Minutes of Meeting of Town Commission
WORKSHOP MEETING

Tuesday, June 27, 1989 1:37 P.M.
The Workshop Meeting of the Town Commission of the Town of Highland
Beach, Florida, was called to order by Mayor Joseph A. Boulay in the
Commission Chambers at Town Hall at 1:30 P.M. Others present were Vice
Mayor John J. Basso, Commissioners Doris R. Rome and Betty Jean Stewart.
Absent was Commissioner Marvin A. Waldman.
Others in attendance were Town Attorney Thomas E. Sliney, Town Manager
Mary Ann Mariano, Deputy Town Clerk Anne M. Kowals and members of the
general public.
ADDITIONS, DELETIONS OR ACCEPTANCE OF AGENDA
The Agenda, at the recommendation of Commissioner Rome, was amended to
move Item 89.6 (Discussion re DiNegris Townhouses - 4517 South Ocean
Boulevard - Town Lot No. 16) to a position preceding Item 89.1 (Public
Comments and Requests). Same was adopted as amended. ~--
89.6 Discussion re DiNegris Townhouses (45.17 South Ocean Boulevard)
Town Lot No. 16
Mr. Peter DiNegris addressed the Town Commission and explained that his
plan to construct three townhouses on Town Lot No. 16 has received
approval from the Planning Board and the Community Appearance Board.
The Town Manager noted that this project (which falls under the "Zoning
in Progress" Ordinance) has reduced the density for this property by a
minimum of 33-1/3~; Mr. DiNegris is now seeking approval of the Town
Commission. Following discussion, this matter was moved to the July 5,
1989 Regular Meeting Agenda.
89.1 Public Comments and Requests
Beachwalk East Condominium Manager Jere Smingler and Boca Cove North
Association President Jose Echeverria addressed the Town Commission in
support of the reinstatement of the "Town Newsletter".
Mr. Echeverria also recommended that the Town Commission consider a
recycling program for the Town of Highland Beach. In answer to Commis-
sioner Stewart's inquiry, Mr. Echeverria advised that the next beach
clean-up is scheduled for sometime in September.
89.2 Boards and Committees
Mayor Boulay noted the vacancies on the various Town Boards. Talent
Bank Applicants John Giattino, Victor Hadeed and Yvonne Petritz were in
attendance and were interviewed by the Town Commission.

Mayor Boulay acknowledged receipt of a letter from a resident regarding
the possibility of a public telephone being installed in the area of the
Town Hall complex. Following discussion, the Town Commission directed
the Town Manager to obtain some in-put from the Police Department with
regard to this request which will be open for further discussion in the
near future.
89.3 Pro osed Ordinances and Resolutions
1. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
RELATING TO OFFICERS AND EMPLOYEES OF THE TOWN; PROVIDING
FOR THE DEFENSE AND INDEMNIFICATION OF ANY OFFICER OR
EMPLOYEE OF THE TOWN IN ANY COURT ACTION AGAINST THE
OFFICER OR EMPLOYEE RELATING TO HIS OR HER PERFORMANCE OF
DUTIES; PROVIDING FOR CODIFICATION; PROVIDING AN
EFFECTIVE DATE.
Mayor Boulay read the proposed ordinance by title only and noted that
same had first reading on 6/06/89 and was published on 6/16/89. This
matter will be placed on the Agenda for the July 5, 1989 Regular Meeting
of the Town Commission.
• 2. AN ORDINANCE OF THE TOWN OF HIGHLAND BEACH, FLORIDA,
AMENDING THE TOWN CODE OF THE TOWN OF HIGHLAND BEACH,
CHAPTER 28-1/2 ENTITLED "TREES, SHRUBS AND VEGETATION",
SECTION 28-1/2-15 ENTITLED "PERMIT REQUIRED" TO INCLUDE
TREE ABUSE PROVISIONS.
The proposed ordinance to amend Town Ordinance No. 573 will be placed on
the July 5, 1989 Town Commission Regular Meeting Agenda for first
reading.
87.4 Discussion re Newsletter
Regarding the "Newsletter", Mayor Boulay submitted a mock "Newsletter"
to the Town Commissioners and requested that they review the sample copy
and present their comments. Following discussion of the "Newsletter",
it was the consensus of the .Members present that this matter be placed
on the July 5, 1989 Town Commission Regular Meeting Agenda for further
discussion.
89.9 Status of Solid Waste Authority Recycling Legislation
Relative to the Solid Waste Authority Recycling Legislation, the Town
Manager reported that County Sanitation is working with the Solid Waste
Authority with regard to such a program. During discussion, Commis-
sioner Stewart cited an article that appeared in the 6/21/89 issue of
the Wall Street Journal which noted that in Perkasie, Pa., where they
are participating in a recycling program, the Town's people are finding
that things aren't quite what they seem. Town Manager Mariano is
awaiting receipt of information on this matter and will report back to
the Town Commission when same is received.

