE" Commissioner Rome "AYE"
Commissioner Waldman "AYE" Vice Mayor Basso "AYE"
Mayor Boulay "AYE"
At this point, Commissioner Stewart brought up the matter of a Town
Newsletter. She noted that all Commissioners were present to discuss
this prior to departure for pending vacations and that after recon-
sidering the issue, she no longer is opposed to starting a Newsletter
which should be a publication of the government; it should be titled to
reflect that and should be discussed if the Commission wants to go ahead
with same.
Mayor Boulay noted that this is an Agenda Item for the July 25, 1989
Workshop Meeting of the Town Commission at which time he would be
prepared to discuss the matter. The Mayor stated that while the matter
of a Newsletter was not addressed in the recent survey mailed to the
residents, approximately 12~ of the returns received to date contain
written comments from residents requesting the reinstatement of a Town
.Newsletter.
Substantial discussion regarding the reinstatement of the Town Newslet-
ter took place. COMMISSIONER STEWART proposed the MOTION that a Town
Newsletter be started indicating it is from the government of the Town
of Highland Beach, so clearly indicated, Town of Highland Beach
Newsletter in the heading with the address and phone number of the Town
of Highland Beach in the heading with no names of any commissioners,
mayor or any persons listed in it whatsoever; that it be a one page
letter written bi-monthly with Town government information in it, all
aspects of Town government only. (It could include things from the
Library as it is considered part of the Town). That it be prepared for
the August Workshop by the Town Manager for review by the Town
Commission for mailing in September, the first one issue, and to be
budgeted bi-monthly thereafter. A roll call vote of the MOTION seconded
by VICE MAYOR BASSO resulted as follows:
Commissioner Rome "AYE" Commissioner Waldman "AYE"
Vice Mayor Basso "AYE" Commissioner Stewart "AYE"
Mayor Boulay "NAY"
There being no further business to come before the Town Commission at
this Special Meeting, Mayor Boulay adjourned same, upon proper MOTION,
at 5:30 P.M.