89.1f~ Drexel Property/Proposed Construction of .Basin with
Bulkhead and Piers
With regard to the Drexel Property matter, Attorney Sliney reported that
he met with Drexel's Attorney Deuschle and Drexel Representative Mr.
Mihallis several days after the June Regular meeting concerning matters
discussed at that meeting. Following contact with his clients, Attorney
Deuschle was to get in touch with Attorney Sliney. As of this date,
Attorney Sliney received no word from Attorney Deuschle therefore there
were no break-throughs to be reported to the Town Commission.
89.11 Discussion re Highland Ocean Associates
(Royal Highlands/Teron International)
With regard to the Highland Ocean Associates (Royal Highlands/Teron
International) Agreement, Attorney Sliney noted that he is scheduled to
meet with their Attorney Schulman on Thursday (6/29/89) of this week to
fine tune said agreement.
• At this time, Commissioner Rome questioned Attorney Sliney as to the
status of the Hidden Harbor litigation. Attorney Sliney stated that
Attorney George Roberts of Roberts & Reynolds Law Firm is the lead
counsel on this matter. Town Manager Mariano noted that a written
opinion regarding this litigation is expected to be submitted by
Attorney Dan Rosenbaum of Becker, Poliakoff & Streitfeld, P.A. by
July 14, 1989. Commissioner Stewart, at this point, stated that, at the
June Regular Meeting of the Town Commission, she did not correctly word
her motion to hire Attorney Rosenbaum; it was her intention to retain
him as co-council on this matter. Vice Mayor Basso and Commissioner
Rome stated it was their understanding that Attorney Rosenbaum would be
retained in that capacity.
MISCELLANEOUS - ITEMS LEFT OVER
Status of Building Development in Town
Members of the Town Commission acknowledged receipt of a copy of
the June 19, 1989 report of the Status of Building Development in
Town, submitted by the Building Official.
Commissioner Stewart recommended that a written statement prepared
by the Building Official should be submitted for any project that
is a Town Commission Agenda Item.

• Of the three sets of Minutes to be submitted for approval at the
July Regular Meeting, Commissioner Stewart amended the second para-
graph on page 2 of the May 30, 1989 Workshop Meeting.

The Mayor attended a meeting in Fort Lauderdale with regard to the
Intracoastal speed and related problems; the Mayor expressed the
concerns of the Highland Beach Citizens Group. Mayor Boulay was assured
that Senator Tom McPhearson and Capt. Allen Richard of the Florida
Marine Patrol would take the information back to Tallahassee.
Mayor Boulay noted that the Town Safety Committee, Town Manager and he
met with Mr. Marvin Dickerson of the Florida League of Cities regarding
the Town's Safety Program. The Committee will formalize a safety
program in the near future.
The Mayor reported that the Town Manager and he attended a Workshop for
Public Officials which was sponsored by Florida Atlantic University for
the purpose of bringing the officials up to date on Sunshine and Public
Records Law and the roll of the State Ethics Commission.
Mayor Boulay noted that at the last Water Resources Advisory Board Meet-
ing, the Members recommended that the Town Commission consider alterna-
tives regarding long term water needs. The Town Manager submitted a
memo to the Town Commission relative to reverse osmosis, the scope of
work and the costs involved. Mayor Boulay opened the matter for
discussion. Vice Mayor Basso, Commissioners Rome and Stewart stated
this matter should be placed on the July Workshop Meeting Agenda when a
all Members of the Town Commission will be present. Commissioner
Stewart further stated that the Commission should not proceed with this
matter until the Department of Community Affairs submits their comments
(which are expected any day now) regarding the Town's Comprehensive
Plan.

REPORTS - TOWN ATTORNEY
With regard to the Boca Highland litigation, Attorney Sliney reported
that he met with Attorney Dan Rosenbaum to fine tune the proposed
settlement agreement; same will be submitted, in the near future, to the
Town Commission for signatures.
REPORTS - TOWN MANAGER
Town Manager Mariano reported that the Bougainvealla in the front area
of Town Hall have been replaced by Ixora and that area is now being
maintained in a manicured state.
The installation of cluster wells to monitor salt water intrusion, as
required by South Florida Water Management District prior to their
considering the Town's request for an extension of the water use permit,
was completed.
The Town Manager noted that Deputy Town Clerk Redawna Bavender resigned
her position with the Town. Mrs. Bavender will be leaving the Town on
Friday, June 30, 1989.
Town Manager Mariano noted that the park survey will be ready for
mailing on Monday, 7/3/89 and it is requested that same be returned to
Town Hall by 7/28/89. Following tabulation of the returned surveys, the
information will be submitted to the Town Commission.
Mayor Boulay noted that the Regular Meeting of the Town Commission has
been scheduled for Wednesday, July 5, inasmuch as Tuesday, July 4, is a
legal holiday.
There being no further business to come before the Town Commission at
this time, Mayor Boulay adjourned the Workshop Meeting at 3:10 P.M.
